Nini & bee. A quick response to an above post. Not really sure how to quote someone. Anyway, you make mention of of faxing a checklist. The Rio consolate makes no mention of this. We sent them exactly what is stated on the instructons located on their website. I can't recall other Brazil posters make mention of a checklist. Could be wrong though. I have read that not all consulates operate in the exact same way. I'm hoping this is the case.


Some consulates still request the forms to be sent through snail mail. I'm assuming that Brazil does as well. I know for the Vancouver embassy they asked for the forms and checklist to be faxed to them directly.

Which website did you look at, if you don't mind me asking? I'm just wondering what instructions you followed.

I'd say give them another week or two before you give them a call. Chances are that CSC is just starting to catch up from the backlog I mentioned earlier. From what I've seen on these forums, people are just now seeing their hard copy NOA2 after a month or so after receiving approval off the USCIS site. Keep in mind that you don't need a copy of the NOA2 for the interview, you just need it for adjusting status, so you're good without it for now.

About packet 3. We sent it in this past week. Did not receive it in the mail, but she had everything filled out already. I've read that some people have done this successfully. I e-mailed the consulate yesterday about this. I got an automated response saying it may take up to 5 days for a real response. So we'll see later this week. I'm hoping to get an interview date by the middle or end of next month.


Meaning that your fiancee filled out the forms and faxed them to the consulate? Not quite sure about the Brazilian Packet 3s, but I know with mine I also had a checklist to fill out and fax to the consulate on top of the forms. Maybe someone else can help me out on that answer.

Have you done any research on the Packet 3s yourself, kino? On your end you'll need to fill out an I-134 and gather the supporting documentation, and a copy of your birth certificate. She'll have to start getting the appropriate vaccinations for her medical, her police certificates. And of course, there's always the proof of relationship.

Hopefully you'll receive a response from the consulate soon, though it's my understanding that you won't get an interview date until after the checklist has been faxed in. Still, fingers crossed! :D

I've heard cases where the USCIS site doesn't update correctly in time. Judging by the NVC letter, you're good to go. :)

The NOA2 should look very similar to the NOA1, but as I understand there were delays getting the receipts out due to the backlog of H1-Bs at the service centers. Hopefully you'll receive your NOA2 soon; you won't need it at the interview, but you'll need it for adjusting status after marriage.

Thanks for the advice. I was a little worried about that. Unfortunately I didn't use my credit card over there. I have printed out my trip intinerary from Expedia, copied my passport stamp, have my return trip boarding passes, and 5 pictures. Hope that will do it.

I think he's good to go. My fiance sent pretty much the same stuff and we didn't get an RFE.

Besides, while he's waiting for the interview he can gather more evidence, since that's when it's actually needed.

Give USCIS a passport-style color photograph ofyourself and a passport-style color photograph of your fiancé(e), with both photos taken within 30 days of the date of filing this petition. The photos must have a white background, be glossy, un-retouched and not mounted. The dimension of the full frontal facial image of you and your fiancé(e) in separate photos should be about one inch from your chin to the top of your hair in 3/4 frontal view.

If your fiancee isn't able to get a B2 tourist visa, the alternative for you would be to marry and live in Columbia. Though, I'm not sure what process that entails either. I'm assuming that both of you have decided to marry in the U.S. but I just wanted to put the other option out there. If your future step-daughter isn't going to be able to leave Columbia due to her father's wishes, does that mean she also wouldn't be able to attend the U.S. wedding?

co-sponsor for your spouse, even if your assets are adequate. The USCIS looks VERY CLOSELY at current income
and not just the assets.


You'll have to have an income of 125% above the poverty line - for two people, it's $17,112. Look at this link here for more details on the poverty guidelines.

I'd definitely recommend a sponsor that can, um, sponsor your fiancee. :)

Hello Everyone
Im submitting, or I will in the near future, but I somewhere on this site, for the K1 guide says I must provide legal name change. But I dont see if I submit my paper work to USCIS, they wouldnt know this until the interview which she will have legally name change. Because we have been waiting for over 7 months for the judge to see her, anyone comment, or suggestions?


To clarify - is your fiancee in the process of getting a legal name change? If so, it would be prudent to wait until after that goes through before you submit an I-129F.

If you're asking whether you should go ahead with submitting your I-129F, because you anticipate your fiancee's legal name change to go through before those documents are necessary to submit to USCIS, that's another story. I don't generally recommend doing things in the trend of "I should submit this since in a few months I'm going to have this document anyway!" because I find that can potentially cause issues months later.

As it stands, I'm not sure how legal it is to submit a petition while your fiancee is in the midst of getting her name changed.

Yes, it's recommended to have a cover letter for the full I129F application you're sending to USCIS. It's also recommended to have a complete checklist of items that's included in the package - helps to organize things for them, and helps you to ensure that everything's there.

second: one of the requirements are the birth certificate and passport of the petioner...is it only the copy of each or the original one? i know theres no problem with the birth certificate coz you can always get one but how about the passport? if just a copy will be needed, which part of the passport are we need to photocopy?


A copy of either is necessary to prove that your USC fiance is a citizen. The back and the front of the birth certificate needs to be photocopied, or the full contents of the passport (every page).

third: on the part of proof of having a relationship me and my fiance have been talking for more than 2 years and i have saved every chat (yahoo/msn)/emails (do we need to print it all?), receipts, cards he sent me and i sent thousands over thousand of emails, pictures, special presentation, ecards, cards and mails through snail mail...do we need to send it all just to prove the relationship and not to get a request for more evidence? does it need to be original or photo copy will be accepted?


For submitting proof of relationship, the majority of it can be saved for the interview process. What's necessary is to prove that you and your fiancee have met within the last 2 years. If you have boarding passes and hotel receipts that will help. Emails, cards, photos and snail mail are only considered secondary evidence which will back up any primary evidence that you have.

As a final note, I suggest you read the K1 guides to help familiarize yourself with the process. That'll also help answer any other questions you may have.

Submitting evidence for an ongoing relationship will be considered towards that and you're not going to get it returned from USCIS - I'd suggest saving most of it for the interview as that will be assessed more seriously at the consulate.

So you think there would be a problem if my fiance's contract at her place of employment expired before the interview took place and she came to the U.S. to visit until the time of the interview. Does she have to have a job and a place of residence in Canada at the time of the interview. Is there a list of "ties" that you have to have in Canada at the time of the interview (e.g. a place of employment or a residence) in order to be accepted for the K1 visa. Wouldnt the fact that she's a Canadian Citizen be a "tie". What grounds would they have to refuse the visa? She isnt moving here peminantly on her B2 visa, she's just visiting. If she gets denied the K1 she will have to go back to Canada but is the fact that shes visiting on a B2 until the K1 interview going to disqualify her from getting the K1 itself? If you have any knowledge of how this has negatively affected someone else I would like to hear all you can tell me. I need all the facts. Thanks.


The issue isn't that the K1 will be denied if she's denied at the POE to come visit in the US. Many people have success in visiting their USC fiances while the K1 is in process.

The issue is that she's coming to visit while a K1 visa is in process, and at the border she may be asked about that. The fact that she's a Canadian citizen isn't going to be enough, nor will that solely prove that she will have intent to go back to Canada at any point. The fact that she may have an "impending interview at the consulate for her K1" may not be enough reason for them either. The issue is whether she can prove that she has solid ties to Canada, which need to be proven with a letter from her employer, lease on apartment, proof of return ticket, etc. If the officers at immigration feel that there's an intent of her moving to the US no matter what she can provide, then they can deny her entry.

That doesn't mean that her K1 will be denied. It just means that she can't visit you until her K1 is complete.

(As an aside, I've visited my fiance during the process and I went through fine. I'm not trying to be negative, you just need to be aware of what you're looking at.)

I filled out my form with ink and sent it to my USC fiance through express mail. Since they require the original signature of the beneficiary it doesn't make sense to send it through fax.

Are you talking about the K1 petition? I'm assuming that you're the petitioner, or are you the beneficiary?

The K1 petitions have to be mailed to either of the Service Centers in the US. They can't be dropped off at the embassy since the case is only sent there after it's approved by USCIS. The consulate has nothing to do with the case beforehand.

1) I know on my USC fiance's birth certificate he used his "file number" which was listed on the top right hand corner. As I assume each state is different (he's from PA) it may be different for you.

2) I-134's aren't required to be sent with the I-129F. USCIS isn't going to forward the I-134 over to the consulate so it's best to just wait until the interview when they will actually take that into consideration. Submitting an I-134 with your petition will most likely get ignored at USCIS - it's just not part of their adjudication process.
