K-1 Fiance(e) Visa Process & Proceduresdiscovered an error on I-129F after NOA2
QUOTE (MStM @ Dec 18 2007, 05:52 PM) <{POST_SNAPBACK}>
Hello. We've received our NOA2 and my Fiance just received her forms and checklist. We discovered, to our horror, that I mistyped her birthdate on the I-129F form (birthdate is listed as 1983 instead of 1982). Her biographic information, form G-325A, was entered correctly. What should we do about this? Should we notify the consulate of the error or USCIS or both?

The consulate will get the correct information when your fiance brings her birth certificate to the interview. I really doubt it will cause any problems.

I currently reside in Texas and had sent it to USICS TSC
P.O. Box 850965
Mesquite, TX 75185-0965

Also, I just called the USCIS customer service and when I told them what happened the rep I talked to seemed confused as to why they sent it back with that letter attached.

Texas no longer accepts I-129F petitions. You will send your petition to CSC or VSC depending on your state.

K-1 Fiance(e) Visa Process & ProceduresVermont waiting time suprise
QUOTE (bjwd @ Nov 14 2007, 09:57 AM) <{POST_SNAPBACK}>
My lady and I filed and got our first "touch" on August 24. Our service center is Vermont.

So, it will be three months so far as of next Friday. My girl called the USCIS Vermont today to tell them my new passport number. She also asked how much longer she figured the wait would be. The lady told her they were processing from April 24!!!! That means 4 more months, to a grand total of 7 months.

Is this really true? Or, are they high-balling the time line? On the processing times page of this site, it seems that Vermont is at about 4 months median.

Anybody know the deal?

Thanks so kindly

It may not be that long. But Vermont is taking as much time as California, or about 5 months total.

Which do I check? I mean I'm intending to have joint everything with her... does it matter what I check? Could the "wrong" answer mean denial? Please help, and also help for my co-sponsor (same question).

The form is used for other visas, so the question is not specific to K-1 visas. I checked intend. Since technically, I will be solely supporting my wife until she is able to work.

No you wont have to wait 3-4 months. Usually after the receive you RFE submission, and the documents get routed to the correct officer, they will take care of the case right away. It will usually delay the case a couple weeks due to mail time.

Police reports date are end of Apr for Malaysia and earlier of May for UK (I was studying in UK before for 4 years), I wondered is ok for me to present when I was at interview since the date is 5 or 6 months before? Do I need to apply another reports since I have not received packet 3 from the embassy yet?

Please kindly advice. Thank you.

Depends on the validity of the police report. It can be anywhere from 3 months to 1 year. Your police reports need to be valid when you have your interview.

QUOTE (pj1959us @ Sep 14 2007, 02:40 PM) <{POST_SNAPBACK}>
The 19 year old could still get a K-2 visa.

They still need to be named when you are submitting the paperwork. At visa interview time your fiancee will then designate on her paperwork whether they are to be receiving a K-2, following-to-join, or not interested in a K-2 visa.

PJ

True, but an overstay, depending on long it is, may need a wavier. If by the time she finally makes it to the US and is 21. She will not likely be able to get AOS approved and will have to return home. Its always iffy, when dealing with older children.

My fiancee has two children, one is 19 and the other is 21; both are working in the USA but do not want to be included in the visa because they want to return to Russia after they complete their work assignments. My fiancee is from Russia and will will be processed in Vermont and in Moscow, Russia.

Other complication; they have overstayed their work visas; I would guess they are now here illegally.

MY question; if the children will not be part of the visa do they need to be included on the K1 Visa. Can we just not list them as part of the K1 visa applications

They will not affect your fiancee. They are pretty much too old to include on a K2 visa, not to mention, overstays for them will cause complications.

K-1 Fiance(e) Visa Process & ProceduresK-1 needed to get married in the US ?
QUOTE (Mr. Grey @ Sep 17 2007, 04:16 AM) <{POST_SNAPBACK}>
Hi everyone,

I hope I didn't choose the wrong board for my question... however, this one seemed most suitable to me.

I recently got engaged to my girlfriend (US citizen), I am a German citizen. We look to a wedding somewhen in September or October 2008, to take place in her hometown in TX. Whenever I visited her in the past, I entered the US with my German passport under the Visa Waiver Program, because I never stayed longer than 2-3 weeks.

However, since we're planning to have our wedding in the US, I wondered if I would need the K-1 visa to enter the US and get married there. Our plan is not to stay in the US after the wedding, because my fiancee wants to move to Germany afterwards. Therefore, I wouldn't assume that I need the K-1 visa, because I would not apply for Adjustment of Status after the wedding.

Is it possible to enter the US on the Visa Waiver Program for these purposes ? My understanding is that admission to the US is always up to the officer at the POE, who might think that I want to immigrate to the US when I get married there.

Apart from that, would anyone of you recommend applying for a (visitor) visa now that we're engaged ? Would a B2 make travel forth and back any easier than travelling on the VWP until the wedding ?

Many thanks for your answers !

Kind regards,
Daniel

You do not need a K-1 visa for your situation. When you do enter on the VWP for your wedding, be ambiguous about why you are here. Say something to the effect of your going to visit your friends. The reason why you want to do that, is saying you are entering to get married tends to come along with the assumption that you plan to stay. Which could possibly cause you difficulty at the PoE.

Depends on the country, but often, you wont be allowed to be in the interview with your fiancee. On the other hand, some countries encourage that the USC fiance attend the interview.

K-1 Fiance(e) Visa Process & ProceduresVaccinations for K1 and AOS after receiving Visa
QUOTE (em79sugar @ Sep 18 2007, 06:57 PM) <{POST_SNAPBACK}>
So, I am pretty upset with my attorney at this point. He said not to worry about the Hep B vaccination because it is not needed for those to enter that are over 17 on a K1 visa. So my SO was only going to get the tetanus shot he needed. We found out today he will need all the required vaccines later apparently to apply for the AOS, well that is great considering the Hep B shot is a series of 3 shots over six months. And if he has to wait 2 months after he arrives to get the last one, well then that holds us up another 2 months if you have to have that completed in order to apply for AOS. I wrote my attorney a nasty email, telling him he needs to be more forthcoming about what to expect after the VISA is issued or he will be the one responsible for holding up everything else like our EAD, AOS and AP applications over a stupid vaccine. Does anyone know exactly what they will require as far as vaccinations at the time you apply for the EAD?

Thanks so much!!!!

You have the vaccinations done here, in the US if necessary. No need to hold up your visa to do them in your home country, though its possible they may be cheaper there.

You will be apply for EAD with AOS, otherwise if applying for EAD before AOS, it will only be valid until the I-90 expiration, which is 90 days after entry. You will need to have the vaccinations that AOS requires.

QUOTE (Tommeh @ Sep 18 2007, 09:29 PM) <{POST_SNAPBACK}>
Hey all,

My name is Tom and I've been on the hunt for as much K1 information as possible since I proposed a couple of months back, what I am now looking for is some opinions on my situation as there are no definate yes or nos.
I have been to the USA twice to see my girlfriend, once in november 06 for 2 weeks, then again for 3 months at the very end of April during which time I proposed. Now I've been back in the UK for a while, and the main reason I'm posting is because both times I went out to the USA, I was 'flagged' and my stuff was searched and they asked a LOT of questions.

Now, I'm English, from the UK and there is no way I look suspicious. I did not lie when they asked me what was my reason for entering the states, and I said it was to see my girlfriend. I thought this was perhaps it but many people have done the same and been let straight through.

Either way, getting flagged twice definately isn't good, and while the fiance visa is being processed (for which we are hiring a lawyer) I want to go back out there on a VWP again so that I can see her while it's being processed.. lets face it, waiting 6 or even 8 months to see your fiance is not nice sad.gif

Does anybody see that there will be a problem? I will have proof that I have no intent to get married on this visit (Lawyer bill showing us filing for K1 the right way) and that it's just a case of me not being able to wait so long before I can see her.

Thanks for taking the time to read, and please let me know of your thoughts smile.gif

You can visit on VWP, however, you will need to bring evidence that ties you back to the UK. Anything from a letter from your employer, to mortgage, to lease.

Having a K-1 in process will likely get you scrutinized much closer than you would normally.

does he report just his income or the household income(both my mom and dad are joint filers)
see if he is just reporting his income... then even he doesn't meet the 125 percent guideline but when its the household income then we are fine.

Your dad can use the household income, but he has to meet the level for the number of dependents plus your husband.

It really doesn't matter. Especially for well known cities. If its a smaller city it would be more appropriate to include the country.

Her issues with the B2 visa wont cause problems with a K-1 visa. But it will come up and she will have to report it on the forms used for the interview.

On a B2 visa, you can only stay in the US for 6 months out of a year. And you cannot enter with the intent to marry and stay in the US. If she was successful with that, she could get denied or banned at the AOS stage.

Ok, I wasn't totally sure how they see those things. I've seen posts where people simply couldn't prove ties but not where there intent was necessarily to immigrate. Thank goodness she wasn't successful and all-out banned from the country.

I should clarify though, what I said is assuming that she was denied entry due to immigration intent. If she was denied entry for a reason that would make her inadmissible under a K-1 visa, then she will have problems.

QUOTE (typhoon @ Sep 19 2007, 06:18 PM) <{POST_SNAPBACK}>
Odd question, but here goes. An in-law came using a multi-entry vistor visa (B2) to marry her finace using a visa we helped her obtain to visit us and other family. We advised her against attempting to do this, but she was denied entry when she was forced to show that the address she said she was staying at was her boyfriend. Previously her 3 month stay had turned into 6 months through flight extensions, and she came back after only 2 months in her home country.

It isn't clear to me whether she had lied at any time to the CBP or told them the whole truth, but she was denied entry, visa revoked, and sent home. She maintains that there was nothing wrong with what she was trying to do, but now they are looking to do a K1 visa. Due to her intent to immigrate on the non-immigrant visa, is it likely she would be denied the K1 visa based on her denial of entry and subsequent visa revocation? Of course, I am not entirely sure of what was said and what the CBP thought her intent was or wasn't.

To me it sounds like they created a mess of problems, and the fiance is planning to use one of the thousand dollar Internet lawyers to process the K1. To me, this sounds like a much more costly legal issue.

Also, what concerns me in particular is that other in-laws that had their visa issued at the same time (single entry) may be affected by her attempt to immigrate when they apply for another visa to visit in the future. Any thoughts on that one as well?

Greetings fellow K1 forum Subscribers,
I am new to this and would like a few questions answered please, so I can be informative sharing my progress on this K1 visa journey.

1) On the I-797C "Notice of Action" hard copy, I see 2 dates. The first one is "Received Date" and the other is "Notice Date". Which one is considered the NOA1 date?

Received Date: June 12, 2007
Notice Date: June 22, 2007

2) It appears it takes longer to get K1 approved from Canada, than other countries. Is it true?

My timeline

I-129F sent ..... June 8
NOA1 ..... June 12 or June 22, I don't know

Thanks.

1. It looks like your notice was generated at a busy time, some notices were late. But I would use received date.

2. Depends, if your interview is at Montreal, yeah it takes about 4-6 months to get an interview after you have been approved. Vancouver is faster. But its not the slowest country, that goes to the Dominican Republic with over 1 yr wait.

does anyone know how long it takes to get the interview? Its been 2 weeks now and nothing and probably won't get an answer till next Friday (as they only post interview approvals once a week on Friday) making it 3 weeks.

My concern is the embassy website is showing appointments for November. I requested an appointment in during the first week of October. Does this mean that I will most likely get the interview in Nov??? That means this whole process will have taken more than 240 days to complete which from every source I can find is outrageous.

any insight would be appreciated.

It varies by embassy and consulate. In Jakarta, you can get an interview as soon as the next day after turning in your documents. Most countries have a waiting period of 2-4 months for the interview. Some are long, like Montreal, which takes about 6 months.

If you click on the embassy info page, it will give you an idea how long it takes to get an interview in the country you are petitioning through.

It looks like you had an RFE, which definetly would have delayed your processing time. Most February filers were approved in May.

"Certified" means the recording authority in your juris has authenticated the document to be a true copy of court records. That person is usually your county clerk or recorder.

When you get a copy of any court record from them, they will mark it in some way to certify the document is a true copy - it might be all flowery like a gold seal or it may be as simple (as it is where I live) as rubber stamping the document and signing it.

So whenever you send a "copy" of a "certified copy" - the "certified copy" is your original.

While the initial petition cost covers both you and your son. For everything afterwards, he will have his own visa, own AOS and so on. The costs are for some things, slightly cheaper for children.

The fee charts don't cover the visa fee, which is $100 per person, and fee for the medical. Which is also per person, but it varies depending on the country.

As far as the forms, you can read the guides.

You can't file for AOS for him if he is not yet in the country. But once he is, you can pretty much follow the AOS guides for a K-1 visa. I think its slightly cheaper for children under 14 yrs.

I am engaged to a man from Dromore, NI and we are putting together our K-1 packet.

I was married MANY moons ago (1987) and divorced in 1991. I have all the court documents pertaining to the divorce but on the G-325A form it is asking for his birthday. Quite frankly, I can't remember when it is. (Yes, I am old! tongue.gif ) I know the month and date but not the year. We were only married 3 years and for 2 of those we lived in separate states so there really wasn't that much communication.

Any advice on getting the birthdate of a man I haven't spoken to in over 16 years? I really don't think I want to track him down across the country and open that can of worms again for a birthdate.

Any other suggestions?

Thanks so much.

Becky-

Just put as much as you know down. I know my form wasn't 100% accurate, I think my parents birthdays were a little off, but I didn't have any problems.

K-1 Fiance(e) Visa Process & ProceduresNationality and Permanent Residence of Finace
QUOTE (sunray21 @ Sep 27 2007, 12:51 AM) <{POST_SNAPBACK}>
My fiance holds a German passport. She has not been in Germany for years, and travels quite a bit. This means she is not a permanent resident of any country. She now lives in Canada ( last 6 months) but is a temporary resident for a three more months until her temporary permit expires. Then she is traveling again. I am a US citizen and putting a K1 visa application for her. What address should she use as her address? Which counsular office should process her Visa? One in Canada or one in Germany?

So far I have read one article that briefly mentions that permant residence and then nationality is used to determine the counsular office to use. Also counsular office can agree to do this on a case by case basis.

Thanks for you help,

sun

If she doesn't have permanent residency in any other country, she will go through her country of citizenship.

Bonuses are taxable, unless its a reimbursement for expenses incurred while working on the job (But then its not a bonus).

You cannot really include anything from your foreign fiancee, unless he or she transfers the assets to you, or has enough to self sponsor.

Military gets some extra benefits to help with cost of living that are not included in income. Thats why the support requirement is lower. But really 125% of the poverty level is hardly enough to live in many places in the US.

My bonus does come each month in a sep. check with no taxes taken out of it.

and he does transfer money monthly from his bank to mine...so does that count then?

I am not too worried as we are well over the amount, I am simply curious as it will add to this.

Your bonus should be reported to the IRS, if your taxes are not taken out when you get the check, you will have to report it and pay for it with your tax return.

Only if your using assets in your bank account as means of support. Which is generally annualized over a set number of years. 3 or 5.

I am thinking of moving outside of the US to live with my fiancee while we wait for the K1 process to run its course. Are there any things I need to be aware if I go this route? It would only be temporary and we'd be moving to the US once her visa is approved. Has anyone else done this?

I know I will probably need to get a cosponsor for the affidavit of support, but what if I have a job waiting for me when I get back to the US?

any info/suggestions would be appreciated.
thanks again guys 'n gals!

Dont forget your going to need to file I-134 for the K-1 , plus your 2007 W2. Which is going to have to show your reach the 125 % poverty line. Then for AOS your going to have to do similar.

The mail thing is covered, I used my parents' address.

So how do college students get their fiancee to the US?

Can't someone else cosign the affidavit of support?

Not exactly co-sign, but co-sponsor yes. You can have a friend or a relative co-sponsor your fiancee.

another quick question,

I am looking over the i-129f and on pg 2 question 20 it asks "Your fiance will apply for a visa abroad at the American Embassy or consulate at:" then it has a box for city and country.

is that where we will put Vancouver, canada?

Also, Does my fiance have to accompany me to the interview?

1. Yes

2. No, he may not even be allowed to attend the interview.
