If your fiance has residency in the UK, getting married in the UK, and then filing for a visa via DCF may be an option for you. If it is, its probably the fastest option available to you. But this only works when the USC meets the residency requirements of the foreign country.

well, you might as well, i had to hand over ticket stubs proving i was there in order to prove we've been together in the last 2 years.

all the advice i've heard says that the USCIS doesn't hand over info to the Treasury Dept, which is the arm of the law that set up the "Trading with the Enemy Act" so i just had to take that on faith.

some other guy on this board tried to say he hadn't been to cuba and it was a hardship because of the law, but they rejected his petition. so then he tried again and had to admit that he lied the first time -- eesh -- but they still let it go forward, so that was lucky for him!



It's relatively easy to get to Cuba anyway - a few extra steps involved, but many people do it.

In the case of Cuba, you have to break laws to follow immigration laws...makes no sense, but meh.


You don't have too, you can always meet in a third country.

Your visa was not yet approved, only your petition.

For whatever reason, probably due to the special immigration laws relating to Cuba, K-1 petitions for fiances in Cuba are processed very quickly.

You are correct. Had you been filing for an IR-1/CR-1 visa, then you would be required to send stuff to the NVC.

Right, there are two types of proof.

1. Proof of having met in the last two years. These are receipts, board pass stubs, passport stamps, and anything else that can give a location and date. This is the evidence required by the I-129F.
2. Proof of ongoing relationship. This is required at the interview. But can include emails, IM logs, phone bills, letters, or anything else that shows that you can communicate in a common language, and that you have been communicating.

No, K-1 is a fiance visa. Getting married outside of the US prior to using the K-1 visa, will make you ineligible for the K-1 visa. The marriage has to occur in the US after the visa has been granted.

Pictures are secondary evidence.

You need to show boarding pass stubs, passport stamps or other evidence that show dates and places. The dates have to be within the past 2 years.

Depends on a bit on how liquid it is. It might be an issue if it was all tied up in a house. But it should be sufficient for sponsorship using assets.

As long as your case is still active at the embassy or consulate, they will continue to extend the Approval notice without needing you to do anything.

You can only stop a money order if the company that provided it, allows you to do so. Otherwise there are no refunds.

First make sure that a ceremony in the country you had it in was not legally binding.

Secondly, don't include any pictures from or even bring up the ceremony. They wont ask about it, and as long as it wasn't legally binding, its not really any of their business to begin with.

Most forms are used for multiple visas. You are not married, you don't have a spouse. You can leave it blank or just say none.

You can cancel your K-1 if your situation changes. No refunds though.

If you let the K-1 process go through, it is possible that it may nearly be completed once your assignment is done. Even if it gets done early, the visa expires in 6 months, so you do not have to return right away.

Though DCF does get your fiance a green card right away.

It depends how much you are transfering. Western union or other services make more sense for small amounts, or if you don't have a bank account. Wire transfer is better for larger amounts.

You can have a wedding, but you cannot get married.

In most countries having a wedding alone is not a marriage. You generally need to file some paperwork before the wedding can be considered a marriage. If you skip that step in your plans, you wont run into any issues with the K-1 visa. But its preferable to do it after you have already received your visa.

...and entered the US...


You can do a purely ceremonial wedding prior to entry and follow it up with a legal marriage stateside.

Your case will likely be in the queue with October filers. Your probably not going to be able to get them to speed things up because of the mistake.

But on the other hand, if you prepare ahead of time, you can get your interview in Jakarta very quickly. Only a couple weeks instead of months as beneficiaries in other countries have to wait.


Dan & Gemvita, thank you for the feedback. I have another question for you. What do you mean by preparing ahead of time? Are you saying that it would be okay to start on getting the police clearance or I should wait until the embassy in Jakarta inform me?

Police clearance from the headquarters in Jakarta is good for 6 months. You can get that now.

Have your fiance send you the affidavit of support form, as soon as you get your NOA2 for the petition.

I think you may be able to have the medical done before you get packet 3 at one of the clinics, otherwise you have to wait until packet 3 before doing that.

Once you have your medical and turn in the forms for document inspection, you can have an interview as soon as the next day. So if you prepare as much as you can ahead of time, you could probably have your interview within a week or two of packet 3.

It's hard to say if there is anything you can do to speed things up. You may be through the process quick enough for the child to be born here in the US. Or you could get stuck in AR/AP which many couples going through Vietnam end up in.

You may want to email the consulate/embassy to see if there is anything that they would request with your fiance being pregnant.

You can't nor should you cover up the pregnancy. They will get the medical results and know that your fiancee is pregnant. It isn't necessary that she volunteer the information, but covering it up is a bad idea. Could lead to denial over misrepresentation.

Vietnam is a high fraud country, so they may ask you to verify that the child is indeed yours, or if its not, that you know about and are ok with it.

I-129F is also used as part of the K-3 visa and there is also another form I-129 thats used for certain work visas. You need to send your petition to Vermont or California depending on your state.

Vermont was really fast, approvals within 1-2 months, however, its slowed down as well.

Normally its just your interview date, also called packet 4. Although procedures at each embassy or consulate may vary. It would be a good idea to ask this question in the Canada forum.

Unless its recently been changed, cases go to the NVC first, usually for just a couple days, before being forwarded to the consulate. Sometimes it takes awhile for the case to leave the service center and get to the NVC.

How many G-325A forms do we need to submit? She only sent me two of them signed but I know there are four pages total when you download the forms. IF we need more can i just photocopy two more? thanks!!!


You need to show that you have met in the past 2 years for the filling. Additional evidence of an ongoing relationship is given at the interview. Though it can be added to the packet if you want to.

You need to submit 4 forms for you and 4 forms from your fiance. All of them should have an original signature. As far as photocopying, it may work, or you may get an RFE.

Anyone worrying about time please do not, they are so fast once uscis have approved the visa! I sent in a covering leter with my packet 2 asking for an early interview and they did it no problem, if your in a rush probably a good idea to send in a letter!


Good for you, i'm happy it went fast. However it really depends on which embassy / country your fiancee is from. China for example from "NVC out" to interview is usually around 5 months and thats the fast track. China embassy " GUZ" does not open provisional files or expedite. If you look at the Dominican Rupublic the usual wait for a interview, after usics approval is over a year.
Remember alot of us are not engaged to folks from Europe.

Yes it does depend on the country. Vita had her interview the very next day after she turned in packet 3. It took about 3 weeks overall between when the embassy received the packet until the interview date.

You have more than enough really. If you want to save a tree, i would recommend that you just copy the last trip or two. You dont really want to overwhelm the adjudicator with evidence so that it takes them a long time to sort through to find the paper they are looking for.

On the copies highlight names and dates. Having your fiancee sign it, is not really necessary.

But for any addtional information, put it on a cover letter. I had a cover letter for the evidence of meeting section of the petition. It had a list describing each piece of evidence I included, and it was organized in the same order as the list, making it easy to find.

I think there is more to this. I've never heard of a ban for intent to stay. Normally, the person is just turned away at the PoE. Also, by coming to the US with a immigrant or dual intent visa, you wont have any problems with denied entry over intent to stay.

Is it possible that your fiancee has overstayed her visa on previous visits?

But regardless, bans can be overcome, but you will be in for the long haul on this one. Consulting an attorney familiar with immigration law is a good idea.

Hmm...that may be difficult (she would quit her job then, and has no children, but a lot of family), but I don't remember her having to show much proof on her previous visits.

How would the immigration officials at the entry checkpoints know about the K-1 application? It just seems to me that this entry would not be any different from her previous visits.

Would point-of-entry be the only potential problem?


PoE would be the only problem as she already has the visa. And yes they would know about the pending K-1 petition.

Officers at the PoE can turn away anyone coming on a tourist visa that may possibly have immigration intent. Being that you have a pending K-1, immigration intent is established. She will have to show that she intends to return to her home country before the visa expires. This can be anything rental agreement, property deeds, or letter from an employer. Even then, she will likely face extra questioning when entering the country.

I don't know about the procedures of all airlines, but EVA Air checks the credit card at check in on an E-ticket. If its a paper ticket it should be fine, but you want to check how the airline handles e-tickets.

1. No, but weather or not he will have to show assets depends on how stable his income is. If his income remains the same each year or improves, than all he needs to disclose is income.
2. Only if required by the consulate/embassy
3. If the police certificate covers the entire country, than all you need is one. But if the police certificates are by province or state, than you would need one for each state you lived in. How this works varies by country.
