I do understand where you're coming from. As you said, you've decided to commit to a lifetime relationship before living with your partner - and from a cultural perspective a K3 doesn't allow the leeway for that. Unfortunately, USCIS doesn't really put such cultural perspectives in priority - and not to say that there isn't room for improvement, either. But USCIS does offer a few choices, as pushbrk has mentioned. All you can really do is make the best decision from the options that you're given.


On the contrary, both CR1 and K3 allow for committing to a lifetime relationship before living with your partner. You simply marry before you live with your partner. What the current USCIS K3 policies don't allow is filing the petition before you are married.

If you meant K1 instead of K3, the first part of the answer is the same. The fiance(e) is not required to live with their intended spouse before they are married. The visa just gets them in the same country.

Living together before marriage is a choice, not the requirement of any visa process.

I have no problem with waiting, I have a problem with being penalized for having foresight and committing to marry someone before having lived with them. In my country and in many other countries, getting married or engaged isn't something that people are supposed to do to test the waters. Engagement is a firm commitment. The way the current K1 visa is set up seems to benefit those who would like to "feel out" their partner by living with them, which is totally fine and acceptable, but for some of us, this is not needed and is not an option we have based on our religion and culture.


Personally, I don't agree with you that a K1 is used solely for the purpose of "feeling" out a partner before marriage. Moreso, I find the K1 to benefit those couples that wish to be together before their marriage. I agree that perhaps under their culture they find it acceptable to live together before marriage, but it's not necessarily because they're indecisive about their choice for a lifetime partner. What with the amount of work we have to put in towards the K1, I would actually find it rather ridiculous that a couple use the visa solely to decide whether they want to be together for the rest of their lives.

You can email both the MTL and VAN consulate to request a transfer based on residency - unfortunately I don't have either email addresses on me at the moment. I'm surprised that the NVC sent your petition to MTL since VAN also does K3 interviews. blink.gif

An email can take between one to three days before you get a response... in the meanwhile, just keep calling the embassy. They may have either sent it to the wrong address or the packet may have been lost in the mail, so request another packet from them.

If you're emailing them again, be sure to put down both your names, your case number, and the mailing address to your house.

I don't know for sure, but I heard that Van embassy stops doing K1. I just had my interview and the waiting time was close to 4 months, so I think it is still 2-4 months like they said.


I don't know where you heard that - the Vancouver embassy is still processing K1s, since I've just received my Packet 3 from them. Not sure about the interview times though.

My fiance (USC) is putting together the I-134 for me right now, but he's a little worried about whether we'll hit trouble at the consulate for the I-134. We're deliberating whether we should look to his parents for sponsorship. I was just wondering whether anyone could either give me some advice or share a similar experience they had.

He has no life insurance, no mortgage, few assets (a car, no house), some savings in his bank account (roughly $1k), and his salary is over poverty guidelines (at least $23k). He works two jobs (one at UPS, the other at a catering deli), and will continue to work there after we get married.

Hi Lee,

I also received an EAC# for my application. The number you received (the MTL one) sounds like the case number from the NVC; it won't work on the USCIS site. Unfortunately that second case number isn't trackable online - you'll have to call the NVC on the phone and harass one of the operators, or email the consulate if it's already been delivered there.

I am gathering up my medical stuff, have appointment next Tuesday. I have no proof of my immunization record. They recommend a antibody titers blood test, which will show if I required any vaccinations. Does anyone know if the antibody titers is covered under Health Care and If not what is the cost of it?.........Please let me know Leeanne


I know for my blood test to show immunity to chicken pox it was covered under my health care (BC MSP). I don't see why it wouldn't be the same for MMR and TD.

I believe that's only for the application process to USCIS. The interview at the consulate is a different matter altogether.

Your checklist (Packet 3) should have mentioned what you need to obtain so that you can bring it to the interview. Depending on where your interview is at (Vancouver or Montreal) that list can change.

Can I ask why you're including proof of military service in there? In all likelihood your certificate is good enough, but that depends on what kind of purpose you're intending it for.

Sure, but as Galateia accurately put it, student loan debt, on top of AOS fees and moving costs. Add in the fact that we're looking at least three months of unemployment on my end (moving + courthouse wedding details + waiting period for EAD) and we're talking more than just $3 a day. Bee has his own mountain of debts to chip away at and I'm not willing to have him support my own financial straits on top of his while waiting for my EAD to go through.

As I said, hopefully I can chip away at the principal while I finish my last semester. We haven't become less dedicated to each other, just pragmatic about the situation. Neither of us like it at all but at some point we have to accept that a little bit of sacrifice is needed for us to get through this hurdle.

Right now I'm not. I'm actually finishing my last semester, so I've got my six month grace period starting at the beginning of September to pay off as much as I can. Now that I've calmed down from the minor panic attack, I don't think I'm going to get into too much trouble, but I'm going to call NSLSC sometime this week and ask them about my situation. We really don't like the idea of our spending another six months without each other, but the thought of facing a tsunami wave of debt just tears me apart. :(



Uh, you realize that the 'grace period' only means that you are not required to make payments, right? They are still hitting you with full interest right now. Which means your principle is growing as we speak.

It all depends on the amount of your loans. Mine are 34k, which means 3k a year in interest alone, which means that unless I can afford to pay giant payments every month, I'm not even going to cover the interest, let alone the principle.

My USC isn't happy at the thought of another 11 months of separation, but on the other hand he sees that watching me have hysterics on a weekly basis isn't ideal either. Torn apart indeed. Everything would be different if he was working, because then he'd be able to help pay it down, but such is not our lot.

I won't be able to call the consulate until Wed, here's hoping I can delay my interview until Dec.


Oh, I'm aware that the "grace period" still means that I'm accumulating full interest on my loan. My debt is at 10k right now, so the interest is not too bad (heh, bite my tongue later for that). I'm hoping that I'll be able to make some payments with a part-time job right now, then work frantically full-time to chip away at the principle. My fiance isn't happy about the separation either, but I think for peace of mind he'd rather have me happier to work at the loan pre-POE than for me to be miserable and frantic at the prospect of waiting for an EAD post-entry.

Crossing my fingers for your interview rescheduling, though!
