Hey fellows, I hope all of you are doing well and I wish you all best of luck.
I have a question if anyone can advise me. My wife arrived at the end of last month on CR1 permanent Visa. So far she has not received her Green Card or -Social Security Card, I was wondering if any one knows how long it takes and if want to inquire who do i have to contact.
I would appreciate any advise. Thank You

My wife's interview was yesterday, and now we are having this very same issue. The interviewer said they need an URDU divorce certificate from Union Council even though she had the original bilingual Union council certificate at the interview. So, we will get this URDU document from the Union Council without a problem.

Now my concern is that on the blue slip they are also requesting a English Certificate from the family court??? But the officer only mentioned the Union Council Certificate as the document we're missing. So, do we need an English Divorce Doc from the Family Court ? Does anyone have any concrete information?

My wife's divorce was also through talaq, so do we really have to go through the hassle of approaching the family court.... this could take months. I'm thinking I should try the route supermom82 took above.

Any feedback would be helpful. Thanks.


My uncle had to get both documents, one from the union council and the other from the family court. He went through the immigration process in 2010 and even though he was adjusting status in the US, he had to get these two documents from Pakistan in order to establish the proof. Sorry as it might seem a painstaking process but as far as I know, there is no way around it. And personally I'd suggest you provide all the documents they have asked for because say you send in the union council one and they take their time to process that and then they send you another request to submit the one from the family court... that will not only waste your time but add to the torture. So try getting all the documents and send them all in. they should have informed you at NVC what was needed but I'm sorry for the trouble.

Ameena if you pay the bills online, it should not take longer than about a week or so for your case to be completed at NVC. The Embassy in Islamabad is pretty quick at issuing interview dates. When our case was expedited through USCIS, we had also approached NVC to expedite it but they refused it and said if we file the documents correctly and as soon as we can, NVC will complete the file and send it through. My case was sent to the embassy around August and I had my interview date for the first week of October. All the best to you and again, really happy things are moving along for your case.

I am really sorry to hear about that Imran. Always thought only men from Pakistan received that. If I may ask, did she take along a new police certificate to the interview apart from the one submitted at NVC? I am not sure where it will go from here. InshaAllaah it should be done soon. Sorry I do not have any information concerning this but I remember I was told that bringing along a new police certificate help speed things up at the interview. Maybe you should call the US Embassy or write to them and ask about it. They are helpful and respond to e-mails.

In my case it took 2 months because we didn't attach a US notarized copy of the passport. We got a letter a month after we first filed the application and then sent US notzrized copy of passport on May 1 and ITIN got assigned on May 25.
Did you send a US notarized copy of passport?

Yes, my wife went to local IRS office in Fayetteville and they notarized the copy of my passport and later it was sent to main IRS office in Texas.

My wife has applied ITIN for me and it has been one week but nothing just yet. I signed the W-7 form and sent a notarized copy of marriage certificate, my national ID card copy and my passport biographical page. I hope that is enough evidence.

I have not heard of anyone writing to an Ombudsman, but it would be good to know what type of responce you get. Please share with us if you do get a positive or negative responce and what your experiance was like.

btw whats the purpose of your writing to the Ombudsman?

Ombudsman Office is there to assist the customers with cases where people are experiencing difficulties with USCIS and have tried all other possible means to resolve the issue. Like myself, it has been more than six months and I have not heard anything from CSC therefore I am thinking about writing to Ombudsman. I don't know if it will be a good idea or not but no harm trying.

Musashii, we've seen that document and have talked to the police department here in Singapore but we're having trouble obtaining 5d:

5 d) Photocopy of document from relevant consulate/immigration authority/government
bodies to establish that the certificate is required by such authority. All documents
are to be translated to English if written in other languages.

Until I receive a letter from the NVC requesting the COC, they won't give me the police certificate.

I lived in Singapore for 6 years and I will also encounter same difficulty.
I suppose you have to wait till you get a letter from NVC requesting the certificate and then send a copy of that letter along with your request or notify NVC that the certificate will be presented at time of interview.

Got this email from the US Embassy in Singapore this morning:

The applicant must produce a Singapore police certificate as part of her application. As stated in our previous reply, you should obtain a request letter from NVC in order for the applicant to apply for a police certificate from the Singapore authorities. This office does not issue request letters for cases that are still in the documentary stage.


So I'll need to get the NVC to give us a letter ASAP or else we'll be in trouble if we can't get the police clearance by the time of the interview.


You need to fill the attached form, the documents requested at shown on that form and a bank draft of SGD 50.

See if you can add your spouse to the Electricity Bill, it'll have your Apartment Address with his name added. They didnt require SSN, make sure his name is visible on the Payment Notice when you receive mail. I wasnt able to add my husband to my Lease Agreement due to SSN too, but the Apartment Office/Manager is able to submit a written Letter for you to submit to USCIS. I submitted more wedding pix with family and friends.


I've received a reply from tycoon....This was too much of evidence.
I just submit marriage certificate, birth certificate and my wife passport copy.

What to send depends on what was asked for. Do your best to respond to each thing they requested. 2 and 4 above are answered in the instructions you received with the RFE. Careful study of those instructions and precisely following them will be critical.

For 3. Either respond by withdrawing the I-129F or answer each RFE.

What do you suggest for 3 sir? Would it be a wise choice to withdraw K3 (it was filed to save time which did not happen). If we withdraw, do we need to write to them that we intend to withdraw I-129F or should we just not respond to the RFE concerning K3 and let them close it after the given time lapse.

First, let me say I am not an expert! However, I did just do extensive research for my own case...
Some other things that would be good to send would be proof that you have been in a relationship for an extended period of time, at least two years would be excellent. Proof of more than one meeting/trip together (or is it that you only met each other one time for the wedding?). It would be great to show proof you both have spent money on each other, as in receipts. Also universally suggested is proof of mail (not email which is free) to each other with the dates on the postmarks. And, if you have mail or invitations that were addressed to you both (indicating you are a couple), scan those as well. If you can get any documents that show your marital status and your wife's name, that would help (maybe your job's HR department can provide something or your health insurance or life insurance).

Yes, we are providing e-mail and chat logs from 2009 to present.
There was only one physical meeting at time of wedding. It is not cheap to fly from USA to Pakistan every now and then you see.
Providing the lease agreement with both our names on it and also providing the remittance slips and some of phone call records.

RFE sent out on August 14, 2012 and received on August 16, 2012.
Although we sent wedding pictures, photocopies of passport pages, affidavits by witnesses and friends who were present at the wedding, CSC-USCIS requires more proof of a bonafide marriage/relationship.
We are planning to send:
  • Chat logs
  • Emails
  • More photos
  • More affidavits
  • Passport page with entry / exit stamps
  • Phone call records
  • Copy of house lease agreement (if the landlord would agree to put my husband's name on it but he says SSN is required to do it so probably not).
Questions:
  • Any expert opinion on what else to send?
  • Do I need to send original RFE letter with the evidence or should I keep the original and send a copy of RFE letter with evidence?
  • Since I had filed two petitions (I-130 for CR-1 and I-129F for K3), I have received same RFE for both the petitions. Should I send same set of evidence x 2 separately for both petitions or would only one set of evidence be sufficient? (They are going to administratively close K3 anyway but still I would appreciate advice from some experienced person maybe Darnell, Saylin or Pushbrk?).
  • To which address should I send the evidence? To lockbox again where I sent the petitions or directly to California Service Center address?

You don't need to submit each and everyone of your chats from Facebook or wherever.
They just need to know that you have been in contact with each other prior to marriage (comes under courtship in RFE letter), proof of ongoing relationship (you are still in contact after marriage) and stuff like that. Basically, they need proof or evidence to establish the fact that your marriage is real and in good faith and not for immigration purpose only.
I submitted:
Some Chat logs, Some e-mails, some photos (wedding and others), affidavits from friends and witnesses of marriage, travel itinerary, copy of passport pages showing entry and exit stamps and a letter answering the questions they asked.
Not all the RFEs are same.

Some people only send marriage certificate and they do not get any RFE.
We sent lot of stuff but still got RFE. It depends on the officer reviewing your petition, beneficiary's country and different factors involved.
It never hurts to play safe and go in loaded than getting an RFE later and having to send proof all over again.
My suggestion is that you send all you have. Good luck.

Will be applying for a CR-1 visa. How many certified copies total of my divorce decree will I need? (those things take time to get!) I know I have to submit it with the I-130 Pack, but do they give it back? Or do I need to get another one? Also, do I need it to get the affidavit of marriage when we go to the embassy before we can have our marriage ceremony? :help:

You do not submit any Originals with I-130 to USCIS. Only submit photocopies and keep the Originals.
Once your case is approved by USCIS, only then you send the Originals to National Visa Center when required (still keep some copies for yourself).

My fiance and I will be getting married in October, and then pursuing a CR1 Visa. I am nervous that we will be red flagged for many reasons, and it makes me sad because our relationship is genuine :(. Reason 1) I am 4 years older than him. Reason 2) I have been married twice before (no children) (if they would let me explain the previous marriages I am sure they would understand why I got divorced!). Reason 3) I brought my second husband to America using a Marriage Visa (DCF) However we were divorced before the two year period to lift the conditions of his green card.(let's just say he went crazy once he was in america, not the way a married man should). And Reason 4) My fiance is Afghan, and not sure if just his nationality alone will send up red flags :(. We are both muslim and both very devout in our religion and realize marriage is not a joke. He has never been married before. I am embarrassed of two failed marriages, but what is past is past and I can not change it. :unsure:

1 - 4 years older is not much of a gap and it will not raise any red flags.
3 - Your second husband coming to US might be a red flag (You probably had to send in an Affidavit of Support for him). Even divorced, if he is still in America and still on that Green Card, you could be bound to that support agreement. I am not sure about it though. There are more experienced people around here who might be able to give you a more accurate answer.
4. With your husband to be having worked for US military, his nationality should not be a problem.

Merely living in a country with all the political unrest and violence is not enough reason to expedite your case unless there is a direct threat to your spouse's life which will have to be proven by some police report / FIR (documented).
I live in Pakistan where there are lot of blasts, violent protests and rallies but it was not enough to get an expedite even though we mentioned the warnings issued on www.travelstate.gov
Our expedite request was denied without even asking for a proof. That should give you an idea of what will happen to your request should you choose to make one.

I only got a permanent job in June 2012. Before that I had been working temp jobs and did not have sufficient income on my own.
Let's say my current monthly income is not same each month, it varies due to Overtime. Example: Made $1573.86 in July, $2523.20 in August and $1080.17 in first two weeks of September and next paycheck coming on September 28. How shall I calculate my individual annual income? Take the maximum and x 12 / take the minimum and x 12 or do take average of 3 months income (3 months income /3) x 4 ?

Q: I was studying and was in between jobs back in 2010 so my tax returns for 2010 are not that bright. Will that effect my petition at time of interview?
Q: Do I need to send a copy of my birth certificate to NVC as a proof of my US citizenship?

Thanks but as per DS-230 i need to submit Police Certificate as well and i believe if it submit to NVC than its 2-3 months before my interview. Are you sure that i need to get police certificate 2-3 weeks before interview, what about to submit with with DS-230 ? as its ask all the original documents + police certificate, can anyone plz update me

I was going to apply for a Police Certificate and submit it with DS-230 until I found out about the validity period. So in my case, I will write a letter to NVC explaining why I have not sent the PCC just yet and I will also inform them that I will bring it with me at the time of interview and will present to Consul Officer but that is just me.

You can contact your relevant embassy/consulate and check with them.

Currently Living Mauritius - Dec-2009 - Present

as i visit my home country do i need to make my police certificate from Pakistan current date or till Nov-2009? to cover my visits back to Pakistan or its OK till Nov-2009 when i left Pakistan for job.

Also within my home country i lived two different homes within same city, should i need to mention in Police Certificate or current home address is OK?

You need to provide Police Clearance Certificate from any and every country you have lived in for a period of 6 months or more after the age of 16.
Acquiring a Police Certificate from Pakistan takes about 1 week, you need to fill in a form in which you need to mentioned where you lived and from when to when. That will cover your 2 residences as long as they were in same city. Take note that Pakistani Police Certificate is valid only for upto 1 month so you should get it only 2-3 weeks before your interview date.
You will also need to get one from Mauritius since you are living there for about 3 years now.

I sent:
  • Blue RFE letter on top of all the documents
  • Chat logs
  • E-mail copies
  • Photos (Wedding, After wedding, with family)
  • A letter explaining how, when and where we met, proof of relationship before and after marriage (ongoing relationship)
  • Phone records
  • Lease agreement showing Petitioner's and Beneficiary's names together (You can send insurance, credit card or joint bank account information if applicable)
  • Affidavits from Family and friends who were present at wedding.
RFE response was sent on Sep 5, 2012 and was received on Sep 7, 2012. Our case was approved on 09/24/2012 (text on mobile and updated on website) and NOA2 was received in post/mail on 09/28/2012.

NOT REQUIRED TO FILE is a much better thing to write. If the reason was "INCOME BELOW THRESHOLD", then just write "NOT REQUIRED TO FILE, INCOME BELOW THRESHOLD" and skip the attachment.

Another tax question:
My wife's gross income in 2011 was $9,074 as she got a job only around mid year 2011. Now she has got another job (starting May 2012) which is paying $10 per hour @ 40 hours week and 1.5 for any additional hours. Considering her current job, she would make slightly more than poverty guideline but NVC requires recent 3 years tax returns in which her income was not sufficient.
Can she file I-864 solo or will she need a co-sponsor?
Also, thanks to some not so smart H&R Block which she used to file her 2011 returns, as per their advice, she filed as single when she was already married to me in December 2011. She has send papers to get me an ITIN (am the foreign spouse) and she is waiting for my ITIN to file for an amended tax return as married. If we have not got any amended or updated tax transcript by the time we need it, what do you suggest we do? File the existing one and attach an explanation?

Situation:

I have already received a hard copy of NOA2 and now waiting for NVC to receive my case file. I was advised to call them on October 15, 2012.
I am moving to a place near my work on October 13, 2012.
Who must I inform and update my address? NVC, USCIS or both?
Also, When shall I inform NVC about change of address? After they receive my case file and issue a case number or before?

There is no such requirement from USCIS to keep your husband's name as tenant even if he is not in the country. My 2cents for this idea.

It's upto you if you want to move again. It should not make any difference but I don't recommend either unless there is no other alternative.

The lease agreement copy was submitted as evidence only because we were asked by USCIS to provide something as proof of ongoing marital relationship (emails, chat logs, phone records, remittance, joint bank account, insurance policy showing beneficiary's name or petitioner's name etc). We did send emails, chat logs, phone records but since we do not have any joint account or insurance policy as most of these things would require my husband to have a SSN, all I could get was my landlord to sign for me a copy of lease agreement with my husband's name on it as a co-occupant / tenant.

As for moving part, I am having to drive for 1 hour and 20 minutes to reach the place I work and same or even more time to come back which is also not easy on gas so I was considering to move to somewhere near my work place.

Hi,
My petition for CR-1 [I-130] is currently with USCIS at RFE response review stage.
Among the evidence which was submitted to USCIS, was a lease agreement of the place where I am currently living and it has my husband's name as a tenant. It was submitted to establish the fact of an ongoing relationship. I had moved once before and already updated the address by calling USCIS.

I need to move again somewhere closer to my work place (same state) but I don't know if it would be a good time to move now or wait till the petition is forwarded to NVC. Also, would I be required to submit the lease agreement of new place with my husband's name on it (if I move)?

Go with my first answer. NVC needs civil documents from the visa applicant. Petitioners are not applying for visas.

Send the original or original certified copy to NVC. You can take photocopies to the interview and trade for the originals at that time.

From my understanding, NVC only needs the beneficiary's (original and copies) documents such as birth, divorce and marriage certificates.
Should I send the petitioner's divorce and birth certificate too (originals) or just (copies)?

Can't help you with the original question, but i don't think an RFE will cost you 2 months. On average, it takes about a week for the NVC to process the response for an RFE. Please see my timeline for the turn around in my case.

I have to wait for NVC to issue me a letter that they need that Certificate of Clearance from Singapore. Then once I get that letter, I will need to send it to COC department in Singapore, filing an appeal for them to issue me the certificate. This alone shall take about 3 weeks. Once the appeal is approved, then I will have to send the fingerprints and application form to Singapore Police Force (takes 3 days by courier) and they will take another 10 days to process it. That is why I said about 2 months :(

Don't they grant you when you simply ask it? You need a letter from someone requesting a declaration?

NVC never sent me a list of documents. They asked me to refer to WWW.travel.state.gov

Singapore Police Force does not issue Clearance Certificate any more.
Those who require the certificate have to make an appeal to them and provided that appeal is approved, only then can request a certificate but to make that appeal and to request the certificate, a letter from respective authority such as NVC or Embassy is required.
