Hi everyone. This is just a heads up in case anyone else received a second I-797C that may have stalled their case without their knowing.

I'd already received my biometrics appointment letter dated 11/1/10 for an appointment on 11/29/10, which I attended and had my biometrics taken on that date, (I received the stamps, etc. on the NOA letter.)

In between those two dates, dated 11/18/10, I received a second NOA stating that "In processing your case we have reached the point where we need you to make an appointment to go to one of our Application Support Centers to have your biometrics taken." As I'd already received the NOA with an appointment date of 11/29 I disregarded this second request assuming that it was just duplicity and that once the biometrics from my original appointment were in the system.

Fast forward a few months and I'm starting to see approvals on these VJ pages, so I thought I'd check the USCIS website and see where I was at yesterday. I was shocked to read this:

"On November 18, 2010, we mailed a notice requesting additional evidence or information in this case CRI89 PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283."

Today, I decided to call USCIS to resolve this matter as it would seem that even though I had my biometrics taken on 11/29, the case was in suspense due to my not making a second biometric appointment -- even though I hadn't even had the first appointment at the date the letter was sent!

The lady I spoke to at USCIS kept stating that sometimes the biometrics need to be taken a second time if there was an issue with them. Despite me explaining several times that at the date of the second request I hadn't even had my first biometrics appointment yet she didn't seem to grasp this fact for several minutes! Eventually after explaining the situation again, she realized her error and placed me on hold to escalate my concerns. The second person I spoke to was initially of the same opinion until he grasped the dates involved, but then put me on hold for several minutes while he sorted things out and promised me that my original biometrics were in the system and unless I had an RFE for further information required there should be no reason why my case can't progress as normal now.

So, if anyone else received a second NOA asking for you to make a biometrics appointment, (before you even had gone for your first appointment), you might want to contact USCIS and make sure they haven't placed your case in suspense for no good reason. (Of course, sometimes a second biometrics is necessary if the original results are indecipherable or lost by USCIS. In my case though, I hadn't even had my first appointment before my case was put on hold due to not having a second biometric appointment!)

Thank you for your post regarding the letters. I'm going through the exact same state of limbo here and the dates I received those letters on are very similar to yours. I'm kind of concerned now because when I last called USCIS, they asked me to disregard the RFE if I have already gone in for the biometrics and that because my case is inside the given time frame, there is nothing they can do about the notice. The person I spoke to did not however confirm whether USCIS received my biometrics for which I believe I should call them in the morning now. This entire process is just horrible. Online Status of my case still shows the RFE they had sent out on November 18th and my case has not been touched since November. Depressing!

Something strange is happening with the USCIS system. Perhaps I don't know if this is how it goes but I received a letter which informed me that USCIS had made an appointment for my biometrics on November 24th. This letter was received sometime in early November. Then, on November 18th they sent out an RFE with the request to make an appointment for the biometrics and that the case will be suspended until the RFE is fulfilled. This letter was only received in the mail and not through email. Next when I went in for the biometrics on Nov. 24th, in the evening I received an email from USCIS informing me of the letter which was sent on November 18th and that I should follow the directions given in it. This was a day before Thanksgiving so I waited and then called USCIS on Monday. It seems they did not know I had gone in for the biometrics. When they confirmed I had gone in, they said I should now wait to hear from them. Currently, the online status shows that RFE and has not been updated since my last phone call to them which was on November 29th. Reading all your posts here about the RFE, I'm wondering if others have received such letters too...since USCIS has sent out such letters to at least a few people. Just wondering. Please share your thoughts. This is driving us crazy!

I thought someone posted a link earlier about a person who used to work at USCIS. S/he said that once the 5 months are up, that's it. If they get a congressional inquiry, that application is immediately pulled up and processed as soon as possible. They also try to avoid congressional inquiries because that shows that they are failing, so they try to avoid those like the plague.

That person either lied or is not up to date. I am past 5 months, have sent congressional inquiry and still got nothing more than a "generic reply". So if that person was right, I should have received a notice of action by now as that person also stated it does not take long once they actually look into your petition.

Makes no difference.
5 months on 3 June 2012. Called CSC and no information except "we are still processing petitions from 16 December, call again after 25 June".
Contacted congressman on 4 June. Congressional inquiry sent, reply received on 6 June as follows "the petition is currently under review and you should receive a notice of action within 30-45 days".
Called CSC on 11 June. Tier 2 officer refused to input service request as they are still doing 16 December (wow from 4 June till 11 June they have not moved a single day).
Wrote to CSC follow up, received same generic reply "your petition is currently being adjudicated, you should receive a notice of action within 45 days".
What did you learn? Nothing and nobody can help except God. You contact your representative now or later does not matter. If you are lucky you will get it without any external help and if you are not so lucky like myself then you will just have to wait and wait no matter who you contact.

I live overseas with my Indonesian wife, i came under financial hardship due to a change in government regulations that made it where i could not get a legal job anymore( my family had to send money to us 2x a month just to get by. , My mother is very ill and in the hospital around 2-3 times a month where my father is working 2 jobs and one part time so we are needed there urgently to help my family with my mothers serious illnesses. and UScis did not put me in the proper que as a citizen living overseas... Then recently i came into some trouble with kidney stones and gallbladder stones and inner ear infection and kidney infection.
Where Indonesian hospitals will not treat you unless you pay for treatment up front....

Yes thats the problem. I never even looked at their posted times, I have only called and spoke to Tier 2 reps every time. I would assume the reps had more accurate information that whatever the time said online (again I've never even seen the online one)

But when the rep says to me "VSC is processing Jan 16th right now, since you are Jan 12th you are now outside of processing time... I will filed a request for more information" then to get a response like that sayd NOVEMBER? How is that even possible??? There are TONS of people form Dec, Jan, Feb and a handfull of March approvals already.

Im just beyond frustrated with this whoel experience. Like i said, if they just told me to wait till June or July to start with then it wouldnt have been a big deal but we were told on March 19th that we would know in 2 weeks or so... and the VJ timeline also said April 1-15th as an estimate. BOTH of them matched... naturally I thought it was safe to assume the information was accurate... Here we are a month later and being told we are still MONTHS away. :(

I know other people are having similar experiences with USCIS reps as well, I hope you guys all have better luck!!!

First thing is that they only give their names when you call which could be pseudo names. They refuse to give their ID number saying it is against the policy.
So even if you knew where and who to complain about them giving false information, all we have is a name which could be fake. Don't know what to do.

Well yea, I've now officially given up on getting answers.
March 19th VSC claimed to be working on Jan 1, 2012 cases
April 18th VSC claimed to be working on Dec 25, 2011 cases (#######?)
May 1st VSC claimed to be working on Jan 16, 2012 (making mine now "outside of processing time" and the rep filed a request for information)


Here is what the e-mail said:


"Type of service requested:
-- Outside Normal Processing Times


The status of this service request is:

Our review indicates that this case is actually within our current processing time. We are currently processing cases filed on behalf of an immediate relative of a U.S. Citizen filed in November 2011. We regret any misunderstanding caused by our posted processing time report. If you do not receive a decision or notice of other action within our current processing time, check our website for an update or call customer service at the number provided below."



You kidding me??? Mat1st they are working on Jan 16th? May 7th they are now working on NOVEMBER 2011?? This whole thing is completely ridiculous. I don't care how long it's going to take as long as they stop giving me flase hope. If they told me flat out that it was going to take at least 5-7 months just for USCIS step at VSC that would have been fine... but they told me 3-5 months at VSC and then keep telling me "2 weeks you should hear something" and now to be told that they are still at least 2 months away from looking at it...

I get that no one can give a 100% accurate information but the fact that they have gone BACKWARDS by 2 months in the last 60 days is just ridiculous.

I hate missing my husband every day and being strung along by their false information just to get shot down again causing huge emotional issues in an already difficult situation. Ugh.

The problem is not only with their posted processing times report. Even if you call them, even if you talk to a Tier 2 officer who is supposed to give you most updated information; that information is not correct. For some unknown reason, they never give correct information. You can call today and hear they are working on January, you call right next day and you will hear a completely different date.
It may be more than 5 months since your NOA1 date but if you call them and put in a service request, you may still hear "we are still in the given time frame as we are still processing petitions from xxx month" because their clock and dates are out of this world and do not tele with the normal calender.
No other choice but to wait 5 months from our NOA1 date and then contact Congressman / Senator if still no news.

What I mean by touched is that if you sign with USCIS to view your case progress and receive text or email you can see if it's touched physically by a human so on my case USCIS I can see the message as you do :
On January 24, 2012, we received this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, and mailed you a notice describing how we will process your case.
But now if you sign with USCIS or open a account with them you can see the progress of your case and receive emails or text every time there is some progress so I can see that after receiving my case on the 24th somebody touched my case on the 28th because is the last update on my case!!

I have subscribed for e-mail and text updates but never received anything except NOA1 notifcations before receiving hard copies. Anyway if touched means a physical activity on petition then my last updated for I-130 is 6 January 2012 and last updated for I-129F is on 04/12/2012.
No email or text notifications though.
From reading other posts I have an understanding that CSC-USCIS is processing petitions anywhere from 15 November to 12 December 2012.
Also my wife called and she was told to wait till 3 June and if we have not heard anything till that date then call and inquire. According to that Tier 2 lady officer, they are on track and within their national goal timeframe. However, these people are most commonly known for providing fasle information and are called missinformation line by VJ family. Only USCIS and God knows how they work and what is actually happening.
Now I cannot really say we can trust USCIS so God is our only hope and saviour. Pray and keep our hopes up.
I am hoping to receive my NOA2 in June.

I'm pretty sure your math is wrong here. I see it this way: Jan 3rd to Feb 3rd is one month, Feb 3rd to Mar 3rd is two months, Mar 3rd to Apr 3rd is three months, and Apr 3rd to May 3rd would only be 4 months. how did you get 5 months already? Am I wrong?
I'm at Vermont and I called a couple of days ago, and they said that it is now taking 5 months for them to approve your petition and I should only call if my petition hasn't been approved by June 20th :(

Thank you for doing the maths my friend but if you take a look at my earlier post you will know I was counting the way you did but got confused by a post made by benuk. This whole waiting game is taking its toll and my mind goes bonkers some times and can't think properly. Sorry if that caused any trouble.

Why you wouldn't count January?? did you get a touch? My case arrived at CSC Jan 24th and they touched the Jan 28th...The mind those wonders! :dance: :dance:

I don't really understand what do you mean by "touched"? All I see on the USCIS website is:
On January 3, 2012, we received this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, and mailed you a notice describing how we will process your case.
with a last updated date of 01/06/2012.
According to my timeline here: Based on timeline data, your I130 may be adjudicated between June 10, 2012 and June 27, 2012*.

hmm now that makes me wonder if I should be calling them inquiring about my case if it has been 5 months?

Well.. unfortunately they got my hopes up for no reason.

4 weeks ago (March 19th) they claimed they were working on NOA1 date of Jan 1, 2012...
Today... they claim they are working on December 25, 2011. #######?

How did they do negative 6 days worth of case in the last 4 weeks?
I just don't get how they can go backwards... even if the are backed up then they would have just not gotten very far lately, they wouldn't be going back in dates? I don't know, I'm just really pissed off with them right now.

I know I've not been waiting as long as most people, but the fact that they told me 4 weeks ago that I would have heard by April 10th (ish) then why are they now telling me "You are looking at the last week in May". That's very frustrating.

Anyway, thats the info I got.

I have learned not to trust the information given by CSRs of UCSIC. Just wait till you reach 5 months time from your priority date and then call if you have not heard anything. If they still do not tell anything then contact your congressman or senator to look into it.

Has anyone else got an update? I know that the processing time is 5 months, but I am seeing people not too far behind me getting approvals, in addition to VaggoLena's amazing approval; so I am getting encouraged, almost to the point that I would be shocked and upset if mine took much longer :(

As of April 16, 2012 CSC-USCIS is processing October 2011 petitions. There are some November and March approvals too according to Igor's list but those may have been among lucky ones who got expedite approved somehow or both petitioner and spouse living abroad.

They say they're still working on September, so we can't put in a service request if they aren't "officially" past our NOA1 date yet.

Does not make sense. You filed in October so Nov, Dec, Jan, Feb and March. 5 months gone and their current goal is 5 months. Are they stupid or am I counting wrong?
And God forbid if they sit on their lazy bums and are still doing September in May 2012 then are they still not "officially" past your NOA1 date?

Yeah but the Pakistani embassy I spoke with here in Chicago said NADRA doesn't issue POC cards anymore, just NICOP. Anyways, as I get to Pakistan were going to the NADRA office to see what we can get, it seems like the rules/guidelines are a bit hazy...

LOL cute....right so my office is in blue area....ermmmm best examply right infront of parliment house! You gotta know where that is. So anyway, yes I am sure you had a bad experience, however Gulf is the best option nowadays! My mother and sister in law just flew back in april w/o any problems.
