OKAY so lets say USCIS has sent the approved I-130 petition and NVC never got it cause it was hypothetically sent to the National Records Center. Whom am I to call to have it rediscovered and what exactly do I say to them??

There are restrictions, but definately not exactly what you say. She can surely leave the country however she has to reenter the US once every year. For example, if she flies out of US on June 1, 2009, she will have to reenter the US BEFORE June 1, 2010. Now, it does not matter how long she stays in the US for once she reenters. Maybe a day or 2 or a week, month, whatever she pleases. But, if she does not reenter, it means she does not need the green card and it will then be revoked. Remember, greencard is merely a residence permit to stay in US, so you have to keep it valid by showing ties to the US. It is not a citizenship or anything permanent. So you have to continue to prove links and interest to US. I hope this helps, if not, you can always call your local social security office and confirm as well. But this is what I know for certain.

All Right this is what I have been thinking about since that touch on 21st and this recent approval of a may fellow filer:

Nightsurf's NOA1 dates to May 8th and Snorkies' May 10th ----- both CR1 filers at CSC. Their petition was sent in the last week of April and first week of May. Considering these dates and taking some help from my Imagination, could it be possible that the CSC has actually started working on May filers and our time will come soon too?

Seriously Rajaa she can speak English and even though because of her age we are on great terms but hubby hasn't taught me any Arabic yet (either he doesn't want to or he is not good at it)...technically everything is well but I would love to secretly learm the contemporary Arabic so this year when I visit my husband's extended family in Amman...I can sneak around finding out what they talk about concerning me.
All the stuff a wife has to do.... innocent.gif

Thanks Jen, cmnb and Rajaa for asking, it was fortunate i wasn't present there at the time of explosion.

As for the touch...hubby got back to his city today from his trip and found a letter from the USCIS stating that they have received the expedite request. That touch I suppose could be related to that as both files were touched.

Rest is fine. Rajaa I was reading a book the other day and came across this name...so for the record, I do not have any skills in arabic whatsoever but would love to understand what my step-mother in law says about me in arabic tongue_ss.gif

Rajaa please do not worry. This touch I received could be related to the request my husband made for an expedite after two bombs exploded near my house earlier this month. About 50 people were injured and one died after strings of bombs that blew in my area and other busy places around it. It was horrifying. I do not know if this touch was a general touch or a requested one as the e-mail I had received yesterday about my other petition said there was a request for it to be reviewed. I do not know but I can tell you, seeing the speed at which CSC is working, InshaAllaah something positive will happen for us soon. Don't loose hope as Rajaa means Hope and longing if I am not wrong.

I am also noticing on VJ for the past few days that VSC is catching up with CSC. They are a month apart processing I-130. Hope they stay that way. The USCIS website however, reports a date of Sept, 2007 for I-130 processing...I dont know what to believe. :confused:

I hardly understand anything they do and how they do it... so no help here. lol... I am happy today cause my husband and I are planing a trip for me to be there in September insha;allah... gives me some concrete date to look forward to.

On this thread where you have posted...right below the indian flag there is written My Timeline, click on that. If you have not made one yet then do so and that timeline page with your filing date and service center information calculate the time keeping the other entries at VJ as record to compare to and show you the date you should be expecting your case to be adjudicated. I have just come across something really nice. Someone who filed I-130 in April 2008 (and I-129 too) at CSC had their case adjudicated in the last week of June (I think without an expedite request). I am getting excited now

Rajaa don't lose hope. Trust me you are not alone in this. For me and my husband its been a long and frustrating journey....but then again we are not alone in this. I just read a heartbreaking post by a sister on this forum and how she was repeatedly denied an expedite even though her case was serious. Then I read her husband has received his visa last week and that has brighten up my morning a bit now. I am the beneficiary Rajaa. My husband is the USC. The research so far has showed that the AP is tougher for men from muslim countries than women. PK sadly is on that list too.

CMNB I really appreciate your post. Sadly I do not know anyone else going through this immigration process here. Those who are at the forum are hard to locate. Most are stuck in AP and others have already gone through it or waiting for approval.

You can shift your timeline to the 'signature' section on the MY CONTROL page. Then your timeline will appear like the rest of us. You can adjust font size and color there and update it accordingly.

Yes the change in date under the Last Updated part is what one refers to as a touch. Now that your check has just been cashed, they are probably shifting your petition to your service center. All the best to you and everyone else.

Rajaa while on the one hand its comforting to know that I am not the only one going through that feeling of sadness and on the other it seems like a long..long...really long time since things have moved in any direction for me. Your path has changed from mine now as you've sent your I-129F. I had checked the K-3 timelines in my country and it all sucks...especially this Administrative Process threat. Now it sure seems like a huge test of nerves and when you too young to be patient, it gets worse. Allaah knows. I do not know how to deal with this process anymore to be honest. Sorry everyone else, I do not mean to bring you down with this post but I am getting impatient now mad.gif

A good friend here applied for her H-4 visa which a non-immigrant visa for the spouse of the person having an H-1 (working visa) and she had her interview back in February. They sent her back with a blue slip asking for more documents and the embassy has kept her passport. Since then she hasn't heard from the Consular officer and when she called the embassy she was informed that they have not reached a decision yet. Its frightful.

The thing to look out for in your NOA is for the beneficiary name. If the beneficiary name is correct in your NOA then I think question 17 should not slow the process.

Just happened to read your previous post about a question on I-130. Sorry to hear you had trouble understanding it. As this petition is designed to be filed by a US citizen or Green card holder therefore any mention of an 'Alien Relative' refers to anyone OUTSIDE the US. I am afraid you have messed it up if you have put the beneficiary's name there instead of yours.
Please correct this so no one else stays doubtful about these terms.

Alien Relative = Person being sponsored by the US Citizen/Green card holder

You have not received the NOA1 yet? I should be a little suspicious if I were you. I think you should call USCIS and speak to someone there. Tell them your problem and ask them what is to be done now.
I don't trust the USCIS and the RFEs to be honest. We had filed our petition back in January and then found out that we had not included a marriage license. Even though we had registered our marriage but then the USCIS did not send an RFE and here we are...refiling the whole case and waiting for the fugly NOA2. Check with USCIS please.

Rajaa what I did was I went to Portals that directed me straight to 'Pakistan' and there I found timelines and all other people from my country. Clicking on Portals should direct you straight to Morocco. Hope this helps.

One sad fact I came across is that no matter how swift the Process for both K-3 and CR1/IR1 goes at USCIS and NVC, I found out that people (some even from 2006) are waiting after their Interview for clearance aka Administrative Process to come to an end. I am really freaked out since no matter which way one goes, if you are meant to rot without your loved one, the immigration people will make sure that happens. It should vary for other countries but unfortunately for my country (I am the beneficiary), they are grilling almost everyone. Some went on AP right from USCIS after approval. I am sure every individual is viewed as a separate case and the scrutiny is strict for men than women but still two people are awaiting clearance for their wives...both on K-3. Finally the whole Immigration Process is getting to my head headbonk.gif and since yesterday I have been pretty low. I guess the Immigration people don't realise this. If only things were better sad.gif like they were before 9/11... sad.gif

There are two bills at NVC...one is of Affidavit of Support or AOS fee bill which is paid by the Petitioner and an Immigrant Visa or IV fee bill which is to be paid by the beneficiary. If your wife chooses you as her Agent then you can easily pay both bills online. At the Embassy I think the only bill need to be paid is of the courier service that will deliver the passport back to your wife's city. This is how its done here. Maybe its the same for India too.

You need to relax as It'll all come to you naturally once there.

Hi cmnb,

Just saw your post. Thought I should write and help you out.

1. Petition is sent to USCIS
- USCIS Sends Notice of Action or NOA1 to the petitioner
- Then USCIS sends Notice of Approval or NOA2 to the petitioner

2. USCIS sends the case to NVC or National Visa Center
----NVC assigns a case number
----Sends information to the Petitioner
----then the whole NVC process takes place

3. After bills are paid, forms are sent to NVC and they declare the case is complete Then the case is forwarded to the Embassy or consulate.

Consulate gives an interview date and sends information about what documents should be brought at the time of the interview and also gives information about the Medical that is mandatory.

Then the interview takes place and by that time the beneficiary will know what is happening to the case.

Don't panic. By the time all these stages will come, you'd be ready good.gif

Congratulations on the swift approval.

Renata do try the online paying system. Its fast but slightly risky. Sometimes bills are charged twice but its time saving! (sounds like I am working for NVC blink.gif )

cmnb the interview will be scheduled once the case is completed at NVC.

Its very hard to tell from the touches. Good sign though that someone has been going through your file or has moved it around. A touch can either mean a lot or nothing. Need to wait and see where this goes. All the best!

Jen I was able to open the spreadsheet. Seems like google was acting slow. Looks great now. Girl can you change that red color if possible to something less bright? maybe my eyes have become too sensitive to bright colors these days. It was hard to read properly. Hope its fine. You're doing a fabulous job with the sheet!

That's an excellent news! Two people getting approved in such short time...CSC must be on fire! I guess they have made good use of their time. I am so hopeful now...even though the file hasn't been touched recently but that crazy feeling is there

Rajaa my husband uses cards from www.speedypin.com to call me and his relatives in Jordan. I have not been able to view the rates as they are not available from here. You can check this website and see if its useful. $1 a minute is too much! hope this helps.

Also, I have been using Yahoo Messenger from the beginning for both voice and webcams. If I had a better connection, it would have worked even better. MSN messenger seems complicated.

cmnb, you are worrying for no reason. I can imagine its not easy being apart for that long but look at the bright side, once done with this visa process you'd be with your wife for good. As for going to this lawyer for a free consulation...I would say In these times, Avail whatever you can get for free *wink* and make the most of it. Also I suggest you ask her to join VJ so she too could read about other people and get more information. Besides, we all know this forum is addictive but helpful.

Thirdsjen come on!!! You should be happy you'd see your hubby in August this year.... I saw mine back in March....still feels like ages but waiting to hopefully to be together soon whistling.gif la la la la la whistling.gif

Hi cmnb! That's a tough one to answer... Firstly it depends on which service center your petition is at. Some have been working faster than the others. Secondly, if your case is not complex and there aren't too many checks then you get through within normally 4 months. People who file for expedite and if their expedite request is approved normally get to hear from the USCIS within a couple of days. counting from May and keeping in mind the NOA1s received within a week or two, maybe this is going to happen sooner than others. My last NOA1 took about 30 days so this time its been way faster. October/November maybe.

Yes NicoleX08 we were approved last month...and were half way through at NVC but then had some complications with the marriage certificate and the Embassy told us to re-file. Back to Base 1 unfortunately but it's fine. Everything happens for our betterment.
You too should not worry about your petition. Panic only if its been six months and you have not heard from them.
