My wife called USCIS on 24 February 2012 and inquired about the petitions.
Apparently CSC (California Service Center) is processing I-130 petitions from August 2011 and I-129F petitions from December 2011 according to the Customer Service lady.

Supposed to be 5 months after your NOA1 but only USCIS knows and God knows better.
Can't trust USCIS with the information, just pray to God if you believe in one.

Make a guess? Our expedite request was denied twice. We were not even asked to submit any evidence at all to show them or tell them anything. That should tell you something. You can try though and you just might get lucky.

Just an update:
Called USCIS-CSC on March 23 2012 and talked to a tier 2 officer this time. Was told that I-130 is under some cooldown and I could only request for I-129F. Officer asked questions and said he hopes I have the required evidence and I told him I have it.
March 30 2012: Letter reveived from USCIS-CSC stating same old thing. Denied. Without even asking for any evidence once again.

im still very worried about him but .. it really didnt do much good for us except to get an earlier interview date and there isnt any way you can expedite AP so here we are 9 months after our interview still waiting for this to complete and him to come home and finally be safe!

As for the AP thing, I have a strong personal opinion. Its purpose is to push the couples to the limits and break them down, nothing else. When a government office or agency is conducting name search or background checks, it does not take 9 months. If that was the case, how do they track the "wanted" people? Do they really wait till 9 months before search is complete and only then they take action? I don't think so. They have enough resources. I have heard enough stories of the official agencies locating their targets and taking necessary action within hours and those are local stories. 1 - 2 months I would understand but 9 months or longer? I believe that is just some bull #######. There is nothing wrong with their database, it being slow is just a lame excuse but since we cannot do anything about it, we just have to listen and wait.

I know what you mean, Im from Venezuelan and we have one of the highest rates of death by criminal situation in Latin america(including robbery, kidnap, etc etc) last year over a 14.200 people died on criminal situation (civils, criminals and police officers) No one is safe enough here. You can't go out with your cellphone, jewelry, or any expensive item. I love when my fiance comes to visit me but Im always scare because is TOO OBVIOUS that he's a tourist (He's Christina aguilera's blond jajaja, 5' 11',and blue eyes) when we're walking in a mall or something there're people staring at him and he keeps acting like if is still in the US. I've to take care of him all the time cause I guess he's not aware of the danger. He thinks like every country in the world it's like US.

We are not in war but we live in one. My fiance feels awful everytime he reads something, or hear the gun shots when we talk through skype. I've been robbed once like 6 month ago. A guy put a gun on my head and he only took my cellphone. When I told my fiance, he had blood pressure troubles and had anxiety.

He always says, "can't wait to bring you home". And can't wait either jajajajajaj. But I have faith on God and I know He's taking care of me.

My interview is in 11 days, hopefully I'll be home soon. BTW hope u can fix your situation, and be with your wife soon.

When my wife came to visit me, I had to get her dresses in local clothes so she won't stand out and luckily she is not blonde so it was not that bad but still I had to be very careful while bringing her out to move around.
I did get robbed in broad day light after I was coming out of a money exchange outlet. The robbers knew exactly where I had put my money so they put me on gunpoint and went straight for my pocket. Funny thing is that there was a Police checkpoint just 2 minutes walk ahead from the place where I was robbed. That is why I did not even bother to file a Police report. I thanked God that they only took the money and spared my life.

As for the expedite request, my wife called and was told that it is under some kind of "cooldown" and she cannot request again or do anything about it until after next 5 business days. I suppose the Tier 1 Customer Service lady who took the request did not key in the information properly and made it look like just an attempt to get an expedite for no reason and that is why the request was simply dismissed without even asking for proper evidence.

i not smell any 'proper intake' of evidence for the expedite request, at all.

On a 'phone-call-initiated' request, the USCIS Human tells the caller what to do to get evidence into the right USCIS office.

You've not written about that one part, at all; I sense it's missing .

Suggest the petitioner call back on Friday morning, get it all sussed out with as many humans as it takes (to get it sussed out).

Exactly. The petitioner was not told to submit any evidence, was not given any instructions on where to send it.
The Customer Service Representative from USCIS just told her that she will hear from them in 5 days. Nothing more. Petitioner has the evidence and was waiting to be asked for it but was never asked.
The request was dismissed without even looking into the matter.
So, +1 to you Darnell for noticing it.

If I were a poliitician in my country, trust me I would not even need any expedite. I could simply ask for a political asylum or would have made $50,0000 or more easily by corruption easily to get a business visa under treaty country with a processing time of 2 months.

Yes, it would fall under "humanitarian situation". It's similar to when USCIS was expediting all Haiti cases after the horrific earthquake that hit there.

If you do get the chance to submit evidence, I'd suggest putting together news articles or something about all the blasts and injuries. As well as a doctor's note detailing your wife's breathing problems and the cause of it.

She had to head to work today but she told me she is going to call USCIS tomorrow and see if they will let her talk to any Tier 2 officer and / or let her submit the evidence. If that does not work, we will write to DHS Ombudsman and perhaps they can look into the whole scenario. We do have evidence (news from local and international websites, statistics of deaths and injuries and also her medical report from hospital).


On side note, I wonder if she should just attach all that evidence in reply to that e-mail address from which she was sent that denial e-mail? unless that address is a "do not reply" one.

Hmm, you do fall under one of the criteria categories, although, depending on your evidence, it could be denied or approved, but like you said, they didn't even request any evidence. I'd suggest for your wife to call them up and explain what happened. Tell them you have evidence and wish to send it in before a decision is made on the request.

I am not sure if I fall under one of the criteria categories or not.
All I can say is that there have been at least 146 blasts in the country where I live since January 2012 to date and recent one just 3 days ago killed 2 policemen, injuring several others. Not counting any from 2011. There are kidnappings for ransom and suicide bombings. Anyone can search on google and find enough evidence. I don't know if that is not reason enough to request an expedite. Also due to her being so stressed over all that news and concerned about my safety she is having breathing problems, been diagnosed with bronchitic asthma (she did have this condition 3 years ago but it was under control and she did not even have to use an inhaler for it until recently). Why was an expedite requested? What was the criteria?

What happened on the phone call? What did the wife say/ask for?

More details are needed...

An expedite was requested on "humanitarian" grounds. My wife expressed her concern about my safety as the situation in Pakistan is not really safe or stable.
It is even mentioned on DOS website under travel warnings for those who are visiting Pakistan. I am not sure whether she managed to talk to some Tier 1 person or Tier 2 but she was told there are other expedite requests from Pakistan and we might get approved. She was not asked anything else, was given a TKxxx tracking number and was told that she will hear from them within 5 days.
Today (after 2 days) she received an email as shown in the previous post. No evidence asked, nothing at all just denied. So I am just wondering, why would they simply deny without even asking for any evidence? I would not mind a denial if they had asked for evidence and it was not sufficient.

1. What guidelines are they talking about and where to find the guidelines?
2. She was never even asked to provide any evidence regarding the expedite request. How can they just deny the request without even asking or viewing the evidence?
3. Does it mean a straight denial of expedite request off the bat? or is there a chance that "IF" we somehow find and meet the expedite guidelines, we can request an expedite again?
4. Since no evidence was ever requested by USCIS, can we send an e-mail to DHS Ombudsman to seek a solution?

Correct me if I'm wrong but I believe humanitarian reasons are based on the country or region experiencing severe famine, recent major natural disaster, etc, or if the country/region is a war zone.

Basically: If your spouse has to wait 5 months, she'll likely die or be tortured.

I live in Pakistan. No famine and not really a direct warzone except suicide bombings every now and then, drone strikes by NATO drone air planes, random killings and kidnappings. Also, political unrest and violent protests and rallies every now and then against load shedding. (load shedding is a curse my country people have been facing for many generations). Imagine having no electricity for 12 to 16 hours a day and not being able to do anything without power. Living everyday in uncertainity not knowing when one could be blown in pieces. If this does not meet the guidelines of humanitarian grounds, which available category would you suggest?

No. Because the only way you can know what a potential RFE is for would be by getting the RFE letter in the first place.

I wonder if they really expedite on humanitarian reasons?

1. You are right. Instead of hiring more of those no good customer service guys/ladies who cannot even answer our queries properly USCIS should hire more adjudicators.
2. If I remember the history correct then except the natives aka indians, all others in the states would be immigrant terrorists no? Others who immigrated to continet, overpowered the natives and became rulers. I don't mean to offend anyone here but just going by definition of the term "immigrant terrorist".
Btw, if by any chance and miracle you are given a surprise tour of any of USCIS service centers, how many people you think you may find playing solitaire or browsing Facebook and not doing their work for which they are paid.

While I agree that the process is unbearably slow, I do understand that no government agency can ever get the manpower to process upwards of 100,000 petitions every month, while still taking into account the seriousness of immigration law and national security. Paying taxes is one thing, but the vast majority of American tax payers will never have to deal with the USCIS, ever. So expecting the USCIS to employ enough people to deal with the constant and massive flow of petitions isn't entirely fair to the US taxpayer either. It is what it is.

That being said. I'd be in favor of doubling or even tripling the filing fees if it meant cutting the wait down by half or even a third.

That would both create a hell of a lot of new government jobs, and I think most people would be willing to pay the price if it meant they were reunited with their families much quicker.

While I agree to your statement about them being low on manpower and taking into account the seriousness of immigration law and national security, I cannot help but to laugh after reading an ad in local classified newspaper.

EB-5: $500,000 investment in Government approved project. Processing time up to 3 months. Yes, this one gets you a Green card as well. (More sugar you add, sweeter it gets).

Moral of the story: When money talks, everyone else just listens.
Then there is no worry about national security and immigration laws. You give them what they want and you can have what you want. 2. Only the wearer knows where the shoe pinches. I am nobody to judge but guessing by your remark " oh its only been two months", I would think you are wearing the comfy hush puppies. Not everyone will feel about a certain situation like you do :)

While browsing and reading the forums I remember a senior member saying that once USCIS actually adjudicates your petition, it only takes few hours to 3 days. The long wait which kills us is the time taken for the petition to reach adjudicator's desk.
So I will agree with tweety on this one point. Get more people, assign them different categories. Just like adding more RAM to a computer or getting a dual core processor with ability to handle more processes at a time. That should help to reduce backlogs and in the long run everyone will have less waiting and separation time. Not saying they should give priority to recent filers but one backlog leads to another.
Only the U.S. Citizens or legal permanent residents are eligible to file a petition for fiance/fiancee, spouse or relatives. I believe all of you pay your state and federal taxes. Do you still deserve to be treated this way and be forced to undergo the long painful separation? Don't mark one person as selfish. He or she only talked about a flaw in the system and proposed a suggestion to improve it. Nothing wrong with that. Just because we cannot do anything about a flawed system does not mean we start bashing the one who pointed out that flaw. Remember, opinions are like a.. holes and everyone has one. Cheers!
