Using medicaid is not a problem. However, if you qualify for the program, do you have the necessary income to sponsor an immigrant?

I've been told this too but I really don't want to leave anything to chance. I can afford to use an immigration attorney, and if it takes some of the difficulty and potential stress out of this I'm going to use it! The process takes long enough as it is and I have the WORST luck with forms and stuff!


From time to time, you see horror stories on here about how their lawyer screwed up their paperwork or sent it the wrong place. If you do decide to go with a lawyer or agency make sure you do your research.

No agency or attorney can speed things up. When it comes to choosing an agency or attorney, buyer beware. Most people here have done it on their own, If you don't think you can handle it, you can get a lawyer or agency to help, but do your research before choosing one. There have been issues with lawyers not well experienced with family visas.

K-1 is faster, but you won't be able to have a wedding outside of the US unless its either not considered legal (No marriage certificate), or you do it after your fiancee has come to the US, and you been married and filed for AOS. At the same time you can file for AP or wait until your fiancee gets her green card. Then you can travel outside of the US and have another ceremony in South America.

We went to an immigration attorney in the U.S who explained I can come back on a waiver visa , get married on the “spur of the moment”, re-adjust my immigration status and apply for AOS.

Since you say you "wish to marry" you could hardly honestly state that you "married on the spur of the moment" now, could you? Entering the US on the Visa waiver program with intent to marry and immigrate based on that marriage is visa fraud. People do get away with it but it is not advocated on this forum.

Well technically, if you enter with the intent to get married on something other than a K-1 or Dual Intent visa. You will be committing visa fraud, and possibly run into trouble with adjustment of status.

However, it appears you decided to get married after you came to the US, so you could do what your lawyer is suggesting. But in case you are asked to prove that you had no intent, keep your return ticket and any evidence that ties you back to the UK. If you take this path, you will not be able to leave and return without AP. That takes 2-3 months to get after you apply to adjust status. If you do get married and leave (without AP), you can only return to stay on a spousal visa.

If you meet the requirements for DCF, it might be easier to file for CR-1 as you can apply directly to the embassy. Your fiancee will also get a green card as soon as she enters the US on a CR-1 visa. It will also probably be alot easier for the two of you to make the move together.

If you take the K-1 route, I do believe you need an address in the US to receive the notifications. A relatives or friends address would work fine.

DCF and IR-1/CR-1 are the cheapest options. While they may cost slightly more up front, you wont have to pay for AOS later which is $1010. K-1 and K-3 both require AOS to be filed before getting a green card.

DCF if you can qualify for it also likely the fastest option.

All Visas require a medical, which varies by country. In Indonesia it was about $60, plus another $60 for all the vaccines.

At the interview or slightly before it, K-1 and K-3 pay a non-immigrant visa fee of $131. DCF and IR-1/CR-1 pay an immigrant visa fee of $355.

Other than K-1, i dont know what it will cost to file the forms for the particular visa. K-1 costs $455 to file the petition.

Unless you are already living in Indonesia its difficult to get there in time as it can move rather quickly. You don't need to be at the interview, but you can if they let you. If you are getting a ticket to the US for your fiance, you should not get it until you have the visa in hand. Even if the interview goes well, you may not necessarily receive the visa right away.

My Indonesian Fiance is living in the UK, and is currently a Resident. She cannot obtain a passort without a lot of hoops, time and money which we would like to use towards a Visa to the US.

My question is, does she have to go back to Indonesia where she is a citicizen, or can we go through the process while she remains in the UK.

As a legal resident of the UK she can immigrate to the US from there. If her passport is about to expire, it might be a good idea to renew it before getting started.

She could get UK citizenship provided she meets the requirements, but it wont assist in immigrating to the US. Indonesia does not recognize dual citizenship and she would loose her Indonesian citizenship were she to take that course.

I am living with my fiance in the Netherlands; she is Indonesian. We are registered here as "living together" (which requires that we both prove we are not otherwise married) but we are not a "registered couple" since that involves a whole different set of cumbersome paperwork.

Therefore, we want to go back to the US to get married, but we will continue to live here, and will probably move to another country in southeast Asia sometime in the next six months. Are we able to go back to get married without setting up residence in the US?

Or do we need to stay there for some fixed amount of time? How long is that? How soon could we move to another country?

If we are able to do this, what forms do we need to use, and where can we file? How long will it take?

You would think this would be a common situation, but we can't find much info on it.

Citizens of Indonesia need a visitor visa to enter the US on a temporary basis. She should be able to apply through the local US Embassy or Consulate.

Hello.

I am confused as to what to do. My fiance will be coming to America next year and we were hoping to get married by my family in the summer of 2011. However, within three months we would be moving overseas to a place where neither of us is from. So he would essentially come over, we would get married, and probably leave one month later. He wanted to come on a tourist visa. My question is, could we do this if we are intending on leaving? Or do we have to pay all the fees of a K-1 fiance visa just to get married here. We aren't applying for permanent residence unless we come back at another time. If we do choose to do so in the future, we could just start the K-3 visa. Any help on this topic would be greatly appreciated.


Tourist visa is all you need. K-1 is a path to permanent residence, not needed to just get married in the US (and leave).

In respect to Indonesian culture, its better to have a ceremony before leaving if possible. But yes that is an option too.

Yes, that is correct. That is what my wife and I did.

All you have to do is make sure that the person officiating the ceremony is aware not to do anything on your behalf to register the marriage (I don't think they can, but its good to cover that side). If asked at the port of entry about your marriage status, you are not yet married. The reason for bringing this up, is that some people consider themselves married once they have a ceremony and might make the mistake of saying they are married if they come in on a K-1 Visa.

I'm new to VJ and have done a lot of reading and I'm still confused on where to begin my journey. I've been dating my fiancee for over a year and half. I'm a US Citizen and she's Indonesian. Our plan is to marry is to have a traditional Indonesian marriage in Jakarta in APR 2011 and have her come to the US immediately after the wedding. Of course this leads to a lot of questions. Just to begin...

1) Is 13 months ample time to gather the necessary documentation to wed in APR 2011 and have her move to the US shortly thereafter?

2) From my understanding (which is limited), if we marry in Indonesia we'll need to file a K-3 when we're married. This process may take up to 6 mos from the day we're married. If a visa process typically takes 6+ mos to process, what type of visa or paperwork can we file 6-12 mos BEFORE we're married so that I won't have to wait additional mos after our wedding date for her to come to the US?

There is no visa that will allow you to do exactly what you want to do without a significant waiting period.

However, Indonesia like the US, does not recognize a wedding ceremony as a marriage unless you go through the steps to legalize it. In Indonesia for a Muslim wedding it is done by signing a marriage book. For all other religions you have to go to a government office to register the wedding.

You can have your ceremony/going away party without taking the step to legalize the marriage and then follow it up with a wedding at the county offices once your fiancée is in the US. The thing to be aware of is that until you have your wedding in the US, you are not yet married if the question arises (Which it might at the PoE).

You can't file anything until after a meeting has occurred. But you can plan ahead and get paperwork ready before and during your meeting together. There are some things your fiancee will have to sign (Although they may have relaxed that somewhat since I did the process)

I just sent in my I-129F form in on 6-23. My fiance is from Indonesia, but is currently living in the UK as a UK resident. I didn't think to mention that she will not be returning to Indonesia, and would like the inverview to take place in the UK. Should I wait until I get my for NOA, or send a letter right away not knowing if it will be connected with my I-129F form.

Hi,

I lived and worked full time in Holland for the past five years. During this time period i paid Dutch income taxes but did not file in the US. I returned to the US in August '09 and after looking for work for several months I decided to open my own office. Business wise things are happening very slowly and with little financial return at this point.

My fiance 'moved' with me from Holland to the US (she is Portuguese). She lived with me in the US utilizing the VWP for three consecutive periods of 89 days with one week breaks between each entry. On her fourth entry to the US she was denied entry. The officer said she had not done anything wrong but that she was abusing the VWP and needed a different visa to 'live' in the US. She now has 212 (a)(7)(A)(i)(I) written in her passport. (she is not banned)

I filed for a K-1 in May this year after her denied entry. I applied for expedited processing due to my mom having advanced stage Alzheimer's. Our intention is to marry while she can still comprehend her only son's marriage. Another reason for the expedited processing request was that my fiance and I are invested in opening the office and our ability to collaborate and execute the few contracts we managed to get is greatly jeopardized by her not being in the US with me. (As part of this expedite processing I submitted financial info - which reveals a very limited base of potential support if no new work comes in). We were denied expedited processing and told our I 129f application will be date processed.

We want to get her back to the US as quickly as possible. Will my limited financial means jeopardize our application? In hindsight revealing my financial situation was not the most strategic thing to do. Could they deny our K-1? Should I go to Portugal, marry there, and do a K-3? Should I send in a I-134 with my father as sponsor?

As a US Citizen, you must file taxes even if you are residing abroad. Although the first $85000 of income or so is exempt from any US income tax.

You will have to show assets or income as financial support, if you cannot meet that requirement yourself, you can file the from with a co-sponsor.

Cutting short TB treatments is the primary reason why drug resistant strains have developed. TB can still return even if the person shows no symptoms for a period of time, and if it returns its likely to be more resistant to common treatments. Making the problem much more dangerous.

we know that we can get the wedding licence when im over there and things but that expires within 30 days.

Signed letter from parents. In some places you might need a judges permission to marry under age. Marriage licence is for when you are actually ready to get married.

My fiancee has a son in Kyiv and he will not be attending her visit. ( ensures return and non immigration on the B-1 )

She can visit on B-1 while the K-1 is processing. However, she will need to show proof that she intents to return. This could be anything from lease agreements to a letter from her employer.

You will be fighting an uphill battle in your case. The hardship case has to be made by your fiance for himself and not for you. You might be able to do it, but I would suggest that you work on an alternative plan and have your fiance start learning Indonesian and look into what jobs might be available in his field within Indonesia.

How much do they look at the age difference, I am from Canada and my Fiancee is from the US and we have about 17 years difference between us. Is that going to cause a problem?


It does vary, some consulates will look at it more than others due to the rate of fraud that occurs in that country. Again its not a reason for denial in itself, but it may have the consular officer looking more closely at the case. As long as you have nothing else that might be considered a red flag you should be fine.

1. You are too young to marry. Generally if you are over 18 you are fine.
2. There is a large age gap between the petitioner and beneficiary (15 years or more). It may be considered a red flag in some areas and result in closer scrutiny of the case. By itself its not a reason for denial.

We noticed that on the NOA2 there is a box that says:

Notice Type: Approval Notice
Valid from 07/23/2010 to 11/23/2010

What does that mean? Why is it only valid from a certain date to another certain date?

If you don't follow the next steps with the embassy or consulate. The approval will expire and you would have to file a new petition. If you do follow the next steps, the embassy will continue to extend the validity of your approval until an interview can be conducted.

Hello All,

My fiance and I met online in 2007,and since then our story has been
one of love, patience faith and determination. After a few months of
chatting with each other we both new we were meant for one another,
so in November 2007 i applied for my passport to visit her in the
Philippines but to my surprise i was denied due to a mistake by
child support It seems that child support had miscalculated my
earnings and never bothered to notify me of any changes so after
1 1/2 years of back and forth calls we finally got every thing worked
out and i received my passport and am going to the Philippines this
September to finally meet my very patient,understanding and loving
soul mate.

Can anyone explain to me in simple terms what is all involved and
what steps i should take before during and after my visit and please
explain all terms i do not know what any of those abbreviations stand for

During your visit, take lots of pictures, keep receipts and ticket stubs.

You can take care of the some of the paperwork like the letter of intent. Look at the guides for more info.

I have not seen anything similar to my question and hope that you may be able to help or direct me, My position may seem complicated, but will keep it simple and to the facts...


I am UKC and fiance is USC we want to get married but know we need to apply for the K1 and know we need understanding of the following.

My parents immigrated to canada in 1965 and 4 years later to the usa and I wouldve been 4...by the time I was 13 my parents need to return home and requested assistance from the british conulate general in L.A weeks later it was agreed the consul would assist our return to England and they had green cards taken away and escorted to the airport in 1977. I am currently pursueing any documentation from the office as we speak.

2 months of being in England i was accused of greivious bodily harm to a boy slightly younger than me and it eventually went to court with a conviction, but suspended probationary period, but had frequent visits from a probation officer for a few months afterwards.... I have requested a poice check PNC to see what shows up, but will be honest on the application when the time comes but still feel the need to track down the court files on this if i can to prove my prudence in all aspects of the application and how serious I am of being honest

in the late 1980s wanted to go on holiday to USA and asked the embassy if the assisted removal would affect me and they said no so went and filled in the card on the plane checking no to each question.

few years later went again, but applied for a multiple entry visa as i was going to the behamas and returning to the US after a 2 day cruise and it was approved.

Since then have been many many times and unkowing the meaning of moral turpitude, sumising it was not related to me....I know no exscuse for ignorence, but was my honest assumption and was not aware of applicability to my childhood.

I have been to see my fiance 3 times alone this year and fear that all previous visits are now ileagal entries and may go against me.

Out of intrest do cases of moral turpitude get looked at and still approved for the K1?

any advice greatly appreciated


The conviction you are talking about occurred when you were still a minor. At least in the US, unless you were tried as an adult (which generally only happens in cases of murder) your record would be sealed and could not be used against you as an adult.

I don't think you should have a problem with this, but you might want to talk to a lawyer.

Would it be better for me to wait until she moves to Dubai, and then file the petition? She has lived there before, but she is only there because of work so I doubt she is a legal resident, but I don't know how it works.


Legal resident means that she is living in the country on a valid visa (non-tourist).

It would probably be better to file after the move, you wont need to try to correct the address later. I am not sure if its possible to give then a new address as part of the petition if you file now.

I am new to the site. I have a question about a fiance visa. My fiance and I are planning to file for her visa in September. We have had an ongoing relationship for a year and a half now, and we were engaged when I went to visit her last January in the Philippines. My question is as follows: My fiance is now living in the Philippines, but she is planning on relocating to Dubai for a job in October. My question is if I were to file her petition now, while she is still living in The Philippines, would there be any problems if she relocated to Dubai?


If she is a legal resident of the UAE, she can have her interview there. But if the petition is not approved by the time she moves, you may need to inform USCIS or the NVC of the address change.

It basically is just making sure you have met, right? By the time we apply, we will have lived together for 6 months, and therefore have TONS of evidence. I read it's generally taking around 5-6 months. But we have to sell my fiance's house before he can move over. Just curious... :)

Besides that, once the visa is approved, you have 6 months to use it. If you need time to sell a house, that's probably the best time to do it.

Hi Folks.... If I file for a finance visa and also use credit consolidation will I be able to bring my fiancee over for marriage???

I do have income of over 50,000 a year....

Does anyone know if they do a credit check???

Or just look at past income tax reports???
