Enjoy your time with your fiancé Corinthians wink.gif

This morning I passed my driving test YAY ! I looked on the permit and the date of expiration is august 16th like my I-94. So I asked what I will have to do after this date and they told me to comeback with my california driving license, and a proof of status (EAD or GC) and the will re-send me a new one, I will maybe just have to have a new picture done, that is it. So no need to retake the test !

Jenny,
Im soo sooo sooo sorry. That is all I can say. You have stuck with me through all of this and it isnt fair...You will get through it and if u have to move to England with your cats....*hugs*

so any work Juliette on the whole working once ur case is pending thing???? Jobs have been popping up for what Johny graduated for and we are sending his AOS out this tuesday. We really want for him to work. he has just been cleaning the church and helping his friends out for some money but we want a place of our own ASAP, living with my dad isnt completely working. so we really need both of us to work. I am only going to be working like 2-3 days a week because of a full summer of clinicals.

I tried everything, I called SSA, I went to USCIS, I asked questions here and I CAN'T have an official reply. I wanted to do the E-verify thing but apparently your employer has to do it after to hire you which is weird and stupid in my opinion. So, I took the decision to wait until my EAD, I don't want to take risks. If you can you should get an infopass, maybe you can meet a good and informed officer.

Bad news guys.
"your visa has been denied under section 212(a)(2)(a)(1) of the immigration act A waiver of the applicable is available."

I dont know what this means, he has old convictions, which we were worried about, but i think 212 is lack of proof of relationship? my fiance told me: "I dont qualify for automatic approval its up to homeland security to approve me a waiver, only this time we both have to write letters explaining why a denial would cause extreme hardship, more forms to fill, $538 to pay, at least 15 weeks more to wait, "

We are eligible for a waiver but have to prove extreme hardship.

I am utterly heartbroken and crushed. He cannot even visit me til we get approved or denied. I am gutted! I dont know what to do! I cant be with the man i love! I have to go cry now!
thank u all for your well wishes!

Jenny

that sucks Jenny, so sorry to hear that mad.gif mad.gif

Here in NC if i take my test it will only be valid until my I-94 expires, and i would then have to re-take it when i have the GC.

Thats what I was told here in Florida whistling.gif

I am so sorry Jenny, that sucks !!!

Shan, for the driving license you have to get a new one when you have the GC or EAD but you don't have to take the test again, when you have it you have it.

Hey guys ! It seems too good to be true. So tomorrow morning I will ask my employer to do the E-verify thing on uscis.com. If it says "not authorize to work" I will print the page, ask an infopass again and say to the immigration that it is unacceptable to come to the USCIS in LA and to get wrong information which can be a very big deal for our future in the USA.
I don't really know about the driving license, I went to the DMV, I said that my international license will be expired at the end of may and that I wanted to get the California one. She asked me my passport and SS number. She looked at my I-94 and K1 visa. At the beginning she said "I need your Green Card". And I said that I'm pending for the AOS and that if I had to wait for my GC to get the exam it would be bad cuz' it could take a year.
She took my documents and asked to different person and she came back saying that it was ok.
I was not really ready to take the test but she filed the application and say "go to the window number 14 and then they gave me the 36 questions and I passed !
I don't think that it is valid til the end of the I-94, I think that it will be permanent.

Corinthians, the job is in my husband company. It is a sound band touring company. My job will be to fix sound material.

Hey guys ! I passed the written test for my driving license this morning YAY ! The driving test is after tomorrow !!!
I also went to my infopass appointment today cuz I had questions about working authorization.
This is what happened :

The woman checked my passport and my status on her computer. She then asked me what I wanted.
I asked "I applied for my AOS, EAD, AP at the beginning of May. I got an offer for a job and I would like to know if I can accept the job before to receive my EAD because I have the work authorized stamp on my I-94."
She asked me if I got the Notice of action for my AOS and EAD. I said yes and gave them to her with my biometrics appointment letter.
She said : "Even if you didn't have the stamp on your I-94 you can work. We the immigration don't require a EAD while a green card is pending, it is up to your employer to accept to hire you even if you don't have a green card or an EAD yet. As a pending applicant for your GC you are totally allowed to work."
I asked her again, showing the list of the documents accepted as work authorization> She said "I am positive, if you can find an employer who is ok to hire you without a GC or EAD this is not a problem for the USCIS, you are legal here in the USA and allowed to work, once again, the EAD for somebody pending on the AOS is not a requirement for the USCIS it is a requirement for the employer"

Im sorry for keeping you in the dark unsure.gif ........Remember the day i said that i was going to call the counsulate and see what happened at the interview?? Well as i was calling the counsulate my fiance was calling me on the phone. i answered and it was her telling me that she was in AP. Well on monday she gets a call from the counsualte to come for an appointment. she asked what should she bring and they say her passport. So naturally we are excited but nervous at the same time. She goes to the counsulate on wed. and they give her another interview. She says the interview was 45 min long ClockWatch2.gif . they asked her about me and my parents........everything was game, but she knows everything (even my social security number by heart ) so she answered all the questions well. Alhumduallah. After the interview the lady asked her for her passport and told her that they would call her in a few days. MY fiance asked " call me for what? " the lady smiled and said " your visa " my fiance said " really, sure, everything is ok " the lady responded " yes hen my fiance asked when will you call me? the lady said in about a week and my fiance left. Well well well......what a differnce 24 hours makes. she received a call on thursday (the next day after the second interview) from the counsualte and they told her to pick up her VISA TODAY!! I had to go to the office today and i wanted to leave early so i could be home to talk to her on the web cam, becasue i wanted to SEE the visa. But i had a stupid department meeting. When i got home i had her show me the visa and it finally hit me idea9dv.gif ......WE DID IT!! i did not want to post anything here until she had it in her hand.

USCIS Update:

The man on the phone said it's all up to the discretion of the person reviewing our file. He said lately many people have been asked to require the I863 and many have not. Same with the tuberculosis test. He said not to mail anything at all in unless we get a request for it, as it will likely never make it with our case.

So we'll wait and see!

Great !!! Congratulations !

For the I-693 stuff. For what I understood, the USCIS has our complete medical file, or is supposed to have it. My doctor in France and the girl at the embassy in Paris told me the same thing : You won't have to do medical in the US because you just did everything that they need. You just have to know that USCIS lose a lot of medical files, so be sure to have all your medical document (Chest Xray + Syphillis results + AIDS results + vaccins record) so you can get a new medical (I think the I-693) in case of.
So I think that as K1 holder we are not supposed to do the I-693 cuz' they have it in our medical folder, the one we carried in the brown envelope.
I will put a copy of my vaccins record and a copy of my Tuberculosis and blood results. If I get lucky it is cool, if I'm not I will do the I-693.

Well I kinda gave up on the I-693. I will send a copy of my vaccins form, the one my french doctor gave me. If they still have my medical folder at the USCIS I will be fine. If they want more I will bring this I-693 at the interview. I have to give 1010$ for the AOS so I will wait for the 110$ for the civil surgeon...

The USCIS website seems pretty clear that the I-693 is needed. Us July filers are likely the first people to suffer from the new requirements they set forth, so even though we've only seen a few RFE's for not having it, it seems like we'll be seeing more. I'll let you know how I get on with Dr. Arnold- $30 isn't bad at all for peace of mind and not risking delays!

We gave up and mailed everything but the I-693 this evening. We just want to get the EAD asap. We sent in the DS vaccination form from the UK medical in place of the I-693 but we'll be mailing the I-693 separately.

What did you do about tuberculosis stuff, Juliette?

I did the chest xray in France as the embassy required for tuberculosis. So I have my Xray here and the sheet which goes with it sayin' "Tuberculosis clear". It is not enough anymore ?

Well, we just got the run around by ANOTHER civil surgeon, and coincidentally the last one in our city. They tried arguing with us that we had to do the full medical exam, even though we showed them the I-693 instructions and specially highlighted the K-1 visa portion. We contested and asked why they'd refuse to operate the way USCIS mandates they do, and the physician said, "We do things our way around here. Go elsewhere." and walked away. We were like, "It's fine. We'll just pay the extra fees and get this over with" but they refused to see us. Needless to say, we're both furious and reported him to the USCIS.

I highly recommend you guys start reporting these physicians who are refusing to do I-863 the way the government mandates. I think if enough of us started making calls, we'd see more action on this front.

Anyhow, question for those of you who used Dr. Arnold. Did you have a TB test done? Was it done by a different civil surgeon or just another physician? Did Dr. Arnold transcribe the TB test results, or did you just send in a copy that another physician completed with your AOS forms? We're not sure how TB fits into this.

I thought AOS was supposed to be easy, but it's quickly turned into a nightmare for us. I'm a full time student and absolutely cannot take a day off of class to drive 3 hours away to try our luck with the other nearest civil surgeons. We're considering mailing off our application without the I-863 (just using the DS form he got in London) and mailing the I-863 later on once we get it back from Dr. Arnold. Does this sound reasonable?

Sorry for the rant...I'm still shaking with anger.

To be honest, the whole thing confused us quite a bit and we just decided it'd be easier for him to not look for serious work until the actual EAD arrives.

For those of you who had your DS vaccination form transferred to the I693 (how pointless is that, seriously?), did anyone try to tell you your vaccinations were incomplete? I know all of us London embassy people went to the same place and likely have the same form.

Sebastian and I went into the civil surgeon's yesterday and even though it says "Series completed" next to his tetanus shots (as well as all other relevant shots), they tried to tell him he had to repeat the whole tetanus series. The receptionist was beyond nasty to us and although I'm usually an overly polite customer, she was being so demeaning that I interrupted her in mid-sentence, told her we'd take our business elsewhere, and slammed the door. This delays AOS yet another week while we wait for an appointment at the one other civil surgeon around here. Don't get me wrong, we're exceptionally grateful that we're finally together and married- but with the economy being so horrible it would be nice if he could start looking for serious work.

If this is better suited in an AOS thread, I'll move it but I know a few of you were talking about vaccination stuff last week.

You know what ? I was supposed to have my appointment today at 2:30. The doctor is sick (yeah it happens), so I have to reschedule... That sucks !

So what are the news here ? I just read the 1+ year waiting room and now I'm feeling totally depressed for these ppl. How USCIS can be so unfair ? I saw some approval in 60 days a couple days ago, that sucks !

Just another example of good ol government consistency!

From what I thought I knew about getting an ssn (and God only knows I'm wrong often enough) Dawn should have absolutely no trouble getting an ssn because she hasn't married yet.
What we read was that you could get one as long as your k1 was valid - which expires the minute you marry. So in my understanding Juliette is extremely lucky to have gotten one.

Good Luck Dawn - if they won't even look at the proof you have on their own website I truly hope that immigration can help in some way. Have you posted this anywhere else? Good luck hun!

*We'll post some proper pics in the wedding thread when we get them back from the photog. -- These are just a couple that Jackson took (our 10 year old). Thanks for all the compliments!! smile.gif

I didn't receive my SSN card yet, so maybe I will have some trouble sad.gif I might receive it in 2 weeks...
I couldn't go and ask for my SSN # before to get married cuz' I left to Vegas just 1 week after I entered the US so my informations were not in the system yet...

I am in the same boat as you Juliette, as we went to Colorado a week after I arrived. I don't think we will have any problems as the offices we both went to understood the K1 regulations and accepted our applications. The K1 in itself becomes invalid as soon as you enter the country, it is the I-94 that you receive at that point which is the elegibility to register for an SS card as long as you do so within 76 days of entry (this is to allow the 2 weeks for its issue to still fall within the 90 days the I-94 is valid for). Marriage does not invalidate the I-94, though there are plenty of threads on the boards that suggest that a lot of the people who work in SS admin think that it does as others have had problems.
It is standard for them to send it in the post and takes up to two weeks so you should be fine.

Thank you for these informations Talyss smile.gif

Hey guys, I know that it is not the good topic for this question but I wanted to ask you guys before to post the same question at the right place.
I applied for my SSN today, even if I'm married now the woman couldn't put my new name. She asked me to bring a document for the Homeland security or to wait to get my work authorization card with my new name on it, and then she will change my name on the SSN card.
Do you know if during the AOS process (maybe when we will fill the petition) we can ask for them to put my new name.
Thank you !!!
Ju

Juliette

The only thing i can suggest is you apply for SSN in your maiden name and then change it over to your married name later when you file AOS! At least that way you will have a number to work from.

Although i'm having a nightmare just getting a SSN full stop!! Been told no 3times now!

You're kidding Dawn?!?!! Have you tried different offices? You can always take a drive down and go where Nick did! laughing.gif ....oh and we'd love it if you'd stop in when you did! whistling.gif smile.gif

Yes i tried a larger office near the military base as i thought if anyone knows they would...how wrong was I the buggers still had no idea.

Even showing them there own information on K1 that says i can get a SSN it was still a no. Going to call immigration tomorrow to see if they can help, if not i'm heading down your way!! Any wedding cake left???

Your wedding pics look lovely by the way, can't wait to see more of them.

Ask them to check on their computers with your visa informations, they will see how wrong they are !
Shan and Nick I would like MORE pictures, you look SUPER happy !!!

The first time I went to the SSN office the lady said that I couldn't get a SSN number before my AOS cuz' they need my work authorization.
I was confused so I said "oh ok, I didn't know" and I left thinking "this is bullshit cuz' I know that Nick got his SSN even before to get married".

So I went home and I printed the part on their own website saying that as a K1 holder you can get one.
I went back this morning, and it was the same woman. I said "I already came here to get a SSN and you guys told me no blablabla..." "but I checked on your website and I can def get one". So she took my passport and played with her computer for a couple minutes and said that it was ok.

So you should print this document and go back, sometimes they know nothing about non immigrant visa...
I will try to find the link for you
