Black and white is fine. The only reason why you'd need 2 copies of the entire packet is so that you and your fiance can each have a copy in case of an RFE (and peace of mind!). Most often than not USCIS won't be seeing the other copies.

I plan on overnighting that I-485 over to USCIS 5 minutes after we have our marriage certificate. Am I correct in thinking that travelling abroad after marriage for emergency or honeymoon won't be a problem, and that waiting for an I-131 to be approved isn't "really" necessary? Or since the K1 is only good for one entry, is it no longer "valid" for the above purposes once she enters the US to be wed?

I'm a bit confused about this, because information from various sources seems contradictory. If waiting on the I-131 is necessary, what if she leaves on emergency before that goes through? Hopefully that won't be too big a mess..

As you highlighted above, K3 spouse visas don't need to have AP in order to travel abroad, simply because they have a multiple-entry visa. A K1 is different because the visa is valid for only one entry.

If there's ever an instance for your fiancee to travel abroad in the event of an emergency, she can apply for an emergency AP at your local Infopass office. This can be done regardless of whether she's in the process of applying for a regular AP, and shouldn't have any affect on that application. However, if you both intend to go abroad for an overseas honeymoon, you'll both have to wait until the I-131 is approved.

Depends on what kind of "paperwork" you're talking about. K3s have to return to the home country for consulate interviews so they can't just stay indefinitely in the US. If you're thinking about using the travel visa for her to get married in the US, she'll have to go home afterwards. Since it's also illegal to come over on a tourist/travel visa with the intent of using that visa to marry and stay afterwards in the US, expect that she'll be questioned quite heavily at the border by an immigration official about her intentions.

That is, if she can even get the tourist visa. whistling.gif

Many couples spend time in the non-USC's country prior to filing for a K1. In terms of the I-134 you'll have to file for your future spouse, you might want to consider lining up a co-sponsor for her in case you can't meet the financial requirements yourself. While they do keep assets in mind, they'll also be looking at your annual income.

I hate to be rude, but it just boggles the mind how many people have been recently asking whether they can marry prior to their K1 being approved. Isn't the point of filing for a K1 so that a couple is able to marry in the US? It says in the instructions that you both have to be free to marry within 90 days of the non-USC entering the States - isn't the intention of the visa clear enough? -_-

At the time, I was in college working towards my degree and had recently quit my retail job, so I got to visit him between semesters for about two or three weeks at a time. If I hadn't quit my job I definitely wouldn't have been able to visit him in PA, since I was only allowed one week per trip out of my accumulated vacation pay. Bee only has three weeks' vacation out of the entire year from his job, and only allowed to take them in one-week intervals.

Overall we really had to plan well in advance to see each other, but we were amazingly grateful that we got to visit each other when we could. smile.gif

Why not?

As long as she doesn't need anything from you personally when she checks into the flight (ie. credit card verification), there shouldn't be any additional problems. Nowadays people can check in just by showing their passport and/or itinerary at the counter.

If your fiancee enters the US with the intent of marrying and staying, that would be considered visa fraud. As mentioned, you can marry her while she's over on a tourist visa, but she'll have to return back to Malaysia afterwards, and you'll have to file for a K3 or a CR-1 for her so that she can legally immigrate to the US.

I'd suggest looking at the options between the K1, K3 and CR-1 here, so that you have a better idea of the processes for them all. Good luck!

This is dependent on the country and embassy. Some police certificates cannot be requested without the Packet 3 letter, and the expiration date of the police clearance should be kept in mind in case the embassy takes awhile to get your interview date. Medical examinations can also be dependent on whether a case number is needed; again, keep in mind that you shouldn't have the medical too early, since you'll want to have room to file for AOS as well within the one-year medical expiration date.

Affidavit of support stuff can be completed as long as there isn't a change in the petitioner/sponsor's income, ie. promotions and raises, etc.

It's legal if there is no intent prior to the non-USC entering the country. However, the important thing is proving at the AOS interview that there was absolutely no intent - keep in mind that the burden of proof is on you.

In this instance AOS would also have to be filed with an I-130, so the total cost would be $1365 (AOS fee = $1010, I-130 fee = $355). It is slightly cheaper than the K1 in this instance, but not by much.

(Please, correct me if I'm wrong!)

If your explanation fits on your form, don't worry about the supplement. Some people like to go into detail and therefore provide a supplement, but that's not necessary if you kept it simple.

Which consulate are you going through, MTL or VAN?

The DS-230 and the affidavit of support is submitted to the embassy, not the NVC. Absolutely nothing is submitted to the NVC - they're responsible for forwarding your case to the appropriate consulate.

If you check the processing times that will give you a rough idea as to the time frame you're looking at. Please fill in your timeline - that will help us give you more information.
