Kayleigh, is your fiance near an RCMP detachment? If so, he can just go in and request a police certificate from them and it will cover all of his residences throughout Canada. If he hasn't had a prior criminal record, it'll just be a simple name check and they might be able to do it on the spot. smile.gif

While the terms and conditions of the VWP are business or pleasure for 90 days or less, they'll also look at your previous visits for the year and how long you've stayed for. If they believe that you're using the VWP to spend more than the allowed maximum time you're given in the US, they might ask you to shorten your visit or even deny you entry. The officer at the POE may believe that you have intent to stay despite the ties you may have to your home country.

I don't think it's so much an issue of how many times you've come into the US, but so much an issue of accrued time that you've spent in the US already.

A doctor's appointment may not be enough to prove ties to the home country - could you get a letter from your parents stating that you live at their residence and you intend to return within a specific time?

The I-134 does not need to be submitted with the initial I-129F application. You can save that for the consulate interview. Be best to get it prepared once you have a rough idea of when your blind date with the consulate is going to be. smile.gif

Whoa! Stop, take a deep breath, and breathe.

Take a look at the I-129F application instructions and the VJ guides at the top of the page. They'll help you answer all the questions you've asked, and anticipate any others that you might have later on.

In response to all your questions, the G-325A is meant to be filled out by both the USC and non-USC fiance. And don't worry about the I-134 until you get close to the consulate interview, so it's up to date.

The consulate will automatically extend the approval date for you if they haven't managed to schedule an interview by the last day. good.gif

Some consulates occasionally ask for the NOA2, others don't. That might come up in your Packet 3 but for the most part you shouldn't need it. You will however need it for your adjustment of status application once you're married.

Hey Epiphany,

Proof of engagement means that you have to show that you've had an ongoing relationship since the two of you have met. This includes photos, boarding passes for flights, emails, phone records, itineraries, and anything else you can think of (even the engagement ring receipt). The guides will have more info if you're stuck.

If the embassy allows you to be present at the interview, you're definitely more than welcome to go with your fiance. There's no right or wrong answer for this - I consider it peace of mind, really. Some think it adds more validity to "having a real and valid relationship", others go simply because they don't want their fiance to be alone for the interview. Either way, it's up to you. :)

If all goes well, your fiance could have her visa in less than a week.

It's not specifically stated on the Packet 3, but some couples bring their copy of the NOA2 to their interview. The NOA2 will be required for AOS once you are married.

Start filling out your I-134, collecting your proof of relationship, getting your medical booked, vaccination forms or booster shots (if it's cheaper to do it in the Phillipines). You can also start filling out forms like the DS-156 and DS-156K and DS-230.

Hey Everyone!

Scott and I got our NOA2 and the letter/packet 3 in the mail dated JUNE 1! Finally. But we both know it's not all smooth sailing from here on it either!

Got some questions about package 3--we are dealing with Montreal

Do we wait till we actually have the documents in hand before signing the checklist and sending it? Or did anyone else just check it and then start grabbing the things--birth certificates-I had the kids long forms somewhere but can't find them so I am going to send away for them again as I need to for mine.

Was going to go get police check a number of times but life has been so busy that I wasn't stressed about it--now that we have package 3--I'm a bit more stressed!

I am assuming that they schedule the interview once this checklist is in and I don't think things will take that long to get. We would just like to have the interview for the beginning of August.

so my question is---sign and send checklist and hope we get everything in time or wait till I have everything in hand--thoughts??

Definitely send in the checklist as soon as you can. Montreal is taking quite awhile to get interviews scheduled and while you're waiting you can get everything sorted out.

Thanks...like everything else related to this process, it's good to know we're not alone! After I posted, I found a couple other threads also talking about the UCSIC website/email updates lagging far behind the action. From what I understand the CSC is more behind in their paperwork/notifications than their actually approvals. I guess I'll just keep waiting for the NOA2 - I suppose it shouldn't be a problem - do we actually need the NOA2 for anything?


A copy of the NOA2 is required to file for adjustment of status after you and your fiance are married.

This is golfguy78's fiance. Has anyone gone through vermont and had any luck? Has anyone had a canadian/us relationship that worked out through the visa process? This has been going on for over a year. There has to be something that can be done. Thanks for the advice.


As TracyTN mentioned, there are lots of USC/Canadian couples that have gone through Vermont Service Center successfully. I can only tell you through my own experiences that it takes between 3-6 months through VSC and the Vancouver consulate. Petitions will not take over a year unless there is something out of the ordinary.

TimsDaisy has given some great advice and I would suggest that you nail this lawyer's ###. I'm so sorry to hear about your troubles, but if this guy is really scamming you, something has to be done.

Maybe 4-6 months from start to finish, maybe. *skeptical*

I would definitely file a complaint with the head of the firm, or the bar. That kind of timeframe is unacceptable, especially compared to some of the speedy approvals that we've seen from people that don't use lawyers. Sorry to hear about your trouble, and hope things work out speedier now. :(

I believe there's a way to call USCIS through Skype, but maybe someone else can fill in on this part.

Wow, definitely check with VSC and see if they've received your application. There's no reason that you shouldn't have received your NOA1 in the mail already.

Also, was there a particular reason for the delay in filing your petition? Waiting 10 months for your lawyer to file is just unacceptable if it was just a few forms and gathering evidence. :(
