You apply for the EAD and AP at the same time as the AOS because then it's free. Otherwise you'll have to pay separately for the two documents.

AP can be used in cases that isn't an emergency too. It takes roughly 8 weeks. If there is an emergency though, you can make an infopass appointment and expedite it and receive the emergency AP on the day.

I've posted this elsewhere, but my grandfather died yesterday suddenly; I'm looking into getting emergency AP but apparently am not eligible as we haven't yet applied for AOS. I'm trying to get my K1 re-validated by the consulate so that I can go back to the UK and then use it to re-enter, but it doesn't look good.

We did, and we spoke to the lawyer and very thing about it, and was advised that the chances were we would have a hellish AOS and they would charge us with Visa fraud, and since there was no way we could prove hardship it would have ended with me being deported or fined or jailed and the same for Chris (minus the deportation).

I have FINISHED UNIVERSITY!

And I've recieved an amazing offer, someone I know has a sister working for the hospital in Harvard as a psychologist, and says she might be able to get me an internship. That would be amazing! I have to ask whether I'm allowed to do this with a EAD or if I have to have a greencard, etc.. but awesome.

There have been a LOT of AOS cases lately that were finished in about 2 and 1/2 months, but yeah, I'm not complaining, there is never any gaurentee of anything happening fast, or even at all in this process. Most of the K-1 cases seem to get transfered to CSC which means no local interview, supposedly this only happens if it'd be faster to transfer to CSC than the local office, and presumably they pre-screen them somehow so that they don't send people to CSC who will require an interview (for some kind of red flag or something). The VJ site doesn't seem to have a very good guestimate tool for AOS processing since there is a lot of room for wild variables, people handled at local offices will have a big difference from people handled by CSC etc... I think people who file after the I-94 expires (after 90 days) are much more likely to have a slow AOS too.

Anyway, for those who get their AOS filed right away and don't have any mistakes or some kind of serious red flag, I think most will get the GC in about 3 months. It does all depend potentially on each person's situation and some luck of the draw probably.

I used my SSN to open a bank account and have been asked for it nurmerous times without work being the main topic (I even kept the SSN card attached to the card it was sent on and used it as proof of my address which was invaluable). As it is free and mostly hassle-free, why not get one anyway? you dont know when you may need it biggrin.gif

It's kind of weird but all kinds of people have offered my wife work, and even a few jobs posted online that interest her... but the kicker is almost all of this work is very short hours stuff, odd hours, etc... at this rate she'll have full time employment via 10 different people/businesses (well, she's not actually working anywhere yet but things are lining up like that).

Wow, its good to know that people are prepared to employ non-Americans. It gives us all hope. If she has a few different jobs she shouldnt get bored either, there would be quite a bit of variation.

Congrats on the EAD! It's the same in the U.K with foreigners, I think.. people are generally quite friendly, but I have heard my housemates (who are Japanese and Turkish) say that they've experienced some negative things, apparantly when they hear your name (even if you have an English accent).

I know exactly how you feel.

I also find that so many words are the same but have different meanings. I sometimes feel really tired if I have been with a group of Americans as my brain has had to ignore the accent, listen to the words, translate to English and then I have to form a reply in English and then convert to American, all in seconds. Most of the time its ok but when they speak fast it really does seem a different language lol. But in the end it is quite naive of me to think Americans speak English as Americans speak American the clue is in the title lol.

Life is great though and I love our family being together, its all well worth it. kicking.gif

The wife's AP document showed up today... so we went online to check if the case numbers from AP and EAD would finally show up online (the AOS stuff is not very consistant in this regard) and both numbers worked finally... the AP was approved on the 7th and took a week to get to us... the EAD was approved on the 13th... so probably next thursday she'll have work authorization in hand. After seeing 3 people and being progressively passed up the ranked he finally had an interview with the Chief of Staff of USCIS, who proceeded to tell him that he had no idea what was up with our case, nor what was happening. But he did tell us (and this I like) that it was rubbish that we didn't know anything and that its really not fair that we know nothing. So he proceeded to give Chris his number and email (and his assistants as well) and let him know that he would look into our case and that we should have our NOA2 (be it approved or denied) by the end of the week. Having married first didn't allow us to get the SSN in her married name, the name had to match what USCIS had, they said we could notify them of the change but it wasn't clear how (for all I know they meant file AOS as a method of notifying them of the change). We ended up getting the SSN in her maiden name, once AOS is complete we'll get it updated to show her married name, but it's no big deal at this point. I have seen cases (after we went through the SSN deal) where people only had to show the marriage cert and they were given a SSN in their married name, maybe they were K-3's or something, I don't know all the details but it seemed impossible having seen the procedure used here (they checked some database and if the name didn't match no go). Each state has diff requirements for marriages, so make sure you know the details, some states require a SSN before you can get married, there are also potentially diff requirements like getting blood tests, waiting periods, and of course different fees (though I don't think the marriage license fee is going to be a big deal in many cases compared to the other costs of this process... but you might have to pay using cash or something along those lines too and may even have to have exact change).

I went into the local office after on the 14th day of arrival and was given an SSN in my maiden name( the name my passport is in) without any trouble. 2 days after we married we went ino the local office again and upon showing our wedding certificate, were able to change my name and a new card was sent out. No fee, no hassle smile.gif

Interview was a piece of cake, other than the 5 hour wait.

I gave him passport photos, my birth certificate, 134 form with a tax return and my police certificate. He didn't ask me for evidence of their U.S citizenship or any more supporting evidence like pay-stubs, etc. or relationship evidence.

The actual interview went great, too. The nice American man asked me how we met, what Bill did/does for a living, when I finish school and what our wedding plans were.. then told me that he was going to hold onto my passport (I gasped inside for fear of AP) so that he can put a nice visa inside. smile.gif

I travelled for 7 hours today and waited for 5 in the waiting room, with a headache and anxiety, but it all turned out great.

Best of luck! Its very straightforward, get there as early as you can, be prepared for a boring wait. Dont forget, if you are taking proof of ongoing relationship (which I did and for my interview it wasnt asked for) dont take cards that when opened they play music. These show up on the x ray machine and they wont let you in with them so you have to put them in the rubbish sad.gif

I'm so sorry for your bad day. After reading your post, I couldn't help but think if Nigeria was the hot subject after the latest terrorist attempt on the flight last week. The administration has called for accountability on all levels so maybe that was the real factor?
