When you do connect to the right line, It says "Thank you for calling United States Citizenship and Immigration Services California Service Center". I have no idea what the other options say since I never call them.

Generally I dont think they will be able to tell you anything, unless you have been touched.

Well you have to wait for your NOA1 to arrive in the mail, which should arrive any day now. If you used a personal check, you can get the case number off the canceled check, but I dont think you can with a money order.

Just relax, due to H1B processing, notifications for both NOA1 and NOA2 are a bit slow. If you used a personal check you can get the case number off the canceled check and track it online.

Your case has been forwarded to California. Texas doesnt process K-1 visas anymore. You can call an inquire and see if you can get your case number. If your check has been cashed, your likely in the queue waiting to be processed. As far as approval, dont expect to see anything until later this month or next.

The guides do tell you everything, but no you dont get a phone call. You do get a couple of letters though.

1. Thats your first NOA, it looks like everything is being sent to your lawyer.

2. Assuming you dont get an RFE, in about 44 days you will get another Notice of Action. This copy you need to keep. It will have your alien number on it. At that point its forwared to the NVC, an new case number is assigned to it. Then its forwarded to the embassy or consulate. The consulate will then contact either by mail, or email with packet 3 information. Each consulate does things its own way. You will recieve instructions or a checklist with packet 3.

If so, call NVC. If asked, they will tell you when your case was received and left their jurisdiction. They can also tell you when USCIS approved you.

Once you have this information, contact your Senator. The most expedient way to this is to go to his/her website, fill out a "Right To Privacy Act Release Form". On there, tell your story, give pertinent dates, sign and fax.

My last touch was May 5th and I went through several useless conversations with USCIS. 36 hours after sending my fax to Senator Akaka, I finally received an email saying we were approved.

I recommend anyone else having a similar difficulty to pursue this course of action.

K-3 has different processing times than K-1 visas do. What worked for K-1 filers may not quite apply to you. Just hang in there, you should find something out soon. Being that your fiancee is from Pakistan, its possible that petition processing may take a bit longer than most others.

Where and when you pay for the visa, depends on the consulate. Look up your consulate in the embassy info section of this site. The fee is $100 per visa. Ussualy an equivilant amount in local currency is accepted. Wether you pay at the interview or at a bank designated by the consulate, depends which consulate you will be going through.

First of all, a big THANK YOU to everybody who runs this site and contributes! It's been such an amazing source of information and advice for us, and getting started and staying sane throughout the visa process would've been so much harder without you!

We are an American/Australian couple, and filed our I129F at CSC in February. We were wondering what the procedure is for setting the interview date with the consulate in Sydney... After I (the Australian benefactor) receive the first letter from the Sydney embassy, will it specify an interview date in that letter, or do they assign the interview date after receiving the completed forms? I want to make sure I have enough time to get everything organised - plane tickets for my fiancee to come over, medical checks, police checks (including one I'll probably need to get from the UK) - before the interview. Once I receive the forms from the embassy, can I take my time in filling them out and returning them, or are there specific time limits I will have to adhere to?

It depends on the consulate. Each consulate does interviews diffrently. But it will probably be 1-3 months between the consulate receivng the packet and having your interview.

Basically it means the government cant hold you to the promise of support in the document. Its just used by the consulate at the interview to determine if the sponsor is able to sufficiently support the beneficiary. When you file for AOS, you are required to fill out I-864 which is legally binding. The government can enforce the terms of that document.

I have a filed for a fiancee visa for my girl in the Philippines, everything went well with the interview and she is just waiting for her police clearance from another country she worked in. After that they will release her visa. The embassy of Japan (which the country she worked in) said that it will be released between now and 1 1/2 months from now. My girl is pregnant right now and is due in 2 months. If for some reason she gives birth there, I understand that she can take our child as a k-1 dependent.


My question is , does anyone here know what the processing time is for that type of situation? Do i have to wait another 8 months for them to get here? or will it be sooner? Any info would be appreciated.. thanks.

Yup, but you still have to file with the US Consulate reporting a birth abroad. I do recall somthing about needing to do that within 60-90 days after the birth of the child. Though my cerificate of birth abroad was files over 4 years after I was born, though that was in the 80's. But if its your child, you dont need to get a visa for the child.



But my child is illegitimate.. dont i have to prove that its mine through some type of test lke DNA? Is it better if makes our child as her dependent?

That doesnt matter. There is still only one father. If you are the father, then the child can become an american citizen just by registering the birth with the consulate. It doesnt matter if the child was born in or out of wedlock.

Im new at this. Im getting conflicting reports as all embassies are on different timelines.

I have the two NOAs and NVC has sent me a letter on April 16 saying that "my fiancee will soon receive a packet with instructions". The packet will be coming from Cidudad Juarez in Mexico.

1)How soon is soon?

2)And once he gets this packet and gathers all of the info and takes it to the consulate, is he interviewed on THAT same day?
This web-site is a life-saver, I can't imagine life without it.


1. Takes a couple weeks to travel from the service center to the embassy. It goes through the NVC on its way there, you can call the NVC with you case number to find out its progress.

2. Depends on the embassy, go to the embassy info section of this website. It will tell you how the Mexican consulate works.

Could please expand a little, as I'm not clear. Just using assets (what else would one use?), you're saying that the petitioner needs to have about $50K to support two people.

Do you mean $50K annual salary or $50K in savings? And last question - where does that figure come from? It's so much higher than the $16K required income.

If your going to just use assets, you need to have about $50,000 to support two people. Anything less though can be annualized to to supplement your income.



In savings or anything liquid like stocks and bonds. I dont think I would count a car since it depreciates pretty quickly. The figure comes from taking $16000 x 3. Well the actual number is 48,000 but its better to be just a bit over rather than right on the limit.

If you have less than that, say $10000, you can take $10000/3 and that would make up for a shortfall of $3333 in income.

Hi everyone. I am in the process of petitioning my fiance and have some questions regarding I-134 form.

1. Is I-134 the one we need for affidavit of support? I heard there is I-864. Which one should I use? And I heard it depends on the Country where my fiance is from. Anyone here is from China? Please help me. Thank you.

2. I just graduated from College last May and started my full-time job in Sep, 2006. Thus, my 2006 tax return only shows approx. $15,321 in salaries and wages, and $1,940 in taxable interests even though my annual salary is above $50K. Is it OK? Also, I have requested a proof of employment from the firm I am currently working in, which shows my starting date and current salaries as required on the instruction. So, is it ok even though my 06 tax return only shows a total of $17200 in adjustment gross income? I have heard that it is better to provide the college diplomat so that they will know when you graduated. Is that helpful? If I also include all my ADP payroll statements from Jan 07, will that be helpful? And I also got a consulate letter from my bank which lists all my accounts, their starting dates, and current balances. But it doesn't include the total deposits within the past year since the bank said that's the only format they use for such letter. So is that ok or I should provide all my bank statements within the past 1 year in order to show all the deposits?

3. Regarding the proof of employment, how recent does it need to be? Let's say if my fiance's interview is in August, do I need to get that letter in the same month or it's ok if I get it now (dated May)?

4. If the above is not sufficient, how am I supposed to get a co-sponsor? My cousin is willing to help me, but do I need to state in a separate letter saying that he is going to be the co-sponsor or he just needs to fill out the form and has it notaried? If so, is his 06 tax return sufficient enough (the total income is above the proverty requirement) since he just changed his job and won't start until the end of this month.

I really appreciate if anyone can help me with the above questions. I know it's a little too long:), but hope I can get the answers. Thanks in advance!! :no:


1. Both may be used. But only the I-864 is legally binding. And that is filed with the AOS. I-134 is may be used with the interview but it does depend on the country, when your fiancee gets the packet from the embassy it will tell you what they require.

2. Get a letter from your employer and I might include current pay stubs. But you wont need to worry about your past income.

3. I think its fine, but if you want to be sure, contact the consulate. You will find an email address in the embassy info part of this site.

4. You should be fine. If your current salary is $50k per year thats way more than enough to meet the requirements. If you were to use your cousin as a co-sponsor, he would have to fill out the I-134 form and provide documentation.

Hi. On the I-134 Affidavit of Support form in Part II - Supporting Evidence, (on page 1 right above section A), it states, "The sponsor must submit in duplicate evidence of income and resources, as appropriate".

Does this mean that all my papers that I submit to verify my bank account, employment, salary, etc... needs to be submitted 2 times? Do I need 2 copies of each paper? Thanks.


I would verify with the consulate since its pretty much up to them as to how they will use it, but all you need to do is make a copy of the evidence that you have submitted. The consulate may not even requrie a second copy.

I-134 is used for the interview. Thats what you need to fill out now. You may need to do one as well (even if you use a co-sponsor) as your co-sponsor. Send the documents to your fiancee to be used at her interview.

I-864 is used when your fiance files for AOS after you are married.

Normally there is only one consulate in each country that handles family based visas. In most cases its the consulate located at the US Embassy in that country. In the case of Mexico, Jaurez consulate handles the interviews and processing for K type visas and other family based visas. You can put another consulate on the form, but when it travels through the NVC, it will get forwarded to the correct consulate in the country.
