Asia: SouthPakistani Spouse/US Citizen Wife Needing Help Here Please!
QUOTE (blueberry kobbler @ Jun 2 2008, 02:10 AM) <{POST_SNAPBACK}>
unsure.gif I am new to this site and I am totally clueless on this entire process. So, I will try to explain a but to you of what is going on with my situation. First off due to being misguided by friends who had married prior to me I have delayed filing my case for my husband. I suppose if I had applied my visa paperwork by now we may we may already have recieved an approval. We married in 11-07 and still have not started the papers as of yet. We are very eager now to get the ball rolling. I got a few questions: how to start? do we need a lawyer? will a lawyer speed up the process? what do i need from him or he need from me to establish proof of a bonafide relationship? I need any help you can provide. Also, I was previous married and on our marriage certificate in Pakistan it does not list me as divorcee it lists me as widower. So, I think this may cause issues in our case??? If so, how can I fix this problem? Do I have to go back to Pakistan and remarry or am I able to re-submit the marriage paperwork? Please help me..thank you.

Hi, ask your husband to send you photos (2X2). Ask him to send four photos. Any professional photoshop can assist him here. Ask him fill to G325a form. Preferably more than a set. All this information is found on this forum and the USCIS website.

As for your previous' marriage issue, I think this might get you in trouble because one, it has to matche with the facts and two, you will need to submit your divorce decree or death certificate of the spouse. Either way with a previous marriage, one of these two certificates are mandatory with the other documents and you will be needing them till the end of the process. Now you will need to work this out because its common to make such errors during the time of nikaah when men of the family end up writing weird things in the contract. You will need to sort this out. Either you provide USCIS with a death certificate of your x-husband or if he is alive and it has been a divorce then your divorce decree will be needed. Also, this certificate is complicated as I remember reading that the document if issued in Pakistan have to be from a particular office and not by the local nazim's office. please read on that. Also I am surprised you waited that long to file for the visa but anyway its never too late. Please sort out this previous marriage status before proceeding with the petition as this can cause trouble and even if USCIS does not notice this and even NVC might slip this, your husband will have a really tough time at the interview....Allaah forbid.

Anyway I hope this is helpful.
All the best to you.
Sara.

If I married in Pakistan is it necessary to file it in USA prior to filing my K-3 documents? If so, how do I go about doing that?

No the Nikaah naama along with the translation stamped by the notary public etc. and the nikaah nama signed and stamped by the registrar office is what is to be sent along with Your I-130. This is the registered marriage certificate+license from Pakistan and is acceptable all around the world Including USA.

Hello! We are ready to submit our I-130 and I am trying to figure out if I need to submit a copy that is certified with a gold seal and stamp or if I only need to submit a copy of our marriage certificate and no seal or stamp is needed. It has a stamp which stays Pakistan Nikah Registar but there is no gold seal or stamp. So, do I need my husband to send me one with a gold seal and stamp to submit or do they just need the stamp? Is there anywhere I can see examples or can anyone explain to me what is acceptable from anyone who has an approved I-130. Thank you in advance.
:-)

Fatimah, just submit a photocopy of the Marriage certificate and copy of a translation of it in English as far as marriage certificate in concerned for USCIS. Save the originals for NVC where you would need to submit all originals including your husband's birth certificate, police certificate etc. For USCIS, send all copies like your husband's passport's photocopy, your passport's copy, your birth certificate or proof of being a US citizen/ green card holder's photocopy....Bottom line...Submit only photocopies of documents to USCIS and these will be ordinary photocopies. They will review the original documents at NVC. I think this is how it would work. I am beneficiary for CR-1 so maybe someone with a K-3 in process can help more but as far as USCIS is concerned, send photocopies of both your marriage certificate in urdu and the document having its translation.
hope this helps,
best regards,
Sara.

Asia: SouthContacting U.S. Embassy/Consular Section in Islamabad
I would try calling as soon as the lines were open. Also, once you are through to the designated line and you hear the automated voice say something like 'sorry all lines are busy'....press that number again for that line....like it says press 1 for immigrant and 2 for non-immigrant or something....press your line number again....it might say sorry all lines are busy....be persistent....sometimes I would hear that message 20 times and finally the phone call would get through to an operator. you do not need to disconnect and re-try. Try this strategy. and best time to call it precisely at 12:30 or right before the time ends. it would also work to call right after they return from lunch or call on a Friday when most people are busy. All the best.

Hi,

I have been unable to contact the Consular section in Islamabad despite many tries between 12:30-3:30 Pakistan time for several days. Is there any other means or times to contact them? They are not responding to my mails either. Appreciate sharing your experiences.

go to the ceac.gov website and put in your number's that was given when you are at the NVC stage. IF not there yet then once you get you numbers you can look and it tells you if you are issued, admin. processing, or what ever the CO told you during the interview. The numbers start with your country for example: ISL = Islamabad Pakistan, and then a series of numbers to follow the letters. Hope this helps..smile.png

Mexico, Latin & South Americamedical in cdj

ok so were getting ready for my fiancee interview next month i was just wondering if we had to make an appointment for the medical exam

also were can i find the 2011 poverty guidelines to see if my dad could be my co signer on my i-134

there is 5 of us and make like 50,000 is that ok could he be my co signer.

When the embassy sends your fiancee a notice for interview appointment, they also send some instructions and forms which also contain a list of approved medical physicians and laboratories. Your fiancee will have to make an appointment with any of the approved ones and get her medical done prior to her interview.

You may download Poverty Guideline Form from here: I-864P
As far as I know, there cannot be any co-sponsor for I-134 (Affidavit of Support). In past, the Consul Officers did however approve of having a co-sponsor for this but that depends on the country and the consul office. You may have a co-signer or co-sponsor on I-864 or I-864A.
For I-134 there can be only one sponsor who has to qualify on his/her own. If you do not qualify and meet the poverty guideline, your dad can sign but then he has to qualify as single sponsor.

This is just my opinion, you may do some more research on this topic.

I got married in December 2011, we signed both Urdu and English Nikkah Nama with Nikkah Registrar's seal & signature. Also Union Council seal.
You can also get the Computerized Marriage Registration Certificate from NADRA (issued by Union Council) when you register your marriage with them. This certificate is in Urdu/English on same page.

Thanks, Musashii, yes, this helps a lot. I have a few more questions, and you have been MOST helpful. I am planning to go to Pakistan from Germany approximately the second to third week in June. Would the visa start closer to the time of my anticipated visit? Because otherwise, it would run out before I even got there. It says on their website that DC serves TN, while NYC serves the northeast. Do you think if I just sent it to NY rather than DC, they would reject it? My friend's uncle does know someone inside that embassy and could carry it there personally, but not in the DC one. I don't know how they would feel about my sending it to a diffferent embassy than specified...if that would target our application as a problem. I am worried about them losing my passport or not returning it in time, which would ruin my visit to Germany if there was a delay. We are planning to meet in Germany around June 9, stay there about 10 days, then go on to Islamabad, Pakistan and stay there another 2ish weeks, about 30 days in all, like you said.

We are very blessed to be able to travel to meet each other, but as you know, that gets really expensive. Don't know if we will end up doing K-1 or CR-1, depending on if we decide we want to be an official couple. I brought another man here 4.5 years ago on K-1 visa, but ended up divorced (because of abuse) so don't know how this will impact the future of a K-1 or CR-1 with my friend from Pakistan.

Thanks for all your info and help!!! I appreciate it!!!

You may call NY consulate and check with them if they will do your visa. If your friend's uncle knows someone in NY consulate then it would be even better idea to ask him to check with that guy and see if they will do. In Pakistan or with Pakistani people, reference or pulling string works best (that was supposed to be a secret so don't tell) :P

Now, let's suppose you have got your visa affixed on your passport. It shall be valid for up to 6 months (from the time it was issued). So if you get your visa in April and you are planning to visit Pakistan in June, you should be good. Remember that 6 months validity is for visa to enter Pakistan, not to stay there for 6 months. Validity of stay should be 30 days or more if you are lucky so do not exceed your staying limit. Since you are already planing to go to Islamabad, you can apply for extension should you need to do so.
Good luck to you for your journey and umm, with your friend.

Hi--and a hello to Gee....I am also planning to travel to Pakistan (in June). I will meet my friend in Germany, then both of us will go to Pakistan to stay at his house. Since I live in TN, it looks like I will have to apply to the embassy in DC for a visa. Is it possible to apply to a different one or must I apply to the one in DC? (His family knows people that work at one in another city so they know he is an honest man.)I can't take off work to drive there, so I will have to mail the application there. What is the typical time to receive your visa from the DC embassy? If I am both a tourist and have a friend there, which visa is best to apply for? How long is this visa for? It looks like there are places to check off how long you want a visa for. Is it suspicious/red flagging if you put one for a year in case I want to go see him my next vacation...maybe in the fall?
Wow, it looks like you got your visitor visa super-fast!!! If we end up deciding to be a couple, what is the typical wait time for a CR-1 visa versus a K-1 in Pakistan? Thank God, he is able to travel to meet me in another country.
Although he says it's not dangerous there (in his area), were there any particular things to watch out for?
He is in the travel industry, which I am afraid might make it harder for us to get a visa for him to move here, along with a few other red flags we have. Anyway, I wish everybody luck and am encouraged that there are not too many horror stories of green card fraud in this forum compared to some others.
Keep the faith!!!! I appreciate any advice/ideas.

Pakistan's official Embassy is in DC but there are Pakistani Consulates in other states such as NY and maybe Texas. You can apply for a tourist / visit visa. It used to be valid for 90 days but after recent conflicts of interests back in Feb 2011, they only issue visa for 30 days unless you know someone inside ;) but even if you get a visa for 30 days, you can get it extended free of cost from U.S. Embassy in Islamabad, Pakistan.
To apply for any visa, you will need your passport, 4 passport size photographs, a completed and signed passport application form and the applicable fee which is probably $120 I am not sure. Also you will need to submit invitation letter x 2. One from your friend to you stating that he is inviting you to visit Pakistan and other letter from him to whichever embassy or consulate you will apply for visa, requesting them to grant you visa and that he will make sure you do not overstay your visa period and will not become a public charge. You will need to submit a copy of his passport or national identity card as well.
CR1/IR1 visas in Pakistan usually take 6-7 months for approval of your I-130 petition. Then comes NVC process and approval, interview and all. Since Pakistani males are cursed to go through mandatory Administrative Process (most of the time) the whole procedure may take anywhere from 12 - 18 months before you can see your spouse again (unless you are rich enough to pay him some visits).
Nothing can be said about security. Apparently it is safer in Punjab province but we never know ...
Hope this helps.

  • As you have applied for visa, it may take them 7-10 business days to process your application.
  • Do call them and check the status after 5 business days.
  • Only purchase airline tickets after you have your visa in hand. You may use www.expedia.com or some other site for this purpose if you have facility to pay using credit / debit card.
  • Once you have confirmed the ticket and know when exactly you are travelling to Pakistan and which city, go to http://www.travel.state.gov/ and check their instructions for United States Citizens travelling to Pakistan. You may want to register with them in some smart traveler program but that is up to you.
  • Do leave a copy of your important documents such as passport, birth certificate etc with your parents or relatives. Also they should know where in Pakistan you will be staying and any contact information / numbers.
  • Don't be discouraged but keeping the current circumstances and situation in Pakistan, do not try to go out unless necessary. Don't do anything which may draw any attention to you.
All the best.

Hi Musashii,
Yes, I have heard that for some that they were able to get it on the same day too. I was considering to do that, but its 3hrs away & when I spoke to the woman at the Consulate, she said that they would receive it, then look at it & call me, ask me questions, then if all was fine, she would send it to the Consulate General (I guess) and it would be decided if visa is granted. She also informed me about the letter of invitation & what it should say. She said it was fine to have him sign it and scan the letter & both sides of his CNIC then email it to me. She never mentioned a notarized letter ..or anything notarized. I double checked again on it with another rep, because I had more questions as to answering application questions and they said the same.. soooooo... maybe it just depends on the location of the consulate, because I think California & NY is also a little different then Houston & each other. Also, on the sites, not all the info is there in reference to a tourist or visitors visa. I know it changes again once you are married. If they do have any questions or I missd something that Houston center wants..I REALLY hope n pray they will call me. Will let ya know :D

My wife traveled 7 hours (one way) all the way from NC to Washington just so she could get it done same day.
If you have more time, you can use USPS mail or some other service.

My wife came to visit me in November 2011 (she was my fiancee at that time and we married later).
I only sent to her two letters. One was direct invitation to her and other was a letter for her to show or mail to Pakistani Embassy. I sent her a notarized copy of my National ID card, a notarized copy of my passport. Both the letters were also notarized.

Basically, the embassy wants to know that you will not become a public charge while your stay in Pakistan just like any U.S embassy would ask for it if your fiance was to visit you. For the fees and other charges you can search for the nearest consulate. My wife had to go in person to Washington D.C embassy to get her visa and it was done on spot.

Asia: SouthInterview question in embassy

Hello Dear All,

I want to know the answer of this question regarding interview in Embassy(Pakistan Islamabad).

If i feel comfortable to give interview in Urdu instead of English. Is this language selection will effect my visa approval?

As I have read the Islamabad Embassy reviews, you may be offered the opportunity to give interview in Urdu instead of English and there may be a translator present at the time of interview. It should not be a problem. However, may I ask if your spouse who is supposedly a USC (United States Citizen) from Pakistan and speaks Urdu? Because if not, they might ask you at time of interview that how do you communicate with your spouse and if you are not so comfortable with speaking English, won't it be a problem for you in future?

Asia: SouthSponsoring again...
You definitely need to provide USCIS and NVC the copies of your divorce certificate and original respectively. How can you obtain it? You need someone in Pakistan to do that for you. When it comes to Union Council or any Government related department, they can be a royal pain in the bottom and never want to do their job without getting some Quaid-e-Azam (that is the grease someone talked about earlier).

Union Council gives a bilingual Divorce Certificate which is basically registered with NADRA. You may also require an Urdu Divorce Certificate (Certificate Talaq as they state in Urdu). Take note that Union Councils have ceased to issue it ever since the latest bilingual Divorce Certificate came in to the picture however the U.S. Embassy in Islamabad still requires it no matter what (in most cases that I studied here on VJ). This again shall be a pain in your bottom as it was in mine but once again, a little "grease" shall ease that pain.

Third possible obstacle, "Divorce Certificate from Family Court". In some cases, the applicants were asked by the Embassy to provide a Divorce Certificate from Family Court. If the divorce/ Khula was initiated by the wife then it will be needed however, if the divorce/talaq was initiated by husband then it is not required but you may still need to get a "Letter of Opinion" from a lawyer in Pakistan stating that the divorce was initiated / given by husband so family court did not get involved and a divorce certificate from them is not required in your case. This letter has to be sent to NVC.

Now, come to your question about sponsoring your spouse. If your ex-spouse never entered U.S. then you can still sponsor your current spouse. When you fill in the Affidavit of Support I believe you are asked if you have ever sponsored anyone before? You shall reply it as Yes and also attach a letter of explanation stating whom you sponsored, when and how it was terminated before it was even used. (This is just my opinion though and things could be different and perhaps someone more experienced here could offer you better advice). All the best.

Is there any site that will tell them exactly what to do. My wife assembled my package and I am clueless. She is out of town so I can not contact her. My friend's wife is reqesting that I gather this info for her because I am experienced. Boy, is she more than wrong. My wife did everything I just signed basically and filled out my own forms and collected needed affadavits.

Now what should she do about the pics? "Photo of" or "Photo of Azim" should go on the label? Just the words "Photos of" or do you also add the names?

Also, if she did not legally change her name on her SS card should she do so prior to applying for the case?

your case was denied and reaffirmed by uscis i thought u were waiting on next interview date i mentioned uscis n nvc cos idk the process if uscis sends u back to nvc or straight to embassy to get interview date........but once u were denied at embassy and ur petition returned the ap stopped and now ur at the beginning again waiting for embassy to give u interview again.... That isnt ap its the process it takes to get another interview after denial then after the interview u may face ap again but maybe not

ok now i got u , thanks for explanation...

I thought you were at the beginning again (after your reaffirmation) with USCIS getting docs to submit with NVC when they move it there? or already at NVC waiting on what to do and medical etc for interview?
