Hi, my fiance and I are a little confused about our situation right now. helpsmilie.gif

I met my fiance when I was studying in America, and right now he's still enrolled in college. Last year he made around $35,000 income from stock distribution and part-time job, and has around $123,000 worth of stocks and $32,000 in the bank. However, his annual income didn't meet the requirement for the last two years. so my questions are:
1. Do we still need a co-sponsor?
2. Do I need to bring the last 3 years of tax return to my interview?
3. Also, I've lived in two different cities in China mainland for more than 6 months since I was sixteen, does that mean that I have to get the Notarial Certificate of Non-Criminality from these two different cities?

1. No, but weather or not he will have to show assets depends on how stable his income is. If his income remains the same each year or improves, than all he needs to disclose is income.
2. Only if required by the consulate/embassy
3. If the police certificate covers the entire country, than all you need is one. But if the police certificates are by province or state, than you would need one for each state you lived in. How this works varies by country.

They are generally only processed by visa type. The only country that seems to get the fast track is applications with benificaries from Cuba. This is likely due to the special immigration laws related to Cuba.

The question is really intent. If you decide to marry when your fiancee is already in the country on a tourist visa, you can do so and adjust status successfully.

However, if your fiancee enters the country with the intention of getting married and staying, that is considered fraud. While some have been able to do this successfully, it can come back to bite you.

Yes you can go ahead with the K-1. If the work visa comes through, you can cancel the K-1. However, if your fiance intends to immigrate, make sure the work visa is considered dual intent. That way once he is here, he can get married to you and file for AOS.

When you arrive in the US, the K-1 is valid for a 90 day stay. He can only work for 90 days with the EAD stamp, and JFK is the only airport that currently provides it.

The timeline is only an estimate based on the data provided by users on this site. The two service centers have about the same approval time now, so it likely doesn't matter which service center you select.

It doesn't speed up the process, but it changes a few things. She will have a different medical and wont be able to get all of the vaccines while she is pregnant. Its unlikely she will be allowed to travel late during her pregnancy. If thats the case, the child would be born abroad and you would have to file a report for a birth abroad to get a passport for the child.

J-1 has a home residency requirement, but thats not something you have to worry about. You should be fine with a K-1 visa once you are ready to apply for it.

If you have never been married previously, then you don't really need to show that you are free and legally able to marry. Otherwise you would include copies of divorce decrees.

No, the citizen is not required to attend the interview. However, I strongly recommend that you go. I went with my husband, and the interview was a piece of cake. Your presence is just an example of the love you share for your spouse.


That actually depends on the embassy or consulate. Some places don't allow the fiance or spouse to attend the interview, they have to wait outside.

Packet 3 is the instruction packet, with forms and instructions for what to do next. Packet 4 is just your interview date. How this is done by each embassy or consulate can vary. But most people receive a packet 3 and 4.

Reasons to deny a visa are very specific with the exception of fraud question, is there a bonafide relationship? That is the only question that is up to the CO's discretion, everything else is pretty clear cut.

Do you pose a health risk?
Are you a security threat?
Are you likely to become a public charge?
Have you ever used drugs?
Have you ever committed a serious crime?

If you can answer no to all those questions, than the only thing you have to worry about is proving that you have a bonafide relationship.

I just got home from the airport. I was in Peru to get married. We had a "religious" wedding BUT no "civil" wedding. My not yet legal wife needed to have her middle name removed (I won't go into why this had to be done) before we could have the civil wedding. This process of having the name change took a lot longer then expected, so we could not have the civil wedding before I returned home today.
Now, what should I do? Go back to Peru in 2 months and get legally married or start the K-1 K-2 ????Which would be the FASTEST way? The main reason we wanted to get married in Peru was so her family could attend the wedding, which they did, as well as my family. So now where we get legally married is not important.
Just want to know what might be the fastest way to get her here!!!!


Well it depends, if you want the least trouble, just get legally married. It will take a little longer but you shouldn't have any problems.

As far as doing K-1/K-2, it depends on how much information you give. If you tell the CO or border officers, that you had a wedding, it could cause problems even if it was not legal. Just treat it as an engagement party. She is not your not yet legal wife, she is your fiancee.

Well AP can be filed for with no fee only after AOS is filed.

You can get married right away, and then plan a church ceremony for family and friends later. With that you wont be restricted to the 90 day limit and you should have the time to plan the ceremony you want. If you are in Minnesota as your profile seems to indicate, marriage licenses have a 5 day waiting period before they can be used.

You should get from your fiance a copy of the G-325a with all the pages signed by him. And a letter of intent to marry. You can both do one letter, or each of you do a separate letter.

If your fiance has ever had any name changes or previous marriages, you will need documentation regarding that, with a translation to English.

Besides the proof of meeting, that should be it.

The Embassy in Indonesia only accepts documents in English. If they require documents in English, its usually indicated in Packet 3.

If you have the time, and can follow the guides here on this site, and the instructions on the forms, you don't need a lawyer to file for you. If you have complications in your case, such as several previous marriages or criminal history either for you or your fiancee you might want to consider having a lawyer help you with your case. Most people on this site have filed successfully without the assistance of a lawyer. A lawyer will not make your processing time any faster. You are in the same queue as the rest of us.

Processing time is in 3 stages. It all depends which consulate, and service center your petition goes through.

1. USCIS processing is handled by the California service center and Vermont service center. Texas and Nebraska go to California. Since your going through California, it will take about 3 months. Longer if there are problems with the name checks, or you forgot to include certain information with your petition.

2. Once the petition is approved its forwarded to the NVC, which then forwards the petition to the consulate. This takes about 2-4 weeks.

3. As far as the consulate goes, it all depends. Each consulate has their own way of handling Visa petitions. Some will schedule the interview right away, others will do it only after your fiancee returns packet 3. I plan to place paper sheet protectors with a subject name in between some sections. I supplied my passport with stamps going to Hong Kong for evidence meeting within the past two years and I also attached 3-5 pictures of us together. (The pictures is in a zip lock bag labeled Proofs of evidence meeting within past two years, using a binder clips to attach it to my copies of passport.)

I'm so anxious to send this packet out and just wait for good news :-D.

2. Only 1 photo is needed, but some put in 2 just in case.

We had a wedding before my fiance came to the US, but it was not a marriage. We made sure that the officiant of the wedding knew that it would not include the marriage. But we did everything else thats part of an traditional wedding.

We will be having our civil ceremony this Friday at the courthouse.

You do have to remember that you are not married for all legal purposes. If you do suggest that you might be married it can derail the process or cause issues with being able to use the K-1 visa.

If your looking for what dates to use in the timeline, it doesn't matter to be exact. The time line is only an estimate anyway, you may be approved earlier or later than the estimated date.

1. What you will earn by the end of this year is fine.

2. Do not sign until you are in front of a notary. You will sign it, and the notary will also sign and stamp it.

Thanks for the replies! I was mainly interested in the filing fees but appreciate any input, it all adds up. I figured the I-145 would be necessary, didn't know about the visa fee.
I just discovered the fee increase yesterday, I had intended to send my I-129 package today but had to back up. I'm P.O.'d and discouraged and just weighing the overall situation. Wondering if it's really worth it???? Life in Thailand wasn't so bad and I'm increasingly disenchanted with this country!


I considered living in my fiancee's country, but I realized it would be, at least at this time, difficult to get work there which paid well. Most of the jobs in Indonesia for expats are upper end managerial positions or engineering related. Might be something to consider in a few years, but right now it wasn't a possibility.

Well its hard to know about what the later stages will cost, since the fees could change by then.

But there are other costs, in addition to the fees that you may run into. In the visa process stage, you will have to pay for the medical which can vary depending on the country, and visa fee to the embassy or consulate were your fiance will have the interview. Also, postage and document preparation costs can add up. I spent something like $100 or more at kinko's to get everything ready. If your fiancee is not located in the city with the embassy or consulate that they will have thier interview at, there are travel and lodging costs to consider. In most countries, interviews are only done in one city.

The bonus though, depending on your tax bracket and when you switch your W-4 status to married, you could end up with a nice tax return at the end of the year.

After your fiance is here, he or she will have to file for AOS, and the fees for that are over $1000. Also, you will have to support your partner as they will likely not be able to work for at least a few months (unless you get the work stamp through JFK). Being able to switch your status to married will have less taxes withheld in your paycheck, which will make supporting your partner easier.

If your looking at all costs, you probably should be looking at how much travel and airfare adds as well. And well, depending on your style, a wedding can be pretty expensive, though i would suggest not going outside of your means.

There is no real way to put a total cost on everything, some of it depends which country your fiance is in. And of course, fees are likely to increase by the time you would be filling for naturalization.

While its financially prudent to plan and be aware of the these costs, don't let the value of your relationship be determined by money.

Follow the instructions given by the embassy. Each embassy or consulate may have their own procedures for paperwork. There is a part of that form you are not supposed to sign until in the presence of a CO.

You can self-sponsor, but as far as i know its limited to certain countries, and only if you have somewhere in the range of $100,000 or more in assets.

You need to have your fiance call the service center and see if they can track down what happened to the case. At this point its possible it may need to be resent.

yes, the whole plan was (eh this was before we started looking into the visa's etc) because in march his parents are going to india for a wedding, so for that month i was going to stay with him, and during that month he wanted to marry me, and find our own apartment.


If you can get in, you can certainly get married, but you wont be able to stay. You would have to return home, and apply for a K-3 visa or CR-1/IR-1 visa.

Depending which visa you apply for it will take about 6-12 months to get and cost a couple thousand by the time you make it through the process.

If you mention boyfriend or fiance as the purpose of your visit, you may be asked to show evidence of ties to Australia. If you don't you may get sent home before you get a chance to see your boyfriend.

If you are allowed entry, don't overstay the visa, as it can cause problems for you if you do want to return later on a K-1 or another spousal visa.
