If you mention boyfriend or fiance as the purpose of your visit, you may be asked to show evidence of ties to Australia. If you don't you may get sent home before you get a chance to see your boyfriend.

If you are allowed entry, don't overstay the visa, as it can cause problems for you if you do want to return later on a K-1 or another spousal visa.

The question is this. Did your husband when he entered the country, have any intent to marry you?

If yes, then he has to return home, and apply for K-3 or CR-1/IR-1 visa.

If marriage came up only after he was already in the country, than you can go ahead with AOS. You will have to file form I-130 along with I-485 and have a complete medical.

1. You need to get your case number off your NOA1 or cashed check before you can track your case status.

2. Read up on what you need for the interview.

Yes, you can use your parents as co-sponsors. They will have to fill out the I-134 and provide supporting documentation later when your fiance will have her interview.

Is that dodgy? I suppose we'll just have to explain to the minister at our proper wedding that we have a license from ages earlier? Can anyone think of any holes in this plan?

If you change your name with the civil ceremony, your legal name is what is on the marriage certificate. You will need to use that name with AOS, you may have to use it for your drivers licence and SSN as well.

Just explain to the minister that you are already married and that the ceremony is for friends and family. You cant get married twice anyway.

On the USCIS site, it means how old your case has to be before they will do anything about it. Processing time for K1 is about 5 months right now.

At 75 days, no difference. Letters will only will only help you if you get past 6 months of waiting. Current wait times are about 4-5 months.

Digressing - Have any of you looked through a guide titled Fiance & Marriage Visas: A Couple's Guide to U.S. Immigration by Ilona M. Bray? Is it worthy of the $35 I'd be spending on it? I was thinking a book on this stuff might be handy for all the little things we might get confused (and overly worried) about =)

2. That applies to the certificate of citizenship, which if you were born in the US, you wont have. All you need to do is include a copy of your BC or Passport.

It shows about 30,000 K1 visas issued in 2006. Also interesting to note is how the number of visas has increased over the years...from only 12,000 in 1998!


There are more petitions processed than visas granted. Some don't make it to the end, and other get denied for whatever reason. But I would assume the majority of petitions do make it to visas.

3. I am a really low income student who has no saving. And since I was pregnant last year, and I’ve spend half of the time this past two year staying in China. My income is around a thousand (or lower). Will this become a significant problem even if I can manage to find a co-sponsor?

4. Any idea of finding co-sponsor? People, even friends are kind of hesitated when it’s come to signing legal paper and sponsoring someone. I current have no one for the co-sponsor.

5. My Dad is in China, and he wants to come over, and expect me to apply for him as well. Will there be a problem for applying for both I-129F and I-130 at the same time?

1. You dont need a lawyer, but if you do decide to use one, caveat emptor.
2. You don't really need to involve your son in the visa process. Other than indicating him on the forms where needed.
3. If you can get a co-sponsor you should be fine.
4. Your friends or family are going to be the most likely candidates.
5. Yes you can, but showing support will be a bit more complicated. It might be a good idea to wait until you have established yourself here in the US before sponsoring your Dad.

With AOS, AP and EAD are free. All you need to do is pay the AOS fee + Biometrics. I think the total is $1080.

If for some reason AOS takes along time, you can apply for AP or EAD as often as you need to renew it for free.

Good luck then, if you want speed then the route I suggested at county courthouse or the 30 mintue deal in Virginia is it, especially if you want speed so you can apply for AOS before you leave on honeymoon or when you get back. Otherwise you start adding new parts to the equation like other states and then waiting on them to process your marriage license and well you are going to wait more than likely, only way to get the speed you want is to do it yourself and get married in that 30 minute deal in Virginia, otherwise it is going to be or could be several days waiting for that license or weeks, because each state is different and each county recorders office works at different pace, just telling you what I learned firsthand.

It does vary, but most people get AP within 90 days. You can file as soon as you get the marriage certificate and you have taken care of the vaccination supplement of the medical.

If your not too picky about the order of events, you could meet somewhere with your fiancee and have a honeymoon before she enters the US. Then get married after entering the US together.

You do have to be careful about any flights transiting through the US before you decide to use the visa.

You should get a letter with your new case number, but you can can also call the NVC, talk to an operator and get your case number as well.

Medical is pretty easy. The available doctors are on the embassy page. The cost is 600,000 IDR for the exam, and vaccines are extra, which for us was about another 600,000 IDR. You can schedule the medical as soon as you have packet 3, and you will need to wait a couple days before bringing in the rest of your documents for document inspection.

The consulate will get the correct information when your fiance brings her birth certificate to the interview. I really doubt it will cause any problems.
