IR-1 / CR-1 Spouse Visa Process & ProceduresCR1 visa refusal under 221(G)

Nothing to worry. If the Consular Officer said so that your paper work is good and kept the passport so wait until you get the good news. Are you sure you are good as far as the paper work is concerned?

Yeah i m quite sure about the paper work, these are the words of counselor officer "ok all we are done here with your documents, i need nothing else from you. I am putting administrative process which is mandatory for the immigrant visas. This green paper (221(g) explanation) will let you understand everything. So we will let you know. It might take to three to six months". Humm but the embassy is full of uncertainties. I m hopping for good news. I want to go to my wife :-(

IR-1 / CR-1 Spouse Visa Process & ProceduresCR1 visa refusal under 221(G)

Hi,

Yesterday on Nov 26 I had my interview in Mumbai Consulate at 7:30am for the CR1 visa interview. Everything was going well all of a sudden the Visa officer asks about Snaps and I showed her the album, she saw that and the Visa Officer left the place and had some discussion outside. In short I am telling that I had 1 hour and 45 min. interview by three separate visa officers starting with one blonde lady, then one Indian lady visa officer and one lady Caucasian in an interrogation room there and they grilled me left right and center. Then after that they issued me a 221(G) refusal letter stating that I need to submit photographs of the ongoing relationship, or transfer of property, joint bank account statements.

In this stage how much it will take to complete the process because I am half dead now. Waiting for the visa to see my husband. I am dying to meet him. Anyone has any idea? Please have some. :crying: :crying: :crying: :crying: :crying: :crying: :crying: :crying:

Hello i have the same case, i was interviewed (US embassy Islamabad) on November 1st, 2012. the counselor Officer was saying that all we are done here your paper work is good, we need nothing more from you, but your case need a little administrative process which might take 3 to 6 months. The counselor officer returned some of my original documents and kept my passport. He handover me a green paper which was explaining administrative process 221(g). so what should i do further. please help

IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavit Of Support Problem

If your cosponsor has money in the bank i think there is a 1 to 3 ratio of earned income, meaning if he/she has 3 times the minimum required in liquid assests that should satisfiy the afidavit of support. Also if they happend to approve you and that is the only thing pending for approval then your cosponsor could fill out the tax forms based on what he/she intends to file.

He thought his income was enough so he didn't fill out Assets's portion. Lets see what happens.....

If your not "dying" to get this immigration visa and your only reason is because your daughter is having surgery then why not just get a tourist visa? You can get letters from her Dr verifying her medical condition and pending surgery so why not just go that route? If you got the visa a few weeks before her surgery that would give you 5 1/2 months then you could always file for an extension for another couple months if needed. Then once your co-sponsor gets his/her taxes sorted out then you can just go through the immigration process. Just a suggestion.

Actually it was my wife's decision & She told me there is no catagory for visitor's Visa :( . Also our daughter needs to stay there for another 3 4 years & Visit visa expires when i come back (That's what she thought). That's the main reason, but If they reject then i wont re-apply. Because it will mean will have to wait for another year :(.

Having a copy of the extension he filed wouldn't hurt either.

I hope so, i will let you know whether it was enough...

For a wage/salary earner the extension letter and proof of current income is acceptable. For the self employed the tax return number is what's used. The person at NVC wasn't being deceptive.

Submit what you have and hope for the best. One thing that you learn on VJ is that there are no absolutes. Worst case scenario is a request for the 2011 return. At that point find the solution that works best.

Thanks for the help again :).

Not really. When filing an extension, you still state your income. The affidavit needs to state the same income as shown on the 2011 extension.

Thanks for the help, i think he did same.

The 2011 tax return is what's needed. Line 22 from the tax return is the income number that is evaluated. The 2010 return and extension for 2011 will not give the required info.

There is one thing, He called NVC & they asked him to send Extension Letter, then he made another mistake & wrote 0 in 2011 & I have pasted their reply below.

Part 6 Sponsor's Income and Employment
[x] ****** ******'s current individual annual income is not listed on Line 23.
Part 8 Sponsor's Contract
[x] The joint sponsor has not dated the appropriate line.

The 2011 tax return is what's needed. Line 22 from the tax return is the income number that is evaluated. The 2010 return and extension for 2011 will not give the required info.

By the way, Thanks a lot for you kind help :) .

My guess is you will be asked to supply the documentation. If you can't, then another joint sponsor can be submitted.

Means Tax Return for 2011? And Extension letter wont work, Rite?

For a self employed person the most recent year's tax return is where the income is obtained. Without that document, you should seek another joint sponsor.

There are only 6 days left in Interview & i don't think a new joint sponsor can be arranged in that time. Does it mean a rejection? If so why did they schedule an interview if it was such a big problem? :(

About my relation with my wife. We met in 2005 & engaged in Feb 2008 & got married in Feb 2010. And we have a Daughter & Doctor wrote a letter to USCIS to speedup the process & they did but NVC said it doesn't meet their "Life or Death Situation" so it will not be expedited.

First sorry to her about your daughter and pray you get to her soonest. Now you should most definetly present what was filled out with current salary no one cares about 2010 they want to know if need be can the co-sponsor support this person. So yes the $109m00 and extension about 2011 is what you bring with you.

I pray no AP for Islamabad and you move swiftly through.

Thanks for your help & pray :).

Is the joint sponsor self employed or a wage/salary earner?

Self Employed, He owns multiple LLC's & had some problem with documentation, that's why he took extension.

IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavit Of Support Problem
Hi,

I am from Pakistan. I have immigration visa interview on 31st July in Islamabad but there is a big problem. My wife doesn't work & she arranged a Joint Sponsor to file Affidavit of Support.
Joint Sponsor took Extension for the year 2011 & has not yet paid tax for the year 2011. So he simply wrote his income for the year 2010. NVC replied back that they need Tax return for the latest year. So he again filled out the form & sent them Tax Extension Document, BUt in the form he chose current year as 2011 & wrote income of USD 0 as he thought this is what was required. Now NVC schduled interview & asked fill out AFOS again & i should present it on the Interview Date.

Now he sent me a couple of AFOS's. in First he wrote 2010 as Current year & attached 2011 Tax Extension letter.
In 2nd AFOS he wrote his current income USD 109,000 (Against Which he hasn't paid tax) & attached Extension letter.

I have a couple of questions, which AFOS should i present at the interview & secondly how many chances are there that Visa will be rejected/delayed? I actually am not dying to get the visa but i have a daughter in USA whom i have never met & she has to undergo surgery next month. Is there any chance, they will give me a visa? Apart from AFOS, everything else is complete. (And I am sorry my english is terrible).

IR-1 / CR-1 Spouse Visa Process & Procedureswhat is an EXPEDITE???

oh wow that was mean!! it looks like everything get horrible at the NVC!!!

what kind of wisa are you waiting for???

I think NVC & USCIS have different standards. Our kid was born almost 4 months premature and wife is alone there. She needs me, so she contacted USCIS, they asked for a letter from Hospital. Doc faxed medical condition of our Daughter & USCIS immidiately approved that. But they asked for RFE & guess what did they ask? Passport sized photos of the Petitioner but once received they completed processing. She then asked NVC If case was being processed on Priority basis? NVC simply replied its not a life or death situation. She then didn't contact them back & followed instructions.

I think for Pakistan, you do have to worry a little bit about this. Reading through the interview experiences, almost everyone gets asked this question.

If you had a grand wedding, it will be to your advantage to demonstrate that. A small private ceremony 'could' create some flags. Since we tend to have elaborate weddings, spanning over multiple days and events, it is important to show all those. It is also important to show pictures with the bride's and groom's families to demonstrate their involvement and approval. Some pictures with other guests (extended family and friends) would also be helpful. For example, did any relatives fly in for the wedding? Also include pictures in casual settings, both pre and post wedding.

All of the above may not at all be required, but help prove that the wedding was real, and not staged. At least this is what I will have my wife take to the interview.

Make sure that you know each and every person in the pictures you plan to take with you. The interviewer could ask you about them.

I will make sure I take maximum pics :).

I had a home wedding by Justice of teh peace, as we did the big deal in Thailand with 350 guest there.. So I only had close friends attend here at my home, 15 people was it.. That was no issue for the interviewer.. They were definitely looking for picture though, we had about 10 with us, copies printed from digital pictures, Wal-Mart to the rescue to print them out.. That was it for that part of the evidence they were looking for... Do not worry about number of people or too many pictures....

Thanks, that's encouraging :).

i would suggest bring ur wedding pics just a few you dont need a whole bunch of it tho coz i know for a fact that CO usually ask for pictures, good luck on your interview!

Thanks :)

Just take some to show..what my hubby did is he printed out some then put in in a small album that can be folded..because you're going to give it to the person behind the glass using only a small hole..make a copy also of the pics that you're together before and after the wedding.

Thanks for the useful Info.

We had an handful of us and some with guests from the wedding. Remember its the total field which makes the team a winner.

Thanks :)

In Pakistan it is very important that he bring some wedding photo's showing his wife and guests. They have used the excuse of a small wedding to deny people and I know because it was one of the reasons they used to deny my husband his visa.

Oh that's harsh. I have found pics of people who attended the wedding :). Thanks a lot for your help.

take as many as you can. Mostly bring at least one photo of each wedding related ceremony. It's not required but a highly recommended evidence to prove your relationship.

Thanks, I definitely will do that :).

if 60 people is not acceptable to the embassy just explain your situation and it should be alright. I'm sorry your daughter is ill I hope she gets better soon. Good luck on your interview. Let us know if your wife gets her visa.

Its not my wife who needs to get Visa, Its me. My wife is petitioner & cuz our daughter was born 3 & half months pre mature, they both can't come to Pakistan for another 6 to 8 months. Never met my daughter & its been almost an year since case was filed, i wish If they only let me meet them, but rules are rules.

60 people is a lot and should be acceptable. Try to bring pictures to the interview showing as many guests as possible. The embassy feels that it's a part of Pakistani culture to have large weddings and if your wedding is small then something is wrong. When is your interview?

31st Of July. We married in Feb 2010 & have a daughter (Who is almost 11 months old & is ill), still they will have doubts about our marriage? That's strange :( .I already am worried about AFOS as it has all sorts of problems :( .

Wedding ceremony was small cuz we live in different cities & couldn't take everyone with us & they too were not living in their own city at that time. So i hope its not going to be a problem.

If there weren't many you need to be able to explain to them why there were so few people. Believe me they make a big deal about that.

There were like 60 people or more.Is it acceptable?

You should take wedding pictures with you. Take a few pictures of you two together and also take pictures showing all of your guests. For some reason the embassy in Islamabad likes to see if you had a big wedding. They feel it's normal that Pakistani's have a big wedding. If you had a small one be able to tell them why.

Thanks for the info. I don't think I have any pic of total people who attended the ceremony. Because there weren't many.

Would be a good idea and support your case, don't need to bring the whole album, just 6 photos would suffice. You probably would have to print them for their inspection.

I will take 20 :) also gathered photos of my daughter in case they ask for them. I don't know why but i have a bas feeling :(

Hey sara,

Just checking to see how you are keeping? Any latest developments? I see your case is not in background checks, but rather just waiting for one department to respond to another. I think a snail is taking the message across!
Did you say you are planning to move to India? I just heard living in your spouses country could also be a problem You have to prove your ties and domicile with US at the time of interview.
