Have you or your husband been previously married? If so, you would have to provide proof the marriage is terminated (divorce decree). If not, maybe there was an error on one of the documents? If you made copies of everything you sent (hopefully you did!) have another look at the documents and see if there's something wrong.

The instructions are pretty clear about the additional documentation that is required to be submitted along with the W-7 when you attach it to your return (original valid passport or notarized or certified copy of a valid passport). If you do not want to attach the passport there is a list of about 15 other items that may be used (you need to select two off the list and at least one must have a photograph and one must demonstrate your foreign status).

If you do not want to attach the original documentation to the return in hopes that they will indeed return it, check with your local Taxpayer Assistance Office (TAC) of the IRS as some will process the W-7 independently.


Thanks very much fwaguy... I'm in the same situation and I just got my W2 from my employer yesterday. I knew I needed to use a W7 form to get her an ITIN number and needed to send it to a special address. However, I didn't realize I needed a copy of her passport. My wife is in the process of updating her passport to her married name. Once she's got it she's going to get a notarized copy and send it to me. Thanks again! :)

My wife had a C-1/D visa (crewmans working transit visa) during her tenure working in the cruise industry. When her employment terminated last year her visa was canceled by the US Customs & Border Protection people in San Fran. It's not exactly the same situation as you but it's sort of similar (denial vs. cancellation). I was told to answer 'No' to the question about being under immigration proceedings but include an attached amendment explaining it.

Edit: I want to add that my response is just advice so please don't take it as 'the gospel'. We're about 6 weeks into the process and no RFE's so far though. :)

No... not much different than a three week vacation

Yeah, that sounds right to me too. I think they mean 'lived' as in a permanent residence. My wife used to work on cruise ships. She would only physically be in the Philippines for about 8 weeks at a time while between contracts but her living address was listed in the Philippines only.

It's a bit disappointed to see the CSC times creeping up again. A short while ago they were down to 88 or 92 days but today they're at 110 days. I know it's expected for them to go up and down as time passes but while the CSC rises the VSC is sitting steady at 32 days. :(

Question: Given that the processing times at the VSC are 3x faster than the CSC, why don't they balance the load a little more evenly? :huh:

Congratulations on getting action on your petition. This is just an ongoing sign that your petition is in process, but dont get too excited, they can take a long time to approve the petition even after many touches. Hoping the approval comes soon and that the two of you can be together soo, cause it is awesome when it finally happens!

Yep, we're only about 1 month into our I-129 process so I know it's a little too early to hope for an approval just yet. Not from the CSC anyway. Now if we were going through VSC... :whistle:

Glad to help and congrats on the I-129 touch! :) I've been reading here for about 6 months and I'm still getting used to all the lingo and forms. I remember after I first started reading I saw 'AOS' and I learned it was Adjustment Of Status. Then I saw AOS used where that made no sense and I learned it was also an acronym for Affidavit Of Support! :P

I wanna know what the heck is a Touch??? I look at my Uscis online thing almost everyday and I dont see nothing :( No date no nothing... and I not looking in the right spot? How do you know you are being Touched ( and I am seriously asking this :P kidding aside :))

Check the 'Last Updated' date on your petition. When it changes that means it was 'touched' on that date. :)

As far as I know there's no way to list the previous touches so you have to keep an eye on it. Not hard though... Like any of us let a day pass without checking our online status! :P

It seems like my k-3 petition is being touched everyday.
It was transfered to CALIFORNIA SERVICE CENTER on January 12, 2007. Since then I am looking my status and it always update date (01/13, 01/14, and now 01/15)

Is it normal or they are really doing fast processing?

I think your timeline is a little off. It says you got your I-129 NOA1 on January 30, 2007. ;)

Ours was transferred to CSC on 1/6 then got touches on 1/11 and 1/12. From what I've heard from VJ veterans and immigration experts, the touches could mean anything and usually mean nothing.

My K3 was also sent to California, my wife is from Texas. It's no big deal where they send it though. I was told that they often send applications to the office with the least back-log, at present this is Califoria but it could change..

Then again, it's difficult to believe anything you're told by USCIS. Seriously though you don't have anything to worry about and it's good news as it means you're being processes.

All I-129's are first sent to Chicago. From there ours was transferred to Missouri and then to California. However, which service center yours is forwarded to has nothing to do with which office has the largest backlog. I wish it was the case because the VSC is processing applications about 3x quicker than the CSC. As far as I know only Vermont and California are processing I-129's now and which one processes your petition is only based on where you live in the US. You can see in my sig the transfers for our I-129 and I-130.

The transfer to the CSC is normal. Our I-129 went to Chicago, then Missouri, and is now being processed in California. We have a similar timeline as well. To estimate when yours will be approved you can compare timelines of others who recently had I-129's processed at the CSC. You can also look HERE at the estimated processing times for the service centers. Keep in mind those estimates go up and down though. CSC was down to 82 days a little while ago and up to 110 days just a few days ago. It's at 98 days now.

The only problem is California doesn't report status of your K-3 seperatly on their web page telling me that it is given the same priority in that office as a K-1 application.


I was under the impression that the processing was essentially the same so time processing times should be about the same as well.

Correction: I should have said in my previous reply above that as far as I know 'CSC & VSC are the only service centers processing fiancee & spousal visas.

Yep, it's SOP for your petition to be transferred to either California or Vermont. AFAIK only California and Vermont are processing I-129 & I-130 applications now. Where yours is processed is determined by where you live (which state).

As others have said, the I-129F (for the K-3) is optional. You can just use the I-130 route but it will usually take longer because the I-129F normally goes through the NVC quickly while the I-130 gets additional processing.

In short:

I-129 is generally quicker but requires more steps after your wife is here because you have to adjust status, get a social security card, and green card
I-130 is generally longer but your wife comes into the country with a green card and social security number and no need to adjust status
