I would add that if you were one of the ones transferred from VSC to TSC that the time between Noa2 to NVC case number is probably 4 weeks. That is what a lot of us from the transfer are experiencing. 

 

Now is the time you should be collecting all of those documents she will need for her interview as well and get them sent to her.

Thanks! I will give it a week or so before I get my fiancé to call regarding funding out the case number. I jumped the gun slightly (due to a misunderstanding with the doctors surgery) regarding booking my medical, but I got it pushed out to the 5th sept thankfully. At least I should have my case number by then and it wasn't a total waste if money!

What site do you use to check the status of your paperwork once it has left USCIS? I am just curious so I can make a note of it. I have my NOA2 (or my fiance does) and our paperwork has been sent to the NVC. I am going away for 2 1/2 months come September and was hoping to have my case number etc (and potentially my packet 3 - but that might be wishful thinking) before i leave. Our NOA2 was dated 22 July.

I think you might have it all by then, it really depends on when Texas (I take it you were transferred too) gets it mailed out. I hear the London Embassy is one of the quicker ones. Just remember that tracker website will only work with the Case number from the NVC (or when you call DoS). Once you do have the case number just keep an eye on the tracker, because as of today our petition has gone from In Transit to Ready and still no word from NVC.

Just back from work or else I would have been able to reply to you sooner. The NVC is a part of the Department of State, and I say to contact them first because they are much easier to deal with. When I first received our notification that our petition was being shipped to the NVC, it said call the Dept of State for any questions. I basically ignored that part and just did what the guides said and contacted the NVC. So I did this several times, about 2 weeks after receiving our Noa2, and then again on the 3rd week. Each time I waited 20-30minutes listening to the same 4 or 5 messages repeating in rotation to only hear "Sir we do not have your petition, it is not in our system and you need to give it 8 weeks to reach us." After the first phone call I actually received an email saying that it was shipped to them, and so I waited a week before calling them back. Same thing, annoying wait time and messages about my time being precious (what is this lord of the rings?) and finally the same we don't have it, wait 8 weeks response and that the email is just not true/means nothing. Then I got some good advice from a fellow VJer, that said they called the Dept of State that day and were given their case number. So I did the same thing and wouldn't you know no wait time, no annoying messages. After pressing the correct keys a guy answered the phone right away, asked me a few questions and then said, "O yes sir your petition is at the NVC being proceed now and should be ready soon." Hey great news I said and here the NVC told me they didn't have it, I guess I should be getting my case number soon then. The guy said, you want the case number, here it is and the rest is history. 

 

As for right now there is still no notice from the NVC about our case but with case number in hand I checked our status yesterday. Surprise, Surprise, it's in transit to the Embassy. So this is why I say to contact the DoS over the NVC, and so the number I gave you is for the DoS and not the NVC. You can try to call them now and find out but it will probably take about 3 weeks before it leaves for the NVC, but then again each case is different and I would definitely start calling after 2 weeks. Which is what they recommend on the guides.

Well when you do call them use this number: 202-663-1225 Press 1 for English and then 0 for an operator. Just inform the person why you are calling (Check if NVC has your file, and/or looking to see if you've been assigned a case number). They will ask for the case number or NoA2 receipt number, the beneficiaries's name and birth date. That's all I was asked.

If you experience anything like in our case you will get an email once it has been shipped to the NVC, for us it took about 3 weeks to get that email and then I waited a week before contacting them. Call the department of state visa services over the NVC, as they can tell you if they have received it or not. I used https://ceac.state.g...er/Status.aspx? once i got our case number from the DoS to track it from there. Which took a few more days to say it was in transit to the Embassy. 

 

I hope this helps you get an idea of what to expect next and how to track it.

I recommend you call the Dept of State (202-663-1225) over the NVC. Our petition was shipped on 7/18 and I called a week later to hear the same thing I heard last time I called; "we don't have you in our system, please wait up to 8 weeks". After calling the DoS (hit 1 for english and then 0 for an operator...i was surprised no wait or annoying music!) he took my info and told me the NVC had it and should be done processing it shortly. He also had my case number too. DoS was much more easier to deal with than NVC.

Congratulations but skip the NVC and contact the Department of State as it says in the notification. I feel if you contact the NVC in a weeks time, like I had, you will get the response that it is not there yet and that the notification you received doesn't mean anything. Yes the second person I talked to said this to me, and also to wait up to 8 weeks. The next day I contacted the DoS (thanks to some great advice) and found out my case number and that the NVC had it and should be done processing it soon. You can reach them at 202-663-1225 (press 1 for English and then 0 for an operator) 

 

As for the I134 you should start doing that now, many of us start after the NoA2, because you will also need a lot of supporting documents (read the direction for it too, as it says you need duplicates for the support docs) for it. You should go to Embassy website and see what all is required and gather that as well and send it to. This is as far as I can advise you without seeing any timeline information.

We were apart of the first batch of TSC transfers from VSC back in May.

 

And I'm happy to report that my fiancee picked up her Passport with Visa and Visa Packet today from the courier!

In my opinion, and from what i've been reading this last year, the K1 is the fastest option. I don't know much about the K3 and I believe that many choose the CR1 over it. As for the VWP, my understanding is that if your underlining goal is to get married that you could be facing some serious problems. You would have to prove in some way that wasn't the original intent of the visit, though i'm sure others will chime in and let you know. Now if you were to be married in her country and then she comes on the VWP that is a different subject, and would also put you in the CR1 filing and subject to the border control. 

 

Best of luck. Also google things like "marriage visa waiver program" "k3 vs k1 vs cr1" and things like this and you'll get your answers. I even bet that the first first results will come from this website.

Hey everyone, so I'm going to be meeting with my Fiancee here in a couple weeks in Finland. While we are there we plan on putting the K1 petition packet together and I want to give her an identical copy of the packet along with original documents she will need later down the road (trying to eliminate wait time with mail). My question is, though there is a copy of my original birth certificate in the packet, I am giving her a certified copy of it as well so she can use later in place of parting with the original for awhile. The thing is they do not look the same, so should I make back and front copies of it as well and send it in with the petition, or should they not care about the minor detail when it comes to interview time and what not. I thought just as a backup send in a copy of my original, and a copy of the certified copy in the packet as well. Thanks for any advice, VJ peeps are definitely making this process a lot easier...now if only we could speed up the process :P

I would say, and I haven't been married before so doesn't apply to me, if they issue an RFE just wait for it to happen and send it then. I don't believe there is a way to send extra documents with your petition so that they can add it to you folder. I believe they expect you to have done all of that before you sent it. So just wait, and have it ready to send.

Unfortunately a U.S Citizens duty, no matter where they live outside the U.S, is to contribute through taxes if they are legally working. I'm not sure if you fall into this category but you maybe eligible for the 2 month filing extension. This gives you until June 15 to file, you can also request another extension up to October. This is copied from my list of what I will need after the NoA2 arrives. For the bank statement have them give a statement on when the account was opened, what the 12 month (yearly) deposit was, and how much is currently in there. Make sure they use their letter head or special watermarked paper (Get copies just in case).

 

As for your employer have them write out a statement on the company letter head that states when you started working, what the nature of your job is, if it's a temporary or permanent position,  and how much yearly you gross.

 

If you are self-employed their are more tax returns you need to submit.

IMBRA not an issue.  That counts approved petitions. 

 

Refile, as everyone else said.  Don't use an attorney.  In a straightforward case like yours, if you use an attorney you will spend maybe 3-4 hours over a week or two gathering required documents and info.  If you don't use an attorney you will spend 3-4 hours over a week or two gathering required documents and info. About the same, right?

 

Then the attorney will go back and forth with you over a few weeks, making sure everything is perfect, slowing your process.  Then they will have someone type up your documents who is likely to make more errors than you, because they aren't you, they could and have made spelling mistakes, date mistakes, etc. that you are a lot less likely to make. 

 

And for this service, slowing down and putting typos in your petition, they will charge you a nominal fee.  The guides here are very clear.  Even I was able to follow them successfully.  Save time, money, and aggravation.  VisaJourney is your friend.

Do all of this while you wait for the dismissal  and then you can turn right around and send it. It's going to take some time either way because there are things your girl is going to need to sign, so you'll be mailing or taking trips to get them done. It's not very hard to do it on your own, and most of us here are self-appliers.

Generally they are pretty good at getting them out quickly, I think I've normally waited 2 weeks but sometimes as long as a month before getting it. If possible, and anyone who knows chime in please, he could give you a copy of the papers he filed. If he did it online with a service like turbo tax, he can print a copy of it from their website.

I'd add about question #4, Remember there is going to be period of 2-3 months where you won't be able to work while you file the AoS. Though this gives you a perfect window to learn the area and start looking for potential employers. Also depending on how much money you plan to bring in you may need to inform CBP:

"You may bring into or take out of the country, including by mail, as much money as you wish. However, if it is more than $10,000, you will need to report it to CBP. Ask the CBP officer for the Currency Reporting Form (FinCen 105). The penalties for non-compliance can be severe.
?Money? means monetary instruments and includes U.S. or foreign coins currently in circulation, currency, travelers? checks in any form, money orders, and negotiable instruments or investment securities in bearer form."
 
If she does need to get a co-sponsor another good thing to remember is that he/she will need to fill out their own separate I-134 and include all supporting documents for it  . Your Fiancee will also need to fill out a set too.

Thanks all for your responses. I have already told her about K1 and the need to marry in the US and not her country. She is blaming it on her brothers (she is from a village) and how they won't let her go alone. I told her that it's impossible for me to go to her country even for one week. She simply ended the relationship and said good luck in your life. We fought a lot before this but she would always go nutts and call me 100 times a day until we get back together. Now after she got the visa it seems it's the opposite.

 

At this point, I have made up my mind and I don't want her anymore. My main concern is that she would use the visa to come to the USA and live with her sister illegally. If I tell the embassy there, would they call her back and revoke the visa??

 

That's a shame to hear, but we have just as real relationships as everyone else on the planet and sometimes things just don't work out. Even after all the paperwork, and the finale of the first act is in front of us. If her reasons are true then I would not worry too much about her using the K1 visa to come into the country. After all her brothers wouldn't let her leave on her lonesome to you, what changes for going to her sister's instead? Though cover all your bases, and let her know that you will be contacting the USCIS ahead of time to inform them that the relationship is over, and the K1 is no longer needed.

First off you should really try to find a way to get ahold of her, and see if this was just bad communication between the two of you. Maybe she's even in the process of gathering her thoughts. So try to get a hold of her and talk it out. None of us here will completely understand your situation or what happened in your discussions. If left to my own interpretation I would say the commitment and bond between you two was not very strong. Though I do not know you personally, or her, so I couldn't say. Now what you need to do is, get ahold of her, talk to her, and if you have the funds to do it this is what I would recommend. Let her know that the K1 is strictly for marriage here in the United States, that if you do any legal or non-legal ceremony that could spell trouble for the K1 (outside the US). If she were to slip up and say my husband in context to you, or mention the non-legal ceremony it will cause nothing but headaches. So if you have the funds, why not get married here like originally planned and then after you file the AoS and AP (Advance Parole) travel back to her country for a marriage ceremony there. If she likes the idea, great! If not tell her you two should have talked more about the options of marriage, and that if you two were to marry in her country that you would have to start the process over to a Cr1. Thus wasting all the time you two went through to get the K1 and waiting even longer.

I'm not sure about the answer to your original question, but a clarification on the last part. Did you mean to say you make 23,800? If that is the case you are above the 125% poverty level unless you have 3 or more people under your household.

 

1 person = $11,490 (125%: 14,363)

2 people = $15,510 (125%: 19,388)
3 People = $19,530 (125%: 24,413)

 

If you have 3 and over then well then i'm just running off at the mouth. laughing.gif

When he goes to re-apply make sure he goes over the documents several times, and not just once. Go through them one day, let it sit and go back another day and reaffirm you have everything that they need and in order. Make a checklist and make duplicates. Maybe he can scan every page and the order he is sending them. I loaded mine to dropbox so my fiancee could go over them as well. It sounds like to me that he missed a few of the essential documents, but as others say the affidavit of support document shouldn't be needed until the interview. As for the intent to marry make sure you both have one, and they are signed. No copies of it, he should have the original copy that you signed.

If you 2 are able to meet again before he reapplies I would have him print out all the documents and bring them with him. 2 sets, one for you and one for him. Sign it all there and bam you have a copy already smile.png

 

Good luck and may you have a speedy approval in your second chance.
