QUOTE (EmilyT @ Oct 2 2007, 05:30 PM) <{POST_SNAPBACK}>
another quick question,

I am looking over the i-129f and on pg 2 question 20 it asks "Your fiance will apply for a visa abroad at the American Embassy or consulate at:" then it has a box for city and country.

is that where we will put Vancouver, canada?

Also, Does my fiance have to accompany me to the interview?

1. Yes

2. No, he may not even be allowed to attend the interview.

Takes about 90 days to get EAD, after you apply for it with AOS.

You cannot legally work without it.

K-1 Fiance(e) Visa Process & ProceduresWhat is CFO Training?
QUOTE (Vann @ Sep 16 2007, 11:48 PM) <{POST_SNAPBACK}>
Hello all! Someone mentioned something about CFO training on this board and, from what I understand, it has something to do with a passport being stamped?

My fiance received her K1 Visa yesterday and was told by the delivery man that she must attend some "counseling" that she was supposed to have before her passport was issued. She's to go to Manila and, from what she told me, visit two different offices.

Is this "counseling" meant to be CFO training?

Thank you!

CFO is unique to the Philippines. But it is required for a Citizen of the country to leave and live abroad. More info here: http://www.cfo.gov.ph/

Not to beat a dead horse, but I travel tons both on and off government business. One way tickets are virtually ALWAYS cheaper. The rule to round-trip tickets stems from the fact that they are cheaper than purchasing TWO one-way tickets, generally. If you are not planning on returning, then a single one-way should be cheaper on virtually every airline.

Right if both of the tickets are the same fare class. But it also stems from comparing a full fare one way ticket vs a heavily discounted round trip ticket.

One way ticket is very expensive. If it works out with her she will still have to go home to get stuff whatever. You can hang onto the return ticket for ahwile before having to use it.

Not always. Round trip tickets are generally discounted more than one way tickets. But the price generally depends on fare class, airline, when you are traveling, and how far ahead of time you buy the tickets.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa - How long do you have to wait for NOA1 notification? Our lawyer told us 6 mts?
QUOTE (Flo&Chris @ Oct 6 2007, 11:43 AM) <{POST_SNAPBACK}>
HI just wondering how long we could be waiting for NOA1 notification. We have a lawyer in AZ taking care of our K-1 process due to me being denied a student visa and a tourist visa previous to our K-1 application...I have never overstayed any previous visa or done anything wrong but they decided to deny me student and then tourist visa.

Does anyone know how I would go about trying to visit my fiance in America even though I have 2 denial stamps on my passport? I am Irish. Surely it is ridiculous that I cannot visit my fiance in america? As a result of me not being able to travel to see him he cannot keep a regular full time job because he has to come here to see me.

HELP US!!!

Depending exactly when you filed, NOA1 can take 2-8 weeks to arrive. If you have a lawyer, your NOA1 was most likely sent to your lawyer.

Its not ridiculous. About 50% of those illegally residing in this country came in on a valid visa. So if you show any immigration intent (without the correct visa), they wont let you in. No matter where you are from. In order to visit, you need to show that you have ties to your home country and that you intent to return. Having a job, lease or mortgage helps with that. Not working and/or living with your parents is going to make it very difficult.

Your fiance will need a regular job in order to meet the support requirements. (Or enough assets to make up the income difference)

I suppose you had permanent residency in the UK, and thats what was put on the form. Changing that after the form was sent isn't easy to do.

You have to talk with the NVC to have the case sent from the UK to the Netherlands. They are not open on weekends, and often quite busy during the day. Your best bet is to try to call them in the morning after they open, or later in the evening.

K-1 Fiance(e) Visa Process & ProceduresI-129F Naturalization Question
QUOTE (shigil @ Oct 8 2007, 10:43 PM) <{POST_SNAPBACK}>
Hi again,

I became a US citizen in 2000, so I was naturalized thought my parents, because they first applied and once they became US citizens, I was 18yrs and younger, so I became naturalized through them.

Here is what it says in the I-129instructions:

3. What Documents Do You Need to Show That YouAre a U.S. Citizen?

A. If you were born in the United States, give USCIS acopy, front and back, of your birth certificate.
B. If you were naturalized, give USCIS a copy, front andback, of your original Certificate of Naturalization. (True for ME)
C. If you were born outside the United States and you area U.S. citizen through your parents, give USCIS: (True as well)

Which one am I?? I am so confused.

1. Your original Certificate of Citizenship, or
2. Your Form FS-240 (Report of Birth Abroad of aUnited States Citizen).

D. In place of any of the above, you may give USCIS acopy of your valid, unexpired U.S. passport issued witha validity period of at least five years. You mustsubmit copies of all pages in the passport. (Also an option but will take more time to submit application, passport not yet renewed)

Also in the I-129F itself, it asked ::::

10. My citizenship was acquired through (check one)
If "Yes," give certificate number, date and place it was issued.

Birth in the U.S. --> ( no )
Naturalization --> (yes, I was naturalized)
Give number of certificate, date and place it was issued.
Parents --> (yes, our case number and naturalization is due to my dad's naturalization)
Have you obtained a certificate of citizenship in your name? --> (yes)

Do I check both and answer this question???? Do both apply to me?? Thanks for all your suggestions.

Certificate of Citizenship, and Certificate of Naturalization are two different things. One is given to naturalized citizens, the other is given to citizens born abroad to US citizen parent or parents. You can send a copy of whichever one you have or a complete copy of your passport.

OP, you need to determine for sure whether your fiance was given an extension and if the extension was for 6 months. Only when you get that info will you be able to determine if he is subject to a bar and will or will not have problems with the K1.

Overstay for less than 6 months is not subject to a bar from re-entry. Overstay for over 6 months but less than a year = 3 years bar. Over 1 year overstay is subject to 10 years bar.

The USCIS did send them a letter for the extension. However my fiance was suppose to respond within certain days but did not follow up... so does that mean we are in trouble? crying.gif

It is possible to overcome overstay bans, but the process is much more difficult and of course, there is no guarantee that the wavier will be approved. You need to find out exactly how much of an overstay your fiance has on his record and talk to an attorney that is familiar with wavier processes.

Do you know what waiver do we need? I was reading here that some fills out 601 waiver? Can you tell me what the 601 waiver is?

Yeah thats the wavier. I'm not really familiar with it though. There is a forum farther down the list that is dedicated to wavier specific issues.

It varies, some people have been able to change an address with no problems, while others have problems. The closer you are to receiving NOA2 the more likely that it will be sent to the wrong address. After NOA2 it doesn't matter anymore.

This process is so frustrating and long, being in the dark, not knowing when you’re going to find out information, it can drive someone nuts. I've heard that calling to check status can delay your process and I surely don't want to do that. People that petitioned 1 month before me have already received their NOA2 in August and early September. You would think that if someone was 1 month ahead you would be the next month behind them, but here I am getting close to 2 month past them. I've been away from my love for 5 month and it's been such a struggle to be apart. Can anyone shed some light to how much longer this wait could be?

I fear that I perhaps we have not furnished enough proof of relationship. I never kept our msn conversations, and I finally gave up on printing a copy of my skype records when I couldn't figure it out after a week of trying.
But I did have a letter, our comments on our online myspace and orkut pictures, and my plane ticket to visit for three weeks over Xmas and New Year's!

I have done a lot of research though, and I figure it's better to send it off and have forthcoming evidence ready if they ask for a RFE. I sure hope not though!

I'm so grateful for this site and forum, I don't know what we would have done without it!

Now we just wait.....

A little confused, Plane ticket for a future flight? Have you met in person yet?

Ongoing relationship evidence is not that important with the petition, it's used in the interview. With the petition, you need to show that you have met in person, in the past 2 years.

Hello, I was an active memeber of the visajourney forum about a year ago and have come back for some help.
Here is my story, we got the K-1 and basically backed out at the last minute and decided to return to Venezuela (I am a us citizen but have lived most of my life in venezuela, thus that is the reason we "both"returned)
Now she has applied for a tourist visa once again (the one she had got cancelled when she got the k-1). Today her tourist visa got rejected because she has an american fiancee (isn´t it ironic, we went through the whole k-1 thing and did not stay in the US and now they think she is at risk of staying!!!)
Any thoughts on what to do in this case? is she now banned from the US forever? we still plan to get married (I know we are complicated I guess) does it mean I cannot take my wife to visit the US even if I am an american citizen?

Thanks for the help once again,

Leopoldo Vasquez

She wont be banned from getting a visa, but getting a non-immigrant visa (other than the K visas) will be difficult. Yes you make have difficulties taking your wife just to visit.

This is the first year I have hit that income and NONE of my tax forms say that I made anything over 2,000 because I was a student.

Also, I will, but have not declared of one job, because it was a nanny position (but my employer will write a letter)...so there is no evidence of my income other than the letter of employment.

Will this be ok, or should I get a co-sponsor?

Just extra info: I have no real estate. I am unsure about my life insurance policy (my mom made it).

THANKS!!!!

The value of your savings and other assets are annualized over 3 years. You want to include letters from your employers, and current statements for your savings account and the account that holds your stocks and bonds.

I have 4 questions....

1. I met my fiance on one of the cupid sites. Should I list as a marriage broker? I do not think cupid is a marraige broker. We simply exchanged emails and started talk I visited 3 months later for the first time.

2. In the last 5 years she lived for a full year in 8 months in London and 4 in Italy while in school. Her passports are stamped. Do I need the address she lived while in school or will her home address suffice?

3. How should I spell Brazil? Brasil or Brazil (American style)

4. Brazil has 3 consulates. The Brasilia office has the shortest wait of all Brasilian offices for interview. I have to fly her to one anyway so can I choose the office she interviews at?

Thanks for your help,

Mike

1. I don't think so.

2. She will have to give the address of all the places she has stayed. (You wont need to include any place she lived at temporarily or on vacation). She will need a police certificate from the UK though.

3. Doesnt matter

4. Only the consulate in Rio does interviews for K visas.

QUOTE (Zen Dragon Drew @ Oct 9 2007, 05:11 PM) <{POST_SNAPBACK}>
Hey, my name is Drew and I'm a police officer in New York city. I met a really nice Thai girl on the internet a few years ago, long story short we were friends for a while, recently I went over there and we met, fell in love, and here we are...hopefully getting married next year sometime if all this bureaucratic headache goes through without a hitch blush.gif

Anyway, nice to see everyone here seems so friendly and helpful, hopefully you can help me out with some of my many questions and snags I have along the way. For now my question is probably a fairly simple one I already know the answer to, but thought I would check with some people who are in the know already.

I'm just filling out the initial I-129F right now, hoping to send it off with all the material and filing fees in about two weeks. My problem is that the box on the first page for her address only has space for street, city, country, and zip, but she has a district in her address as well. I've asked another couple about this and she gave me a shortened version, but then my fiancee told me that the district has to be in there for her to receive mail. So my question is, since I can't possibly fit the entire address into this box, should I write something to the extent of See Attachment in the first box titled Street and then attach a paper on the back of the form with her full address? This seems to be the only option I have, I couldn't find any other forum topics on this, though I'm sure there are some. How should I fix this? Thank you for any help and nice to be here.

Yes you can write see attached, and attach a sheet with the complete address.

For the K-1 visa, you need the I-134 in the visa process, and then you would use I-864 later in the AOS process. And there is no charge associated with those forms, at least not for K-1.

My intention was not to marry her when i went over but it ended up we did. We married in 6th January 2006 and did adjust of status , think it was the 1-129f form if i am not mistaken. Anyway i had to leave on 22nd March as my mother was dying back in the UK. Things didnt work out with my wife so i didnt attempt to return back. I know it seems odd what i did but i did love the woman but we all make mistakes and learn by them. I overstayed by 24 days.

As my fiance will be applying for the K1 visa after i am divorced, hopefully around January 2008. Will it raise a flag as i was married to a US citizen before? Were still trying to decide whether to get an immigration lawyer involved but arnt sure who is good and who is bad. We want to go down the correct route as we have heard a few people having problems appyling the K1 themselves. Can anyone recommend what good lawyer to use? My fiance lives in South Carolina.

You will be asked about it, but you shouldn't have any problem with. Only overstays of 180 days or more will get a ban.

Yes, you can be turned back on a tourist visa, but for the most part, the reasons why are not issues with a K-1 visa.

The issue with you purchasing her ticket is that they require the credit card used to purchase the ticket during check in. Which would be fine if you were traveling with her. But since you wont be, you may have to send her the money to purchase a ticket from the Philippines. Sometimes this is the cheapest option anyway.

Is this a Phillipines-specific problem? Because whenever I've flown with an e-ticket, they've used the credit card or the passport swipe to verify my ID, but there was no transaction at that point. Or I've headed to the counter and handed them my passport. I don't think the purchaser has to match the name of the passenger (or else children could never fly.)

In which case, as long as he books the ticket in her name and pays for it, when she shows ID to check in, she'll be fine. If it's cheaper for her to buy it there, that might make sense.

No its the airline, and it may vary. Some require that you have the credit card used to purchase the ticket at check in.

Hi everyone! I am working in a home-based kind of company which does not comply me to pay taxes to the government since it's a home-based kind. How strict is the embassy for asking RFE about the beneficiary's employment? And if they do so, what are the most possible evidences they ask?

God bless!

I misread the question, for the benificiary it doesnt matter.

K-1 Fiance(e) Visa Process & Proceduresyour I129f may be adjudicated
QUOTE (Klaire and Martin @ Oct 14 2007, 10:46 PM) <{POST_SNAPBACK}>
The line in our timelines which states "...your I129f may be adjudicated as early as...", does this date estimate when we might receive the visa, or when it might be passed on to the embassy, or what? Thanks

Thats when you might have your NOA2 generated. It will take 2-4 weeks after that to reach the embassy, and then anywhere from 1 - 6 months until you get an interview, depending on your embassy.

K-1 Fiance(e) Visa Process & ProceduresFees after initial I-129f filing fee?
Everyone pays a $100 visa fee. The medical/vaccinations vary by country. In some cases it may be cheaper to get all the vaccinations done by a national health program.

3. Do I have to send A copy of the entire I-129f package to my fiancee.
Yep! She should know everything in it for interview. Especially the G325A

Its not required, only suggested. The embassy gets the original packet, So the only reason to send it would be to help your fiance know what is in the packet. Information which could be conveyed other ways.

QUOTE (scientist1976 @ Oct 15 2007, 11:00 PM) <{POST_SNAPBACK}>
Ok ladies and gents. I just got back from the Philippines last week and noticed that I finally received my NAO2 approval. I noticed on the letter it had an expiration date of January 17th 2008. Well I am gathering all the necessary information like my I-134 and the necessary docs to send to my babe in the Philippines. I noticed on the K1 guide on this website, it said I had to send the original I-129F to my fiancee. That might be a problem because I only have a copy, the original was sent to the USCIS back with May 2007. What am I going to do now...Well I had a few more questions to ask you experts:

1. How many years of tax returns do I have to submit with the I-134 and how many pay stubs and also W2s ( I am a W2 employee)

2. Do I have to send my fiancee a certified copy of my divorce decree for her interview.

3. Do I have to send A copy of the entire I-129f package to my fiancee.

4. Do I have to Send her an original letter affirming your desire to marry my fiancee again

5. What if we do not get everything completed before the expiration date on NAO2?? What is going to happen?

The reason why I am asking is because the immigration place that is helping me do the paper work said all I need to send my fiancee is the I-134 form and 2 paystubs, plus 1 year of tax returns. They also said I need a letter of employment and a letter from my bank talking about my account balances. So I need to know what am I suppose to send fiancee??? Help Please

1. 1-3, depends on the embassy and if you have a letter from your employer or not.

2. Yes

3. No

4. You don't have to, but it can add to the evidence of relationship that your finance will take with to the interview.

5. You should at least complete what you need for packet 3, which your finance should have received or will be receiving soon. Everything else needs to be completed by the interview. If you respond to packet 3 as soon as possible, they will extend the expiration as long as they need to get an interview scheduled. If you don't respond with packet 3 before the expiration date, they will likely let the petition expire.

... I guess he could come over there while you give birth but then you'd have to apply for the K2 for the baby to enter the states as well and that means more money.

wouldn't the baby be USC citizen as her/his father?

Not if the baby is born in the Philippines smile.gif

Yes it will be ... birth just has to be registered with the US embassy in the Philippines... wacko.gif
If one parent is a US citizen, the child is a citizen too, regardless of where it is born. Out of wedlock would require convincing evidence of paternity, but as long as the child is his, that wouldn't be an issue.

Not that I advise getting pregnant now, but still...

Its not entirely automatic, unless both parents are citizens. But its not too hard to get citizenship for a child born out of the US.

From here: http://www.visalaw.c...n1/2jan105.html
QUOTE
Children born abroad to two US citizen parents, one of whom has resided in the US prior to the birth of the child, continue to be US citizens at birth, and need take no special actions to retain citizenship.

Children born to one citizen parent and one foreign national will obtain citizenship at birth if the citizen parent resided in the US for five years before the birth, with two of those years after the age of 14. The child does not need to take any special action to retain US citizenship.

Children born out of wedlock to a US citizen mother will be US citizens if the mother resided in the US for one year prior to the birth of the child. Children born out of wedlock to a US citizen father will acquire US citizenship if the following conditions are met:

* There is an established blood relationship between the father and the child,
* The father was a US citizen at the time of the birth,
* The father has agreed to financially support the child until it is 18, and
* Before the child is 18 it is legitimated, or the father acknowledges paternity in a document signed under oath

While these are general rules, Congress has continually amended and revised many laws relating to citizenship, particularly those dealing with the requirements for retention of citizenship. If a person believes that they have a claim to US citizenship, they should consult with an attorney for a full examination of that possibility.

What should I do about the plus signs on PDF documents I filled out online and then printed? It covers up some seemingly important info such as the last two letters of her first name, pretty much all to and from dates in the G-325A and a few other spots. I have everything in order and ready to send out tonight, what should I do?

Thank you,
Drew

+ sign means you put more text in the field than what could be printed. I would just say correct any issues with a pen.
