Called the NVC today and they said our case is on its way to the London embassy. :D

Just checking in, I have been doing some training with the Army...this process is moving fast, I have already received and interview date...

Hey Good to know you've got the interview date already !. Did you send back Packet 3 after the medical, or prior to it ?. It sucks that the embassy here requires me to do the medical first then I could send back Packet 3.

Has anyone had this problem: I called NVC and got my case number, but now every time I enter it on the automatic system it says that there is no record of my case? I was trying it yesterday, and the day before. I am just trying to avoid having to wait every time for an operator to find out if my case has been sent to the consulate yet. Any ideas? You have to talk to a person. The automated system doesnt ussualy have K-1s.

I sent one to the U.S embassy in Jakarta, but never got replied. They only replied to Dan's emails because he's the USC. They suck.

The NVC automated phone system doesn't work for me and I wondered if anyone else has the problem. When I call it I get the option to choose english or spanish and after choosing I get more of the message but part of the way through it acts like I pressed a button and says sorry I didn't understand your input, then starts over. After doing this a couple times it pretty much tells me (in a nice way) you're too stupid to use this system so we're gonna hang up now.

Anyone else have this looped problem with their automated line?


You need to talk to an operator, which is option 1 for english and then 5 to reach an operator. If there are alot of calls, you will get looped back to the menu and you just have to try again later.

Yup our case is already in Jakarta, we already have the medical scheduled and most of the documents together. After we turn in the documents, its pretty quick to get an interview in Jakarta, we may have our interview by the end of June, otherwise at the beginning of July.

I have a question for the forum. I am getting conflicting information from what my lawyer is telling me versus what the NVC representative is telling me. I received an email from CSC saying that my I-129F was sent to the NVC on the 23rd of May. From what I read on the FAQ and K3 guide in VJ, once the NVC receives the petition it is assigned a case number and then forwarded directly to the embassy. My lawyer is telling me that is not true. She said once the NVC assigns a case number, it is sent back to us with a packet that we have to complete (AOS) and send back to the NVC and then they forward to the embassy.

My situation has another twist. I have also filed for the I-130 and the NVC sent us the bar coded packet with the DS-230 and I-864 on 5/22 (we still havent received it).

My primary goal is to bring my wife here as quickly as possible since she is 5 months pregnant.

In my opinion, the K3 will be received in Venezuela before the I-130, but my lawyer thinks otherwise. If the information in the FAQ is correct that the NVC directly forward to the emabssy, the I-129 petition can be there as early as next week. Since we still havent received the I-130 packet yet, I am predicting it can take up to anotjer 4-6 weeks before the I-130 gets to Venezuela.

Can somebody help clarify? What would you guys do if you were in my situation?



I dont have the specific dates, but my timeline is approximately the following:


12/11/06 Filed for I-130
2/28/07 Filed for I-129F
3/8/07 I-129F sent to CSC
5/2/07 I-130 approved
5/18/07 NVC receives AOS Bill
5/22/07 NVC sends bar coded instructions with I-864 and DS 230 package
5/23/07 I-129F approved and sent from CSC to NVC
6/1/07 (estimated) NVC receives I-129F ????
6/1/07 (estimated) Receive bar coded packet from NVC for I-130

I think its possible, that by the time your wife receives her visa, it may be too late to travel. Airlines don't allow passengers on the plane when they are in the late stages of pregnancy. If the case is, that your child is born in Venezuela he will automatically get US Citizenship by registering the birth with the embassy.

1. how big is packet 3?
2. does it come via email or snail mail etc?
3. if there is more paperwork to be filled out - is there a place on it you can give them your new address if applicable?

Every consulate does it diffrently, but for Jakarta, an email was sent to me, the petitioner. They sent a couple documents, and a few forms to fill out. As well as instructions for the medical.

Jakarta consulate requires 3 forms, DS-156, DS-156K and DS-230. Some of those forms are used for any type of a visa. So some of the questions dont exactly apply to K-1 visas. It looks like australia requires the same forms, but thier instructions are somewhat diffrent.

Nagishkaw, I don't think we need NOA2 until filing for adjustment of status which is many, many months away. Yes we need to the that NOA2 eventually for sure, but it should not hold up the process.


Thats right, you dont need the NOA2 for the interview, but you will need a copy for the AOS petition.

It should take about a 3-5 business days to reach the consulates. Some people here should be hearing from the consulate soon. If were lucky we will get something on Friday, But i think Monday is more likely.

Has anybody that was approved late last week 17th or 18th, made it to NVC yet? I called them late last night, and my case is still not in their database, so I'm just curious if anyone else has had luck. I think there were a couple of us w/ NOA2 late last week. I know I'm being inpatient...I can't help it. :blush:
If NVC is turning these things around in a couple of days, that sounds good to me! I just hope my petition makes it to NVC soon! :)

Ours took 10 days to get to the NVC from the approval day. I hope yours won't take that long. Keep calling the NVC. Not to making it faster, but to make sure if your case arrive safely there.

What fee? You already paid the USCIS fee and you'll pay the consulate a fee but there shouldnt be an NVC fee. Is there one? You have me worrying now!

As i first started the K1 application, I ask the border patrol officer about K1 visa and they told me that K1 the fastest way to bring your love one here and then marry, so I did this and now its been 1 full year since my case is going thru, and now this AP thing, so how this case would be fastest then anything else, its seem to me slowest then every other case, and like you said it could take weeks, months and even a year, since I already have 1 year on my case and if it take 1 more year, I would be dead by then seriously and yeh her interview is passed but I dont know why they put us under security clearance is this is now a regular procedure? or they would have an doubt on our case or something? why?

is there way we can involve any lawayer or conressmen to speed up the security procedure? or no?

I am really really so frustrated now with the AP


Its unlikely anyone can help you speed it up, but a congress person may be able to get your more information on why your case needs additional processing.

If your in AP with a K-1, you may still have ended up in AP with K-3 or IR-1/CR-1. And to bring a spouse or fiancee to the US to immigrate, those are pretty much your only options.

My case actually took about 4 months, but due to other obligations, my fiancee wont be able to leave and come to the US for another couple months.

As you can see from my signature, I got some amazing news the other day. I now need to cancel the I-130 and I-129F petitions I have at the NVC (well, I guess one is in Vermont). Does anyone know how? I have tried calling the NVC, but the lines have been so busy I haven't been able to get thru to a person yet. Didn't know if there was a form (I'll just bet there is!) or a fee (probably one of them too!) or whatever. I want to get rid of the petitions as soon as possible to free up some spots for the rest of you!!

I suppose you may have to wait until it reaches the consulate, and tell them at that point to cancel the petition. You could probably just let it be without any issues as wont be needing to apply for a visa to the US again.

Its usually only at the NVC for a couple days before being sent to the embassy, but it does take a week or so in transit between the NVC and the embassy its being sent to. That applies to K-1's. Spouse visas spend more time at the NVC.

For K-1 visas its usually only a day or two. Sometimes petitions get held for AR or AP, and that can delay the petition being forwarded for a few days to months. But then it takes a week to a month to get the consulate/embassy.

Departs the United States permanently and either formally

Its one or the other. Becomming a citizen will take either 3 or 5 years. For most cases its 5 years unless the green card is obtained through marriage and is still married to the same person after 3 years. However, becomming a citizen is optional as in many cases it would result in the lost of citizenship with the birth country.

Make sure you have plenty of evidence to show that you aren't really getting married, however, you don't want to jeopardize your K1 application.


Well, as far as money goes, thank God for student loans! I'm traveling to the Philippines in July, I could only probably plan one more trip after that (to pick her up when she gets her visa!)

So, yeah, I'd like to do the wedding ceremony without the legal marriage in the Philippines so I can get jump started on the K-1 Visa as soon as she gets her brith certificate corrected so she can get her passport. But even at that rate, the time difference between the K-1 and the K-3 is only a matter of a couple of months or so, so I may want to do it by the book so I dont risk scrutiny, right?

What kind of evidence do you mean? Not calling each other husband and wife in customs? Not wearing the wedding rings? Stuff like that?


With K-1 you do have to show evidence that you have met each other in the past two years. Anything from photos, to recepits to boarding passes help here. Just send copies. You need to show that you were in the philipines at some point and that you were with each other.

Then follow that up with a civil wedding here in the US, after the K-1 is approved. Thats probably the quickest way the two of you will be able to get together in the US. Assuming no delays.

If you do go this path, don't mention it to any immigration officals. Although its not legally binding, it is possible that it will cause confusion and delays.

You wont get a notification in your email when its been "touched". When your last updated date changes, its been touched. But dont put too much meaning into it. All it means is that the file was scanned into the computer while it was moved from one place to another. Though generally, alot of last updated changes in a row, means that its being worked on.
