Hi sunsi,

1) I know on my USC fiance's birth certificate he used his "file number" which was listed on the top right hand corner. As I assume each state is different (he's from PA) it may be different for you.

2) I-134's aren't required to be sent with the I-129F. USCIS isn't going to forward the I-134 over to the consulate so it's best to just wait until the interview when they will actually take that into consideration. Submitting an I-134 with your petition will most likely get ignored at USCIS - it's just not part of their adjudication process.

Probably the reason why they sent you an RFE was because they felt that the evidence you submitted wasn't enough to prove that you and your fiance had met within the last 2 years. Photos aren't quite enough - they're considered secondary evidence. They need something such as boarding passes, passport stamps, or other primary evidence which can correlate to the fact that you and your fiance have fulfilled the requirement.

If you booked your tickets online, do you have printed itineraries of your trips? Any kind of receipts (hotel, movies, restaurants, etc) that put you in the place where you and your fiance spent time together? Credit card statements from your bank that show your credit card being used at a particular place?

Without going into personal details that's really all the advice I can offer, but hope it helps. Good luck!

I would certainly agree that itineraries add to the overall package, but alone they certainly can't prove that someone actually went through the trip. The passport stamps confirm that the trip actually took place.

While we had a set of boarding passes to correlate with one of our itineraries, I don't see why passport stamps + itineraries wouldn't be less evidential than boarding passes.

Just make sure that you bring proof of ties to Canada, such as a letter from your employer stating that you are on holidays and intend to return to work, bank statements, school schedules, etc. We also received our NOA1 a few days ago and I'll be heading to the States on Friday (YAY!).

I've never had any problems travelling there and back, so I'm sure it'll be alright for you too. Have a good time at the wedding. :)

Eh, I'm turning 24 next February and that didn't seem to make a difference in them giving me an NOA2.

Age isn't heavily considered in the adjudication process - what does matter is that the relationship is valid, which is much more important to them.

A couple other queries: I've been thinking about paying the $1000 bux or so to an attorney to help, since they claim to have 100% success in obtaining the visas. Does anyone have experience with these companies, or think that it's unnecessary?

The only problem I can think of with our criteria is that, well, we just met in February, and although it hasn't been that long, we are completely sure we want to spend our lives together, and especially since it's going to take a LONG TIME to process these documents, we don't want to waste any time "dating" from overseas...Would they deny us on the basis that we didn't date for very long?
Also, while I was in Brazil, through some dumb fluke I only got a 30 day tourist visa, which I overstayed for about 2 months.
And, we only have but ONE photo of us together (since my camera was stolen 2 days after we met :( and he didn't have one at the time.)
Are these issues a big deal, do you think?


The amount of time you've been together doesn't reflect upon your petition as long as you can provide evidence that you have a genuine relationship. They won't deny you simply because you've been dating for a short time.

USCIS will want more concrete evidence, such as boarding passes/itineraries and passport stamps. Photos will help to build the evidence, but that alone won't be enough to pove.

A lawyer may be good if there are concerns with you overstaying your visa, but if it's a very simple case, then it probably won't be necessary to hire a lawyer. They can't expedite or make your case faster - and sometimes it can take longer, since they may be handling many cases and won't send out things on the day that they get them.

A long time ago it was possible to get transferred to the Vancouver consulate if there were extenuating circumstances or the beneficiary could prove that they were living in the jurisdiction. Currently it's extremely hard to get approval for a MTL to VAN transfer, since both sides have come down on transfers.

Yes, she only needs her own birth certificate for the interview. For the initial filing of the I-129F, only yours is needed to prove citizenship, and a regular photocopy will suffice.

I guess if you wanted to save a tree, you can write one letter for the both of you. ^_^ However you wish to present your letter(s) of intent, it's important that both you and your fiancee sign them to validate the intention stated in the letter.

I wouldn't worry about the message from UPS - a lot of folks get this message. That's UPS's way of saying that no one was available to sign for your package and they'll try again in the next business day or two.

Are you a US permanent resident or a citizen? You first said that you were a resident, now you say you're a citizen - if you're a resident you're not able to file for a K1, only citizens are eligible to file for the visa.

As long as your fiancee is at the age where she's allowed to leave the PI, she doesn't require her parents' permission to come to the United States on a fiance visa.

Some consulates do ask in Packet 3 that the original birth certificates of both the USC and the beneficiary be brought to the interview for verification. Slightly crazy (because if my fiance wasn't coming to the interview, I'd feel really uncomfortable asking him to mail his original BC to me) but I'm sure a photocopy will be fine if he's also got his passport with him.

Does this mean I should NOT file K1 beforehand, as Boiler suggested? I still don't quite get the logic behind that (I mean, we're going to be honest with INS if they ask her status) but if waiting on the K1 for a few weeks lets us visit, then it's probably worth it. Or is INS just concerned that we're engaged, regardless of K1 app status?


Two possible ways USCIS will look at it, before or after applying for the K1:

1) Your fiancee comes over on a tourist visa prior to you filing your K1. She carries with her proof of ties to the home country. USCIS may presume that your fiancee has the intent to immigrate over with the tourist visa by marrying you once she gets into the US and adjusting status. If they believe in the slightest that she has such intentions, she'll be turned away at the POE.

2) Your fiancee comes over on a tourist visa after the K1 has been filed. She brings proof of ties to the home country. The officer at the POE asks your fiancee who she's visiting, and may ask whether she's filed the K1. She may or may not get turned around at the POE if the officer believes she's going to stay, regardless that she's filed the K1. Unfortunately the K1 isn't going to be the guarantee that she goes home.

I hope that makes sense. My point is, what USCIS is concerned about is whether your fiancee has intent to stay, despite whether you've filed for your K1 or not.

People have managed to travel while the K1 is in process - as long as you bring proof of ties to the home country, there shouldn't be a problem. Just be aware that the officers at the POE are allowed to turn you back if they believe there's intent to stay.

I understand the idea behind the question, when INS asks incoming 'tourists' if they are engaged or married to US citizens, and I've seen the advice here at VJ about "K1 applicant visiting US" -- but has anyone here had personal experience with it? Does country of origin matter? (i.e., does it help that there is very little illegal immigration from Finland?) What is the "strongest" evidence we can supply INS to support our case that she isn't planning anything improper? Is this an area where it could help for me to have an immigration lawyer -- i.e., a number she can call if something goes wrong?


The best evidence that your fiancee can provide at the POE is ties to the home country and intent to return home at the end of the visit. You can include a letter from her employer, or an apartment lease in her name, or evidence of a return ticket home (or all three!). While I can't say that the country of origin matters, several people have mentioned that they were questioned whether they filed for a K1.

Definitely not necessary to contact an immigration lawyer solely for this purpose, but you should expect that if the POE officer does suspect even for the slightest that your fiancee does intend to stay, she will get turned away at the POE.

I know personally I traveled during the process, asked about my fiance, and was only asked for proof of my return ticket even though I also brought a letter from my employer and proof of attending school the next semester.

1. Does it matter if the G-325a is typed and printed -vs- using the government's 4 part form? FWIW I was sent a form with carbons in between the pages.

2. I sign my G-325a and she signs hers, right? I don't sign both of them, in other words?

When she has visited previously she has simply shown her passport and come on through. Mind you, this is in a car -- she drives to Detroit and flies from there. I am wondering mostly how much she needs to disclose. I don't mean that she intends to lie, just omit that we have filed for the K-1.. saying, "I am visiting for pleasure for 120 days to see my boyfriend." Does the USCIS frown upon this?


I would advise that your fiancee be honest about whatever questions the immigration officials ask her, since all they may very well ask could be "What is the purpose of your trip?" or "Who are you visiting?".

If your fiancee is in school at the moment, proof of registration at her educational institution might help as well.

While visiting doesn't hurt the chances of your K1 getting approved, the most important thing to consider is whether the officials at immigration believe your fiancee has intent to remain in the US. The only thing that I can think of in your situation for proof of ties is an itinerary showing the return ticket. Usually a letter from her employer will help, though you've mentioned that she's going to be quitting her job. Regardless of the amount of proof that you may or may not present, she may be turned away at the border regardless.

So, my boyfriend and I have been getting ready for the k-1 process. He's in Brazil and needs to get a bunch of documents together so we're still a little ways away from even sending in the first applications. But I just read today that Bush signed some kind of waiver for visas so that Brazilians don't need a visa anymore. They just need a passport, I guess...So....I'm just wondering, does that mean that he could just come visit on that non-visa thing, and get married without this k-1 deal. I'm confused. Anyone else know more about this Visa Waiver Program?

I haven't managed to find any other info about Brazil recently entering the Visa Waiver Program, but if that's the case, your fiance can enter the US to marry you. However, he won't be able to stay, and you'll have to file a K3 (spousal visa) for him to be able to immigrate to the States. As lal_brandow put it, you can't use the VWP as a way for your fiance to marry and stay in the country.

What I have noticed is that, regarless of trends that we see here, some cases will be processed faster, some slower. What you find here are estimates, nothing more.

The affadavit of support is more often called the I-134, just to lessen the confusion. :)

Any official documents, such as birth certificates, should be certified. Emails and proof of relationship stuff generally don't need certified translations.

I recommend it - what my fiance Bee and I did was make three copies of each - one for him, one for me, and one in case we received an RFE (Request for Further Evidence) and needed to send one out to our local service office. That way we each had an identical copy to obsess over. :P

On a further note, I definitely recommend reading the guides. While they won't answer ALL your questions, it'll give you an idea as to what you're preparing for - and perhaps you'll get more questions along the way!

If your fiance entered the US before he met you, then it'll be easy to prove that he didn't come into the country with the intent of using the visa specifically for marriage to you.

Are you two planning a formal wedding for mid-2008? While you're leaving a reasonable time frame between December 2007 and mid-2008, it's not recommended to have set wedding plans before the K1 is approved, since delays can often happen in the process. USCIS will not usually expedite petitions for couples who have made the preparations for a formal wedding.

As pushbrk mentioned, you can file now and choose to use the visa later, since it is valid for 6 months.

I am thinking about quitting my current job after I get my packet 3, so I can spend time with my family and friends, and also prepare all the stuff before leaving.


As the beneficiary, I kept my current job throughout the visa process, and the consulate officer didn't refer to it at all at the interview. The only reason it was ever brought up was because I'd switched jobs after the G-325A had been submitted, and he said it wasn't an issue.

Actually, at my interview the consul officer did accept my OF-167 attachment as well as the submitted I-134. From what I read prior to the interview the Vancouver consulate requires the US citizen to sign the statement so that he/she is (doubly?) cognizant of what responsibilities he has towards his foreign fiance.

charlene, since the attachment is included in the checklist (as a regular piece of paper) and will be mailed to your fiance I'd suggest waiting for that. smile.gif
