Look closely in your passport if you entered the USA on an immigrant visa as per where you posted this, the officer at the POE should have stamped your passport with I-551 stamp, this is "Temporary evidence of Permanent Residence".

Me and my fiance are SOO HAPPY!! I have to contain myself from jumping up and down at work tongue.gif My family is also very very happy smile.gif I cannot wait for the day when I wait for her at the airport!!

OK, now onto serious business, so I understand that NVC should get our paperwork now and in about 5 days there's some number I have to call and check up on this?
I also have to send her the packet I sent to USCIS plus the copy of the approval notice....what else? I want to say THANK YOU to everyone on this website for their input and for sharing their experiences with us, we have learned a great deal from you all and from this wonderful site biggrin.gif

It is very important to say the truth especially since I assume that is what you wrote on the explanation on how you met. When you tell the truth your fiance will be more relaxed at the interview and will have nothing to fear since your relationship is genuine.

I don't know how I missed your posting about the co-sponser, but I did. I mean, if the friend said he would.. that is a lot of responsible he's agreeing too, and he may be having his doubts about doing it. Is he your personal friend? or your fiance's? Have you spent much time with him?

Anyway, I hope you either don't need the co-sponser or you both find someone willing, good luck to you! I imagine it is pretty emotional at this point. Hang in there!

Middle East and North Africathe magicjack
actually the price for the device is 20 plus the first year of usage of 20, makes it $40. It is a $20/year service, it is well worth it. We have used it for almost a year, we bought 2, they save you a LOT of money on internatinal calls. You just connect it to your PC, install it and choose a phone number (if you call the USA make sure to choose a USA phone number and area code, that way when you call or when you get called from the US, it's completely free).
It works off of your internet service and if you do not have good internet, it won't work. We tried to use it with my wife's wireless internet and it didn't work. It needs a good internet connection, preferrably highspeed internet.
So buy one, connect it to your PC, connect the other end to a telephone with a telephone jack, install it on your computer, enter all info requested and choose a phone number.
Enjoy!

IR-1 / CR-1 Spouse Visa Process & ProceduresPolice Report Question
Hello,

We are in the process of obtaining the police report for my husband through the Australian Federal Police. On the application form for the AFP, it states that fingerprint checks are very rarely required, and to make sure that you really need a fingerprint check. Can someone tell me if this is necessary? Also, if it is necessary, where can we go to get fingerprints done? My husband is in the US right now (legally on a visitor visa) so we will need to do fingerprints here and send them to the AFP.

Thanks

Choice is terrific!

It is not a problem with him staying in the US. Other than that, is there any downside to applying for the Adjustment of Status vs him going back to Australia and going the NVC route? As I see it, it is saving us some work of him going back and forth to Australia until things are approved.
abarnesFemale02013-03-23 12:52:00
IR-1 / CR-1 Spouse Visa Process & ProceduresI-797, Notice of Action Received
According to USCIS, it is quite allowable for him to be in the US and apply for permanent residency if I have an approved I-130. Green Card for an Immediate Relative of a U.S. Citizen

If I am reading this correctly, we apply for an I-485 and he has residency while the I-130 is processed. The only question that I have is if he would still have to go back to Australia for processing or if it is all done in the US. Am I reading this correctly?

IR-1 / CR-1 Spouse Visa Process & ProceduresI-797, Notice of Action Received
Hi All,

I received an email last week that our application was approved. Today I received an I-797, Notice of Action in the mail. Is this the same thing as the NOA-2 that you have in the timeline? Here is what my letter says.

The above petition has been approved. The petition indicates that the person for who you are petitioning is in the United States and will apply for adjustment of status. He or she should contact the locate USCIS office to obtain form I-485, Application for Permanent Residence. A copy of this notices should be submitted with the application,

If the person for who you are petitioning decides to apply for a visa outside of the United States based upon this petition the petitioner should file Form I-824, Application for Action on Approved Application or Petition, to request that we send the petition to the Department of State National Visa Center (NVC).

and so on.

So, what does this mean? My husband is in the US on a valid vistor visa right now, but we had planned for him to go back to Australia when things progressed, as we were told that he had to be in Australia once things moved forward. Does he not have to go back to Australia? If he doesn't go back, does it slow things down?

Thanks
Anne and Mark

IR-1 / CR-1 Spouse Visa Process & ProceduresUnderstanding all of the steps
Thanks for the replies. I find all of this confusing, mostly because there are all kinds of numbers and names and yet nothing seems to match up. I fill out an I-130 but it is an IR1/CR1. On my timeline (which I filled out) it says there is a NOA1 and a NOA2, but my letter just says Notice of Action. I'm trying to match up the jargon with the documentation.

Here is the exact email I received this week. So what does this mean? And is there an estimated timeline from here?

Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

Your Case Status: Initial Review

On March 17, 2013, we mailed you a notice that we certified our approval of this case and sent it to the appropriate appellate body for review. They will notify you directly when they make a final decision. If you move while this case is pending, follow the instructions provided in the notice and use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

If you have filed an I-485, I-589, I-751, N-400, I-90, I-821, I-131 or I-765, you can expect to receive an appointment notice to appear at an Application Support Center to have your fingerprints and/or photographs taken. The timing of your appointment is determined by the number of applicants ahead of you that also need a biometric appointment. We try to schedule biometric appointments as quickly as possible and in most cases you will receive your appointment notice within 30 days of submitting your application. We will send your appointment notice approximately 14 days ahead of your scheduled appointment. It is important that you keep this appointment. If absolutely necessary, you can request that your appointment be rescheduled however, please be aware that rescheduling may delay the processing of your application. Please follow the instructions on your appointment notice if you need to reschedule. Occasionally, you may receive an appointment notice to appear at an Application Support Center to have your fingerprints taken when you have filed a form other than those listed above. In these situations, you may receive your appointment notice more than 30 days after submitting your application or petition.

IR-1 / CR-1 Spouse Visa Process & ProceduresUnderstanding all of the steps
Hello. I apologize if this has been covered somewhere on this site. I've looked around and didn't find anything on this, so I hope someone might be able to explain things here.

I am American and my husband is Australian. We submitted an I-130 form and received an I-797 on November 13, 2012 that the petition had been received. This week, I received an email stating that my case is in Initial Review, and that the case was approved and sent to the appropriate appellate body for review.

I find the whole process a bit confusing. I'm not sure what exactly this message means. I'm not sure if I am supposed to do anything. I'm not even sure what all of the steps are and where we are in the process.

If anyone can explain the process to me, I would really appreciate it.

Thanks
Anne

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 to I-864

Hello,

As you can see from our timeline, we started out on the I-130 journey last year.  March 17th, we received the NOA2 letter of approval.  The letter stated that we could apply for an adjustment of status since my husband was in the United States (which he legally is).  We've sent in the I-864 and all of the required documenation (medical form, tax documents, and so on) plus a check and received back acknowledgement of receipt of the application.  On April 16th we received the notice for the biometric appointment, which is tomorrow May 7th.

I have two questions.

The first is in regards to this site.  I don't see a way to change my timeline so that I can enter in dates for these types of forms.  There is no I-864 on my timeline.  This is probably not a big deal, but people seem to like it when you update your timeline.

My second question is really, how does this whole process work?  I've seen a lot of information on how the standard I-130 process works, but it appears that we have bypassed that process, or moved into a different track.  Can anyone tell me what our next steps are? And can anyone tell me how long it is taking for those next steps to occur?

Thank you
