I definitely don't mean to burst your bubble, but 2 and a half months is a optimistic time frame between NOA2 and visa approval for any embassy. Considering the amount of mailing time your petition is looking at, the waiting period for interviews to be scheduled, then the potential chance of hitting administrative processing at the interview stage, it really does vary from consulate to consulate. Definitely check the stats for a rough idea as to what you're looking at.

Definitely find ways to decrease that time frame - start collecting your documents, for instance. It helps with the separation anxiety, to boot smile.gif

I flew to see my fiance a couple of times while our K1 was in process, and always brought proof of ties with me when I traveled (proof of return ticket, letter from work, etc). Short of them requesting to see my proof of return ticket, I never had a problem crossing the border. We actually got the approval email while I was in Philadelphia. smile.gif

Yar, it's really something to consider, especially with the plans that you've been considering. (Which sound lovely, by the way!)

Keep in mind that even if you do apply for a marriage license and receive it on the spot, sometimes they're not valid for a few days. When we applied for our marriage license at the Chester County courthouse in PA, we thought we'd have to wait three days like it said on the website. Turns out that we did receive it on the spot, but it wasn't valid for another three days. Like you, we were concerned about adjusting status as quickly as possible.

As zqt3344 also mentioned, there are going to be some states which will take forever to issue a certified copy of your marriage certificate. Some states take weeks to record the marriage down in the county clerk's office, while other states can process copies on the spot in merely a few days. In your position I would definitely see which states offer faster processing, since I don't think you want to be stuck in Florida waiting for your certified copies to go through! (And you'll definitely want those certified copies for any "official" stuff like SSN, driver's license, name changes, etc...)

You can get the vaccinations done ahead of time from your family doctor, but you'll have to go to Vancouver for the panel physician exam. (Yes, I know the vaccinations don't have to be done until adjustment of status, but this panel physician will be checking for the vaccinations at the exam. Check for your age-appropriate vaccinations here.) The cost is $275 from Dr. Morgan's office. They only do the exams on Wednesday mornings, but you can pick up the results that afternoon at 2pm. He should give you an x-ray (which you don't need to bring to the consulate), your medical results for the consulate interview, and a copy of the vaccination supplement which will help you for your adjustment of status later on.

A suggestion that I've recommended to out-of-town people who want to stay overnight in the city for the interview: come in Tuesday night, have the medical exam on Wednesday and pick up their results that afternoon, then have their interview scheduled for Thursday. smile.gif

For a K1 visa, you'll need to use the I-134. Both the fiance and the sponsor will need to fill it out.

Adjustment of status is when the I-864 is used.

As for the temporary EAD stamp, the only reliable airport which are handing them out is JFK. Other land border crossings occasionally hand them out, but not enough to say reliably. There was one other VJ member who received a temporary EAD stamp at the Vancouver airport, but I personally asked for one and was told they weren't giving them out when I processed my visa there.

The guy in that post is allowed to enter the country and get married to his USC fiance - he's just not allowed to stay.

It's quite possible that he intends to head back to his home country and file for a K3/CR1 visa after the marriage. Under those circumstances entering the country and marrying his fiance would be perfectly legal.

There isn't a need for a K1 fiance visa to enter the country, unless he wishes to remain in the country - then it's a whole different kettle of fish. If the guy had intent to enter the country to get married, and remain afterwards, then it's considered visa fraud.

The processing payment is different at each US consulate - most often it's cash only in US funds at the consulate during the interview. I was asked to make a deposit at a Scotiabank branch in Vancouver and bring the stamped deposit slips with me.

My guess is, when each G-325A is being sent to its different spot, they don't want to take the time to make the photocopies - too much time would be spent doing it, and I'd imagine some would get lost along the way. And seeing how databases and servers can corrupt or even fail, they'd want the paper copy for backup emergencies.

It's surprisingly easy to fill it out on the computer - all the fields get entered along the way, and you only have to print the 4 copies.

My fiance is from the Philippines and on the G-352a it says "Show below last occupation abroad if not shown above. (Include all information requested above.)" She lived in Japan when she was 19 (shes 25 now) but she doesn't don't remember the employer's full name and address, and the month and year she began and ended her job there. She lost her phone that had contact to her friends in Japan and doesn't have any other way to find this information I believe. What should I do?


All the answers so far are interesting but off track. In this context her last occupation abroad is her current or most recent occupation. In this context "abroad" means outside the USA.

The correct answer for the form is "see above". For a USC, the correct answer is often "none".

No, the "five years" does not apply. If they haven't worked for more than five years, then you put their last occupation in that section.

I need a little bit of advice here.

I am a US citizen. My fiancee and I have been dating for about 1 (one) year. We are considering 2 options:
1)Fiancee visa
2)Spouse visa

We are somehow more inclined towards the fiancee visa just in case things get delayed. However we had planned already on getting married in southamerica, so the spouse visa is under consideration.
Now everywhere I read, it mentions a minimum of 2 years knowing each other for the fiancee visa. How can we deal with that and move forward with the fiancee visa since we only have dated for 1 year?

The requirements for the fiancee visa are that you need to have met within the last two years. You're okay - lots of people have applied for the K1 very early in their relationships. :)

If you have other evidence to prove that you two have met within the last two years (ie. boarding passes, passport stamps, hotel receipts) then photos won't be needed - as liz mentioned, she didn't include photos, but she had other evidence in her petition to prove that she met the 2 year requirement.

However, at the interview you might hit a huge wall in proving a genuine and bonafide relationship with your fiancee. I know personally I brought a whole whackload of paper evidence (phone bills, emails, etc) and all they wanted to see were the photos.

Overall, I'd say the more evidence that you have for your petition, the better chance you have in avoiding an RFE or denial.

I'm going to visit my fiancée in september and I just wanted to hear from the ones who visited their fiancée, while the application was pending, what did you tell the officer? Did you say you were coming to visit friends, your girlfriend/boyfriend or you fiancé? I'll be bringing proofs of tie to my home country but if I can avoid being taken to the "back room" using the proper words I'd be ok with that! I said that I was visiting my fiance and friends, and he asked how long I was visiting for. When I said two weeks, he asked to see "proof of a return ticket" so I gave him my itinerary for my flights. Then he asked what my fiance and I both did and wished me a good trip. :thumbs:

I've flown across three times now, and never had a problem with immigration - definitely bring proof of ties, but answer the questions honestly and it should be relatively painless.

I visited my fiance in PA while we were waiting for our application to be approved. I brought along a letter from my employer stating that I was on holidays for the length of the trip, a copy of my schedule for the upcoming summer semester, and a printout of my itinerary.

At pre-clearance customs in YVR the officer asked me why I was visiting the US, and I told him that I was visiting my fiance. He asked if I had a return ticket, asked to see my itinerary, and then asked me a few questions about my fiance. He cracked a joke about "how I had it made" (this was after I told him what my fiance did for a living) and I laughed, then he told me to have a good trip and sent me through.

Nerve-wracking, but easy!

Hey and welcome to VJ!

The only reason you would even contact a district representative or congressman is if your application had either taken substantially longer than the average wait, or USCIS was giving you the runaround. Otherwise, there's no way to expedite the application; if it was possible, you think we would still be here? :)

It's also possible that with the example you gave us, it was approved from the date he sent in his application to the day that he received his NOA2. It may not factor in the length of time it takes for the application to get to the NVC and the interview at the consulate.

The posted dates on the USCIS sites are reflective of the cases that have taken much longer at the service centers; usually those cases have been RFE'd, need further adjudication, are under appeal, etc. In most cases, petitions take much faster than those dates posted.
