I thought the Manila consulate was in charge of setting your interview date, not the NVC.

Makes no difference in processing time whether you're a woman or a man. I think there'd be a lot of angry people if there was!

K-1 Fiance(e) Visa Process & ProceduresPrevious Marriage Certificate?
Only the divorce certificate is needed if you're filing for a K1.

If you check the embassy information for Vancouver, there are links to a scanned Packet 3 which lists the documents needed for the embassy. Keep in mind that it's for a K3 visa, but the majority of the items listed are required for both visas.

4- When the interview time comes around, I read that I will need to provide information of my fiance's bank statements and investments. But, my fiance doesn't deal with a bank and doesn't have any investments. How can we show that he can support me if needed? Should he just open a bank account right now and deposit money in it and get a record of the statement? How much is a good amount to show that he could support me? Would it be best to get his parents to be another "sponsor" for me?

If your fiance makes above the minimum requirements to sponsor his household size (most likely the two of you) there isn't need to show investments or bank statements, only tax returns from the past three recent years.

If he doesn't make above the requirements, then it's time to get a sponsor. His parents will suffice if they meet the sufficient income levels for their household.

6- When is the best time to do the medical exam? Would it be a good idea to meet with my Doctor in advance to make sure that I am up to date on everything and to make the medical exam go much faster?

You'll be asked to do the medical exam once your petition is approved. The results are taken with you to the consulate for your interview. Keep in mind that it will be done by a USCIS-approved panel physician and not your family doctor. The only thing you can prep in advance are your vaccinations. Check this page for a list of age-appropriate vaccinations which you will need. While you technically won't need them until your adjustment of status application (far, far down the road...) it's recommended that you do them now, as they're cheaper to do in Canada (free, really!) than in the US.

7- I heard that I will be required to do a test of some sort to show that I know things about the US. Is that true?!

Hell no! Maybe for citizenship, but not for this visa. They make us jump through enough hoops. laughing.gif

Yes, both the USC and the beneficiary has to complete a G-325A. Make sure that you both sign all four pages, and submit the documents with original signatures if you're planning to make a photocopy of the entire package.

K-1 Fiance(e) Visa Process & ProceduresI-134 Employment letter
QUOTE (uskars02 @ Nov 15 2007, 07:09 PM) <{POST_SNAPBACK}>
Is there any particular format to the I-134 employment verification letter we need from our employer? Can anyone provide an example format?

Also, do we need this from our direct manager/supervisor or can we get it from our HR Department?

HR department is fine.

For my now-husband's letter, we went with something like this:

"I'm writing to confirm Bee's employment here at Brown Parcel Services. He started with us in the beginning of 2001 as an Espresso Delivery Boy, and was promoted to a Mailroom Underling in the summer of 2003. He received the promotion for his current position of Head Honcho at the beginning of 2007. His position entails the duties of supervising Espresso Delivery Boys and training Mailroom Underlings.

His salary is three million seashells a month, which adds up to thirty-six million seashells in annual income."

Hopefully you get the idea. tongue.gif

K-1 Fiance(e) Visa Process & Proceduresmust i return to the philippines?
I agree - it's extremely rare that they'll grant you a waiver to the two-year requirement.

Definitely go and visit your fiancee in the Philippines if you can - it'll help you out with the requirement, and add to the proof of relationship package that you'll both need for the interview. smile.gif

QUOTE (Lenny Pumpskin @ Nov 17 2007, 03:00 PM) <{POST_SNAPBACK}>
One idea we had was to not file AOS yet and have her travel internationally on a tourist visa (and re-enter the US on a tourist visa) then file AOS upon her return. But this seems risky at best.

This will not work. Best thing to do is make an Infopass appointment.

K-1 Fiance(e) Visa Process & ProceduresI want to be with my fiancee
Not so. The visa process takes different times to get approved for each case. Once visa applicants with approved K1s enter the United States, they only have a 90 day time period to marry their USC. As Krikit said, you may not get the visa by your planned wedding date, and it's usually not wise to plan anything ahead in case your visa application is delayed for any kind of reason. We'd hate to hear that you lost your money on deposits!

If you want to check the timelines, you can get a rough idea as to how long the process takes, but take it with a grain of salt. It can honestly swing both ways depending on your particular case.

Congratulations on the engagement, and welcome to VJ!

To add to the visiting part, I know I entered the States to visit my fiance while my application was processing, and didn't encounter any trouble. The customs official at the airport looked at my itinerary and saw that I was intending to return in two weeks, and told me to have a great trip.

EDIT: grar, lots of people replied before I did

WACnnnnnnnnnn actually, not EAC. The number will be stamped on the back of your cancelled check, or you can get it off the hard copy notice that you'll receive in the mail.

Most people usually get numbers that start with WAC, but there's the occasional person that gets the EAC number. whistling.gif

Peace sister, L.

What's VWP?

Visa Waiver Program.

Technically he can stay for 90 days, but he'll have to show the immigration officials that he has ties to the UK. Even with that, if they believe he has intent to stay in the US, there is a chance that he'll be denied entry.

This is from the French consulate-general website based in Vancouver, but it's applicable to your situation:

You can give that a try, or check with your embassy to see whether they have services for obtaining a police certificate. Hopefully that helps you out! smile.gif

K-1 Fiance(e) Visa Process & ProceduresCan a K-1 visa holder come on tourist visa to visit U.S.?

Just to make sure I am clear.. the immigration officer can and may force her to use the K-1 instead of the B-2 when she enters?

I'd assume so. Either that, or the other option would be that they'd deny her entry if she didn't want to use her K1 visa - this is just a guess though, since I don't have personal experience. tongue.gif

K-1 Fiance(e) Visa Process & ProceduresCan a K-1 visa holder come on tourist visa to visit U.S.?
I've heard that a few people have successfully managed to travel into the US without using their K1 visa. However, those are really rare cases and it's ultimately up to the immigration officer to make the final decision.

Seeing as how you have 6 months to activate the K1 visa and another 90 days to actually get married, you can always take that route if you want to make any big plans for the wedding.

K-1 Fiance(e) Visa Process & ProceduresCan I get away with planning a real wedding now?
Bee and I opted to do the legal courthouse wedding first and plan for the big ceremonial wedding afterwards. We wanted to get the ball rolling on stuff for our AOS paperwork so that I could get a job faster, and we didn't want the hassle of planning a huge wedding only to have a wrench thrown into the plans - being caught up in name checks or being denied at the interview was a small possibility, but it was there and it worried us enough that we didn't want to risk whatever plans we had going awry.

Okay, and we also didn't have the money for it at the time, but that's something totally different. laughing.gif

K-1 Fiance(e) Visa Process & ProceduresWhat we need to get married in the US
Depends on what state you plan to marry in - for our courthouse wedding in Pennsylvania, all I needed was my passport, while my husband (USC) brought his driver's license. They didn't even ask to see his SSN even though on the county website it says they needed to see proof of it.

I'd give a ballpark estimate of 2½ months, but it mostly varies by embassy...

Regardless, I can safely say: too damned long!!

thanks jesse you never fail to give me hope good.gif , I was under the impression that it was much more for some reason.

I definitely don't mean to burst your bubble, but 2 and a half months is a optimistic time frame between NOA2 and visa approval for any embassy. Considering the amount of mailing time your petition is looking at, the waiting period for interviews to be scheduled, then the potential chance of hitting administrative processing at the interview stage, it really does vary from consulate to consulate. Definitely check the stats for a rough idea as to what you're looking at.

Definitely find ways to decrease that time frame - start collecting your documents, for instance. It helps with the separation anxiety, to boot smile.gif
