K-1 Fiance(e) Visa Case Filing and Progress Reportshas anybody been on AP due to request for a police certificate?

We already sent the UK police certificate and USEM already received it last february 12 and was forwarded to consulate. During the interview, the consul said that if we provide this, the visa will be issued.  Has anybody been in this situation? Can someone give me an estimate or timeline on how much more days or weeks do we need to wait for the result of the issuance of visa please? We are on our 10th month for this K1 visa which is supposedly should have been "faster."

I called USEM yesterday and they already received my fian?e's police clearance. Will I be getting a notification from embassy that they received it or they started to review the case again? or will they just notify me once its done?

Yep, if you have a miserable attitude and/or are willing to try to suck the joy out of a someone else's quick approval, this is your thread. This is where you can feel free to inflict your pain on others and not try to disguise it as mere jealousy or envy, but call it what it is: Pathetic.

Sign up below to climb on the Negative Nancy Bandwagon! It has an itinerary of all sorts of places: the first stop is Karma -- this is a great place where you reap the rewards of what you sow.

Show your determination to wallow in self-pity; this is the very dark and special corner of the Internet where you can weep the venomous poisonous tears of failed hopes and worst fears - and don't worry about flooding the place with it because overflow into other threads is expected and already happening. Another advantage: there's a black hole in the floor that you can fall into and infect all the others with your unhappy unluckiness.

Come in! Come in and sit on your very own Pity Pot - it's got your name engraved on the front and a list of all the people who unfairly got approved ahead of you straight at the bottom so you know precisely who to ####### all over. Also included: a nifty bag where you can hold all your grudges together in one place. There's an extra pocket for your sunglasses; you won't need them because there's nothing bright in the future, right?

The stench is normal - it's caused by all that overwhelming support you get from the other trolls holding your hand as you all pollute the atmosphere with your complaints. You know you suck, so suck it up! Never surrender to the idea that The Lucky Ones simply trying to enjoy their good fortune are merely happy, it's for sure that they are intentionally try to make YOU more miserable. Kill them with unkindness! Make lots of posts about how evil they are to be smiling when you yourself have nothing to smile about. Stomp your feet - don't forget to view their profile and try to find information to insult them with, either, or you'll lose your Pyrrhic Victory card.

BLAH BLAH BLAH , this was a nice and happy thread till you came in. so why dont you go back to youre little hole and keep quiet.

Just because some of us have a hard time being apart from the ones we love and exercise the right to moan doesn't mean we're wallowing in self pity or trying to negate the success of others that have been approved before us.

No, this actually wasn't a very "nice and happy thread" at all. You're kidding right? Scroll up and look at all the miserable icons used on all the posts...you'll see how miserable this thread has become. It started very happy and very uselful. Then it just degenerated into slamming the USCIS and later, the people who got approved earlier than people who filed earlier. It's a bit unsettling to hear all the terrible, negative views expressed against the USCIS by people trying so desperately to get into the USA. I can't wait to get to the US to be with my fiance. I'd much rather be approved in 2 months rather than 4 or 6. But I knew this would take some time. We all did, right? We all are having a hard time being away from "the one we love" but, sorry, yeah...you are wallowing...at least some of the people here are...and some definitely are unhappy about the success of others. Jump over to other threads where one common poster here totally polluted a nice thread with her negativity. She's even got a nick name over there. We're all very close people. Just hang on a little longer and you'll all be together soon! Happy Thanksgiving to all the July filers...even the unhappy beneficiaries. You'll be happy soon because of all the hard work of the USCIS!!! smile.gif Send them a Christmas card when you get your NOA2! smile.gif Happy Happy Positive Thoughts!

I think that you are talking about me. You can say my name, I'm Juliette. You might be referring about a message I wrote in the "The fastest NOA2 in 2008 or someting like that". I was kinda rude, but I keep keeping my position. I will say it with other words : "I don't find supportive that people are showing their 2 weeks approvals while other people are waiting for more than 7 months. I'm keeping sayin' that this other thread sucks and is not supportive AT ALL". I'm not a negative girl, I posted more than a hundred messages on VJ, always postive and nice. But when I think that a thread sucks I have the right to say it.

Thank you guys for my birthday wishes

I agree about the border thing. I wish they'd give some sort of provisional paper that takes the uncertainty out of travel while this is going on. We could afford extra trips but who wants to roll the dice with $1500 and get turned away because a customs agent didn't get their coffee that morning.

iahmjpinoyDo you read your posts before you hit the Add Reply button?

Corinthians, yes I do read my post before I hit "Add Reply" button, otherwise my post would REALLY offend alot of ppl that don't like getting straight talk unsure.gif . I like to think that we're all adults and don't need our hands held cus we can't handle the short separation that we are going thru.... I'm sure everyone had a 'life' before meeting their SO, did that all of a sudden go away and now your life only revolves around your SO??? whistling.gif Sometimes tough love is hard to swallow when you keep feeling self pitty for yourself cus you're not getting what you want as you watch other ppl getting theirs... In real life, life is never fair....

Visiting your SO doesn't mean only coming to the US, how about visiting them in their country if you have the money so they won't risk getting denied and wasting the $1500 for the trip.. whistling.gif

Seriously, I just want to thank the ppl that gave me 'congrats' and in a way wish I didn't post my approval as it seemed to cause a lot 'moaing' by others..

Good luck to everyone and happy holidays... and speedy approvals to everyone!!! As I'll be leaving this thread as it seems more ppl are getting depress/upset as they see others getting approved, which is pretty sad...(yeah-yeah, I know, YOU have the RIGHT.. headbonk.gif )

Like I said before I'm very happy for you and it is cool that you sahred your happiness with us. I'm sure that if people said "bad" things it was not against you, it was just against uscis process.

That would be a good idea, some sort of agreement eg where we could visit say 5 times and then the paper is "used" up with maybe a time limit of say 2-3 weeks.
Would the majority of people go thro all this hassle if we were just going to stay illegally???

They want us to prove an ongoing relationship but make it so hard in terms of getting to see each other. Ahh well we'll be "home" soon I'm sure kicking.gif kicking.gif whistling.gif whistling.gif

INDEED ! The fact that we are doing the K1 process which is a pain in the butt is a good proof that we won't stay illegally ! We are following the USA immigration's rules and they keep being jerks ! An official document would be great. We should be able to cross the border any time we want with our NOA1 in hands. Before we began the K1 process Jamie called 2 times the immigration to ask if I can continue to go back and forth from France to the US (cuz' I was already doing it since december 2007, I stayed a total of 9 month in the USA but I never overstayed). The immigration officer said : We are positive, she can go back and forth, but until she get her visa K1 she will have to leave the US after the 90 days like all the other waiver tourists.
And now we are apart cuz' I can be denied... F*uck a duck (this one is especially for you Shannon ? Nick)

Soooo just to clarify IYO if circumstances have allowed you to see your SO during the petition process this stops your right to moan at the unfair way that applications are approved?? unsure.gif

IMO It is human nature to whilst being pleased that someone has the NOA2 to feel insanely jealous that it's not yourself.
There is support in abundance in this thread for ALL the JULY filers, but freedom of speech does allow us to voice our opinions whilst they may not be everyones opinions.

Lets hope the approvals start rolling in for all, especially for those that have sat in this July waiting room together for so long offering support & advise when needed! whistling.gif

Well, I actually had another chance to go back for 2/weeks, but decided my time off and money would be better suited to be used after she got her visa in hand. Everyone has the freedom of speech and voice/moan all they want about how unfair the way applications are approved, but some ppl just act like their life is going to end if it doesn't happen quickly. Some ppl will get lucky and get approved before the 6/months time frame, but trying to say ppl are not doing their job when they are not even over that 6/month processing period as stated by USCIS unsure.gif whistling.gif , IMO is just funny(I myself wasn't expecting my approval till Jan, even though Igor was stating Dec. and I've been looking @ the average of 4/months for alot of ppl).... I guess that's where stress handling & maturity level comes into play, some ppl have a better handle on it than others, IMO....

But on the same note, sometimes having too much time on your hand can drive you crazy... and seeing ppl get approve b4 you can push your buttons even more.. but with anything, I have a job that takes up most of my time and I also keep myself busy with family and friends, life goes on....

Wishing everyone a speedy approval b4 the holidays are over.... now excuse me while I go fight the morning madness @ the stores and try to get some holiday deals!!!!

Ingats lage!!!

P.S. - I do like the inscription on Shannon & Nick rings..

Well, I think that we should close this conversation. The problem is not you of course, I'm happy about your approval which means that USCIS is working on end of july petitions. I don't care if the process is long, I don't have to get married tomorrow. The stupid point is that during the process (while they are checking if we are truly in love etc...) you can be denied at the border. It is maybe not the case for everybody but I have enough money to go back and forth to the US, but I can't do it cuz' I could be denied. So I'm ok if they need time to approve my case but I find horrible that they want us to be apart. That sucks. Congrats on your approval, I hope to see many ones next week, and I just find unfair to force lovers to be apart.
I have my man, my dog, my apartment, my friends in Cali, and I just want to be able to live my life.

Happy Thanksgiving all smile.gif After a heartwrenching talk about postponing our marriage, I managed to coax the fiancé into bringing it forward - around late 2010. We were going to withdraw the petition but have now decided to still go ahead with it, but want to defer the issue of the visa. Would anyone know if this is a safe thing to do and how long we can delay it for? Or should we cancel and just reapply? I'm just worried that they might deny us if we try to apply a second time.

And again, thank you for all your sweet messages - it gave me so much hope to read of those who had waited years until getting married, and I can't thank you enough for giving me something to believe in. Even with this ghastly process tearing us away from the people we love, you are all so strong and positive - and I admire you all smile.gif

I think that when the embassy gives the visa you have 6 month to use it. You can ask before the end of the 6 official months for 6 extra ones. So 1 year after the interview. You kinda have the same timeline than me and I expect to have my interview end of january/beginnig of feb 2009. So if it is the same for you, you will have 'til January/Feb 2010 to get married. If I'm wrong please correct me.
If I was you and if you are 100% sure to marry your fiancé(e) I wouldn't delete your K1 to do it later. You might have problem with the immigration to explain them and they could giving you a bad time.

Where did you see august approvals

Here it is

iahmjpinoy
07/23/08 - Sent I-129F
07/25/08 - Recieved by CSC
07/29/08 - CSC sent out NOA
07/30/08 - I-797, NOA notice date
07/31/08 - Check Cashed
08/03/08 - Touched
08/05/08 - NOA#1 Hard copy recieved
11/26/08 - NOA#2 APPROVED in 119/days!! WHOO-HOO!!

Although I am happy for those who are approved I do sometimes let the jealous bug bite us. It is very fustrating because I have not seen Kai for 1.5 years now face to face. I get scared because what if it has been to long and they say NOPE SORRY..why did you not visit sooner...WELL MONEY YOU KNOBHEADS!!! DUH had I had money ..you bet we would be traveling every damn month!
It gets fustrating that they do not do it in order and I do not think it is fair!
YES I am very happy for you that got yours as YOU miss your loved ones as well. I just hate the fact that i see people who get to visit or get an NOA2 and I want to bawl...
BUT I know he will be home by feb I wont expect anything less then that..I wont HE WILL BE HOME IN FEB!!

Yeah, I have read the message about touches.

It's just like, what processing takes 2 days once you look at it. We have a clean app., no skeletons, etc. so what's up?

No idea what they have to do with these cases, the Q/A with the former adjucator doesn't really specify other than that they look over the documents you submitted. I'd imagine they have other things to check (such as in my case, Andy was present in the US when we filed, so I bet they have to check that he left).

Nothing here yet either, but I told myself from the beginning it could be easily December before approval. Most of you who filed CSC and are expecting NOA2 filed after me, so don't expect anything too quickly. tongue.gif

In the meantime... for those of you with some place to go tomorrow for Thanksgiving, enjoy yourselves. I'm trying not to get hung up on spending it alone.

yep. lets just all hang tight. uscis closes in 30 minutes for november so we can just rest assured we have a great December to look forward to! On the website you can read :

Your case may have a new "Last Updated" date and you may receive an Email Notification of your case being updated, without the status of the case changing. This is due to internal USCIS processing being performed on your Case. This will be reflected in the "Last Updated" date, but may not result in a different status message.

CSC doesn't seem to record touches either, I wouldn't get worried about it. If you read the other threads it seems like 90% of the people never get a touch before they get their NOA2.

Stressing about getting touched/not getting touched isn't going to make things happen any quicker, it will happen when it happens, it's the US Government we are dealing with, they work in their own way and nothing we do is going to change that.

Have to get all you June/July/Aug people out of the way so they can start on September. smile.gif Hang in there, yours is coming soon.

I'm not stressed at all to not have touches. The thing is that many people received by mail their NOA2 without getting any updates on the web site. The case status is still pending and the date never changed. I just wanted to know if it was the same for California and Vermont. Cuz' I think that maybe I got my approval but it is not showing it on USCIS website.

Do you think that the problem is for everybody or just for VCS ?
It is weird to not see more approvals on Igor's list, even if we (VJs) just are a sample of the K1 petitioners.
Maybe it is because their website is all fu**ed up ?
Maybe we can just know when our folder is at the NVC or when we get our NOA2 in the mail box.

Will I need to have anything translated for the k1 visa interview? I know the in Japan the police records are in Japanese and English but the birth certif is in Japanese. I know for a fact i need this translated for the AOS but what about k1 interview?

I can just tell you for France cuz' I don't know about Japan. You need official translated documents for your petition, but you don't need translated document for your interview. People who work at the embassy can understand the language of the country they live in. I think that you need english documents when you deal with the USA directly like for the petition or the AOS

Unless the French certificate is alot like the Belgian one, I wouldn't worry too much. Plus, you never know the history of that person, maybe there is more going on than just that...

I would hope USCIS has seen a French certificate before so it wouldn't be a big problem. All of these packets are made up of copies of everything; it's not realistic to send originals I think. 6 months without your birth certificate?

Well, the birth certificate is never the original. Only the french government has the originals. But you can get a copy whenever you want just by asking to your city court. And you are right about the fact that I don't know the history of that person. I will try to not getting worried, but the closer I get to the 4 months NOA1 anniversary the more nervous I get.
I'm so tired of this waiting, if we knew that before we would sent our petition at the beginning of the year. But like several person we thought that we could get married whenever we wanted...
My man arrives in 5 days in France so I'm happy, but we can't stop to think that 10 days after we will have to say goodbye to each other again and it is horrible ! And the worse like everybody here I think, is that you don't know when you will see your loved one again.
I don't understand why as a husband and wife to be we don't have the right to go back and forth just to be with each other. I find crazy that you can be denied at the border because you want to see your love. Whatever, I will stop now cuz' I could write page and page about the stupidity (sp) of the K1 process

Hey guys,

I posted this as a reply on the june forum, but maybe you can tell me what you think, I'm closer to you now my friends of the July waiting room wink.gif
I have to admit that I'm scared to receive a RFE now, even if it is the first time that I read this :

I have to admit... I'm going a little nuts here. How I wish they would process the petitions in the order they receive them!

I'm more than just a little nuts, since this RFE story my life is centered around USCIS, it's driving me crazy, I hope it will soon be over , I can't stand it anymore, I miss my baby more than ever.
Do you know exactly when does the file go through the security check?
My fiance thinks our delay is because of our RFE, they asked for a copy of the original of my divorce certificate (we sent only the translation into English), because he says the certificate doesn't look too official (it's a 2 page document , signed, stamped so very official smile.gif ). I don't know what to think anymore....Maybe the file is stuck at the security check (I don't know if it's done before or after a RFE), maybe our files is lost on someone's desk.
Sorry to bother you guys with my problems, my thoughts....I lost my optimism after this RFE, it's not me anymore.

Ok, I'm totally worried now. In France our "divorced certificate" is just our "Birth certificate". On our birth certificate we have the mentions "divorced" with dates and place etc... I only sent my translated copy because they ask : All your documents have to be in english.
So it was translated by an official translator, with stamps, dates signature and mention : "Mister X sworn translator to the court of appeal of Douai, I certify the within and foregoing is a true, full and correct translation of the french original instrument as the same appears on record and file in my office etc...."
Do I have to be worried ? I really thought that they ONLY wanted the official translated document.

The first quote part is from this Belgium girl. My reply is beginning with "Ok, I'm totally worried now..."

Congrats on all the recent approvals. I hope everyone has prepared (or are currently preparing) for the interview stage and informing themselves about the AOS paperwork.

My folks offered tonight to fly Andy and I to Texas to get married so they can attend as well as my sis and brother-in-law (since our earlier hopes of a Vegas wedding we realize now we can't afford). I'm really touched by their offer and it makes me feel a lot better. Not sure how we'll pull it off yet, but I'm guessing Andy will be happy to here this news when he gets up in a few hours.

I also finally finished my internship requirements and gave my notice, and heard good things from my prof (basically that she didn't want to send anyone over there from the art/design department again). It really made my day that she thought the situation I dealt with was as screwed up as I think.

Still waiting on NOA2... I thought I'd be among the first. I hope it comes soon.

Cham, I hope you feel better really soon. Have you considered taking megadoses of vitamin C until you're better? My ex-husband was told to do that often (1000mg), and it seemed to help.

Cheers and a to all of you still with me in the waiting room!

I called NVC as well, couldn't find my record either...she asked if I had approval. At least now I know a place to call, try week to week.

Yea rite now they are approving late June/early July filers. Try it next week! good.gif

I have everything ready except for the Bank letter. I am fixing to go to bank as soon as I get off from work.

Not really cuz' you just got approved right ? And the date which is important is when they send you the NOA1, not when you send your petition. So, actually they are approving july even end of july

I'm so sorry missbluesky. I can understand that it is better to wait if your fiancé is not ready but I'm sure that it might be very painful to hear sad.gif
This K1 is a very stressful, boring process. I don't know where and how my man and I are finding the strenght to go through this.
I don't know why but I'm sure to get approved next week, I hope to not be disappointing, we will see...

Lots of love and courage

Hey !
Just got back from Montréal...
I'm feeling kinda depressed, I am in my "I will never get approved" state of mind.
Closer I am of the end of november (the 4 months anniversary), the more impatient I'm getting !
Hope to see the date and status on uscis change.
