If you have permanent residency status in Romania, everything will be done there, include medical and interview. Vaccination records are not provided to the embassy, but may be used by the doctor that is doing the medical. So it may need to be translated if the doctor doesn't know Russian.

Some countries require that certain taxes to be paid at the airport and are never included in the ticket. So its possible that it may apply to you.

I sent in the forms on saturday and I have just read a post that says to use fasteners or paper clips to put the forms together. I just put everything in an envelope (following the Visa Journey guide) and sent them off.

Also, we glued the all our pictures to pieces of paper and wrote a story next to the picture about dates, places, people etc. I know it says to write on the back of the pictures.

Has anyone had experience with this? Will this cause an RFE or a delay in processing times?

If you marry, you need to start over.

Assuming the child is yours, you can get a passport for the child if the child happens to be born outside of the US.

Thanks, Dan. Good to hear feedback from another Minnesotan. I think I'll plan to do the same as you and just get the SSN after marriage. What documents were asked for at the SSA? I'm assuming marriage certificate and K-1/passport. Anything else?


All you need for SSN is passport with Visa and I-94 and your marriage certificate if your fiance will change her name with marriage.

If you go to the SSA office in Minneapolis, make sure you go early. we had to wait over an hour before we got through there.

Some consulate/embassies can provide the passport back the same day, but most will take a week or two to return the passport with the visa.

There is on your NOA2. If you dont keep in touch with the embassy, they will let your NOA2 expire, otherwise they will continue to renew it. But if you need to wait a month, that should be fine.

You were born in the US, and you can use a copy of your birth certificate as proof of that. If for some reason your birth certificate is unavailable, a copy of your passport is fine as well.

Certificate of Naturalization is used by naturalized citizens, and certificate of citizenship may be used by citizens that were born outside of the US.

As others have said, you cannot use the return leg without using the outbound leg.

With comparable fare classes, one way flights are usually cheaper. But often times, its easier to find a round trip flight thats been discounted rather than a one way flight.

Provided he meets the requirements, he would be applying for permanent residency status. The overstay is going to likely cause problems, as an overstay of more than a year causes a 10 year ban. With your situation, you are better of looking for a lawyer to help sort out all of your issues.

J-1 may be subject to a 2 year home residency requirement. If you are subject to it, you would need to return home to your country for two years before immigrating to the US.

Before or after you get married usually works. Some states only require an SSN if you can provide one. You do have to apply for your SSN before the expiration of the I-94, otherwise you will have to wait until you have an EAD or GC to apply for an SSN.

With all the great advice from here and at other forums....and web sites I have looked through (recommended by you all), we have come to this:
We will immediately (tomorrow) begin the K-1 paper work (without an attorney) . After all is processed and he has his visa, he will go through customs at JFK and hopefully get a 90-day temp work permit (advice from another site offered this as a quick way of getting a work permit and apparently JFK is the only one). The min he arrives to see me, we will head on down to the very romantic court house and wed (have the big wedding a couple months later). The next day we will immediately file for his Adjustment of Status and for Employment Authorization and patiently await for it to process. The idea here would be that the two while waiting for the EAD to process he will have a temp work permit from JFK.

OK...so I realize there may be a big conflict here: that being he will have a permit as a K-1 to work and then we wed immediately. I read this on a forum so thats where I got that idea. So if it is not possible, should we A) just forget about the 30-day temp work permit at JFK and just wed immediately when he gets here or cool.gif should we have him use the 90 day-work permit and wed later.

I really appreciate this everyone!! We are both so thankful!!


The work stamp will be good for 90 days regardless of marriage status.

Depending on your state, you may not be able to do what you want as quick as you would like, some states have waiting periods after you apply for a licence and before you can marry.

Right, some people have tried to get a round trip ticket originating in the US, and then using the return. That doesn't work, since the return would be canceled if the outbound leg is not used.

Your looking at 4-5 months for petition approval. If you have to go through the Embassy in Montreal, I understand that its another 4-6 month wait. Vancouver is quite a bit faster, and no you can't choose. Its based on where you live.

Once the visa is granted, you have 6 months to use it.

If Germany allows for dual citizenship, he would be a dual citizen. Otherwise he is a US citizen. I don't think your son can derive citizenship from his father. But you could look into it.

30 photos is overkill, 4-5 is all you need. Its not as important as boarding pass stubs and passport stamps.

I received NOA2 hardcopy from VSC today. It says my petition has been approved and forwarded to listed Consulate.

It does not mention National Visa Center at all. I read somewhere that next step after NOA2 is NVC and then Embassy or Consulate.

Is it normal?


The notice may not say it, but it will go through the NVC. NVC is basically the hand off point between USCIS and Dept of State. DoS takes the petition from this point on.

The first is used for the interview and is not legally binding. The second is used for AOS, and is legally binding.

Not without AP. AP will take 3 months to receive applying with AOS.

Your better off just getting married, and then applying for a spousal visa. You wont need a visa (provided you qualify for VWP) to just get married and leave.

Just the K-1? or the entire process to citizenship?

K-1 is $455+$133+Whatever the medical costs in your country

Its likely you will spend money on making copies, translations and mailing as well.
