You wont get a notification in your email when its been "touched". When your last updated date changes, its been touched. But dont put too much meaning into it. All it means is that the file was scanned into the computer while it was moved from one place to another. Though generally, alot of last updated changes in a row, means that its being worked on.

Quite a situation.

As far as the laws being changed to give an avenue for illegal immigrants to become legal immigraints is stalled last I heard. Not really sure anything will happen down that avenue for at least a couple years.

I really dont know if there is any path you can take. You might finding moving to and living in mexico a better option. Ussualy overstay of a visa or entry into the US without a visa is grounds for denial if you were to apply for a visa. I dont know if there are options in getting waviers for that.

I dont know how many people here can give good advice in this situation. Finding a lawyer might be the best bet.

Woohoo, finally I-129F approval! After received an RFE for missing passport pics, and getting a denial since my lawyer only sent in my spouses pics, the appeal package getting lost in the CSC mail room, the second appeal package led to an appeal!! The appeal process took 7 days. Finally the CSC process is over...now onto NVC and hopefully medical/inteview shortly after!!

Start with reading the guides.

She will have to return home after the wedding. You could file for Adjustment of Status but since she isnt here on a K-1 visa, you could possibly run into trouble. The problem is with intent. If you decided to get married while she was already here, you could do so and file AOS, but if she intents to enter the country to get married and stay she may not only get denied at the PoE, but you could run into problems with AOS.

K-1 is fiancee visa, since your getting married you cant use that.

K-3 or IR-1/CR-1 are your options for spousal visas. Each has thier own advantages. Read the guides for more info. You can only start them once you are married.

I think your a bit confused. For the K-1 visa, I-864 is required later, when you apply for adjustment of status.

For the interview, you may have to provide the I-134 if required by the consulate. Not all consulates use that form.

Only if she entered on a K-1 visa or another immigrant visa. If she enters on any other visa with the intent to get married to you and adjust status, it will be considered fraud and she could face deportation.

But if she is already in the US and you get married before her visa expires you can file for AOS and she can stay in the country.

Can she apply for a B-2 Spouse Visa? B-2 is a tourist visa. Yes she can apply for it, but its up to the embassy to approve it. Being that she has a husband here, the possiblity of immigration is likely. Because of that they would probably deny the visa.

Without applying for K-3 you can take the CR-1/IR-1 option. It takes a bit longer to process ussualy, but you wont have to file AOS upon entry.

K-3 or CR-1/IR-1 are pretty much your only legal options. There isnt much you can do to expide it either, short of joining the military and getting deployed.

FBI is the Federal Bureau of Investigation. One of the federal law enforcement branches. They also do name and background checks on those people applying immigration visas and those adjusting status. For most people this goes pretty quick. But if you have a common Islamic name for example, it can take quite awhile.

I-129 yes, but not I-129F. You can only pay to expedite work based visas. Not family ones.

I knew K3 visa is non-immigrant visa and IR1/CR1 is immigrant visa.

We are planning that we get marry on end of this year in U.S. after that which visa is good for us.

After we got marry, I will back to Japan.

Is there a big different of this 2 visas?

Which visa is more faster to get?


K-3 is usually faster to get, however, with the IR-1/CR-1 option, you will receive a green card upon entry. With K-3 you will have to apply for AOS sometime after you have entered.

In certain regions of the world, for security reasons, or if a consulate has a high amount of fraud. Many cases in that particular consulate will end up in AP or AR.

The K-1 visa will need to be canceled before applying for a second visa. Its likely that he will still end up administrative review, just because its very common in certain countries.

Husband files for divorce. Laws of our state dictate that 90 days must elapse between when application is filed and when divorce can take place

July 19, 2007
Couple miss their adjustment of status interview; their case is closed.

October 15, 2007
We receive a letter from USCIS about removal proceedings that have been started against my wife; we hire an immigration attorney and start a process to get her a voluntary departure order.

October 18, 2007
My wife's first marriage is dissolved by the court

October 31, 2007
My wife and I legally marry. I am a US citizen.

November 15, 2007
An order of voluntary departure is entered giving my wife until March 7, 2008 to leave the country.

February 27, 2008
My wife is scheduled to comply with the order and leave the US.

February 28, 2008
I intend to file I-130 form on behalf of my wife.


She is not eligible to file for AOS as she would be filing it on a K-1 visa, with a marriage to someone else other than the original sponsor, but you already know that.

Even with a voluntary departure, she has already accrued overstay time. Over 180 days, but less than a year, does mean a 3 year ban. You can file a wavier at the interview stage, but you will have to prove hardship. How quickly that will be processed varies. If you can't prove hardship, she will have to wait out the 3 year ban.

A K1 or K3 wouldnt take that long. Which means you probably are apply for another visa class.

Hi everyone,
I am a newbie here and I wish I found VJ sooner. This site is very helpfull and informative.
Right now I have my case delayed. The interview on 2/27/2007 at HCMC for my fiancee did not have a good outcome.The green slip stated that I need more proof of income and was asked for a 1722 letter.
My question is: Can a K1 Visa have a Joint sponsor for I-134 affidavit of support? I got confused when reading this forum. Some got approved with joint sponsors and some opinions stated otherwise.
Can someone confirm this. And what about asset, like a house, to contribute to the financial support?
I love my girl so much and we both are so sad.

You will be the primary sponsor, and you will need to have a co-sponsor. Im not sure if they fill out a seperate form or not though. You need to make sure your co-sponsor is willing to commit to this though. The affidavit is valid for 5 years or until the benificiary becomes a USC.

According to the I-134 form, you only need to show tax returns if you are self employed. For those who are not self employed, a letter from his/her employer is enough. I would double check with the embassy though, they might require more proof.

If your fiancee cannot meet the minimum requriements, then your fiancee will need a co-sponsor.

Basically past earning power doesnt matter, what matters what you currently make and what you will make in the future or wether or not you have enough assets to meet the requriement for 3 years.

If the passengers of an airplane or ship that lands at an airport or seaport in Japan wish to enter Japan temporarily for shopping or rest, they can receive special landing permission from the immigration authority at the port of arrival even if they do not possess a visa.
In principle, applications for such special landing permission are made not by the foreigners wishing to enter Japan themselves but by the captain of their airplane or ship or by the carrier (transportation company) operating the flight or voyage. When special landing permission is granted, the foreigners concerned are not given any status of residence or period of stay, but restrictions on landing time and scope of movement are stipulated as conditions for permission. Also, special landing permission is not granted if the applicant will be returning to his or her place of departure (for example, coming from Hawaii and then returning to Hawaii).
Please note that these permits are for very short stays, they cannot be extended, and the route to be followed in transit, etc. is subject to restrictions. If foreigners wish to travel in Japan, they are recommended to acquire a transit visa or a short-term visa before coming to Japan.
For more details concerning special landing permission, please inquire at the nearest immigration authority.

Children under 18 are ussualy dependents. Children in collage are somtimes still considered dependents. Depending how taxes are filed, if he has a wife she may or may not be counted as a dependent. Filed as a married couple yes, filed seperatly I dont think so.

The table is not labled, but the first column is the number of people being supported. The first column is the poverty guildline if you live in the 48 contiguous states. 3rd column is alaska, and the 4th is hawaii.

Your sponsor has to make or have assets for 125% of the numbers on that table. For two people in the lower 48 states the poverty guildline is $13,690. Your fiancee would have to make $17112.5 per year to satifiy the guidline. If your fiancee's father supported you and your fiancee, and he didnt have any dependents (wife or children) you would take the number for 3 people, and multiply it by 125%.
