K-1 Fiance(e) Visa Process & ProceduresFiling Fiance Visa while working abroad
Hello, i'm new here and need advice. My fiance is currently living in the Philippines. He is right now in the process of filing his annulment which we hope is going to be finish my August. As soon as everything is settled with his annulment, we will be filing the fiance visa. Just recently though he was offered a job in Canada. So now we are kind of stuck. They want him to leave soon. Contract is for 2 years. Can we still file the fiance visa even if he goes to Canada or should we just wait till his contract is over? If we can file the fiance visa, what would we need to do next? Any advice would be great. Thanks

K-1 Fiance(e) Visa Process & ProceduresAnnulment
Hello everyone, I'm new to this site and have enjoyed every single post on here. It's been very helpful to me and my fiancee especially now that we are getting ready to file our K1. Our question is on the I-129f form on Part B (information about your alien fiance) on the marital status we are confuse about which one we should choose. My fiance used to be married and his annulment just got approve last week and Im just waiting for him to send me the certificate of finality. Do I choose that he is single or divorced. I'm not exactly sure because there is no divorce in the Philippines??? Pls help. Also on the Biometric form, on the bottom of the page it ask for an alien registration number for my fiancee? What exactly is the alien registration form?

K-1 Fiance(e) Visa Process & ProceduresAnnulment and Letter of Finality
Hello All, I'm the USC and my fiance is currently in the Philippines. We are in the process of filing our I-129F, but are waiting on the paper work for his annulment. My fiance already got the decision from the court that he is annulled. The attorney told him that he needed to wait 15 days after the decision to get the letter of finality. My friend is currently in the Philippines and my fiance is suppose to give her the letter of finality. But Im thinking it won't come out on time before she leaves. So my fiance said he will just mail it to me. I don't want that to happen because lately I have not been receiving any mail from him from the Philippines. For some reason they are either getting lost or someone is taking them. Because even the things that I send him from a month ago he still hasn't received yet. So Im wondering if I can go ahead and mail out the I-129F package without the letter of finality and just send the annulment decision and just send the letter of finality when I get it. I hope this make sense and someone can help me. Thank you

K-1 Fiance(e) Visa Process & ProceduresCitizenship

Note that a naturalization certificate isn't the same as a certificate of citizenship.

Usually, a certificate of citizenship is given to someone who was born a US Citizen abroad or who became a citizen through the child citizenship act (probably when his/her parents became citizens, or when he/she was adopted). Such a person becomes a citizen through the action of law, but they don't automatically get any paper saying they're a citizen unless such a document is requested. So they (or their parents) file an N-600 to request a certificate of citizenship.

A naturalization certificate is given to someone who filed an N-400, took an oath of naturazization and became a citizen that way.

So does your paper say "certificate of citizenship" or "certificate of naturalization"? Or do you have both?

My paper says "certificate of citizenship. So for question 10 on the I-129 form, I check off the one that says, " Have you obtained a certificate of citizenship in your name?" and I say yes and enter the certificate number their and date and place? Correct?

Was that a U.S. Navy base in Japan?

Yes, it was a navy base in Japan. But I was not automatically a USC because my dad wasn't a USC at that time. We didn't get citizenship till 1996.

 Someone may have gotten their natz certificate in one name, then had a name change (due to marriage, divorce, etc). The form tries to cover all types of scenarios.

So which one do I put the certificate number, date, and place? On the part were it says "naturalization" or were it says if obtain certificate in my name? Thank you

Hello everyone, I just have a question regarding the I-I29F form. Question 10 asked, "My citizenship was acquired through either Birth in the U.S. or Naturalization? and then underneath it it says to enter certificate number, date and place it was issued. After that it asked if I have obtained a certificate of citizenship in my name. I was born inside a navy base in Japan in 1981. I didn't become a US citizen till 1996. So I marked "naturalization" and entered the certifcate #, date and place issued. Then I also marked "yes" for obtaining a citizenship under my name and used the same certificate #, date and place issued. Is that correct? I have the same info for naturalization and obtaining a certificate of citizenship in my name. Confused?????

K-1 Fiance(e) Visa Process & ProceduresNOA2 questions

Get your letters of employment verification and all your original documents together and send them to your fiance. Original paystubs, original birth certificates, original divorce decrees (if necessary) original EVERYTHING. If you found additional evidence, send it....always err on the side of caution.

You'll get everything back after the interview.

Make sure you make at least two copies of EVERYTHING for your records as a back-up here in the US so you have something to compare if your fiance has questions. You might as well send your proof of relationship (phone bills etc.) now, it's a small fortune to ship overseas and yes you will definitely want to use FedEx or DHL so you can insure and track the package.

Hope that helps,

ORIGINAL of everything? Can I just send photocopy? Im really afraid to send ORIGINAL to the Philippines because I've had letters and other paperworks that I've sent that never got to my fiance. Kinda scared to send original????

K-1 Fiance(e) Visa Process & ProceduresInbetween USCIS & NVC stage
It's been almost 3 weeks since USCIS mailed my approved petition to NVC. I've been calling every week at NVC to see if they have received my package. Till now they don't show that they have received it. I've talked to a live person and they said wait about 2-4 weeks and I said this will be the 3rd week. She then said it could take up to 90 days :( Of course that got me very sad because I've seen those who got approved the same time I did and they already have a case number and there packages have already been sent to Manila. Because I was getting so frustrated I called USCIS today (twice), the lady I talked to said that they mailed my package on the 4th of March. I told her that NVC still hasn't received my package yet. She said that it probably went straight to the consulate in Manila. I said is that even possible because I know that it should get sent to NVC before going to the consulate were my fiance is. She said no, it goes straight to Consulate of my fiance. After a few hours I called USCIS again and spoke to a gentlemen who said almost the samething the lady i spoke to the 1st time said. He also said there have been instances when the package is sent directly from USCIS to the consulate were my fiance is. So now my question is, Is that true or not true? I've read a few of the postings on here and most have said that it needs to go through NVC before going to consulate. Am I able to call the consulate directly so see if they received my package without having a NVC case number? I know I should just keep waiting and hopefully it comes soon, but im just to anxious and want a case number already. Any help would be great. Thank you
