I'm getting a bit ahead of myself since I'm assembling documents for the petition and this stage is months off, but, I had a look at the i-134 and also the I-864 and neither appear to have a clear way to list additional, non employer based income, such as child support. I know the child support counts, but what do people normally do to list it? Will I just list my total (work+cs) income and then just provide documents to prove I recieve that amount of cs?

 

Also I'm a bit frustrated because I called USCIS today to find an answer to a different question (do I list the US air force base I lived on as "applicant's last address outside the US of more than one year" on the g-325a, since it was overseas, or does it not count since it was US property?) and they said they can't answer questions like that and I should list it if I feel that's best. Sigh. I hope listing it won't confuse everything.

 

Despite all my questions about the various stages of this, I'm SO excited to finally be at this stage of the process, being about to file it!!!

I thought I had a marriage CERTIFICATE from my last marriage, to use to show my name change. Instead what I have says on it marriage LICENSE...however it has my full maiden name, parents' names, dates of birth, etc, my ex's info, and is signed and dated by a judge proclaiming us married on that date. And it has a raised court seal! So is that ok? Or will I need to obtain something that actually says CERTIFICATE on it?

Does it take that much longer when coming here to stay? O_O My fiance has been through tons of US airports when coming to visit me (he's on a mission to visit them all one day, haha) and the longest he ever had to wait was 2 hours in Houston. That was just waiting in line. His fastest trip through was 10 minutes, in Chicago... so is the big wait just standing in line, or is there more of a delay because of paperwork?

I'm sure this won't be an issue because I've read it won't be, but since it's finally time to assemble and file everything I'm getting more nervous. When my fiance and I started talking, and our relationship, we were still married to our now exes, though separated from them both. My divorce took a really long time because of custody issues. We are both divorced now and legally free to marry eachother, which is why we are only getting around to filing the petition now. We've fulfilled all requirements like meeting (multiple times), written our letters of intent, etc, he's sending me all his boarding passes, letters, emails etc in the mail. We'll both have our divorce certificates/decrees attached. We can prove literally everything under the sun! But will the fact that we were in other marriages when we started our relationship matter? I imagine from some moralistic stand point it could bother someone but from a LEGAL are-we-free-to-marry-and-in-a-true-relationship standpoint it shouldn't. And we've been in a relationship over 2 years now.

I've asked similar to this before but this really worries me for some reason. In my explanation for how we met, I didn't mention when we became engaged but I'm thinking I should, right? (I haven't filed yet, am gathering documents). I'm concerned because, well, my engagement date is BEFORE my divorce date. Now, being engaged I realize isn't a legal status but an emotional one and I have seen the USCIS people don't consider you engaged for visa purposes until you file the petition, so...this shouldn't be an issue, right? Him proposing to me then was more a "I want to marry you when we are legally able to" than a "let's go get hitched right now".

I'm going to have a similar situation when I get to this stage. I will have possibly my 2013 tax documents (if he gets his interview after I've filed), my 2012 ones (which show me with a very very low income), and my 2011 was a joint return on which I didn't work, it's all my ex's income. So I'm guessing that in my case, submitting paystubs at that point showing the right income will be more important than my old and no longe relevant info?

There's tons of reciepts from things my fiance and I did together on his various visits here. However, none of them contain either of our signatures or names. So should I still include them? They're places we went to visit and eat at and movie theater tickets but no way to identify that it's us who went. We don't have any joint hotel stuff because he always stays at my house...

 

Also, they say that when including letters and emails, cross out personal information but is that necessary? I'm concernced if I cross out any private details there won't be much left to prove these were love letters. I mean, they're not filthy or anything but I want whoever is doing our case to read the things.

I have read that if the person applying for the visa has a medical issue, in order to get denied it would have to be one either dangerous/contagious to others, or psychological to the level of causing harm to others or the person themselves. These are the only cases you get denied, right? My fiance has a medical condition that is not contagious, not psychological, not dangerous, not debilitating. It doesn't prevent his ability to live, work, care for himself, or anything. But he'll have to mention it in his medical exam. I've always been worried it will be a problem, but people with things like asthma, diabetes, etc get approved for visas, right?

For the i 129 F and all other forms and documents that get filed with it, how do you generally attach it all together? Staples? Paper Clips? Put it in clear pages in a folder? Is there a preferred method?

 

Also, when putting the passport photos in a zip loc bag and attaching them to a page, do you staple, tape, clip or other to attach the bag?

i am not sure we have such a thing as a divorce nisi in Ukraine. Can it be that your divorce in USA isn't final yet? Maybe you got divorce lately and they mean it can be appealed or what? Or maybe after court your attorneys hasn't signed the final still? I heard that in USA you have to wait for half a year after divorce to be eligible for new marriage. I will ask my fiance later today as this sounds strange.

 

No, every state has it's own divorce laws. For instance, I am in KS and you can remarry here after 30 days. They'd have to check what the laws regarding remarriage in KY are.

My divorce decree from my first marriage is very short and simple and I've long worried it won't be accepted, because there is no seal, just a file number and it is signed by a judge. It's a photocopy and all they sent me from the state it was filed in. HOWEVER, I had a second marriage which proves my first one ended, I'd imagine, right? Some decrees are shorter than others (my 1st one had no kids or property).

 

For my second divorce, though, I have a certificate, the one that is on file in the KS vita statistics office. It's on the same kind of paper as a birth certificate, but it not signed by a judge as it is a certificate. I've been avoiding getting a file stamped decree because the courthouse is really far from me and I have car trouble....will I get an RFE is I submit the certificate and not the decree?

 

Also, my fiance is British and he sent me a b&w photocopy of his decree. Do I need a color one instead so I can get that red stamp?

 

I'd wanted us to file this thing a month ago but stuff prevented us, now I'm wondering if that was a good thing if I need some extra documentation!

After a forever wait, my I 129f packet will finally get filed sometime between now and a month from now. We've been assembling documents for some time but life caused us to have a delay on mailing the thing. As a result, my fiance's G325a form and his letter of intent to marry me are dated when he mailed them, late June. The question is, will this be considered outdated if I mail this now, or even the first week in October? Should he sign and provide me with new ones?

 

On an unrelated note, he is visiting in a few weeks but since he's British, he comes with an ESTA and not an I94. His ESTA is set to expire in October (after he's been here and gone). If he file while he's visiting, do we write the ESTA info in the I94 section on the i129f? Will the expiration date cause a problem? (Even though it was valid when he entered the US, which is all that's needed?) Or would it be better just to wait till he goes home to mail the thing?

I'm finally mailing this on Friday or Saturday, after a forever wait! Just wondering if the whole I 129f packet needs to be in a folder before going in the envelope, or if it, once clipped together, can just go directly in the envelope?

 

I'm sending it priority mail with return reciept...is this a good method, or should I do anything else?

 

Hopefully I'll be in the home stretch of this now, who would have thought that the BEGINNING of the visa process would be the home stretch? goofy.gif

My fiance and I have been talking every day, for hours a day, on facetime, but never bothered to keep logs of it. As much as I can tell, both skype and facetime logs only go back so far, and I can get screenshots of both but not for more than a few weeks because of the volume of calls. Is this good enough? I mean, we have proof of him visiting 4 times in the last year, pics of us together, a pic of my ring, and romantic emails and letters. (of course we also have passport stamps, boarding passes, itineraries, and letters of intent. I am only going with relationship provers, not meeting provers.)

Thanks. My fiance filled out his police certificate form today. He needs passport photos because that's how they do it in the UK, and he's planning to mail it in on Monday to the dept. that issues those over there. I have done more reading and see that from the CSC to NVC is taking about 6 weeks, so I imagine waiting till the 21st of this month won't hurt anything.

I just got my NOA2 last night (at 10:15 pm, strangely enough), after just TWENTY DAYS. I know that now it goes to the NVC but I see so many different things that I am not sure what to do next. People say to call them to find out the case #, so my fiance can schedule his medical, right? How soon should we start calling? He suggested waiting till the 21st, is that about right or should we do it sooner than that, or later? Also, who calls them (him or me, me being the USC)? Do we wait till I get the NOA2 hardcopy, since that has the alien registration # on it?

 

Police Certificate: I will also ask in the UK forum if I don't get any input here, but when should he order his police certificate? Now, or after getting the case # from the NVC?

Yea usually he does not get more than the standard questions when entering the US...glad its legal and we can see each otherdancin5hr.gifdancin5hr.gif ! to be honest, i get questioned more when entering the UK than he does when he enters the US!

 

Ahh, those awesome UK border people. dry.png The first time I was to meet him, I went over there to visit. After 9 hours of questioning me about the entire lives of me, my fiance, and our families, they sent me back to the US. They said they had no proof I wasn't going to stay illegally, because I had no job and therefore no ties to America. Despite my entire life in the US and my two kids here, even! I still honestly think it was because I said I met him on twitter and hadn't met him in person yet. Anyway sorry for the rant but I have serious issues with that whole situation.

Yes, visiting is ok. My fiance just visited me and it was after we filed the petition, and he got in no problem. He'll be visiting again in December. The customs people generally don't have any record you've filed this, but as long as they have a valid passport, esta or tourist visa or whatever their country requires, return plane tickets, and proof of income/residency/etc (ties to their country), it shouldn't be an issue. They don't even ask my fiance anything when he comes here, just why is he here and what does he do in the UK and that's it.

I have a possible cosponsor, but she owes the IRS some tax money. I don't know how much. This is kind of a double question: Will this prevent her from being a sponsor? I don't think it will, but I'm asking the experts. smile.png

 

The second part of my question is: Will the IRS know she is sponsoring someone? She's not trying to get away with not paying, but can't pay it all at once, and doesn't want to get in trouble where the IRS would say "You can sponsor someone but not pay us".  As far as I imagine the IRS is completely seperate from this whole process, but would her getting ahold of tax transcipts alert them somehow? And if it did, does it make a difference?

 

Again, she is not trying to do anything illegal, just doesn't want to get in trouble for cosponsoring.

Oh yeah! My fiance just went back to the UK today cray5ol.gif after his 15th visit. He does get stopped every once in a while at immigration, this last time he was reminded that he only had 90 days for his visit (we wish we'd been able to spend 90 days together!). Isn't it better to show immigration that you have actually spent time together if you can? ALL of our money goes to financing our visits, but we have got to see eachother.

 

He gets asked what he does for a living occasionally, where he'll be staying, who he's visiting, etc. He explains that we're waiting to file the K-1 if it gets that far, but usually there's not that much hassle.

 

Aww, this reminds me of me and my fiance when he leaves! : ( : (  And I SO know about the having to see eachother despite the money! At least they get lots of vacation time in the UK.

I do agree that having proof of having spent time together helps at immigration. I also think the more times someone's been here and left when they were supposed to, the more likely they are to get in the country, because why would they stay illegally NOW if they haven't before? That and yeah, why would you be filing for a K1 if you were going to do it the illegal way? But, even saying that, I'll be terrified as usual when he's going through the airport in 2 months. : /

Well I arrived in the US yesterday, my POE was Chicago O'Hare. It was really easy, these are the questions I got asked:

"Are you here for business or vacation?" Answered vacation

"How many days is your trip?"  6 weeks

"Who are you visiting at this address? (points at address on customs form)" My boyfriend

"Where is he from?" He is a U.S. citizen

"How did you meet?" He used to live in the UK

 

That's it. Didn't get asked to show anything. I really don't think they know that you have applied for the K1. And I don't see any problem with saying you're visiting your boyfriend/girlfriend instead of fiancé(e). It was definitely no more difficult than the other times I've visited.

 

Good! He's visiting me again in September, by which time we'll have filed. He will be armed with all needed documents then but he was just planning on saying girlfriend unless he was questioned further. It's a relief to see they don't have any info about the K1, better to avoid the extra questioning if possible!  : )

Do you have to say you're visiting your FIANCE? Could you just say boyfriend/girlfriend? See, he always comes to visit me (we haven't filed yet, but are about to) and has always said he is coming to visit his girlfriend, and doesn't get asked anything deeper than where do you work, etc. It's not a lie to say bf or gf, and if pressed for more info it would be handy to show the I129f packet, etc. But I'm curious if he could continue to refer to me as his gf next time he visits.
