Yes NicoleX08 we were approved last month...and were half way through at NVC but then had some complications with the marriage certificate and the Embassy told us to re-file. Back to Base 1 unfortunately but it's fine. Everything happens for our betterment.
You too should not worry about your petition. Panic only if its been six months and you have not heard from them.

I did try fixing the timeline but it doesn't work or somehow I haven't been able to find the right button...
I have gone through the whole USCIS process once...from january to April...know the headache.. Made it to the NVC...right at the end we were told to refile due to some complication with our marriage certificate so here we are...re-filing the whole thing. Will try to check if I can update the timeline. Any help regarding that will be much appreciated!

Rajaa, the fee is waived if you do send the I-129f. So no fees there. But wait till you see all the OTHER fees associated with the K3.. but no matter. If you want to go that route and money is no issue, then so be it. It depends on the beneficiary's country too, I think. You haven't sent your I-129f, have you? Yeah thats true. I was reluctant at first to join this forum thinking people would be clueless here but we had already consulted two good immigration lawyers and they both were useless. Waste of money too. Husband and I signed up together and since that day this forum has proven to be extremely helpful. Everyone here is wonderful and helpful.

We had filed back in January and had received NOA2 within 3 months but unfortunately thanks to the stupid lawyers and their advice there was some complication with the case. Imagine we had to turn back from the point where we only needed to file DS-230 at NVC. Now its a fresh start with all documents needed. Hoping for a swift approval. Hope its goes smoothly for others too. Thanks again!

If you do not have a UK marriage certificate then your marriage was not registered with the UK Registrar of Births, Deaths and Marriages, then you are not legally married, so the US will not approve your application...

I have been reading discussions on this forum. They are very informative. Me and my husband got married in London, UK in November 2007. He has filed I-130 in January 19th 2008 and have not heard from CSC yet. Wondering if our marriage which was a religious ceremony in London where both he and I were on Visitor's visa be valid as an actual marriage by the US government. Anybody out there with a similar case? Also, is the check sent with the petition when cashed a sign as the petition being approved?

When they say 'certified copy', in the instructions, they mean a copy from the 'issuing authority' - so basically what they are saying is that they want an original.

All of the documents you submit to NVC are forwarded to your Embassy/Consulate. You should only need one copy - the copy you send to the NVC, they should return this to you at the interview.

I too was asked by my husband to prepare papers for Form W7 end of last year. I first downloaded the form from the website, filled it and got copies of my passport. Then I called the US Consulate in Karachi for the notary and I was given an appointment. On the day of the appointment, I went to the consulate, and there submitted the documents along with my passport to the officer. He sent me to pay the fee for notarizing document which was $30 and any additional papers would cost $20 and so on. After paying that I was asked to sit and wait for the notary. Then I was called by the notary and she asked me a few questions regarding my husband and our marriage. She then stamped the copy of my passport and signed form w7. It is better to take some extra copies of the filled form and of the passport too.

Did you made copies for all the pages for your passport?


No the notary only stamps the page that has biographic information...the first page of the passport where it has your name and passport number etc.

I have read some posts here and have discovered that NVC is now processing DS-3032 through email.

My Question:

- When is the best time to send the email to NVC?

1. As soon as the case number is assigned and one finds out about it through the Automated Messages at NVC
OR
2. As soon as one receives the forms from NVC


Please keep in mind that this Question is regarding E-Mailing DS-3032 to NVC and NOT mailing it through snail mail.

Yes you'd be needing a copy of your wife's passport if you will be corresponding directly to the NVC as her agent, that too certified from the issuing authority for the NVC...check this link for information regarding documents needed from India: http://travel.state..../info_3190.html


Not sure about the processing time though. If you are going for James' Shortcut then it should not take more than 2 months or so.

I recently received a packet 3.5 from islamabad embassy on 18th August 2006 and sent them all the required documents on 23rd of August 2006. I wonder how long would it be, before they schedule my interview date. I have heard that it would not until January 2007 that my interview will be scheduled for. But when i went through different timelines for islamabad embassy on this website, i figured out that in majority of the cases, the time period involved between packet 3.5 and the issuance of CR1 visa is 3 months. I have also read about AR. I duno what the heck is AR though. :help: :help:

your answer has led me to another question, my affidivat of support was filled by me, and a co sponsor, my brother in law, he makes way more than the poverty line, and that is why our AOS was approved, however my job that i have now, is still not enough anyway, or i mean over the poverty line, but i do agree that it still looks better that i atleast have a job...ok, so the question is, can i just do a new affidivat for me? because i don't want to have to put my brother in law through all of that paper work again, since his financial status has not changed....but one more thing, should my husband have with him a recent pay stub of my co sponsor's to prove that he infact still has the same job at the time of my husband's interview (jan 2) ?

Anyway, now , three months later, i have a job...does my husband need to let the embassy know that i have a job and give evidence of it, like a pay stub or something, when he goes for his interview?

I was just wondering that what is done with the AOS after the visa interview...my husband hasn't had his interview yet, but it is on jan 2 ,
will he need the affidivat at his POE (God willing he gets his visa) ? and does that affidivat expire, since i submitted it in july 06, and if he gets his visa it would probably be in like april 2007...so would i have to do a whole new affidivat for him to pass the POE?

My husband and i did all the I-130 paper work together, the I-130 is the petition for alien relative/spouse, and it is the first thing you have to do in your process...so you need to file for I-130 with the service center , we filed our I-130 with the California service center...and it took 6 months to be approved.

We had to provide a copy of our marriage certificate, and i forget what else, but it wasn't much...and it is not very complicated, and if you have questions, the USCIS are good about answering them by phone or via email...im so happy for you that you are married, and taking the first steps towards citizenship

Just be patient, and relax, it is a long road you are traveling down, and sometimes so incredibly annoying and frustrating, not to mention confusing...

You know, there are some lawyers that are free...when my husband and I were doing his affidivat of support we got free services from a lawyer in st. louis...he really helped alot and our affidivat was processed and found correct by the NVC...and now we have our interview date on 2 jan.

Ok, so what i would suggest you to do is download the I-130 from the USCIS website, and just get the proper docs required for that and mail it to the appropriate service center, along with a check i think it cost like 185$...anyway, then they are gonna send you a reciept and notice of action that will have your USCIS number on there, which you can track your case on their website with that number.

Processing times for I-130 can be anywhere from like three months to more than a year, according to the processing times that were given to us when we filed, however it only took us 6 months...which was great.

Another thing, after you file I-130, you can then file for I-129F(a K3 visa), but not until you recieve your receipt notice of action from the USCIS for the I-130, because you will have to send that in with your I-129F petition...
I'll tell you this though, my husband and i also went for the I-129f, and it was approved in just 4 or 5 months time i think, well then the I-130 approved like one month after that, so we were then unable to go for I-129F , so it ended up being a waste of money and time..(I-129F costs 164$)..also, to anyone who doesn't know this ( my husband and i didn't know this) if you apply for I-129F , your interview has to be in the country where you were married. There is a big horror story for us about that...anyway...

Yeah, just go to the USCIS website, and apply for your I-130 petition right away, the longer you delay you're gonna regret.

Ok, i pray for your success, and really it's not that complicated to do the petitions, they are very straight forward.

Hi,

i'll tell you what happened to my husband...we were approved for I-129F K-3, and then he had his interview date scheduled and everything all ready...
However, our I-130 also became approved just two months after the I-129F petition was approved, and the U.S. embassy told us that now since the I-130 is approved (even though we didn't proceed with it at all, we didn't do an AOS , we were gonna just go with the I-129F) then we can not go forward with the I-129F, and there fore we abandoned the I-129F and had no choice but to proceed with I-130...now i duno if there is some law saying that you can not go for I-129F when your I-130 is approved already, all i know is that this is what happened to us. :unsure:

to reach it from the USCIS, usually only a few weeks, after the petition was approved. Mine only took two weeks to get to the NVC and into their system, it's always good to call them as well, they are open till midnight monday-friday 603 334 0700, to ask them if they have recieved your case, have your number , and beneficiarys' Date of birth ready to give to them.
