QUOTE (CaNdiD wiTcH @ Dec 11 2008, 04:30 AM) <{POST_SNAPBACK}>
Hi everybody.. I know this question would sound stupid but here it is..

Is the visa process for spouses of MILITARY and PRIVATE CITIZENS different? (She said that she doesn't know the process as her husband is doing it for her)

Can a military hubby get his wife a visa and take the said visa with him here in the Phil? (I know it is impossible as I am reading the forums in VJ but I just wanna make sure that my so called "friend" is making a fool out of me).

Thanks..

nah. my fiance is also in the military and if that was possible well then we should have done that - got married here and when he left let him get my visa... etc... etc... etc...
but i dont think it is posisble. so tell your so called "friend" to come to visajourney.com. read and learn.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow do you maintain your Long Distance Relationship?
all my relationships were long distance. but this one was the worst and best.
worst cos its the farthest. im in the PI and he's in the US.
worst cos traveling is soooooooo expensive and we can only get off work once a year.
best cos its still working out good despite the minuses.
we got skype. recently i got vonage. theres always yahoo messenger.
long distance relationships are always thought to be no good.
trust. communication. understanding. patience. commitment. respect.
any relationship will end if you have none of those.
this is my bf's first long distance relationship and weve been together for 4 years. and he always said that he wouldnt date anyone with a different zip code or if the drive to her house took more than an hour. lol.
well how about not another zip code but another country code?
and the drive meant a trip to the airport and a plane ride.
we only see each other once a year and take turns visiting.
it aint easy being away.
so trust - thats a given. any relationship will suffer without it.
communication - another given. we email each other, text each other, chat, calls - every single day. im not even gonna start on when he was deployed. holy #######!
understanding - ya takes a lotta effort. putting yourself in his place and vice versa. being fair. being selfless. sooo freakin hard but hey it works!
patience - this word will really shake the sanity out of you. like when your upset - people say count 1 to a million. i say - count a million and then recount.
commitment - staying strong. and no promises. but just being there for each other. no expectations. just keep working on staying together.
respect - now this is my favorite. cos all of the above mentioned dont mean a damn if there is no respect. respect for opinions, for different cultures, family and upbringing. respect for each others friends, respect to also have at least your own life too. respect your differences.
takes a lotta work to be zip codes away.
but who am i to talk - weve had huge and scary fights. harsh words. painful issues.
were not perfect. and s**t happens. but if you want it to work - you will make it work!
cos after giving space and time and analyzing it - we still miss each other in the end. and the fight was just probably stress from no sex. lol. man i dont know.
but i do know that if you pray real hard and ask God to bless your relationship and safeguard it... cherish your relationship (well you prayed hard for it, why not do your part and make sure that blessing is kept intact?)
oh and dont take anything for granted.
and dont let the phonebills scare you. lol. well i know we are.

good luck.

I had my interview for k-3 visa on dec 22. I was told my case has been temporarily refused for further administrative processing. we cannot give you a definite date when the processing will be completed, but the minimum time is approximately six weeks. there is no maximum time limit I was wondering if anyone has expericenced this and if they have recieved visa later how long this can take? Is there a chance of denial after they put in AP?
Thanks

did the officer or consul tell you the reasons? before telling you your case was temporarily closed?

K-1 Fiance(e) Visa Process & ProceduresPassport Help
my mother owns a travel agency.
here are the passport requirements....

1. Birth Certificate (BC) in Security Paper (SECPA) issued by the National Statistics Office (NSO) or Certified True Copy (CTC) of BC issued by the Local Civil Registrar duly authenticated by NSO.

2. Three (3) colored photos of the applicant taken against a royal blue background. Applicant should be in decent attire with collar. Photo must be of good quality, and must have been taken within the last six (6) months. Photo size: 4.5 cm x 3.5 cm. Facial image size: Not less than 3 cm. DFA has the right to reject photos that do not comply with specifications and international standards.

3. Proof of identity / Supporting documents indicating full name, date and place of birth and citizenship

4. If the applicant's IDs are not accepted, here are some alternative supporting docs. 2 or 3 of the following ... Marriage Contract, Voter’s Registration Record, PRC / IBP ID, Baptismal Certificate, Driver’s License, Government Service Record, Income Tax Return, Old SSS-E1 form/or digitized SSS-ID, School Form 137 or Transcript of Records.

A driver's permit will not be valid. It is just a paper with a blurred photo of the applicant and most often referred to as a claim slip to get your actual driver's license. A postal ID is not valid for identification other than dealing with the postal office. A bank ID? Or a bank passbook? I do not know what a bank ID is. But if she meant an atm card with her photo or a bank passbook with her photo, those too, are unacceptable. With the SSS, her employer should help her with that. Social Security over here is different from the US. We live in a 3rd world country where the government system only works 1% of the time. Something you will have to accept as we have also just lived with all its flaws. We hate it but we cant do anything about it.

Good luck. God bless you.

on the website our case was "touched" AUGUST 13, 2008. my fiance keeps calling and all they tell him is to wait for it.
this morning we checked the website again and it said "touched" SEPTEMBER 19, 2008. but still no RFE in the mail.

what does "touched" really mean?

you are just a month ahead of us regarding the filing date. you should be calling now. i mean your fiance. and tell him to make sure they take note of his calls. my fiance called and called but they claimed he never called. thats why our case was closed.

There is a reason why we call it the USCIS mis information line. Sorry to hear you were getting the run around. I hope things are back on track soon. I highly doubt that everytime your fiance called the USCIS line that they got a person "they sound asian and can barely speak asian"? They're not required to speak asian as far as I know. If he had trouble understanding the operator due to their accent, he should hang up and call back again, or better yet, tell them he can't understand their English, and ask to be transferred. Take out buffet? That's not very nice.

like i said. no offense.
i am asian. my fiance is asian. but born and raised there.
he said the person on the other line sounded like a take out buffet. he did call again. and again. and again.... and again.

ok. the accent. they did not speak in any asian language.
i typed that wrong. sorry. my bad.
i meant they speak english but with the asian accent which made it hard to understand.

K-1 Fiance(e) Visa Process & ProceduresK1. Word of advice.
here's the story...

filed ... march 31, 2008
NOA1 ... april 16, 2008
RFE sent ... august 12, 2008
touched ... august 13, 2008
touched ... september 19, 2008

for the record, my fiance never got any notice or RFE in the mail. nothing. and everytime he calls, they keep saying "we already mailed you your RFE. if you dont recieve it, call back in 1 week."
then 30 days passed ... the weekly reply was ... "sir, please wait for it in the mail or call back in a week's time."
and it has been like that since august. huh.gif

today he called and guess what?
they said our file has been forwarded to the "abandoned case" department. because the petitioner never called or followed up. so it's now marked as abandoned and soon to be a "closed case."
what about all those calls every wednesday when my fiance is off? he never misses a week.
so now another RFE has been sent (duh!)... headbonk.gif

word of advice... if you talk to someone from the USCIS and they sound asian and can barely speak asian... request for another officer or call back or get their name or make it clear to them that you want your call to be recorded and noted on your file.
no offense. i am asian. but hello? shouldnt USCIS get someone who can speak and understand english well? blink.gif
my fiance always got answered on the other line by some asian sounding employee of the USCIS that actually sounded like a take-out asian buffet delivery call. gggrrr...

this time he got her name and told her to write down everything they talked about. and to put on record that he called every day off he got. later today, her boss from the USCIS called my fiance back and told him to wait for another RFE on the way... argh. mad.gif

anyways... vj people... keep calling when your case is pending and make sure they take note of your calls. i never want anyone to be the in the same situation we are. my fiance's bday is next month and we had plans. we have been set back to a month already and possibly another two months in the wait. huh.gif

good luck all.

QUOTE (Anariae @ Nov 25 2008, 11:27 PM) <{POST_SNAPBACK}>
Hi everyone,

Well, I just found this amazing site today but I now have a splitting headache! I spent the afternoon bawling my head off after coming to the realization of how long it would actually be before my sweetheart and I can be together. Maybe it was our naivete, but we honestly thought he could move here within a few weeks!

So, I've spent the afternoon/evening looking over the site, reading the FAQ's and the Guides, and am still confused about a few things. First of all, it seems like the fastest process would be Direct Consular Filing. Is there any reason why most people would choose a K-1 over DCF? And I thought I read somewhere that once you apply for the K-1 visa, the foreign national can't return to the US until it has been approved. Is this accurate?

Also, before we began learning about this process, our original plan was that he would have an employer here sponsor him for an H1-B visa so that he could move here relatively soon and begin working. Then we would get engaged, and go through the K-1 process. Would going the H1-B route get him here faster than the K-1, and if so, would he then need to leave the US in order to complete the fiance visa?

Any and all help is greatly appreciated. And thank you in advance to everyone who has gone through this process and is willing to help others get through it without going crazy!

Thanks again,
Anita and John

K1 is probably still the way to go. good luck!!!

To you all out there....I need your advice!!
Looking through so many threads I figured that something is missing in your paperwork we sent in this month!!!! I think it´s Number 18 on the Form I-129F, it says did you meet within the past 2 years - so we just made our cross for yes cause we´ve seen each other already three times this year, so we added boarding passes, pictures, flight iteneraries!! But like it seems we totally didn´t see the part of describe under what circumstances you met! So what should we do...just wait or write a short letter of circumstances and just send it to VSC????? Please help cause I don´t want our paperwork to be delayed when they finally start working on it!!!!

you will probably get an RFE like we did.
when we sent out our papers we realized we didnt give much details on how we met. it was like... boy meets girl. done!
there were no other side stories really.
so wait for the RFE and do whatever you can. youll be fine. good luck!

K-1 Fiance(e) Visa Process & ProceduresThe best way to do this?
QUOTE (mermefer @ Dec 6 2008, 08:29 AM) <{POST_SNAPBACK}>
Hello, I've searching so long for a forum such as this, and FINALLY I found it.

I met my GF(soon to be fiancee) online. We have been together for about a year and a half now, and yes we have met twice. I am a US citizen and she's from Dubai, UAE. We really want to live together...however her parents would highly disapprove of something like this...because I'm not of their religion. The only option we see is her running away from home. Our biggest problem is how she would get here....currently all she has is a visitors visa, her family is planning on visiting the US this upcoming summer for about a month. We want to do everything as legal as possible...we were thinking of having her run away while she was on her trip...but I don't see any way of her becoming legal if she does that, is there any way? If we were engaged and I applied for a fiance visa she would have to wait until that got approved before legally moving here and marrying me, correct? We really are at a loss as to what to do...another problem is that the legal age in UAE is 21, and she's 19..almost 20, we don't know if she would need her parents authorization to apply for a visa like that.

Also about how much would I have to be earning in order to prove that I can support her when she moves here? It's just so confusing trying to figure out how to do all of this without any of her family figuring out...we really hate to do it this way but we don't see any other options. What would you all suggest? that we just wait until she is 21 and figure it out then? or is there any other way we can do this? Our ultimate goal is for her to come here...and gain permanent residency, so she can work, etc..

waiting for 21 would be a good idea. she would be legally able to decide on things.
good luck!

thats relatively normal. we got our noa1 in april. and our noa2 in november. plus the RFE.
to be sure, keep calling USCIS. make sure you talk to someone and not just an automated answer. and jot down the name of the agent. just ask - who am i talking to? and also tell them to take note about your follow up and always give details. like when you got your noa1 and how long youve been waiting, etc.

Does anyone know how long security checks last at uscis? i am currently waiting for the noa2 of our k1 visa, and i was told by my congressman that our petition is pending d/t security checks.

youre a march filer? how come its taking a long time for the NOA2?
normally it takes 3-4 months unless an RFE comes up.
were april filers but we were dreadfully delayed. they said we had an RFE coming but we never got it.
and whenever my fiance called he would get the same answer - we already mailed it.
so after 30 days of waiting, he asked for them to check the database. he was told that our file was put on the "abandoned case" folder.
the reason? cos we never followed up on our case which was total ####### cos he called every week.
so he requested for the RFE to be sent again. we got it a month later... so thats 2 months delay.
and every time he'd call he would tell the operator/agent or whatever you call it to please mark it on our case that we called for follow up.
and we got everything right as expected - but after 2 months of nothing.

call USCIS. make sure you talk to someone and dont hang up till you get answers. your congressman will only give you the exact answer they give you on the website, or on the phone. but if you ask a lot of questions they will note that out on your file with them. and keep calling. everyday if it means that much - im sure it does.
oh and write down the name of whoever you spoke on the phone. so on your next call you can say ... i spoke to blah blah blah and she said they mailed my NOA2 but its been 2 months and i dont have it. can you send me another one?
or something like that.
dont take "wait for the mail" as an answer. its been a while. ask for action.
we got approved 7 months after our NOA2. well... at least we got approved nevertheless.

lots of luck!!!

Im just looking for a little guidance now if anyone can help
My fiance finished her interview they did not deny but delayed it
when asked what our plans were together she replied we wanted to have a child together and raise our family
we are also bringing her daughter over my income was sufficient for 3 but because she said we wanted to have a child they based it on 4 and told her either i had to show proof of substainable income or she would have to write a letter stating she would be willing to work but would also have to convince the consular that she was not doing that just to get the visa?????? i dont know what she should write because if she does that isnt she doing it just to get the visa??? and as far as substainable income i dont know what they are asking they said either or ...do they want me to find a co sponsor????
everyone said she should not say she intended to work that that could cause her to be denied a visa so i guess i am a little lost help!!!!!!

my cousin is an immigration lawyer in new york.
she said never to mention work in the interview. because the sole purpose of the K1 is to be with your fiance. it is a fiance visa. not a visitors visa nor a work visa. so to say you intend to work would raise suspicions. to say you wanna see the US would be a bad idea too.
answers should all be along the lines of... to get married, to be with my fiance, etc. anything beyond that would point to a visa denial or delay for further investigation.
building a family should not be mentioned. if they ask, just say... eventually in the near future, or something like that.
of course in the long run we would have to work and help out our spouses, thats a given. and the consul knows that.
bottomline is... just say you want be with your fiance and get married.
kids and getting a job should not be mentioned if possible.

thanks pretty flower so how do you think she can undo this
i mean they said they want a letter stating she would be willing to work i dont understand why they wouldnt just accept that there and would make her reschedule? and should i now start considering a co-sponsor or should we go with the letter a co-sponsor would be the only way i could get to the income they require at least for this yr

depends.
what was the consul's final word?
was the visa denied or delayed?
does she have to go back for another interview? and bring more documents?
you have to know what they want to determine a remedy for this.

delayed not denied she said she would not have another interview that either i had to show proof of sustained income or she had to write a letter stating that she was willing to work ,but as i mentioned according to the 2008 federal poverty guidelines i more than exceeded the requirement for a 3 person family and 4 for that matter i just saw the note and it said i had i was insufficient for 3 but i made over 30k so how can that be
the only thing i can think is i do contract work for a union so i have to work for multiple contractors i submitted paystubs from each and w2's etc so unless the consular was only looking at 1 i dont know what they want

where would you submit this letter and proof of sustained income?

to the embassy

Im just looking for a little guidance now if anyone can help
My fiance finished her interview they did not deny but delayed it
when asked what our plans were together she replied we wanted to have a child together and raise our family
we are also bringing her daughter over my income was sufficient for 3 but because she said we wanted to have a child they based it on 4 and told her either i had to show proof of substainable income or she would have to write a letter stating she would be willing to work but would also have to convince the consular that she was not doing that just to get the visa?????? i dont know what she should write because if she does that isnt she doing it just to get the visa??? and as far as substainable income i dont know what they are asking they said either or ...do they want me to find a co sponsor????
everyone said she should not say she intended to work that that could cause her to be denied a visa so i guess i am a little lost help!!!!!!

my cousin is an immigration lawyer in new york.
she said never to mention work in the interview. because the sole purpose of the K1 is to be with your fiance. it is a fiance visa. not a visitors visa nor a work visa. so to say you intend to work would raise suspicions. to say you wanna see the US would be a bad idea too.
answers should all be along the lines of... to get married, to be with my fiance, etc. anything beyond that would point to a visa denial or delay for further investigation.
building a family should not be mentioned. if they ask, just say... eventually in the near future, or something like that.
of course in the long run we would have to work and help out our spouses, thats a given. and the consul knows that.
bottomline is... just say you want be with your fiance and get married.
kids and getting a job should not be mentioned if possible.

ok wrong message sent. no problem narzel.
i havent talked to my cousin in weeks but i remember her warning me not to mention work or kids at the interview.
its a given but it should not be said.
consuls take everything word for word and anything you say can and will used against you. or something like that. lol.

K-1 Fiance(e) Visa Process & ProceduresWhat is RFE???
QUOTE (dyoon7979 @ Dec 26 2008, 01:29 PM) <{POST_SNAPBACK}>
Got it..

Will they let me know only if they need something? or will they let me know if they need nothing as well?

will I get something in the mail either way???

QUOTE (mnieto @ Dec 26 2008, 01:09 PM) <{POST_SNAPBACK}>
You'll get a RFE only if they need further evidence....they'll let you know

you will get an RFE (request for evidence) after the NOA1. and as it says request for evidence, basically means they want more of anything and everything - more documents, more photos, stamped passport photocopies, receipts, more affidavits, or what not ... etc etc etc ... all for the purpose of supplementing and to further support your application.
but IF they are satisfied with your application, you will not get an RFE but you get an NOA2.
so this is just a waiting game with the ball in their court the entire journey and us waiting for what they throw back at us.
trick is to just comply and submit all papers required and to convince them of your bona fide relationship. then NOA1 to NOA2.
if not, RFE then comply... then NOA2.

this might help ... http://www.visajourn...?showtopic=4725

good luck.

K-1 Fiance(e) Visa Process & ProceduresQuestion on time???
QUOTE (gethere @ Dec 26 2008, 01:09 AM) <{POST_SNAPBACK}>
I have been reading some peoples stories on here and I am terrified! We rec'd our NOA1 Sept 15 and now we are waiting.....along with everyone else. We are really hoping for Jan or Feb but some people have been waiting for like 8 months with NO NOA2?????? Is there a reason this would happen? I am stressed out right now and I want that NOA2! But I also want to know is it possible for this to not be the quickest route (K1) I am wondering if there was a quicker route we missed?

same thing happened to us.
noa1 in april. then a long wait... we got an RFE though around june.
and another long wait. but this one as like no light at the end of the tunnel. so my fiance started calling them every week. cos the website said they sent the RFE but no rfe in the mail.
only then to find out our case was put under "abandoned files" cos they said we never followed up. which was total #######. cos my fiance called and called and even talked to an actual uscis supervisor. he said he would activate our case back and send us a new rfe.
so all things done with the rfe and all, noa2 in november.
what a long wait. and all because they said we didnt call.

so do the same i suggest. call them weekly if you must. and what we did was talk to an agent, dont just listen to the automated answer. talk to someone from the USCIS. get their names. and tell them you have been calling and following up your case and tell them to note it down that you called to check.
cos when my fiance called, they said - sir, you never called.
duh. he called every day off work he had.
that really pissed him off. so he said - well note it down on my file that i called today and im gonna call again tomorrow and the next day and so on...
so we got our rfe and noa2.

just pray you dont get an rfe like we did. just your noa2.
good luck!

K-1 Fiance(e) Visa Process & ProceduresRFE question
QUOTE (JulietteDumont @ Dec 29 2008, 05:36 PM) <{POST_SNAPBACK}>
Hey everybody,

Like you can see on my signature or timeline we got a RFE on december 11th.
We sent back what they needed 6 days after, we did as soon as we could cuz' they needed a divorce paper from me in France.
My man told me that he had to put the document needed + the RFE mail in a specific envelop (with RFE written in red all around the envelop).
I wanted to share some experiences here cuz' I thought that after you sent the document asked, the approval (NOA2) arrives pretty fast.
I was hoping to get approved before christmas but nothing. If you guys could give me your experiences and what you know I would appreciate it.
We are supposed to get married in the middle of march in Vegas.

Love
Juliette

there is no telling how and when everything works with the USCIS.
look at my timeline. we had a messed up RFE experience too. we kept calling and they kept saying it was sent by mail but 2 months passed and no RFE in the mail. until my bf talked to the supervisor and demanded to know what the heck was up.
thats when we got the RFE in the mail at a good time but yeah - after two months.

you can keep calling like we do. but for sure, we are under their mercy until that much wanted NVC letter comes.
good luck.

or have your partner join you through a visitors/tourist visa and marry her then change status.

Probably not best to be advising someone to do this. If you mean for them to come here on a visitor's visa with the intent of marrying and adjusting status, then what you are advising is visa fraud. I would tread lightly with such advice.

To the OP: Of course it's worth it if your fiancee is worth it. It's time consuming, frustrating, and can be costly. But is it worth it? Heck yeah.

i did not mean it the illegal way.
i meant if the fiance already had the visitor's visa, why not marry there? since the OP's problem here was how much they were gonna spend and if it was worth the expense.
well my bad.
i meant IF the partner already had a tourist/visitors visa.
i had a tourist visa and still came flew back to the PI then apply for K1. if i only knew it was that costly and with USCIS delaying things, i should have just stayed and got married. but still regardless... weighing it down... i was glad we went through the K1 cos it got me thinking if i really wanted to be with my bf and vice versa.
USCIS really shook the insanity in both of us. and made us realize how we really felt for each other.
it turned out to be a blessing in disguise.
you truly find out how important you are to the other person. everything was worth it.

K-1 Fiance(e) Visa Process & Proceduresis applying for fiance visa really worth it?

if you have other choices then do it.
K3 or spouse visa.
or have your partner join you through a visitors/tourist visa and marry her then change status.
but if those are not possible, then do the K1.
true it costs a lot. but its up to you and your fiance to sacrifice on the filing expenses/application fees and what not.
i am not from venezuela but i think in a way we are the same or almost the same in this whole process.
is it worth it?
yes.
in a way it tests how strong your relationship is, how much you want to be together, etc.
but other than the lovey dovey part, it is the better way to do things.

good luck.

K-1 Fiance(e) Visa Process & Proceduresi need ur help please

as long as you comply with all requirements.
have a standing relationship of 2 years.
fiance can provide an affidavit of support.
you have a cenomar. and nbi clearance. and birth cert.
have pictures, emails, letters, etc to back up the existing relationship.
fiance has visited you in the philippines at least once.
you have passed the medical exam.
he has filed his income tax return.
hhhmmm... what else...
nah i think thats basically it. theres tons of threads that provide you with answers on what you need.
but really now, just comply and before you know it you will be with the love of your life.

age and profession does not affect anything at all. this is all about proving you have a relationship and proving that your fiance can support you.

good luck!
