Ok she didn't get the Visa yet because for my previous divorce I sent in a decree from the judge instead of a certificate...I had no idea they actually give you a Certificate for that... so now I have to send that paper and I'm not sure if she has to go interview again or if she can mail it in along with her passport to get the visa...anyone know how it works when you're missing a paper?

Hello all, we finally reached the most important step in this process, at least I think it is. My amazing fiance had her medical this morning and by afternoon she had the results and the sealed envelope in her hands :)
Tomorrow at 13:00 Romania time, she will have her interview. Wish us good luck and keep us in your prayers tonight.

Wonder if this is a new trend, this past year, three of my wifes' friends and co-workers have returned to their home country, and this was after gaining US citizenship. All three are leaving their US citizen husband behind, one to Spain, another to Mexico, last to Colombia. Similar stories, long hard work, low pay, super high property taxes, extraordinary medical costs, practically no time off to relax and enjoy life, all are accustomed to getting all of Holy Week off and three weeks for Christmas. No such thing here.

So what's your reason? Maybe this board needs a section for immigrants that decided to go back home.

If my wife decides to leave, I will go with her, we are a team. Heard on the news that only 400 of the richest families own over 50% of the USA, we can let them have the other 50% and won't have the rest of us for slaves so will have to do their own floor sweeping.


Well my reason is just wanting to be with her and still missing my home country. Maybe the weather here in Seattle has a big part in this too :D but everytime I went back to Romania, I felt like I belong there, can't really explain the feeling. For me, making less money in Romania is not really a big concern. I am fine with making less money and I can still be happy. I did tell my wife though, if I can't re-adjust to life in Romania or if I can't find a job, I want to move to a different country in Europe, maybe the UK (but that steering wheel on the right side is really killing it for me :P ) or even Spain. There is also a chance for us to come back to the USofA but most likely it won't be in Seattle again. It is really far from our home country, the weather is depressing and I sort of miss looking around and not seeing any places or buildings that have any history or culture behind them :) . I mean I can walk around the Vatican for days and weeks at a time and still find it breathtaking :D . Walk around Seattle for a bit...meh.


Another interesting determination I found, as for my case, is that the period of residency (5 years) does not necessarily mean that you have to have been a US Citizen for that period. So in my case I entered the US on 1995 on an E-2 visa and I didn't become a naturalized citizen until 2006. I've now met both criteria. I've remained in the US for 5 years since 14 and I'm currently a US citizen. It seems with the physical presence that congress felt that by having the parent present for 5 years, they would have an understanding of the US customs and culture and would then be able to impart that to the child.

BTW - your kid doesn't necessarily have to be a boy. We've already succeeded in putting a black man in the White House, now it's high time we put a woman in there too.

So why did your wife want to return to Romania?


Well for my wife it's a different story, she has many years of schooling done in Romania which she will most likely loose if we move here. She is an Engineer and Project Manager for a pretty big company back home. We are also in our early 30's so we want children, we want to settle down, buy our own place, we don't want to go back to school, to start over. Maybe if we were in our early 20s, that would be different. After a while, priorities change.

As of December 31, 2010 the Certificate of Report of Birth (DS-1350) is no longer issued. All previously issued FS-240 and DS-1350 documents are still valid for proof of identity, citizenship and other legal purposes."

So I might have read that page wrong yesterday when I came across it...what is the difference between a Consular Report of Birth Abroad and the Certification of Report of Birth ? The latter one is no longer being turned into the Embassy but directly to USCIS...am I just confused? If my child will be born do I just head over to the US Embassy in Bucharest and apply for a Consular Report of Birth Abroad?

Yes we are not turning it in yet (the GC) but by Feb 2012 it would be a year since she left the US. By filling a re-entry permit don't you have to actually USE it?
Her GC is conditional and only after the conditions are removed (or maybe even later) we can apply for her Citizenship.

Yes! I was going to just ask about that, it mentions in the Instruction #11 that Proof of residence is required for the parent(s) but does not mention how long of whatnot. I've been in the US since 1995 (I turned 17 in '95) but I'm planning to move back to Romania for a while and see how I might adjust back home and if I don't like it, we might come back. But if we do remain there I want to still be able to pass on my citizenship to my child :)

Hello all, I have a question that I am hoping someone has an answer to. I have been a US citizen since end of year 2000 (Naturalized) and I am planning to move back home to Romania. My wife has a Green Card (which if we decide to remain overseas, we will turn it back in at the local US Embassy) since she married me here in the US. We are planning to have a child (or two :D ) and I've read that our child will most likely be a US citizen once the child is born and we apply for a US Certificate of Birth with the local embassy. Now I've also read that the embassy no longer does this? And we have to apply with USCIS? Can we apply from overseas? Or do we need to be present? Thanks in advance :)

We don't have a rent contract where we live, the homeowner can provide a letter which can be notarized and most likely Apostilled if needed, would that work?  That letter would state that we have not interrupted paying rent to him while overseas.

Hmm, reading through the guide on here it states that as long as I provide proof that we didn't abandon the US Residency, we should be able to file.  Proof would include the taxes filed (which we have), pay stubs (nobody in America will still keep you on their payroll for 11mos while you take care of stuff at home, so no pay stubs) and rent payments (we can provide that from the homeowner where we live, basically a legalized letter from the homeowner, would that be enough?).

Hello all, haven't posted in a while and now it's time for my wife's citizenship step :)  I'm wondering though, she got her first Green Card in December 2010, in Feb 2011 she left the country until Jan 2012, that's 11 months, due to my mother in law being sick and needing surgery, plus she had to finish up some projects at work that she was in charge of (she was an engineer back home).  I joined her in Sep 2011 and came back with her together, basically I had a nice 5mos vacation :) 

Now, how will that impact our citizenship application?  If we don't count her leaving the country, she would be eligible to file next month (that's 3 years after receiving her first GC), actually she could've filed in September (90days prior) but the time she spent ouside of the country might deterr us from applying unless we can prove she didn't abandon her Permanent Residency. 

How should we proceed?  Any help would be appreciated, thank you.

Alix, this was based on 3year rule and when we applied it was based on their question "Have you resided for at least 180 days continuously in the US before applying?" , or something similar to that.  She left for Romania in 2011 I think, for 11mos due to her mother being sick and needing care and to be taken to doctors etc.  I've sent in proof that we have not interrupted the place where we stay (rent, phone etc).  Sorry I'm at work and can't remember all the docs I've sent in :(

Hello all, my wife had her US Citizenship interview and she passed the test with flying colors but they needed some additional documents in relation to her leaving the country for 11 months.  We did submit the documents with overnight delivery.  Interview was June 5th, they received the documents the next day and have not heard anything since.  I wanted to setup an appointment at the Seattle office, online, but it was telling me none are available.  I wanted to ask if 1 month and a half wait is a normal time period to wait on an answer about the RFE.

 

Any insight?

You're being ridiculous here, in my opinion. First, waiting to have conditions lifted is not that big of a deal at all, as you are with your spouse and have a letter that allows you to travel and work. Yeah, it's annoying, but if I had to dedicate resources to either A) ensure that people get their conditions lifted faster or B) ensure that people don't get butchered by the Assad regime and/or Al Qaeda militants operating in Syria, I would unhesitatingly choose B. Sorry if that impacts you, but that's the way it goes: there is a terrible war being waged in Syria and no one should be condemned to death just so you have the pleasure of getting your green card a couple weeks early. Learn to deal with it.

Second, your Peruvian friends are nuts if they think that Bush left the economy in good shape. You may not remember this, but in late 2008 the entire financial sector of this country absolutely imploded, causing fast amounts of wealth to be destroyed, the credit market to become extremely restricted, and unemployment to skyrocket. Next time someone asks you why American's aren't getting all nostalgic for the good old days back when we all saw our 401ks lose half of their value, you can tell them that.

Third, using Peru as some yardstick to measure the United States against doesn't make any sense. The reason why the sol has gone up has little to do with the economic health of the United States and more to do with Peruvian economic indicators. Since the fall of the Fujimorato in 2000 Peru has experienced tremendous growth in GDP. For a while they were averaging 9% a year. Peru had the fortune of having the largest-producing gold mine in the entire world right as the price of gold shot up as a consequence of the DJIA plummeting under Bush. Vast amounts of wealth were created. Peru has also had the ability to greatly expand its tourism sector, with Machu Picchu being declared one of the "new" wonders of the world, the crime situation being brought under control, and the internal conflict against the PCP-SL and MRTA brought to and end. As I'm sure you know, ever since about 1987 Peruvians have been paranoid of inflation with good reason and the government thus never prints up gobs of cash like other Latin American countries do, nor does it allow the state to grow. With a booming economy, a small state, and little money being printed, yeah, the Peruvian nuevo sol has gone up. If you measure the dollar against the Euro, a currency that people actually care about and spend, obviously you see the exact opposite effect -- the dollar has gone up and the Euro down since Obama took office.

In any event, I don't like Obama or Romney or Bush, and I think that USCIS does a pretty bad job at a lot of things. If someone wants to vote for Mitt Romney because he had to wait seven months to get his removal of conditions petition adjudicated, I guess that's his right, but it is extraordinarily silly. Tell me, what is Mitt Romney's plan to ensure that ROC petitions are adjudicated faster? I've looked at the RNC party platform and strangely I've missed the part about petition adjudication. Can you let me know what page its on? Thanks.

I was sitting here reading her post in disbelief...how can someone think a country's currency value going up and down is only affected by one side, obviously the US side. :lol: Also the whole economy going into depression takes quite a long time, sort of a balooning effect, it certainly does not happen overnight. It's funny how when something goes wrong with the country, who else are you going to blame, the President, of course. :lol:

If your other evidence is weak, being notarized wouldn't hurt. The VJ templates are setup to be notarized.

I didn't have mine notarized but I only sent my package in last week so I don't know if that will be an issue yet.

In other names used, usually refers to maiden names and other names which have been used on paperwork (Passport, ID, Driver's License etc). If that original name has been on any paperwork, then you need to write it down exactly the way you have used it.

Are you sure you are entering EAC or WAC than number? Did you register the number first?


There is only one option to add items, "Add a case to your portfolio" button. I enter the WAC followed by the number (no dashes, like it tells you) but I get invalid number. It's most likely because I haven't received my BIO letter yet like someone else stated

have you received a NOA1?


Of course, how else would I know my WAC number, other then calling USCIS :)
