K-1 Fiance(e) Visa Process & Proceduresi need ur help please

as long as you comply with all requirements.
have a standing relationship of 2 years.
fiance can provide an affidavit of support.
you have a cenomar. and nbi clearance. and birth cert.
have pictures, emails, letters, etc to back up the existing relationship.
fiance has visited you in the philippines at least once.
you have passed the medical exam.
he has filed his income tax return.
hhhmmm... what else...
nah i think thats basically it. theres tons of threads that provide you with answers on what you need.
but really now, just comply and before you know it you will be with the love of your life.

age and profession does not affect anything at all. this is all about proving you have a relationship and proving that your fiance can support you.

good luck!

K-1 Fiance(e) Visa Process & Proceduresproof of ongoing relationship??
my fiance filled out the I-129F's "how you met" with just a few sentences. and sent some reasonable amount of photos to back that up. but they mailed us an RFE saying they needed more. and that RFE gave us a dreadful 2 months delay, missing our christmas plans together.
so as the other poster said over here - the more ammo, the better.
we sent back tons of pics. tons of photocopies of anything and everything about our relationship. and sure enough we got the approval in days.
when i got to the interview, i had about the same stack of evidence to present them. the officer at the embassy compared from folder to folder - the copies we sent USCIS and the copies i had on hand at the embassy interview.
it is a case to case basis though, the philippines being high fraud too. who knows, you just might breeze through the NOA2.
but then again, the more ammo, the better. no wants an RFE.

and those are my two cents on this.
uhm make that four. good luck!

I was wondering about the you must met in person within the past two years ordeal for the K1-Visa process.

My situation is that I met my fiance from Spain online through Myspace Sept 07. Then we start to getting to know each other, and the relationship turn into a love relationship, then met her in June 08 in Europe, then she come to USA to visit in Sept of 08 til Dec 08, then I come to visit her and family in Spain Dec 19, 2008 til Jan 5, 2009 (this was when I ask her to marry me). She's coming again in March of this year (09), then I'm flying back with her to Spain in June of this year 2009.

With the "the two people must have met in person within the past two years" rule, am I eligible to file a petition for the K1 visa for my fiance in July 2009 since from July 07-July 09 we will have met a total of 5 times? Or I have to wait til Sept 2009 to file because that was when we met online Sept of 07?

Thanks for your help.

Success in the visa process requires the ability to read carefully, interpret literally and answer honestly and accurately. This will be critical many times in the process. If your language skills are not sufficient to understand the requirement to meet within the past two years, you are likely to need assistance from somebody with better skills, whether an attorney, friend or family member.

Jesus pushbrk --- do you need to reply in such a condescending way to the poster? Get off your high horse, that was utterly rude and uncalled for.

I agree...in a nice way he just called the OP illiterate. As i said, its prolly ppl are just reading the requirment too fast and not understanding it to the fullest.
I do agree with reading everything carefully and slowly.

and yes i agree too. that was insulting to the OP. he just wanted to be sure. and dont we all?

K-1 Fiance(e) Visa Process & ProceduresDenied entry to USA

ive been visiting the US every year since 2003. and i head home back at reasonable times and i dont overstay.
but every year i always get a grumpy cranky immigration officer.
and they all said immigration questioning should take an average of 3 minutes per person, but nah not me... i always got questioned longer. and with stupid questions like ... why are you still single? how can you save money if youre always travelling?
argh.
but my K1 got approved with no trouble at all.
so chin up. and good luck.

My girlfriend and I have only met five months ago, yet things developed quickly between us. We are both so in love with each other and we both take our relationship very seriously. This month I filed the petition. We badly want to be together and start building for our future. I'm just worried that CSC or the embassy may think that our relationship is bogus since things happened quite so fast. Do I have the reason to worry?

Like I said our relationship is legit and we are both very much in-love.

Remember, she is the one to be interviewed in a few months. The obvious question is, what prompted her to look overseas through her best friend? Was she interested in rejoining her friend and getting a green card - and you happened to be available? Photos with her family together with you, different places you went together are part of the story. But if there is reason for the consulate to believe it's all about getting to the US, and not all about you, then she'll need to be persuasive during the interview. A second visit would help make clear that this is all real.

oh and i dont think "the obvious question" is a problem. huh.gif

QUOTE (crazy.about.shada @ Jan 26 2009, 12:49 PM) <{POST_SNAPBACK}>
WOW!! Not even one person encourages us to start with that. It seems that you are all sure that they won't approve the petition, will they?!! Can't I just say that we hadn't met because I was denied a visa.

Anyways, I think that meeting in a neutral country is the best thing to do. In that case, I will need to keep some photos for us and copies of our tickets maybe. Anything else?!!

Any other opinions, please.

its not that we dont encourage you.
the thing about VJ is, you ask for their opinion and you get it.

when we started the whole K1 process, i thought it was just sending papers and stuff but it was more than that. not to mention the expenses, all files you have to carefully lay out and updating your papers... and then the dreadful wait. its emotionally draining.
K1 or K3 or any process having family or loved ones come over to be together is also a pure test of love and patience. and evidence of that love or relationship.
im sure many would agree that it is a rettible waiting game but all worth it, believe me. blush.gif

so if you cant comply with meeting you fiance then dont go through it cos other than the fees, the paper work and waiting and all... its just gonna fall on frustration.
meeting in a neutral country might work.
but just remember the basic need is... you have to meet.
and i really wish you guys will. smile.gif
4 years in a relationship has gotta be something worth trying everything for.

best of luck. heart.gif

youre good.
we didnt have enough phonecall records, tickets or receipts together... etc. although we got an RFE.
but we sent more of what we just had - more pics and emails and chat archives and just carefully provided the other requirements.
and got approved - when all i had was a thin envelope of evidence and others had a whole stack of them.

this is just strange. you probably met the requirements of presumptive death but still they werent satisfied with it.
as for your title -- denied because of failure to establish that the two of us have met -- i think the whole presumptive death holds the bigger part rather than the establishment of meeting.

its just wierd. you have all it takes to be approved. sorry to hear.

Hello,

I am going with K-3 and about to get the interview date.. I am wondering something.. I lived in the state from 2002 to 2005. I went there with tourist visa then changed it to student visa.. I did not over stay there.. I never did anything criminal.. I got back in my country before my student visa expired. I am wondering if that can be a reason to put me in AP to investigate more about my background in the state... When does FBI investigate people who used to live in the state? I was told living there would be an advantage not disadvantage, now i am confused sad.gif

Thank you so much in advance!!!

no one knows. cos no one dared to open it.
but im sure its papers from the embassy and from the medical exam we all had.
just follow instructions. those papers are important when you get to your POE.
and it should be hand-carried, not with your checked-in luggage.
so bring it with you when you fly out - in your carry on bag and hand it over to the immigration officer ar your POE.

So what should i do?Call st. lukes and ask for an appointment or just wait for an appointment coming from the embassy?

hi. my interview is on january 7, 2009. so a day ahead of you.
medical exams should be 1-2 weeks before the interview. but i might be having mine earlier because im pretty certain of having my period middle of this month or maybe the end. to be sure i will have it early.
you can call USEM and ask them to email you the appointment letter for st. lukes - thats what i did.
but you will also get one mailed to you. so now i have one that came by mail and one on my email account. either way, bring that form with you, your proof of payment, pictures, etc. (requirements for the medical exam are on the manila USEM website)
you dont have to call for a medical exam schedule. all we have to do is show up at st lukes.
its first come first case basis. so we should be there early morning so to finish it all in one day - if there are no findings.

good luck!

US Embassy and Consulate DiscussionK1 letter of intent question
i got this from the VJ page what to send when K1 approved

1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).
2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.
3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).
4. I-134 Affidavit of Support form. Ensure it is notarized (by a US Notary Public), with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.
6. A copy of the NOA2 that you received in the mail.
7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

now the question is...

on the statement that's on bold print... do i have to ask a letter of intent from my fiance?
i already have his paystubs, income tax returns, and affidavit of support.
should i ask for a letter of intent from him too?

thank you for your answers. happy holidays...

Hello, guys. I just wanna ask in behalf of my fiance. I am preparing for my interview documents and my fiance is about to send all the documents that I will be using, he is about to send it to me via FedEx one of this days. My fiance downloaded the new I-134 Affidavit of Support from the USCIS website , this version (Exp.05/31/10) . I am just curious is it true that this new form does n`t need to be notarized. My fiance said there is no need for it to be notarized since it is stated in the Execution of Affidavit (cf. from the I-134 instruction . )it says there" For this reason, it is not necessary to sign Form I-134 before a notary , nor to have your signature notarized after you sign it." because its under penalty of perjury under US Law. I did n`t understand it as much as he explained to me so I am still insisting him to have it notarized. I admit , it gives me confusion. I really don`t have much idea about this Law. I was just avoiding any problems in our documents.I guess I am just so paranoid ! though I understand I was stuck to the idea that it is still need to be notarized.

But we have it final now, he sign this New version of Affidavit of Support and its not notarized anymore, but he attached all his supporting documents. Are we all set for this papers? Do you think we comply all the requirements needed?

Does anybody of you here use this New Form and done with their interview?

Just need some insights about this. Thank you and Merry Christmas! We wish you all good luck for this New Year! God bless!

Sincerely ,
Netscot

ours was notarized just to be sure.
