Even if you do not have enough income at the interview, they will give you time to find a sponsor or prove higher income, so you do have a chance to either get records of current income/second job or find a sponsor.

 

I am self-employed, so they wanted us to get a co-sponsor and we turned in the papers a few weeks after the interview and we got the visa no problems.

Some banks will not accept a direct deposit if both names are not on the check. That is what they did to me, I signed up for direct deposit thinking there would be no problem and US Bank rejected it because of both our names being on the deposit.

Depending on your bank, you may be out of luck, I signed up for direct deposit of our refund before my wife was here and the bank (US bank) rejected it because her name was not on my account so the IRS sent me a paper check.

Then someone at the bank said I could get it cashed with her signature on the check and a copy of here passport as ID for the signature. When I took it to the bank they still wouldn't accept the check so we had to wait until she got here before I could deposit the check.

Luckily Kathlene got here before the check was six months old or I would have had to request a new check!

You will just need to keep records of income and expenses, then file a Schedule C - Income from business when you file taxes.

One good thing there will be LOTS of things you can deduct, but you will only be able to claim the profit as income, not your net.

i.e. You do $3,000.00 a year in business, but your business expenses/deductions are $2,750.00, your profit is only $250.00 and that is what they will consider.

I know because I was self-employed when I filed for my wife and they would only look at my profit, not my gross income.

You will have to declare it on your taxes before it can be counted as income. And legally you have to report the income.

In the US there is no such thing as 'non-taxable' income, remember Al Capone . . .

I agree, I think they accept it without question if the beneficiary takes the CFO after the visa has been placed in the passport.


But what some of you have missed is Kathlene DOESN'T HAVE HER PASSPORT YET ! ! !

Her old passport is expired, so she needs a new one for when she finally gets her visa!

That is why she needs to take the CFO now so she doesn't have to wait for her passport once her interview is scheduled. She cannot get her passport until she has completed the CFO seminar.

Counseling Requirements for Filipino Spouses and Other Partners of Foreign Nationals

Two (2) valid identification cards with photograph (i.e. passport, driver’s license, NBI Clearance, SSS or GSIS ID, company ID, professional license card);
Duly completed Guidance and Counseling form (available at CFO or SMEF-COW);
If married, certified true copy and photocopy of Marriage Contract on Security Paper from the National Statistics Office (NSO), or the Local Civil Registry Offices (LCRO); or original and photocopy of Report of Marriage duly authenticated by the Philippine Embassy/consulate (if married abroad);

Other documents (i.e. divorce or separation papers, photographs, parental consent, letters, other proofs of identity, civil status, etc.) as may be required by the counselors;

and Payment of P250.00 counseling fee.

I guess my documents fall under 'may be required' :P At least we have plenty of time to get everything done. I am just frustrated we have to spend the money for another trip to Cebu! She had to spend some of the money I was going to give her for her Christmas shopping on the trip to Cebu for the seminar.

Sounds like the counselors make up some of the requirements as they go along!

And they DID tell her to bring a copy of my passport as well, I may send her a copy of my birth certificate as well, along with anything else I can think of they might ask for!

As for certified copies of my divorce papers, the clerks office at the courthouse stamped them 'certified' at $20 a copy!

My wife just returned from the CFO seminar in Cebu. She did not get her certificate so she can get her passport because she did not have documents from me. (which I didn't see as required on the CFO website)

Now she has to wait for me to send her a certified copy of my divorce papers, my Legal Capacity to Marry certificate, and a copy of my passport, which I know she will need to have for her interview as well, but it is very frustrating that she now has to make a second trip just to show them copies of papers they did not tell her she would need! She had a copy of our marriage certificate, which would not have been issued if I didn't have all that paperwork before we got married!

They did let her complete the seminar and counseling, so all she has to do is to go back to the office and show them my paperwork and then she can get her passport.

Oh well, at least we started all of this with plenty of time before her interview is scheduled!

Just remember to give yourself enough time in Manila before ya'll leave to attend the CFO seminar and have the visa stamped.



She has already attended the CFO seminar, they required her to attend before she could get her passport, so she only has to go to Cebu so they can stamp her passport once they deliver the visa, so I guess she can leave as soon as the interview is over.

Just wondering, would it make that much of a difference if Kathlene goes back to her family outside of Cagayan de Oro after her interview, or stay in Manila until she gets her visa in hand?

It will be a few weeks after she gets her visa before I will be able to fly in so we can return to the USA together, so I thought it would be best for her to spent the last few weeks with her family, since it will be a year or so before we can return for a visit.

I just didn't know how much it would delay the delivery having to have it delivered to another island.

One thing to consider, if you get your spouse an ITIN and file your taxes, you may not be able to cash your refund check until your spouse is here.

I tried to do electronic deposit for our refund and our bank rejected it because my wife's name was not on the account and they would not cash the paper check until she was here in person to show proof I was not trying to steal her money!

Your bank may not do that but my big, huge US bank did that, so I had a large check I had to keep in the safe for six months.

That is true, some cases are chosen at random for AP, or maybe when the case was reviewed by a supervisor, a closer look was requested.

 

So, until you are notified the visa is in production, you are not totally free & clear.

No problem with them approving the visa, you will just have to wait until the sputum test is finished. Be glad they are letting you to go ahead with the interview. They made my wife wait until the test was complete before they would do her interview.

I just read in another thread about someone going through the ceremony and they told her to be sure and make a copy, even though it says on the certificate not to copy, for safe-keeping.

I would be very nervous about sending off the original without a back-up copy.

OK, we found a mistake on the N-400 after we sent it off.

On my wife's first trip home we put the wrong return date. She returned on the 22nd instead of the 18th. She was only gone a month and a half that trip and then she was gone about 3 months the first of the year to see her dad who passed away from lung cancer, so she is WAY under the limits for time spent outside the country.

I know, I know, we should have triple-checked the forms, but that's too late now.

Can she just show them the stamps in her passport at the interview and correct the forms while she is there? I noticed it has a place where she swears to the corrections made as well as the info on the form.

Now she is worried she will be denied, but I told her they allow for corrections as it says on the signature box on the form. (the box where she will sign at the interview)

Just wanted to get you guys opinion.

Kathlene had her interview in Louisville yesterday. We got there 30 minutes early and turned in her letter. Her appointment was at 1:30 and she was called right at her appointment time.

She was back there about 15 minutes and came out & first told me she failed, but then smiled and showed me her paper!

They just asked a few questions about her application & then went to the testing. She got 100% six questions correct in a row,read one sentence & wrote one sentence. Then they told her to expect her oath ceremony in about a month!

As soon as we got back to the car she called her mother in the Philippines & told her. Her whole family was still awake waiting to her about her interview.

Thanks again for all the help & info available on this forum! It is better than any lawyer you could hire!

January would be fine, Kathlene keeps asking if we got anything in the mail about her oath-taking. She had a short interview and passed all the tests with no mistakes. I told her not to worry.

I am out of vacation days until January, so that way we could take a couple of days off and spend some time in Louisville.

I understand they only hold the ceremonies in Louisville and I guess they wait until they have a certain number before they schedule a ceremony.

There are no shortcuts to the oath ceremony if it is like the one my wife was in, the 12:30 time is for registration, so the official ceremony most likely won't even start for another hour.

Then the ceremony will last maybe a couple of hours. The last thing they will do after the speeches will be the oath-taking and handing out of certificates.

So, unless you are close to the airport, either reschedule your oath or maybe you can get a later flight, but I would plan on not getting done until 3:30 or so if everything goes smooth.

I was thinking of printing the pictures of me and my wife on letter size paper with a caption beneath each one, two or three per page. Since most pics are digital now, why print them separate then tape or glue to each page?

I thought it would be very easy for them to review if they are printed on regular size paper and have them top punched so it will just go right into the file.

Just thought it would look cleaner and be much less of a hassle for them to deal with.

Did you file as single or as married filing separately? If you both were working and filed as single you could be in trouble with the IRS. If only one of you was working, you should amend your return to married to get the tax advantages.

If you filed married filing separately, just send both transcripts or forms in. They will still show proof of you both residing at the same address.

Now I have had a chance to take a few deep breaths and calm down a bit from this unexpected bit of news I see I have three things I need to do.

1. Contact the embassy and see if the date IS correct.

2. Decide if it is worth the risk to try and rush and make the interview and perhaps forgetting something or not having all our papers in order.

3. Reschedule and hope for a new appointment not too far out, but with enough time for us to get all the papers ready.

As it looks right now, if Kathlene waits for me to come and us fly back together, it would be in late July at the earliest I could get there with my work schedule, since we were thinking it would be August or September before she would have her visa anyway.

Thanks for all the help and advice from everyone here and hopefully all this means our visa journey is nearing its end and our new lives together are beginning soon!

OK, I guess I had better contact the embassy and make sure she has that date for her interview, then I will have to try and see if I can get the info I was going to send her there in time, I may try and send it to a friend in Manila instead of trying to send it to her where she lives outside of Cagayan de Oro and save a few days that way. I still have my paycheck stubs, pictures, call records, ticket stubs, etc. here with me because I thought I had a few months to send everything and I wanted to keep my pay records as current as possible for her interview.

How many days should she allow for getting her medical done in time so it will make it to the embassy in time?

Worst case - how long a delay if we have to reschedule her interview since we have less than two weeks to get everything done?

OK, can anyone explain to me when I went to the embassy website and entered Kathlene's case number just for fun and it gave me an interview date of June 6, 2007 ! ? ! ?

NVC just transfered it yesterday, so Manila hasn't even received the paperwork, much less sent Kathlene any of her packets?

I am guessing this is a glitch in the system because there is no way we could have everything ready by then. That is unless I win a sweepstakes and I hand carry everything to my wife's side on the next plane out! :wacko:

Anyway, I'm just hoping for a late summer (August or so) interview.

I called the NVC info number today and they have transfered Kathlene's case to Manila yesterday! (May 22, 2007)

The Manila embassy website says to allow 3 to 5 months for them to set her interview.

How long has it taken you to get your interview? I know I have seen some people get there interview a lot sooner than the time stated by the embassy.

BTW, we have applied for the CR-1 if that makes a difference in processing time.

KATHLENE HAS AN 'ALL CLEAR!'

Kathlene went in for her medical evaluation after finishing her sputum tests and the told her she was fine! She will return on the 12th to pick up here papers and get the last of her immunizations and then they will set her a new interview date!

We are so happy/relieved that we have passed this hurdle and are almost at the end of this journey, ready to start our journey together!

So, if you have enough notice about your interview, it might be a good idea to go a couple of weeks early in case there are any problems like we had!
