Are you getting a divorce from your husband or are you simply separated to try and work things out? If you are getting a divorce, you'll need to send in divorce papers after they are completed because you'll need to file to waive the joint filing requirement. If you are simply separated and not planning on getting a divorce, my guess is your separate addresses may cause you to have an interview. You will be explaining your entire situation to a USCIS worker and they will determine whether or not they believe your marriage was entered in good faith based upon your answers. Since you say you did enter in good faith and submitted all the evidence you had along with your 751 application, all you can do now is wait. There is a long gap between the biometrics and an interview/approval date for many at this moment so don't be surprised if you wait months before you hear anything.

Hi ,
We have filed I-751 last week to remove conditions on my GC and that too on my expense. Just yesterday my husband mentioned that our relation is just not working out but he will help me through the I-751 process. He is actually having an extra-marital affair and is also not mentally balanced. I am not sure what to do, so have couple of questions

What if he actually doesn't support me in this process till last stage and in that case I have to file a waiver petion if I am correct. .So that way I have just wasted time and money on this joint petition. Also how long does divorce process takes in CA and how long it is approx taking I-751 process to complete. I also believe I can't leave country while any of these processes are going on. Any ideas or opinions ?
If the situation comes where I have to file waiver, what evidences or documents can help me getting case in my favor like proof of his affair or mental problems Thanks


If you are going to file for a divorce, then yes, you'll have to file a waiver to file the joint petition. In order to do that you'll need the divorce decree and you would send it in to USCIS to be filed with your already filed I-751 (with your A# on any paperwork mailed in). Your husband can't prevent you from removing conditions. I'm assuming he is your financial sponsor (if he was the one who filed form I-864 for you), therefore he cannot just say he won't support you because he decides he doesn't want to. In short, he cannot get you kicked out of the US unless he can somehow prove your marriage was not entered in good faith and it was fraud. Since you already mailed in your I-751, I'm hoping you included a ton of paperwork showing that you entered your marriage in good faith and still have many forms of joint finances, property, etc? If not, you will get an RFE for this evidence and you must send in whatever evidence you have.

I can't tell you how long the process of I-751 will take but I do know the CSC is running more quickly than the VSC so at least that's on your side. I would prepare for a bout a 6 month wait though and if you get it sooner than that, great.

Since you filed last week, you will soon receive a Notice of Action (NOA) letter from USCIS stating they received your application and extending your legal status in the US for one year. This letter provides a way for you to travel and leave the country if you need to. I would be wary of leaving for too long though because you will need to be in the country to complete your biometrics and attend an interview if you're called in for one. If you must leave the country, have someone check your mail to let you know of any important correspondence, and be prepared to come back if you need to.

If you haven't already, be sure to read over the I-751 filing instructions as it gives notice on what to do if you're filing to waive the joint filing requirement.

Tax transcripts aren't required for ROC but are used as good evidence of a continued marriage if filed jointly or under the same address.

If you do get a divorce before your due to file I-751 you'll need to file right away (even if it's before your 90 day window you'd usually file in). You can do this by filing the waiver your friend mentioned to you. Be sure to read the guides here on VJ as well as the instructions of the I-751 form. You'll need a divorce decree to send in with your application.

Either way, as long as you entered your marriage in good faith, your USC spouse can't get you kicked out of the country. They provide these waivers for people who are unable to file jointly for the I-751. You still have some time though so wait and see what happens in your relationship.

Yep one check and make it out to "U.S. Department of Homeland Security" although I must concur on reading over the instructions!

For additional addresses, we just typed it up on a blank document with the address and dates, similar to how they have it laid out on the application itself. We put my husband's A# at the top of the sheet along with the question it regards.

If you're called in for an interview it'll be to prove the legitimacy of your marriage as bona fide in which case they require both of the couple to attend. If you get a divorce before the interview, however, be sure to bring the divorce decree with you to the interview if she simply refuses to go. Whichever way it turns out, make sure you go to the interview because not showing at all could deem your application abandoned.

Agreed. If you have an otherwise strong packet of evidence of a bona fide marriage, no need to wait. If it will put you at ease to include it, you can wait since you'll still be within your 90 day window to send in your ROC.

Pre information: My husband came here on a k1 visa. Now we are married. He now has his greencard for almost two years. We will soon file to removie conditions. His greencard is due to expire in late November I believe so we will file around September. Now getting to my question, we are planning a trip home to his country in may for three weeks. Will he have any problems leaving or coming back in on his current visa/greencard. I wouldnt think so. But do we need to file anything for him or do anything for him prior to going and basically, can he just walk back out and come back in as easily as I can? Going to Morocco if that means anything.

Since you're traveling in May 2012 (I'm guessing) and his GC won't expire until November 2012 (again, guessing), his GC will still be valid to travel in and out of the U.S. He'll need a valid passport (sometimes good for 6 months after travel date for some countries) and his Green Card. Just make sure you come back to the U.S. in time to file ROC but I'm guessing you won't be gone from May - November ;)

You should be ok, especially if the green card is still valid upon re-entry. If you file for ROC your first NOA will serve as a one year extension of the green card as well. Somebody correct me if I am wrong, since I won't go through this until June.

Thanks all for your supportive and quick advice.
here's what we ended up doing (since it was Sunday and couldn't talk to homeland security or a lawyer or anything....)

we booked the flight for late morning, and showed up at 7:50am at the USCIS biometrics service center (opens at 8am). We were 2nd in line. We talked to the supervisor, showed him the plane reservations, explained the medical emergency, and without a word he "ok-ed" it, we filled out the form really fast, and were out of there in 20 minutes, biometrics done. then straight to airport and now my husband is on his way home.

So for future folks who might face similar issues--- the "walk-in" for us in St. Paul did *not* work when we tried it last month for a non-emergency, but in the case of this medical emergency the staff seemed to be understanding and let us do the biometrics then and there when we needed it. so we are very grateful, and hope that folks in the future can have a similarly positive experience. you need that when there is an emergency in the family....

There's really no way anyone can tell you how long it will take to get your 10 year GC or if you'll get called in for an interview. Many get approved without an interview but it's always a possibility. Right now CSC is processing cases faster than VSC but I'm not sure which one you've filed with. Some on these boards have been waiting since May, June, July 2011 with no approval. Some who filed just in September are already approved. Your best bet is to have someone check your mail and get in touch with you if you receive correspondence from USCIS; and be prepared to fly back if you get an interview!

Hi All,

I will be applying to remove restrictions on my green card in March of this year. My wife (US citizen) and I live together on the east coast and have all the required proof we need to provide. I am currently interviewing for a new job which is located on the west coast. If everything goes well I will have to start the job towards the end of March. The job, if I get it, will be a great step up and I do not want to let it pass. My wife (US citizen) is a teacher and does not want to quit her job in the middle of the term. So it is possible that while the I-751 application is under review my wife and I will be living separately till the summer (about 3-4 months after we file the I-751).

I am wondering if this situation is going to cause problems/delays with the application. I have the following questions :

1. Do I need to explain the situation and that we may live separately for a few months in a letter attached to the I-751? Is this going to delay the review of our file?

2. Will our USCIS center where the interview may be conducted change from the east coast to the west coast?

3. If I get the job, my wife will quit her job in the summer (about 3-4 months after we file the I-751) and move to the west coast. It is uncertain at present whether she will get a new job quickly. I know that we do not have to provide financial support documents with I-751 as my wife had to do with the original application. But will the USCIS raise a problem about financial support if we explain the situation. Obviously, I will still be earning enough to support the family.

I would appreciate any input from the knowledgeable members here. If you have been in a similar situation please let me know how you handled it. Also, do you recommend discussing the situation with a lawyer or an USCIS official.

You said you're going to be filing in March but is that the date of expiration of your conditional green card? If not, why not wait and see if you get the job first and then apply (as long as that doesn't bring you near or past your GC expiration date)? That might makes things easier as far as filing goes because then you won't have to worry about transferring your case. Besides, if you move to the West Coast you'll be lucky to get an "upgrade" to the CSC which is processing cases loads faster than VSC right now :P Also, there's no guarantee you'll even be interviewed; only a select few cases with the ROC process get interviewed. If you do end up on opposite ends of the coast when filing, I would definitely include an explanation with your application. It won't delay your case. Maybe include affidavits as well (not required but may help in certain "uncommon" circumstances like yours).

Financial support is not an issue for ROC. You don't have to provide any form of proof for income whatsoever. I remember even specifically asking this in our AOS interview; I asked "If I stop working when we have children will this be a problem [as I am the USC and my husband is the green card holder]?" I was told "No, we really don't care as we'll have no way of knowing." Very unconventional response but a good one nonetheless :blush:

If you're approved at the interview it shouldn't be too long until you get the GC in the mail, about 10 days or so (approximate). If you're approved without an interview then you'll get an approval notice and your Green Card in the mail.

File 90 days before your green card will expire. Don't send it in early (before the 90 days prior) but I recommend sending it in at least a week before your GC expires so they receive it in time. There's no "renewal" form to fill out - just the I-751. You mentioned that you haven't been saving documents for the past 2 years but you'd be surprised how much you can probably come up with. Any joint accounts you have together (bank, insurance) should be able to issue you old statements from the past 2 years which you can print out and mail in. USCIS wants to see legitimate evidence over the course of the past two years so if you only send the current month's statements, you'll probably receive an RFE. Proof of same address is also important: copies of lease signed together, mortgages, are always great evidence. If your license both show the same address, copy that and send it in. Do you have each other listed as beneficiaries on 401k accounts or each other's life/health insurance? Send that in. If you feel your evidence is lacking, get some friends and family to write affidavits.

When you file, you'll get an NOA1 which will extend the conditional green card status for 1 year. You should be able to use this to extend the driver's license and you can definitely use it to travel outside of the US (some DMV's have denied the letter as evidence but some have accepted it).


And if approved, I still have to wait another 6 months after to apply for new green card?


Not sure what you mean here. If you're approved for the I-751 application, you'll receive a 10-year GC so no need to reapply again in 6 months.

Not long at all. Once your service center receives your application, they'll issue the NOA1 (usually the same day). You should get it around 1 week from when you file, depending on the mail service you use to send the package.

Hi! My husband and I are here in the US. We have been married for less than 2 years, so we have to “lift the conditions” prior to our 2 year anniversary of entering the states. I understand that I can apply 90 days prior to my entry into the States. We are planning however, to visit family in Canada at the end of July 2012 (which is when the 2 year anniversary will be). I will be applying right at the start of those 90 days, but worry that the entire process won’t be completed in time before we leave for Canada. Am I allowed to travel while my condition is being lifted? Any help would be greatly appreciated!

You can travel but you must wait until you get your NOA1 which extends your conditional green card for one year. The expired Green Card and original NOA1 letter together serve as travel documents. I wouldn't suggest leaving before your biometrics is completed though because you don't want to miss that. They're usually scheduled around 1 month following when the I-751 is filed.

Our 90 day mark is coming up proceeding my expiration of my green card.

I have two questions:

1. can you send in your application early?

2. do they always ask you to do fingerprints? the reason I am asking is because I will be out of the country for 4 months. I will be in europe and it would be silly for me to come all the way back for a 10 minute finger printing session. Is there anyway around this? should I communicate this on my cover letter? Would it be possible to do fingerprints at an Embassy in Europe??

No you can't send it in early. As the previous user stated, they will send it back even if it's 1 day early so don't bother. Secondly, yes you have to get your biometrics/fingerprints done. They usually schedule within a month of filing the I-751, depending on your individual support center's availability. You can't miss your biometric appointment, if you don't show they consider your application abandoned. I've never heard of anyone including a request to hold off on scheduling the biometric in a cover letter and I'm not certain it would work. Even though it would be silly to come back, it's better than losing your legal permanent resident status. Best of luck!

My questions are:

1. Am I missing anything else (besides the standard stuff needed with the form like form, payment, copy of green card and cover letter)?

2. Bank statements: I'm a little uneasy giving out our bank account numbers on them; is it okay to black them out or something?

3. I never had an interview for AOS as it was transferred straight to CSC. Does that mean my chances of getting one now are higher?

4. How tough is this stage compared to fiance visa and AOS? I've been out of the game so long, I've lost my hardcore meticulousness.

Everyone seems to have already answered most of your questions so I would just add that ROC is a pretty painless process but a lot of waiting. More so than AOS definitely (in our case at least). Chances for an interview are pretty low as they pull people in randomly or if you're a "red flag." Best of luck!

Does he have to be here for this part of the process or can he sign papers before he leaves??

He doesn't have to be here necessarily. You will need him to sign the application as you are filing jointly. There's a small chance of an interview at this stage and there's not way of telling whether or not you'll get called in for one (seems to be either random drawing or if you raise any red flags). If you do get an interview he will have to go to that, yes. The process is taking about 6 months at this point so he may even be back before you get approved/an update. You should get your biometric appointment about 30 days after filing but you can go to that alone. Good luck! :thumbs:

I wouldn't worry about your holes since no where on the applciation or instructions does it say not to put holes or staples. Although it's probably good advice for the rest of us not to do that.

Quick question though: on the thread about the ROC application being denied all of the responses were saying that ANYTIME you send anything to USCIS you should get signature confirmation because that way you have a name of who is liable if something goes missing. I know in that thread the poster said they sent back the RFE docs, but USCIS has no record of receiving it. So which is, ask for signature or not? Or, if you file at the beginning of your 90 day window you should ask for signature, but if you file at the end and can't spare a day, you shouldn't?

There's nothing to say that you have to change your name after marriage - some do, some don't.
