My second question is, about her point of entry. i filed in the guam sent it to CSC but i was wondering if can her point of entry be in new york or in hawaii, not guam?

I hope i can get answers from you guys. i know our relationship is really interesting and kinda messed up but were going thru it.

By sponsoring your new gf for the K1 you could lose both of them. The first one because it is a visa-fraud and the new one cuz' you will be denied cuz' of the visa fraud with the first one. If you explain like you said, the case to the immigration, it will be another proof of visa fraud, bc it is exactly what you did

How come with a lawyer you can get a RFE, it makes me crazy ! You should kick his/her a$$ !
If you received the RFE by mail, with the RFE envelop, you should send your documents by yourself.
If your lawyer has the original RFE letter, you should send him/her your document.

When you say it can take 30-60 days... it seems as though many people on this site get approved within days of the USCIS receiving the RFE info. Any insight as to why that is the case?

It depends on your adjudicator and your case and what you had to send in. Not everyone will get NOA2 days within sending it.



I am a little bit of nervous because the information that I sent with the petition it was the same one. The only thing that I did it was to organize the information and translate this time all the stuff that I sent. It is possible that they send me another RFE????? One more question I took a trip to see my fiance but after I have summited the petition. Does this trip count in meeting as well in person within two years? I am asking this because this trip is the only one I was able to save boarding passes. The other ones I did not save and I only bought them with my visa. But apperently it was not enough proof to meeting in person. I also sent pictures but they did not consider those pictures. I resent those pictures again. Do you think it was a good idea???

Yes, you should send the boarding pass you have because it is a good proof that you guys met in person during the last 2 years. Try to find all the documents that you can, maybe your bank documents showing that you used your visa in the US during your trips. I got a RFE on dec 11, if I have a good advice, send your RFE documents with FEDEX. It took 10 days for my documents to arrive at the Laguna Niguel immigration which is 100 miles away from my house blink.gif
With Fedex your folder will arrive in 2 days...

The problem you can have is if he doesn't have any money the last 6 months, you might need a co-sponsor (I think) and the co-sponsor has to be an USC, so your mom can't be yours.
For the phone bills and stuff no worries, the embassy in France doesn't ask for proof. If you have a couple pictures in case of, you will be great. For the mails part, you should put a good friend's adress in the USA who can send your mails to France. You will get the next mail in about 4 months, hopefuly your NOA2, you don't even need it in France so maybe somebody can just check and tell you that you received it.
So for me the only issue would be the money, he has to have enough money to support you and he will have to prove it with the I-134 and letter of his boss, bank account with last deposit etc... You should find a co-sponsor to be sure.

The best way is the K1 visa or the K3. Like you said he can't get one of these visa before july, because the BEST scenario would be visa in hands november.

I can't help you for informations about Cuba but I can try with the K1. I would say you to choose the K1, cuz it is faster (faster is a big word here cuz' it can take 9 months). We all want to be with our love and soon, so I would apply for a K1 if I were you. Do it soon cuz' like I said to you it is a long and hard road to get it.
And if you choose the K1 you don't have to raise money to go to Cuba to get married...

I am from Europe and I visited my fiancé during the K1 process. I got stopped at the POE (LAX) because I was coming too often in the USA on a waiver. They didn't want me to get in until I said that I was on the K1 process. When I did say it, the officer relaxed and took this as a proof, he wasn't worried anymore of me staying in the states to get married. If you are from Europe you def don't need a tourist visa. A waiver will be enough to stay 90 days.

It might be better for us then to wait to start the process, so that she can definitely come to the USA... we were planning to go to AUS for christmas this year, so if she goes back in mid november I can join her there, and then we can re-enter together with her finished K-1.


That is what I would do. She can come to visit you during the K1 process but she will have to go back before the 90 days period to avoid an overstay. I visited my fiancé during the K1 process and then went back to France and stayed until I got my K1. It takes around 6 or 7 months from the day my husband sent the petition to the day I had my visa in hand, but we got a RFE and maybe now the K1 process is faster than 1 year ago.

Hey and welcome here !

For a K-1 visa you have different steps.
The first one is for your fiancée to fill and send documents to the USCIS. You will have to wait 4-5 months for the immigration to approve your case.
The second step is after the approval, the USCIS send your folder to the NVC (National Visa center), it takes around 1 week.
Then the NVC will send your folder to the US embassy in the non US citizen country, so for you in Pakistan, it will takes around 1 week.
And then you (non US citizen) will receive different packet that you will have to fill and send back.
And then the interview for you at the embassy of your country. The last step (from the day your embassy receive your folder to the day of your interview) takes from 1 month to 3, it depends of the embassy, you should check the embassy informations on this website.

So a K1 visa is minimum 6 months. It can takes 1 year for some people, but I think that the most average time is 7 months.

IF YES, nothing is stopping you coming in and out of the USA using the VWP, you must maintain yer ESTA.

That's it, really.

Of course, the CBP goons will see the mark on the casefile, is a tag in their computers, but
YOU SHOW PROOF of strong ties to Singapura at a USA POE? Usually they will let you through.

I'd be wary of working in the USA unless you have an L-1 visa or a H1-B visa, unless you are fully sponsered by a company in Singapura for the work in the USA for that B1 visa you may or may not have.

My Worry is.. My case is at nvc now (cr-1) just turned in my AOS Packet and IV Packet last week and NVC received last May 7 2013. Question is once i received my case complete letter, can i still travel in US? as it is important because of my IT project.

You need to pass the interview first and get your passport back with the visa stamp in it.

 

But until you have to report for the interview, you can travel as a visitor for business or tourism.

There was nothing stopping you from travelling at any point during the process. If you wanted to go, you didn't have to wait until the case complete. Depending on how long it takes for your embassy to assign interviews, it might not even be worth going to the States now - you'll just have to turn around and come back for the interview. I am traveling back and forth from Singapore to US because of Work related (IT-Job)

 

My case is at nvc now (cr-1) just turned in my AOS Packet and IV Packet last week and NVC received last tuesday. Question is once i received my case complete letter, can i still travel in US?

 

 

Definitely need more information regarding your situation. What kind of case? Have you had your POE? Do you want to travel abroad?

 

For example: if you've applied for and received a CR-1/IR-1 visa, you're ok to travel abroad immediately once you've entered the US.

If you have a K-1 visa and have entered the US, you are not free to leave the country without filing and approval of additional paperwork.

My husband has a B2 (tourist) visa valid until 2022. He lives in Brazil and we just filed the I-130.  I live in the US. Would there be a problem for him to come visit me during this time?  Will he be turned away at a point of entry because he's traveling on a tourist visa during the time we are going through this process of obtaining the IR-1? 

Has anyone else gone through this?

 

No there will be no issue. He can visit US as long as he wants using his B1/B2 visa.  once the IR-1 visa is released thats the time he cant use anymore the B1/B2 visa.

No I don't so.

Just carry the old passport and any other relevant documents with you if CBP or immigration require to see additional evidence.

My US Immigrant visa is printed in my old passport, which soon will be expired (meaning you cannot travel within 6months nearing the Passport Due Date)

 

now i have my new passport and next month i will be entering US as in Immigrant..

 

Will there be an issue for this?

K-1 Fiance(e) Visa Case Filing and Progress Reportshas anybody been on AP due to request for a police certificate?

We already sent the UK police certificate and USEM already received it last february 12 and was forwarded to consulate. During the interview, the consul said that if we provide this, the visa will be issued.  Has anybody been in this situation? Can someone give me an estimate or timeline on how much more days or weeks do we need to wait for the result of the issuance of visa please? We are on our 10th month for this K1 visa which is supposedly should have been "faster."
