K-1 Fiance(e) Visa Process & ProceduresOF-167 form....required for intervie in Canada
Actually, at my interview the consul officer did accept my OF-167 attachment as well as the submitted I-134. From what I read prior to the interview the Vancouver consulate requires the US citizen to sign the statement so that he/she is (doubly?) cognizant of what responsibilities he has towards his foreign fiance.

charlene, since the attachment is included in the checklist (as a regular piece of paper) and will be mailed to your fiance I'd suggest waiting for that. smile.gif

K-1 Fiance(e) Visa Process & Proceduresconfusion of filing k-1
The "original statement" they're requesting is a letter of intent from both you and your fiance. Essentially the idea is that both of you are stating your intentions to marry each other 90 days after the non-USC enters the US.

Example form here: http://www.visajourn...r_of_Intent.doc

Both the USC and the foreign fiance should each have a letter with their own original signature on it, though I've also heard couples doing a joint letter that they both signed.

K-1 Fiance(e) Visa Process & ProceduresTwo phone number related questions
QUOTE (EricC @ Aug 24 2007, 10:43 PM) <{POST_SNAPBACK}>
Hello I have two questions relating to my fiance's phone number.

1) On the I-129F it asks for her phone number. She doesn't have a home phone just a cell phone, should I put her cell phone down or does it have to be a home phone?

2) A few months back she lost her cell phone and had to get a new one. A lot of my evidence revolves around phone calls, texts, and receipts that show her phone number on them. So naturally it shows her old number and then the past few months shows her new number. Should I put an explanation on why I started calling and texting another number?

Thanks
Eric

1) Put her cell phone number down - I also did that and there wasn't an issue. smile.gif

2) If necessary, just mention that her phone number changed. However, the evidence that you have to provide with sending the I-129F is that you two met within the last two years - phone records will help, but you may want to save that for the interview.

Best of luck!

1. You won't receive an Alien Registration number until you receive your NOA1 from USCIS.

2. I assume flat finish means "semi-glossy" - either way, I don't think it matters what kind of finish you have your passport photos in, as long as it meets USCIS requirements.

The AOS NOA won't suffice for re-entry into the US. You'll need to wait for your AP or GC.

K-1 Fiance(e) Visa Process & Proceduresnew and confused
The dates that USCIS posts on their website are from the oldest cases that they're currently working on. So those dates are rather misleading - there are quite a few here who have already received NOA2s from May.

You can do a timeline search to get a rough estimate as to when you can expect your fiance. smile.gif

Depends on what you mean by "stayed". If they weren't places of residence to you, then I wouldn't bother putting them on the form.

K-1 Fiance(e) Visa Process & Proceduresg325
You can attach a separate sheet of paper with the list of addresses that you've resided in the last 5 years. In the field, you can just write, "See additional sheet included with G-325A."

As they're asking for places where you've resided, I wouldn't include the office address - they're only asking where you've lived within the past 5 years, anything other than that would be too much information.

Is this bad u think?

I really wouldn't fret too much about not receiving your NOA1 - you've already got your case number from the money order and you know that USCIS has received the petition from the online update system. The NOA1 isn't needed for any future documentation, whereas the NOA2 hard copy is worth worrying over if you haven't received it in the mail.

I Have met my Girlfriend online, she is from the philippines, we have become close, we chat, video chat everynight, we have constant contact during her evening/My mornings and her morning/my evenings.

I have spoken to an immigration attorney , and he suggest that we take a route with the K1 visa for her.

Another Attorney suggest I take the route in going to see her and marry her there where she lives and file for the I-130.

My question is which one is really better, and quicker

Please need help

blush.gif

Have you met your girlfriend in person yet? If so, you might want to consider making a trip to visit her in person before you even start filing for any kind of petition. One of the requirements to file the K1 visa is that you two must have met in person within the last 2 years.

Personally, I wouldn't want to make that kind of important decision if I hadn't even met my intended in person, despite how often we communicate in other ways.

If you file the petition after the two-year anniversary of the last time that you met your fiance, then USCIS will deny your petition as that is a requirement for the K-1.

How long you've been in a relationship for isn't a restriction for filing the K1 - it's whether you've actually seen your fiance within the past two years that is.

USCIS does not care how long you've been with your fiance for, as long as you can prove that is a genuine and valid relationship.

Any kind of passport, whether it be diplomatic or regular, is only valid for the bearer of the passport.

As far as I know, possessing a diplomatic passport simply won't entitle you to your petition being expedited.

K-1 Fiance(e) Visa Process & ProceduresFlight through JFK to get temporary EAD?
QUOTE (Dan + Gemvita @ Sep 6 2007, 11:28 PM) <{POST_SNAPBACK}>
Some Canadian airports do pre-flight immigration, if you go through one of those airports, you wont be able to get an EAD at JFK.

With different airlines I was always processed by Vancouver International's pre-flight immigration when I flew to JFK (back in the day when my fiance would drive three hours from PA to pick me up). However, I went through an different situation in December while flying Cathay Pacific - instead of going through pre-flight immigration at YVR I was processed through JFK post-flight. Later I found out that Cathay Pacific does the HKG - YVR - JFK route, so their passengers have to be cleared through JFK immigration regardless of where they boarded their flight.

Anyway, just something to consider if you're trying to get a temporary EAD stamp. smile.gif

If you can enter a U.S. consulate in canada casually, without one....that's news to me. And I'm sorry for giving bad info. I'm only speaking from my experience in approx. 5 European US consulates.

Sasha's info I believe is true anywhere else in the world except Canada. My Guess, Soon it'll be implemented in US consulates in Canada too.

I wouldn't go so far as to say that you can enter a US consulate in Canada casually. As I mentioned previously, both myself and my fiance were asked to present our passports at the entrance to the Vancouver consulate. I'm sure that in lieu of a passport one would be expected to present other government-issued ID.

Is there a documented source that says that a passport is required for admittance into a US consulate? All we've discussed so far are counterpoint experiences which may not necessarily be standard throughout all consulates.

Personally, I'd recommend to the OP that he send an email to the MTL consulate and see what they say.

To build on julezabelle's point, there hasn't been any official statement from USCIS that the non-USC beneficiary cannot visit the USC fiance while a fiance or spousal visa is pending approval. On the contrary, I think the evidence stemming from these visits would help to build the case towards proving a bonafide relationship once it's time for the interview at the consulate.

yes it will be fine for the french person to visit during the process. you could be on the safe side and also bring some forms of evidence of ties to france, such as rent statement, letter from employer, bank statement etc. but thats just to be on the super safe side, normally its not even needed when travelling on vwp

At the very least, you can bring a printed itinerary of your return ticket, which fulfills the regular requirements of the VWP. If the immigration official suspects that there is intent to stay in the US, then they'll want to see evidence of ties to the home country. Otherwise the fiancee may be turned away at the border and sent home.
