You will have NOA1 in a few days presuming your address was correct. You can get your case number from that, if you cant get your case number off your check.

Most of the time it takes during the petition process is with your case waiting in a queue. Processing takes about 15-30 minutes for most cases when they finally get to it.

But then the posted date is overestimated. You can look at the timelines on this website to get an idea how long it will take for your petition to be processed.

I think its up to about 5 months or so wait time right now.

Yes our RFE was about IMBRA, however we never used a marriage broker so dont know really why we got it.

Sounds like you used an old form. There are no differences with the I-129F used with K-1 and K-3. But they do release new editions of the form every few months. When IMBRA was passed, there were a lot of RFE's since the forms didn't include the IMBRA questions.

You can apply for SSN after the wedding, presuming you don't need an SSN to get married in your state. Some people have had trouble on occasion getting an SSN in their married name.

Most vaccinations can actually wait until AOS, however its usually cheaper to have them done in the home country. They can test for some vaccinations, but otherwise they will simply redo them.

You may get an letter from the NVC with your new case number. But your fiance should be contacted by the embassy or consulate once the case reaches Germany.

USCIS does petition processing, but Dept of State conducts the interview and grants the visa.

Police certificate vary from 3months to 1 year in validity depending on the country.

Direct filing is for spousal visas. But if can qualify for it, its usually the fastest option. You may want to contact the US embassy in Cambodia to see if you can qualify.

You need a US address with the K-1. USCIS won't sent notices and other communications abroad. It doesnt have to be an address you live at, just an address where someone can receive mail on your behalf.

Living abroad can cause some issues with being able to show support. You may want to line up a co-sponsor.

If you considered a permanent resident in the country you are currently residing, you may want to see if DCF is an option for you. Its much faster than anything that has to go through USCIS here in the States.

Where you live only determines which of two service centers you will be sending your packet to. VSC used to be quite a bit faster, but both are now pretty slow.

The adjudicators can only deny a petition for very specific reasons, not because they don't like people from New Jersey.

Home residency restriction generally means she needs to be in her home country for two years, Any time spend outside of her home country will now count against those two years.

The petitioner needs to show his or her birth certificate if its being used to establish citizenship. But unless the beneficiary had a name change present on the birth certificate, its not necessary to include it with the petition. The beneficiary will need to show their original birth certificate at the interview.

Yes and No. Yes you can work on a k-1 visa, but you need an EAD or work auth stamp to do it. You can get the work auth stamp at certain PoEs. As far as airports go, that seems to only be JFK.

If you apply for EAD before you are married and file for AOS, your EAD will expire when your I-94 expires. And since thats 90 days after entry, and takes about 90 days to process, your EAD will be expired by the time you get it. So your best bet is to just apply for an EAD with AOS.

If working is a nessesity upon entry, you may want to consider the IR-1/CR-1 option.

We will apply for the K1 visa and I thought that the procedure was:

- He has to send a petition for a fiancée Visa at the Texas Service Center that includes the Form I-129F and the Form G-325A.

In the Form G-325A, we have to list the applicant's residence & employment last five years. Is it enough to list them or do we have to provide a letter from landlords, employers that certify what is in the Form?

What is the Alien Registration Number? the number on my ID or my passport number?

You wont have an alien registration number unless you have been to the US before on something other than a tourist visa. Just leave it blank.

Just list then. They will verify with any records or background information they have.

Unless they have other reasons to be skeptical about your petition, your fiancee can probably just tell them the correct info at the interview if they ask about it. They wont deny you fiancee for accidentally providing the wrong information, only if it was intentional.

We've already had our I-129F approved and sent to the embassy and we were getting ready to send in packet 3 when I was looking through my packet 1 for a date and found a typo in question 18: "Describe the cirsumstances under which you met..."...My response was: "Initially, we met in March of 2004 in an online chat room. Our first face to face meeting was in December 2005 when I took a 2 week trip to visit him in Ontario. In May 2005 he came to visit and stayed with me until August 2005. The last visit was in December 2006/January2007 in his home in Ontario."

The bold dates are supposed to be 2006....I screwed up...Does that mean the embassy will send it all the way back? Should I call them and let them know I messed up?


If you were approved, I wouldn't worry about it. Even if you put 2005, it still is within the 2 year meeting requirement.

There is no need to translate anything now. Of course if you get an RFE for a "missing" translation, then you'd need to submit. At the Consulate level, they will accept the birth cert and police reports in French without issue.

Not quite. You may have to translate official documents, if the embassy or consulate requires it. Brazil takes documents in English and Portuguese, but that doesn't mean all embassies/consulates do. Indonesia for example requires translations.

Its really hard to say for sure if it will affect you. If you are going through a high fraud post, they may take a much closer look at something like this, but it may not be an issue in other countries. Don't lie about what she did for work. But you may be able to avoid extra scrutiny with the right wording.

Avoid staples. They will only have to take them out. Use paper clips or other removable fasteners.

For the photos you can if you want, I just papercliped the photos to the related meeting evidence and thats as far as I went with that.

Informing USCIS of a pregnant fiance WILL NOT expedite your petition, unless you are in the military and facing deployment, and then her being pregnant still has no bearing on the expedition.

If it were only so simple.


And now for the worse news...
If they approver her visa AFTER she gives birth.. you probably have to start over and file again to include the child.

Not if the USC is the father. Which i would assume, but who knows. If the child is born to USC parent, they do get US citizenship.

As long as a couple can communicate in any language it is fine. Nationality does not speed things up.

AP/AR= Administrative Processing / Administrative Review.

This happens frequently in 3. world countries and in a lot of embassies routinely. At any stage the case goes into AP/AR for review like background checks, security checks, document verification and home investigations. This happens mostly after the interview at the embassy level but sometimes
occurs at the NVC or USCIS level.
There is no timeframe, no explanation and we call it the black hole. It can last a few weeks to months or longer. We have been in AP for 8 month now.
Search for others from your country and you can get an idea time wise but each case is unique.
In the meantime read, read, read the forums.

There are two things. One is security related, which is usually the issue for people going through predominantly Muslim countries. They don't want a terrorist using a marriage visa to get into the US.

The other is more specifically fraud related. Cases of visa fraud are much more likely to happen from a third world country. They look for signs that may indicate that the relationship is fraudulent. One red flag may not get your case into AR/AP, but several probably will. They look for anything including family relationships (some fraudulent marriages are arranged by relatives), age difference outside of cultural norms, no common language, infrequent communication, and more.

AP or AR can delay the visa issuance for weeks if not months and in rare cases years. There isn't much you can do about it either. For some places its pretty routine.

Do you think being of the same nationality speeds or helps the whole K-1 Fiance process? My fiance and I are the same nationality, there is a year age difference. We are the same nationality but from 2 different areas and me online in a chat room.


Also does having a good income help the process also? I do well over 60K plus bonus. Should I show savings to be safe or should I just use income.

I have not filed yet and am nervous about the timefram it will take.

Speed up the process? No. But it may help you avoid AR or AP. Which I guess could mean the process would be sped up.

If your income meets the minimum requirements, than that is all you have to show. Its not necessary to show savings or other assets.

Hi Everyone,

I'm travelling to the states in Sept for just over 2 weeks vacation using the VWP. My fiance and I haven't submitted application for K1 at this stage but will later this year. I am worried about customs kicking up a fuss and needed advice on whether or not I have sufficient documentation to prove ties to home country.

So far I have:

1. Letters from 2 employers (I currently work full-time for the GOVT health system and letter shows my vacation dates as well as the date i will be returning to work. I am also on a 12 month contract (part-time basis) for a private firm and this letter shows this.

2. Original copy of my university enrolment. I am completing post-grad studies part-time and will not finish until the end of the year and therefore have to return home.

3. Recent payslips for both jobs.

4. Birth certificates for both my 2 children as well as Court Orders proving that i have sole custody - to show my family responsibilities here.

5. Orginal Rental Lease contract.

6. Utility #######...ie phone account, electricity account, both in my name and with current residential address here in Australia. Dont know if these will help.

7. Travel Itinerary from Travel Agent, showing my return dates in their origianl letter head.

8. Return plane ticket.

Could you please advise me if this is enough to show that I'm coming home after my 2 week vacation and whether I should expect problems??

I think your fine. If your K-1 is not yet processing you may not even be asked to show any of that, provided that you don't say that your going to visit your fiancee. But I would suggest keeping it with you anyway, just in case.

I just called USCIS to find out the status on my case, and the representative asked me "did you file I-129F and I-130 at the same time, because if you did, just wanted to let you know we won't be allowing that anymore".

So it sounds like you won't be able to file both fiance and marriage petitions at the same time...at least not at Vermont. He didn't give me a date...he was rushing me off the phone.

Well, for a fiance, they will not accept an I-130 and I-129F at the same time because an I-130 is not needed for a fiance visa or for adjusting status after using the visa and marrying.

Also, if you called USCIS, you didn't talk to somebody at the Vermont Service Center and, they don't call it the misinformation line for nothin.


Actually, I did talk to someone at the Vermont Service Center...I do know how to get transferred there from calling the USCIS number. And I've seen on here that some people have concurrently filed 130 and 129F to see which one is faster. This is what I'm referring to.

I just called USCIS to find out the status on my case, and the representative asked me "did you file I-129F and I-130 at the same time, because if you did, just wanted to let you know we won't be allowing that anymore".

So it sounds like you won't be able to file both fiance and marriage petitions at the same time...at least not at Vermont. He didn't give me a date...he was rushing me off the phone.

K-3 uses I-130 and I-129F, but I-130 is usually filed before I-129F. But by filing the i-129F with the I-130 doesn't mean you are applying for a fiancee visa, only taking the K-3 option of the CR-1/IR-1 path.

Most people here do it on their own. But its really your choice. If you don't have any complications, taking the time to understand the process and doing it yourself is most rewarding.

If you do decide to use a lawyer. Do your research. Immigration lawyers tend to be more familiar with work visas. You want to find someone who has handled K-1 visas or family visas. Rates vary, but it can be anywhere from $500 to $3000, depending how much they do for you and where they are based. That would be in addition to the regular paperwork fees.

Your done with the USCIS at this point, so you can't change the address with them. You can try to change the address with the NVC, but you may not be able to get through to them in time. Your best bet is getting ahold of the embassy and giving them the new address information.
