US Embassy and Consulate DiscussionCo-sponsor
QUOTE (Blaine74 @ Sep 22 2007, 05:11 PM) <{POST_SNAPBACK}>
My last job was about a year ago. Since then I have moved from Boston to Seattle and have basically been helping my family re-organize two of their businesses. I was making around $70k. Now, all I have to show is $50k in Stocks and another $50k in my savings account.

Should I fill out the form with a co-sponsor or should I wait to see what they require?

100K in assets is acutally suffcient to sponsor using only assets. You will need to include statements from each of the accounts.

To be safe however, it would be a good idea to have a co-sponsor lined up. Even if you don't actually have to use them.

US Embassy and Consulate Discussiontax transcripts and identity theft fears
QUOTE (Alijef @ Sep 24 2007, 12:58 AM) <{POST_SNAPBACK}>
Here's a few questions for ya'll,
My father is co-sponsoring my fiancee's (from Brasil) visa, and has reached a point where he is now questioning how much personal info he wants to have "floating around". He tells me he called USCIS and they told him that he could send the info along with form I-134 into the USCIS office ... and that they would process it and send it to the Brasilian consulate. This sounds absurd to me, as the USCIS seems quite incompetent of doing much of anything when it comes to coordinating paperwork.

First question: Has anyone gone this route - sent the I-134 document into the USCIS to be "processed" and then sent along to the consulate for the interview? What do you know about this option?
Second question: Is the Tax transcript absolutely necessary to prove past income? (as he is retired and will be using past income and bank statements for his supporting evidence)
Third: By having a notary public signature on the I-134 form, is the supporting evidence SO important, as a notary public (according to my father) is supposed to look at supporting paperwork before signing off on the form????

Any other suggestions with this issue would be greatly appreciated.
thanks,
Alijef

1. As far as i know, thats not an option, you have to send the I-134 to your fiance, who will bring it to the interview.

2. No, you can use Tax returns or pay stubs instead. But if your father is retired and doesn't have income, then that doesn't really work. If he has a pension plan of some kind you can use the 1099 form that it will generate. Otherwise he would need to provide statements as to the value of his assets. He wont have to provide documentation for everything, just what is necessary to prove support. If income is sufficient, he can leave off assets, and if it assets are sufficient, then he wont need to document income.

3. Well the notary only verifies the signature of the document. He or she will not verify if the claims of assets or income are accurate or true. Thats why its necessary to provide the supporting documentation.

i have a question, is it possible that when the embassy sends me the packet 3 and when i'm about to return it, could i send together the expedite request (for interview) that my fiance has (he will be deploying soon to iraq and he has already a confirmation letter of deployment from his command) im not so sure how to send that letter, do you think it would be alright just to include it in the packet 3?

thank you so much!

Have your fiancee contact the embassy and see how they handle expedition requests.

Hey everyone,

I'm powering through the I-134 and I'm curious whether it's necessary to provide supporting evidence for life insurance, home value, mortgage, etc.. If so, any ideas what documents they might want to see?

Also, while we're on the topic, are official documents from the IRS required for tax information, or is it enough to print, say, TurboTax records of returns?

Thanks!

Brian

If your income is sufficient, no need to show assets. But if you do show them, you need to show documents that can prove what you put on the form.

A copy of the 1040 you filed is sufficient, but it may be better to get tax transcripts from the IRS.

US Embassy and Consulate DiscussionDS-156 Signature Confirmation

Maybe in MTL but this is a consulate specific issue... please check with your consulate for final guidance...

There is no swarn affidavit notation on DS-156 stateing that it needs to be signed before a consular officer, and the form can be signed before hand, my fiancee did this without any problems, DS-156K, and DS-230 part 2 (For immigrant visas line IR-1/CR-1) are sworn affidavits that must not be signed as stated on the instruction line that says "DO NOT WRITE BELOW THIS LINE... The consular officer will assist you in answering this part."

Again

DS-156 OK to sign before hand
DS-156K NOT OK TO SIGN BEFORE HAND.
DS-230 part 2 (FOR IR-1/CR-1 VISA) NOT OK TO SIGN BEFORE HAND.

Yes, I will take your advices into account. Thank You so much.

Hi VJ,

I'm getting worried about filing the I-134 since I still owe 8G in the bank and I have no savings. However, if they are looking for establishment employer, well I have been working in the same company for 4 years now but I don't think that will be a strong support. This coming next year I will get another job but again I don't think that's counted. The only thing I have left is to ask my father to be my sponsor because my father has a lot of assets and he makes way more than poverty line. The big question is, can he be my sponsor? Or I can be eligible to sponsor my fianceee?

Please help us VJ, I know the fact that this has has been a topic for several times but again I need some clarification.

A big thank you,

flavorgreentea

Your debts are not a factor. Your income is. If you've worked for the same employer 4 years and earn over the I25% poverty level for your State, you qualify to sponsor.

Actually reading the I-134 instructions then looking through the form itself would have told you that. I highly recommend it.

Okay I just don't quite understand the "sponsor's household size" part. For what I understand, since I'm going to sponsor only my fiancee that means in the first category meaning my household size is (2) is it?

Right, you count yourself, anyone else that depends on you (which seems to be no one in your case) and your fiancee.

Another quick questions.

"Contents include:
- Payment in the amount of $ [PUT IN CORRECT FEE].
- I-129F
- I-129F Supplement: Part B, Question 18, explanation of meeting in person [ONLY IF USED ADDITIONAL SHEET]
- G-325A and passport style photo (Petitioner)
- G-325A and passport style photo (Beneficiary)
- Birth certificate/US Passport (Petitioner)
- Letter certifying intent to marry (Petitioner and Beneficiary)
- Proof of having met in person in the past two years
- Proof of ongoing relationship [if including]
"

Since i dont have access to my birth certificate right now, i can use my passport instead? Do i need to mail my actual passport or just photo copy every page? If so, this passport will count as proof of being a citizen and proof of meeting in last 2 years, with stamps right?

On the form 129f it asks for my birth cirtificate number. Will my form get rejected if i leave it blank and only include a copy of my passport?

Copy every page of your passport. Copy an extra page with the stamps on and organize that with the additional evidence of meeting.

No your form wont get rejected if all you include is a copy of your passport.

QUOTE (MasterNateDawg @ Sep 11 2007, 02:17 PM) <{POST_SNAPBACK}>
For for G-325A - there are 4 pages. The pack says :

7. G-325A (all four pages) filled out by the US Citizen signed and dated (see example)

8. One passport-type photo (see specification) of the US Citizen. Write the full name of the US citizen on the back. Place in a plastic bag and label the bag "Photo of <Insert US Citizen's Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.
9. G-325A (all four pages) filled out by the foreign fiance(e) signed and dated (see example)

Am i supposed to fill it out with the same info on all 4 pages for myself, then the same info on 4 more pages for my fiance? So 8 pages total?

If you fill it out electronically with Adobe Acrobat, it will automatically copy all information to all of the pages. Then all you have to do is sign each page after printing it off.

I have called all the phone numbers on the usis website, i have even called the foreigh embassy, and still I have no clue as to what the exact cost of the visa is going to be. I filed the I-129f before the increase in july. On the embassy website it says as of Jan 1 2008 the visa fee has risen from $100 to $131. My question is do I only need to send her $131 for the visa or will I have to pay $455 on the day of her interview as well? I just want answers, maybe i have not made myself clear to the operators, or maybe they just dont know how to answer my question. but i need helpsmilie.gif . The only information i can give is that when I called the washington office they have told that I have not paid any fees, I do not know what this means for sure but this is what they have told me. They then gave me a website link that has fees listed, and I am in the same boat I was in before. Do I or don't I? Please help!!!!!!!!!!!!
thanks jerome

K-1 visas are handled by two different government departments, and each has their own fee.

USCIS (Dept of Homeland Security) is $455, which you already paid.
Dept of State which does the interview and grants the visa, is $131. Which you pay before or at the interview.

Hi everyone

My fiance (USC) and I are in Australia at the moment. We have been here since the end of October and we are working/living here. We are intending to stay here until the visa is in hand and then go to America.

Because of this, he does not have a salary/job in the US. We do not have any assets. However, his mother, who makes in the vicinity of $60 - $70k a year, is willing to be our co-sponsor, and if this wasn't enough, we are sure his father (same salary) or sister ($80k pa) would also co-sponsor.

Will this be okay? Obviously his intention would be to get a job as soon as we get to America but in the meantime, we have the opportunity to be together during the wait, so it is easier for us.

Thanks for any help!

That should be fine.

However if your fiance has residency in Australia, Then getting married and using DCF may be an option. If it is, then you will be able to go almost directly to a green card pretty quickly.

I have my passport expired July 2009 but I now moved which it means, my address in my passport isn't the same address to where I now live. My question is, can I use my current passport if I was to go for visa interview at embassy, or I will need a new passport with the current address I have? I am a bit confused. Has anybody here experience this?

As far as I know, it doesn't matter. As far as I know, my wifes passport doesn't even show her address in Jakarta.

You may want to renew your passport anyway, since you will be using it as your primary form of ID until you have your green card.

I am considering the idea of not travelling in Sept to see hubby as I'm not sure I want to throw $2300 down the drain if I am turned back at POE - not to mention the heartache. I wanted to know if on a IR1/CR1 visa I could do the following:

Travel to the states for a 3 week vacation once I receive my Visa to take a load of luggage and to set things up before my kids come over on their IR1/CR1 visa. At least this way I won't be turned back. Here are my questions:

1. Even if my green card hasn't arrived once I get there, could I return home to Australia to finalise work matters and collect my kids with such a short stay in the U.S? Would I just need the visa in my passport to make another entry or would I need a different document to come back and return again with kids? (I know the visa is only valid for 6 months).

2. During my 3-week vacation (if it is possible), could I apply for a SSN even though I'm travelling back to Australia to collect the kids, to return in a couple of months?

Your input is much needed. Cheers

1. Your passport will be stamped and that will serve as a green card until you receive your card in the mail.

2. Yes you can apply for an SSN. You may run into an issue if you 3 week stay is followed by several months out of the country. I think technically, you should be able to do it, but you may run into questions at the POE on your return trip.

My wife(then fiancee)came here on September 8th, 2009. Her I-94 stated that her K1 visa will expire on December 7, 2009. I haven't apply for AOS yet. I was just busy with the wedding and work. I didn't even apply for a social security card or employment authorization card yet either. As long as I send in the application before December 7th, I should be ok right? I need to get the ball rolling that's for sure.

Btw, I went to the social security office to apply a card for my wife. They said I needed an employment authorization card. I posted this question before, and a member here link to a page on the ssa.gov site stating that a K1 visa holder does not need an employment authorization card. I brought all the papers and even printed out the link and they told me I still need the employment authorization card. I guess I should just go apply for one.

Applying for an EAD before filing for AOS will result in an EAD that will expire when the 90 day authorized entry period expires. If you are passed that authorized entry period, you may have difficulty applying for a social security card and will need to wait until your wife receives her EAD which she will as part of applying for AOS.

Asia: East and Pacificgetting married in Indonesia
Marriages in Indonesia are usually conducted as religious ceremonies. Muslim marriages can be registered right away, but marriages in other faiths have to go through a special government office.

You can have just a religious ceremony without making it legally recognized. Just make sure the person officiating the marriage is aware of this, and does not try to do anything on your behalf. When entering the US, you may be asked if you are already married and you need to say no.

Prices depend on a lot of factors. Without more information, its difficult to say what might be the reason you are seeing high prices.

If you are leaving from a well connected hub airport (like LAX) you will pay lower prices than you would if you have to connect from a another airport. Prices vary greatly based on day of week, seasons, holidays, and just general demand.

If you do your research you can generally find reasonably priced tickets. Figure out what airlines go to your destination and pay attention to sales offered by those airlines. If you have to connect within the US, you might do better with a separate ticket for the connection.

Aloha from Hawaii!

My case is, I'm from Indonesia and I enter US with K1-Visa (fiance visa)
I changed my maiden name into my husband's last name on my marriage certificate, and filed all the papers with my new name.
I called Indonesian consulate before i did that, and they confirmed that they will be able to change my last name when i renew my passport.
But then when i renew my passport after i got my Green Card, SSN, Driver License and insurance under my (brand new) name,
the Indonesian Consulate send me my new passport with 2 last name (my maiden name and my husband's last name). :bonk:
I found that he didn't understand perfectly what I wanted, and they ask me to go to the court in Indonesia if i want to change my name matched with my Green Card. :wow:

My questions are,
1. Will there any problem for me to travel with a different name on my Green Card and Passport?
As we're thinking to visit Indonesia this month and will stay over in Japan for a night.
2. Will it be difficult for me to enter US with unmatch name on GC and Passport?
3. Should I go to the court when I'm in Indonesia and have my name changed?

Thanks in advance to helping me in this case,
Syelvia :help:

1. No, for international travel use the name in your passport in the tickets. For domestic travel you can use your state id/drivers license.
2. Nope, you can bring a copy of your marriage certificate in case, but last time we traveled we didn't do that.
3. That's up to you. Indonesia does not automatically recognize marriages that occur outside of Indonesia. The process to have your marriage recognized is a bit of a pain from what I understand. (Which I am assuming would be needed to change your name in the passport). Doing so is really only helpful if you plan to live in Indonesia for any period of time.

Most of it comes down to your personal situation and what works best.

If you are married already K-3 and CR1 are your options. If you are not married yet and want to start the process right away, K-1 is the way to go.

Other questions to consider, are where do you want to get married? (K-1 is not an option if you want to get married in Malaysia, but you could still have a Reception in Malaysia and then get married after entering on K-1 in the US.

How quickly do you want to be together in the US? ( K-1 might be the best option here, although CR-1 is a cheaper route to a green card)

I would recommend contacting the embassy. The US embassy page has more information: http://jakarta.usemb...v/marriage.html

Muslim marriages are pretty easy. You will get a marriage book after the ceremony. Sort of a passport sized book as proof that you are married. That will be your marriage certificate. You shouldnt have to do much extra other than providing that certificate that you get from the US embassy/consulate.

They are two different things. Indonesia requires all non-citizens to provide a Certificate of No Impediment before a legal marriage can be performed. That certificate is acquired from the US embassy or consulate in Indonesia.

Now, what you need to do for the marriage ceremony depends if you will have a Muslim wedding or not.

Africa: Sub-SaharanImagine going through all of this for many wives!
Some women could be submissive and don't brave enough to say NO. In indonesia especially where the majority is muslim, polygamy is allowed and there's a surah mentioned about it. And some men using it as the way to legalize their act over bringing another woman into the house. There are examples :

There's this one old guy, I forgot his name, has 9 wives ( Yes, 9 !) and they live in one same house. Or should I say 9 harems instead of wives. He was on the news and on showtalks on national television. He could be proud of himself but I was so sick to death to see him on TV.

Another polygamist has hiw own restaurant called "wong solo", he's a sick guy too with 4 wives. He even put "polygamy juice" in his menu. Also, he held "polygamy award" event and gave out awards to polygamists. Sicko.

Over here, In Indonesia, the general idea is a woman who gives a concent to her husband for polygamy will go to heaven. I say, F**k it, there are other ways to go to heaven. Really, woman should stand for herself and dare to say NO.

Sorry if it's out of topic. My feminist side just jump out everytime I hear about polygamy.
Excuse my grammars.

QUOTE (Quinn @ Sep 26 2007, 02:51 PM) <{POST_SNAPBACK}>
It's been a very stressfull month, but the good news is that on September 20th my Fiance had his visa interview and he was approved! More stressed occured because the embassy has completely dragged their feet in getting the visa to him, but that's another issue. Anyway, my big concern is that this morning my fiance started talking about tax clearances. Is a tax clearance required for his intial arrival in the US?

Its not required to come to the US, however it may be required for him to leave his home country and live abroad.

Different countries have different rules before a citizen can leave to live abroad. Those in the Philippines must attend a CFO seminar. Some other countries have special taxes that must be paid.

National Visa Center (Dept of State)How can I check if NVC forward my application?

Hello everybody,
can anyone tell me how can I check if NVC forwarded my k-1 visa application. I already recieved a letter from NVC with a case # MNL *******???. Also, at this point what are the neccesary things to do on my part?
Besides the ff;
Bank and savings letter
employer letter
tax return last 3 years
W2 form last 3 years also
401k letter
stock letter
life insurrance letter

Also, when is the best to do my affidavit of support? Now or wait until she recieved her packet 3 or packet 4?
Do I need to notorized it all?

Thanks for the help.

Ross

Call the NVC and connect to a operator. K-1 cases ussualy stay for just about 2 days at the NVC. Its probably on its way.

You may not need all that evidence. If your income is suffcient. Assets are optional. I-134 does not require you to disclose are all your fiances. Just enough to show that you meet the sponsorhsip requirements.

Yes it needs to be notorized, and sending it now would be best. She will receive packet 3 in a matter of days.

National Visa Center (Dept of State)February Filers Goin To NVC
It will take about a week or so. CSC is obviously in California, NVC is in New Hampshire. Keep calling them, they should get it soon. Remember your case will not be available through the automated system.

Called the NVC today and they said our case is on its way to the London embassy. :D

Just checking in, I have been doing some training with the Army...this process is moving fast, I have already received and interview date...

Hey Good to know you've got the interview date already !. Did you send back Packet 3 after the medical, or prior to it ?. It sucks that the embassy here requires me to do the medical first then I could send back Packet 3.
