K-3 Spouse Visa Process & ProceduresDetails of Interview
QUOTE (ara @ Nov 2 2007, 02:50 PM) <{POST_SNAPBACK}>
Hello,

I wanted to let you know the details of my husband's interview. His interview was on Oct. 31st and we were approved!
He is supposed to go and pick his visa up on Tuesday, Nov. 6th.

Although he got to the embassy very early like 6:30 he was like #10 in line. The guard told everyone to open their medical envelope so my husband did not pay him any attention because Komaross said do not open the envelope give it to the CO so when he got to the front of the line to turn his paperwork in the guard said that since he did not listen to him and open his envelope he would have to go to the end of the line so he went from #10 to like #70 he didn't get out of the embassy till 5:30p.m. and he was next to the last he said. So please do what the guards tell you.

Despite the long awful wait he said that the CO he had was very friendly and nice. He was a white american man. He said that he didn't ask for hardly anything at all he just wanted to talk about our relationship?
He really grilled him on that and paid attention to how he answered the questions and the things that he said and didn't really pay that much attention to all the evidence that I had so nicely put together and had spent $220.00 on 5 pounds of paper because I thought we had to have it. My husband said it depends on what CO you get he thinks they already have an idea if they want to approve you or not before you are interviewed ,I don't know that's just what my husband thinks.

The CO asked for a few pictures and emails and took our AOS and that was it. He asked about our relationship like why would a woman from Georgia come all the way to Nigeria to marry you? My husband told him how we met and fell in love he said the CO said he didn't want to know how we were in love he wanted to know what we had in common, what we saw in each other what we talked about on the phone.

My husband said it lasted all about 10 min. and he just told him everything he could and told him how I think he is funny how we are always joking with each other. The CO said so you are a funny man and he said my wife thinks so. LOL.....

So after that we were APPROVED!! and they told him to come back Tuesday and get his visa so I booked him a flight for Friday night Nov. the 9th for him to come to Atlanta and he would have a layover in Paris for 5 hours. Well don't make the same mistake that I did do not get a connecting flight through Europe from Nigeria come to find out after I bought the ticket that now my husband needs a transit visa just to be in Paris for the layover. That is so stupid!!!!!!!!!!!!!!!!!!!
So he has to apply for a transit visa with the airline and it takes 72 hours to get back. So I don't know how everything will go if he gets his visa Tuesday and can turn in his passport and transit visa application on Tuesday he will get it back on Friday morning and he can still leave on his flight on Friday night if not I will have to change the ticket and spend more money for that plus the transit visa is $100.00. So please get a straight through flight to US from Nigeria don't do what I did I guess a lot of people may know this but I didn't or my husband and have never heard of it.

I am thankful that the hardest part of our journey is over with but I am still worried that everything will pan out as we planned things are not so simple in Nigeria so I am praying that all goes well since I am running out of money.
But overall I am really excited that my husband will be home soon and am happy to share my experience with you as you share your experiences!! luv.gif

congratulation to you i am, glad

Is a sky blue background acceptable?

It says that the photos should be plain white or off-white. So I would get them re-done.

But you can have them take a good digital picture frontal view with a white background and send it to you. You can then go into any camera place and have the passport photos printed from that. I have done that before.

K-3 Spouse Visa Process & ProceduresI-130 Questions Please Reply!
Hello! We are now ready to submit just waiting on an answer to these questions:

1. Do we need to or is it recommended to include a copy of the foreign spouses birth certificate in the original I-130 packet?

2. Is attaching photographs onto a sheet of paper, with descriptions of them along with three affidavits substantial proof of a bonafide marriage?

3. Must we mail the package with delivery confirmation or is regular mail suitable?

4. Is it okay to place all of the documents into a vanilla colored filing folder?

5. When should we begin preparing our I-129 packet?

6. Are we supposed to sign the G-325A in blue ink?

7. What if some of the documents are a little wrinkled, will the USCIS reject our application? If so, should we redo them?

Thank you everyone! Please reply if you can, sorry for the long list of questions but we are desperate here.

Yes thats true...
you can schedule the medical once you get your interview letter.
we already did.
however try to make sure that is like 15 days before your interview date.
you always might wanna organize your stuff in hand like make sure that everything is in order.
you have your documents and pictures in order in case they wanna see something
go over your facts...dates and everything.
best of luck

National Visa Center (Dept of State)3rd person choice of Agent
Hello.

I am a USC and i ptetitioned for my husband who is a Pakistani citizen. Both of us are currently living together in Pakistan waiting for the immigration process to complete so we can go back to the US together.

I soon will have to send in the DS-3032 choice of agent form to NVC. I wanted to know if we nominated my father, who is a USC living in the US as the choice of agent so he can forward all the documents to us quicker than choosing our Pakistani address for correspondence, would it be a problem? As my father is not the benficiary or petitioner? but he will be the co sponsor.

National Visa Center (Dept of State)How to deal with NVC
QUOTE (cjgator @ Jan 24 2009, 12:14 AM) <{POST_SNAPBACK}>
For any of you NVC vets who may have experienced something like this....

My wife's I-129F and I-130 was approved just before Xmas.

She is Belarussian, which means she has 2 potential embassies to deal with for the exit interview. Minsk for the K3 (non-immigrant), Warsaw for the IR-1 (immigrant).

We're going K3. We have our reasons for going this route, which I won't spell out here, but a lot of it has to do with her logistics.

USCIS got the info to NVC on January 5. Checked with NVC later that week, they said the 129-F packet was sent to Minsk on Jan 6. Then, I get two identical letters from NVC over the next week, one dated 1/7, and one dated 1/13, saying the info would be sent to Minsk within a week. I called NVC to ask about these, but again, they said it had been sent on 1/6.

Been calling the Minsk embassy since 1/6, up to and including today (1/23), they say they have nothing. Every time I tell NVC that, they say the same thing. They sent on 1/6.

From a tip provided by another VJ'er, I checked DHL's website for the packages sent from NVC since 1/6, up to today. Over 700 packages, sent to all embassies around the world, including some close to Belarus (Warsaw, Moscow, Kiev), but not a single one to Minsk. I decided to call DHL and speak to a rep, he confirmed this. Nothing to Minsk sent from NVC.

So, I call NVC back today, tell them Minsk still has nothing, and DHL says nothing has been sent. My suspicion is they may have mistakenly sent this to Warsaw. I tell the agent that. She was terse, and told me, no, it was sent to Minsk, on January 6, you just have to be patient. I ask her, wouldn't it be unusual for a DHL package to take 17 days to get to Minsk, especially when DHL shows no record of a transmittal, not even one that is in transit. She said there is no way I could get that info from DHL. I told her that I most certainly did get the info, from two sources - their website, and a DHL agent. She said to continue to be patient, and if it didn't get there by the end of the month, to call back.

I think this is BS, and it has me concerned, because there is obviously a time-ticker on the I-129F and I-130 approvals. I'm thinking about calling my congressman's office to see if I can get them to look into this.

Any thoughts? I would really appreciate the perspective of those who have experienced something similar.

Thanks.

CJ-G

I totally understand your frustration. I have been in a very similar situation, only with USCIS not NVC. They approved our petition Sept 3 2008 and said it has been mailed to NVC asme day. However in January, (this month) when i contacted my senator she inquired for me and found out the case was never sent and for four+ months i was under the impression it has been sent. they were doing some addtional background checks and stuff due to which they approved it but never sent it.
Your best best at this point is contacting your senator or congressman...it usually helps, if CR1 is the most suitable route for you, fight for it!!!

Hello,

I am currently living in Pakistan with my husband and am soon going to send in my I-864. I am currently working in Pakistan for a bank making about $3000 USD for the whole year (but i am paid in the local currency PKR). I wanted to know would I be better off stating on my I-864 that I am working or not working?? I don't make enough to file taxes and thus I have not filed any taxes, not that its been a whole year that I have been working. However which would be a better deal stating that I am working and making this much or stating that I am not working??

The onus is on the USC not the intended immigrant... unless your income is qualified income that is likely to continue after you immigrate then you do not include it. So your current work status is not considered

thanks much smile.gif

resposting topic.

per the I-864P poverty guidelines for a household of 4 income requirements are USD26500 for a co-sponsor
as i am not currently working my father will be co sponsoring my husband and his income is USD42000
does his income count entirely towards the sponsorship or is it 1/5th or 1/10th or how does it work??????????????????
i read on the I-864 that a co-sponsors income is 1/5th of the difference
so that would mean 42,000 minus 26,500 which is 15,500 multiply by 5??? so that would mean 77,000+??????

pls help

our case was F4(brothers abd sisters of US citizens).we were interviewed on feb05,2009 and were denied because as the officer said.the petitioners income was not enough to support 10 people(they are 6+we are 4).we offered them to see our bank statements but they refused saying we need a co-sponsor.
i do not know anything about poverty guidlines and all this stuff.
all i know is their anuual income was 52000$ lst year.and according to the poverty guidlines for the year 2008 the money should have been 54000$.they also showed some of their assets.
now the question is was he denial a right one.
and can anyone who is not even related to us support us.of course a us citizen or permanenet resident.
please help.

That is true. in order for the assets to help they will have to show more than the difference....so if it is a difference of 2000 they need to show maybe a house or something that would i think be 4 times more the difference
