Removing Conditions on Residency General DiscussionI-175

Evidence that you traveled together is always great - and it doesn't matter whether or not you used your maiden name.

There's nothing to say that you have to change your name after marriage - some do, some don't.

I agree! Send it in!

Removing Conditions on Residency General Discussiongreen card expired over a year...

i know, that sometime (a lots of times, actually), people have to wait over the year to get them papers. And if extension letter expires, it doesn't make you illegal. But what if foreign passport expired also or close to expire? Is it any other option? I've heard they can just give you piece of paper with the picture, it works just like stamp in passport... have you heard of that? Have you had that?

You won't be in trouble with USCIS just because your passport expired, you just won't be able to travel. If you're extension letter has expired though and you still don't have your 10 year green card, make an INFOpass appointment to get a stamp in your passport which WILL enable you to travel.

Removing Conditions on Residency General DiscussionROC interview
I just want to wish you best of luck! It sounds like you guys will be just fine. Interviews are always scary, let alone when they're for the future of you and your spouse. You already have all the info they'll be asking you in your head; you've spent all these years studying for this interview without even trying just by living together! ;) (F)

Removing Conditions on Residency General DiscussionRFE USCIS is asking for the same docs again?

Hi everyone I filed my wife's I-751 in September and have been waiting since then to get the permanent green card in the mail, but today I get a letter from USCIS asking for the same docs that I sent with the original packet. They are asking for 2009, 2010 tax returns which I included in the packet, Wedding photos, credit card statements, lease docs etc etc..all of them were sent already. Why are they asking for the same docs again? I made sure I send them everything plus tons of other supporting docs as many of you guys did. What should I do, send them the same stuff again, since I already have a copy of the entire packet saved which makes no sense or get a infopass appt and take the packet with me. How can info pass help me?

thank you

They may want some additional documents to further prove the legitimacy of your marriage. If they specifically asked for tax returns I would send those again. Request tax transcripts as those are preferred. If you sent statements every 6 months over the last 2 years last time around, send statements every 2 months or so this time around so they see your joint accounts continued throughout the entire 2 years. Send more documentation since you've sent in the packet too - recent photos and statements. Who knows why they ask for what they do, just make sure you get it back to them in time!

Removing Conditions on Residency General DiscussionRemoving Conditions For Single Person Instructions

Are there any major/important differences to filing as divorced and single, as opposed to filing jointly?

I am referring to the instructions here: http://www.visajourn...ontent/751guide

"Step-by-Step Guide on Removing of Conditions (Form I-751)
These are the basic steps required to file JOINTLY as a married couple. These steps should be followed as a guideline and not as specific requirements for any given case. Every case is unique and this does not address that uniqueness."

Yes, if you are filing individually there are additional documents you need to send in with your application, depending on your circumstances. If you are divorced, you must provide a copy of the divorce decree. If your spouse died, you must provide a copy of the death certificate. There are other conditions and evidence you must send in if your circumstance matches those listed on the I-751 instruction form. Read it through here: http://www.uscis.gov.../i-751instr.pdf

Removing Conditions on Residency General DiscussionI-751 October 2010 Filers

Hi everyone, Finally I got some good news, I got my card today, it's been a long journey and I still have the citizenship to go. Well, I got my interview on October 6, the funny thing is that the Inmigration officer who interview me and my husband luckily was the same one who had interview us for the adjustment of status, so she remembered us and everything went so smooth, was actually a nice conversation, I felt like an idiot after panicking for so long and making my husband panic too...lol. She said the reason I got call for an interview was cause we had move a lot in the las three years, we have been in 4 different states and about 7 different addresses, so that kinda raise some red alerts on us. So, basically it took a whole year since I send the papers to get my card in hand....thanks everybody for your support and expertise advice, it's been an amazing experience that it wouldn't been possible without your help!!!!

Wow what a journey you had!! But CONGRATS on the approval finally!  I am an October 2011 filer so I thought I'd pop in the thread of those who filed exactly 1 year ago :star:

Removing Conditions on Residency General DiscussionDocuments Needed

Hi all,
Are birth certificates and marriage license necessary to send in with I-751? I assume we would need to send them in, but haven't seen them mentioned in the guides or other posts re: evidence and documents needed.
Thanks for your help.

No you don't need those for removal of conditions.

Removing Conditions on Residency General DiscussionROC Bio done in Sept. 2011 - no greed card yet?

My stepson who came to the US with a K-2 visa filed his ROC way before Sept. 2011, for he had his biometrics done in September 2011. According to the average case and his own mother's case, it is taking no more than 3 months after the biometrics to either get a NOA with an approval and a few weeks after getting the actual GC. At least, this was our experience with his mother's ROC process. So I am worry about this long wait. Is there anything we can do? Or does he needs to wait until his ROC original NOA expires? What else can we do? Thanks.

There's nothing you can do except wait, with the rest of us :( No need to worry though, plenty of people around here are waiting close to a year for news since their bio

Removing Conditions on Residency General DiscussionAlready thinking about the next step
You actually don't need the marriage certificate at the ROC stage as they should already have it, but if you want to keep it in your possession then bring it anyway.

You're going to want to show co-mingling assets and housing over the course of the two years so you'll need things that span over that whole time period. Hang on to itineraries of trips you take together, pictures with family, on trips, etc. Keep track of all your leases over the next two years as you'll need copies of those. Any tickets to plays/concerts/shows you go to together that has both of your names on it - throw it in a folder to save for ROC. That's really what I did from our AOS to ROC and it helped so much when it came time to file. I just sorted through the folder of things I'd gathered and it made it a lot easier.

Other examples of things you'll need but may be able to print out much later would be: joint bank statements spanning two years, 401k/IRA accounts showing each other as beneficiary, joint health insurance, life insurance listing each other as beneficiary, children's birth certificates, copies of driver's license with same address..

Removing Conditions on Residency General DiscussionA few Biometric questions
I would give it more than 2 weeks to receive your biometrics after the NOA1. It's entirely possible that it arrives in 2 weeks but it could take longer. No sure way to know.

You can do a walk-in once you receive your bio notice as long as your local office allows it. I wouldn't recommend waiting until you return to get your biometrics done as you'll be gone 5-6 months. This will delay your process significantly.

I believe that if they can't read your second set of fingerprints they ask for your history of residence over the last 10 years to run your check that way.

Removing Conditions on Residency General DiscussionNOA in priority mail or ordinary mail

Hi everyone,
I sent my I-751 packet on the 16th of April. It reached vermont center on the 18th, 12.07 PM. I am awaiting NOA letter. I was just wondering if it is appropriate for me to expect the letter today. Will they send it by priority mail or simple mail? Please let me know your thoughts. I have just received an offer for a job but acceptance of which is conditional on NOA. I am scared as each day is important because of the competition for jobs.

I believe it's sent regular mail but I'm not 100% positive. I would expect it would be approximately 2 weeks before you'll get your NOA1

Removing Conditions on Residency General DiscussionI751 and Domestic Violence

I received my green card provisory in 2010 and after a few months later a suffered domestic violence at the hands of my ex husband. I was still married when I suffered the violence. I had to submit I-751 but my divorce was pending, it took 1 year and 3 months to finalize my divorce due the trial.

I submitted the I-751 without the divorce decree with the help of my friend and lawyer, she is a member of the Visa Journey "Sandranj" .I sent the I-751 as a battered spouse and bonafide marriage, I chose both options, but my friend Sandra warned me that the USCIS could accept my I-751 waiver as a battered spouse and they wouldn't ask the divorce decree or they could accept just based in bonafide marriage and the USCIS would ask me the divorce decree, because good faith marriage that ended in divorce is mandatory the divorce decree, but that I had a huge chance that USCIS would accept as a battered spouse!!! Today after ten long months of waiting the decision Vermont Service Center approved my permanent green card without divorce decree and without Interview.Glory To God.

I'm sorry you went through that terrible situation but I'm happy your I-751 was approved! Now enjoy a happy and fulfilled life, free of violence!

I sent ours USPS with signature confirmation and tracking. It arrived quickly with no problems. As far as payment, can you track a one-time check from a bank? Never did one of those before. I'd do a money order so you have a receipt.

Removing Conditions on Residency General Discussion4 year journey at an end

As you can see from my signature, our long journey has finally come to an end. A little over 4 years after meeting, we have our 10 year GC in hand. Just over 3 years from first filing for K-1. We filed as early as possible at every milepost and lucked out at every turn it seemed. Not a single hiccup the entire way except one lost letter that temporarily extended her GC. We had to get another copy so we could travel.

I know the journey is a lot more of a headache for others and I realize how much good fortune we've had. Everyone here has been great with advice along the way! We'll be married for three years this summer and we have a beautiful daughter who is almost two years old. It doesn't get much better!

Congrats I'm very happy for you! It's always a nice feeling to know you're done with USCIS (for 10 years at least ;))

Removing Conditions on Residency General DiscussionUSCIS VSC Processing Times updated

I hope it comes a little sooner than that  We are traveling July 26-August 5, but with the one year extension letter we should be fine, right? (His gc originally expired November 20-something)

Yeah you'll be fine with the extension letter. We are traveling to Canada in August for a friend's wedding with the expired GC and extension letter. I've read that if you get an officer who doesn't know what it is, ask to speak with a manager or someone else because it is a legitimate way to travel.

I just checked and they updated their processing times again, hoorah! This time it says they are processing I-751 VSC cases as of July 4, 2011. Much better than their previous post of May 2011. I suppose they either fixed their mistake or are picking up speed. A bit of good news!

Removing Conditions on Residency General DiscussionNOA in hand and travel abroad

Hi VJs,

ROC here. VSC

GC expires August 2012. Submitted removal of conditions 5/7/2012, completed biometrics early, 6/1/2012.

I have the NOA extending GC for 1 year, and am traveling in June returning after GC expires. Will the NOA letter, GC expired and passport be sufficient? Or should I get a stamp on my passport? Will I encounter any trouble?

Best,

No need for the stamp, just bring the original NOA1 extension letter, not a copy. Many here have traveled with the NOA1 and expired GC and been just fine!

Removing Conditions on Residency General Discussionquestion on removing conditions

Hi,

I wonder if both my husband and I doesn't make above the property line, and doesn't have the 2 years tax return, because he got laid off. Will we need a joint sponsor when my husband remove conditions on his green card?

Thanks in advance

You don't need a sponsor and don't need to fill out form I-864 for removal of conditions.

You do not have to file an I-864 when removing conditions...

Thanks for sharing!

On a side note, I can't believe it's legal for them to ask such personal questions about how often you are intimate with your spouse. That is unbelievably inappropriate and they can ask a ton of other questions to verify the validity of a marriage other than that. Ridiculous.

Removing Conditions on Residency General DiscussionQuarterly bank statement Question

We are filing the I-751 soon in July - we are going to include the bank statement from when I got the green card which is oct 2010 to current bank statement 2012 quarterly - do you recommend placing the most recent 2012 on top or the Oct 2010 on top?

Also, is quarterly from oct 2010 okay or it has to be the whole thing from the date we got married?

I don't think it matters which order you put them in - ascending or descending. We just made sure our whole packet was consistent - if we did one section ascending we did the whole packet ascending. I believe we had all papers listed with the most recent on top to the oldest on bottom. Quarterly statements are a good idea too, you don't want to print every statement, but you want to show over the course of the last two years, which you are.

Removing Conditions on Residency General Discussionold address new address

Question, when we got the conditional green card we were living in old house that we rented; however, in May 2011 we bought a house (under my name due to credit issues), do we have to make any sort of cover letter to explain about two addresses as in old address vs. new address for the ROC. What would you do in this case?

The ROC form asks about prior addresses and, if needed, you will just submit a separate sheet of paper listing all prior addresses.
