Dang!!  Ours took 179!!  Happy for you!  And don't worry, you'll have plenty of time to get your stuff together; London kind of moseys along, but they get there!  Make sure when you register to pay the MRV fee you pick APPLY FOR K VISA and don't click select courier first or else you'll end up paying twice!

 

I don't know how any of that works, I haven't seen the application, but I'll let my fiance know when he gets ready to do it! : )

The subject says it all. I just now, after 10pm central time, recieved the email that our petition was approved!!!

This is way faster than I ever dreamed and so I'm utterly unprepared. I will need a cosponsor and hope a friend of mine can do it.
NOA1 came the day my fiance was traveling here for a visit, we joked NOA2 woild come the day he went back to the UK. It didn't, it came the day after.
I'm just in shock.

Most of them at NVC haven't a clue. All they can do is read from a script. Course the NVC handles K1's, all visas go through there. Keep calling, sooner or later you'll get someone with a more pleasant disposition.

 

We had occasion to ring them nearly daily for almost 8 weeks, and we only ever struck one nasty one. My now husband started to say ( I was on skype and could see his half of the conversation ) "If you cannot answer my question, I request that you escalate this call to a senior Tier 2 staff member" He just kept repeating that, no matter what she said.  In the end she did, and that was when we found out were in AP at NVC, something they had begun doing just as our petition got there. Until that point we had been told our case was lost, that it was missing, that it hadn't been approved yet, that it was already at the consulate, none of which was true. 

 

So keep calling, and good luck smile.png

Today was the second time I have called NVC. Now it's only been 2 1/2 weeks since my petition was approved, and it's coming from CSC, so I don't REALLY expect it to be there yet. But, the first time I called, the NVC person didn't even look up the reciept number, she just said "you have to wait 8 weeks." Tonight, my second call, the lady on the phone had me read my approval notice and said "You can't call us. You have to call the consulate. National Visa Center doesn't handle K1 visas."

 

Say what?!

 

So, I told her that I do know many people applying for K1 visas, all of whom have had their cases sent to NVC. So then she changed her tune right away and said "Well, it hasn't been 8 weeks yet. You can call back then." I asked if she could at least check and she said  "We don't have your case yet."

 

What is this all about, do they commonly just tell people misinformation to avoid having to do any work? True, the letter says it was forwarded to the listed consulate, but this is standard wording in NOA2 letters, isn't it? The email I recieved mentioned "post decision activity" and the NVC, and I know from everything on this site that NVC assigns them case #'s and forwards them on. Do I just keep calling and putting up with their nonsense? (and incredibly long hold times...32 minutes!)

Frozen glitter: you received your NOA2 in 20 days? I think that's the fastest I've seen on this site? Great job. Do you have any feelings on why it went through California center so quickly?

 

It's nearly the fastest, yes. I saw someone got theirs in 19 days.

 

I have no idea how it went through so fast. I've been divorced 2x and my fiance 1x and so I figured it would take LONGER, not shorter, to verify all of that. I followed all the instructions for how to file. I only included 7 pictures and most of them were headshots of us (like my picture on here) because that's mostly what we have. I had one of us at the zoo with my kids and some superheroes from a thing we went to, and a couple of us at some restaurants. I had one page of skype phone logs from only the week before we filed, and it printed badly. We talk for hours each day on facetime but never have kept any records. I included some letters and emails.

 

I put a nice outline as to what I included and where to find each page, but that's reccomended on here so not that special. So I literally have no idea how it went through this fast. I was expecting 3 months at least. Now I'm panicking trying to convince my friends to cosponsor while I try and get a better job, this is my big fear now.

Hi, in a few months I'll be petitioning for my fiance from the UK to come here, and I had a few questions, mostly about the sponsoring part.

My job history has been very spotty, and in fact I was unemployed for several years while in a previous marriage and taking care of my kids. In fact I'm currently unemployed, though don't expect to be when the time comes for me to file the petition. I'm aware that I can have someone else sponsor him, if my income doesn't meet the income guidelines, but the problem is I don't believe I have any relatives in a position to sponsor him either!

What does a person in this situation do? Can I get multiple sponsors? Would having a certain amount of money in the bank supersede my income? If I'm making enough at the time I apply, is that all that matters, despite my not having tax forms for previous years' income? And at what point do I need to prove I make enough: when I file the I129, when he has his interview, or after we're married and he's adjusting his status?

In addition, when it says you have to earn over the poverty line, is that for a family of two (just me and him), or the full family of 4 that we will be? Can I include the child support from my ex as income for this?

Does anyone ever get denied their AOS because of inability to find a sponsor? Would he have to leave if that was the case, even though we'd already be married? Also, would his ability to earn more money than me (he has a good job currently and his work exp. from the UL would likely land him a decent job over here pretty quickly)be a positive factor despite my lack of money?

He is in fact allowed to remain in the US while the AOS is pending, right?

Took 23 days from NOA1 to NOA2. Less than a month for the petition approval. Then he was able to go for an interview by the end of July. We filed towards the end of May, so that was 2 months. Juarez had no appointments back then. He could have gone for the interview at anytime after they received his file. He delayed going due to personal issues and went mid Sept. It took 3 and a half months, 104 days from NOA1(June 9- Sept 23). It could have been done faster though if he would have gone for the interview right away at the beginning of Aug. That would have made it 2 months from NOA1 to interview.

Yes, it used to be faster overall, which is why I do not think people should try and compare theirs to what anyone tells them happened in their past case. All we can tell the OP is that those people did not get their visas faster because they had a lawyer. :P

Nope not true. They're probably talking the visa section which can be that quick, but the first part, the petition, is what takes a few months.

**Edit - If you're legally divorced (doesn't matter if you're still going through property settlement) and legally able to marry you can start the process now. Some divorce settlements take a while but the divorce itself (being legally free to marry/change your name back) can be final sooner.


I'm not legally divorced yet...in my state they won't divorce you until the custody issues have been worked out. It's supposed to go to trial, I hope hope hope that will be the last step and I can finally be done with it! I just want to move on already!

Thanks everyone for your info. I thought it sounded fishy when she said 3 months because I've never seen it take that short for anyone before. She probably is just taking about the actual visa part and not the petition. Another question, why does the VSC seem to take twice as long as the CSC? And it is completely random which of those the petition goes to?

A lady I work with came here on a K1 visa from India and said it only took her 2 months. She said her son married someone and did the same thing. She said it was this quick because she used a lawyer.

Is this true? I'd never thought it was necessary to hire a lawyer for this if you can do the paperwork yourself. Why is there such a vast difference in processing times?

I'm majorly frustrated because I can't even start this process yet...am still suffering through custody battle/divorce hell. It'll likely be another year at least before I can bring my fiance here. : ( Anything to make it go faster once I'm free to apply is what I'm hoping for.

But I've got a question (and likely many more soon): when do we have to file the document that proves I can sponsor Scott/have a cosponsor? Does that have to be filed with my initial petition, or later, when he files his papers? I'm concerned because I haven't gotten a good enough job yet to sponsor him and need one/need to find someone to cosponsor. If this doesn't have to be mailed with my petition it obviously gives me more time.

 

I'm terrified it will all go badly. We've waited so long....and still waiting for my divorce to happen. Sorry for rambling, he's currently flying back to the UK after his 4th visit here and it'll be August before I see him again....so I'm really down. : (

Ha, no problem with the meeting within 2 years! He comes here every 3-4 months (and just left yesterday from his most recent visit.) His visit dates are listed in my signature, : ) We have tons of proof, photos, his passport stamps, reciepts, boarding passes etc. . When I say apart, I mean living apart.

 

I'm just confused because I see that the one site never changes and there seems to be a vast array of when people say they got approved. And is it true that if it goes beyond 5 months I can contact my congressman for help? Or do I need to wait 7 months?

 

We hope to finish this by March because of other reasons besides missing eachother...his job ends in March. : / If we apply in June and haven't heard by December, would we be able to get it pushed forward to avoid him being stuck there with no job (which lessens his ability to save money to come here with, obviously).

Sorry for all the questions, I've had a few lately. Some background in case you didn't see my other posts, I'm awaiting finalization on my divorce (which has taken a year, sigh), and hope to finally file my 129F in June. So I have no timeline since I haven't filed yet.

 

My worries are mostly about how long it all takes, because I've already been with my fiance but apart from him for 2 years and am horrified about the idea of having to wait a third to get him here.

 

Anyway, I see that the last time the uscis page for the csc was last updated Feb. 28th, and is reporting July 18th as the last date anyone got their noa2. Yet I have seen people on here, who filed at the csc in august and october, get their noa2's recently. So my question is, is that july figure somewhat outdated? Is the site likely to update any time soon? They ARE still processing k1's, right? Also, are there more rfe's coming through now than perviously?

 

Sorry for so many questions about this. I'm just so desperate to be with him permanently. I hope they speed up processing these again. The last time I checked before now was January and csc was averaging 110 days then.

This applies to both the I 134 and the I 864 or whatever the one you file when you do the AOS is.

 

I'm aware that child support from my ex husband counts as income, but does maintenance/spousal support (alimony)? This is due to end next July or when I marry my fiance, whichever is sooner, so I imagine it wouldn't be counted, but would I mention it anyway? I am supposed to report it as income on my taxes (but not my child support).

The I-129F instructions ask for documentation of name change. If you changed your name when you married, then your name would not match the name on your birth certificate used to prove citizenship. They want the legal document that shows change of name, even though you list all your names used on the form. I provided a copy of my marriage certificate to show my legal name change. I even had to provide a copy of my previous marriage certificate at the DMV because of the same reason. I suppose if you use your passport to prove citizenship, then it would not be needed since your current name would match your documentation then.

 

From the form instructions:

 

6. What Other Documents Do You Need?

 

C. If either you or the person you are filing for is using a name other than that shown on the relevant documents, you must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order.

 

Right. I'd rather not use my passport for proving citizenship because it has my denied entry to the UK stamp, and while I'm imagine that really isn't relevant here, the less hassle the better. Besides, since my divorce from marriage#1 will have my maiden name on it (since that's the one where I didn't change my name), I'd still need my marriage certificate from marriage #2 to explain why it did.

 

As for long form birth certificates, because I see differing opinions on this, the one I have I assume is the short form, but it has my parent's names on it. Is that all I need, then?

Slightly offtopic45vn.gif , but I noticed your signature... can I ask why you were denied entry?

We've had a few successful visits back and forth but I'm still very paranoid about it! wacko.png

 

No offense to the customs people at heathrow, but they were awful to me. : (  I had no job at the time, and their "official" reason was that my unemployed status made them suspect I was going to stay in the UK, because I had no ties to the US. You know, despite having spent my life here and having my TWO CHILDREN back at home. They said TONS of women leave their kids behind and move illegally to the UK.

 

I think the real reason was that I had met my fiance online and had, at that time, never met him in person, and was splitting up from my now ex husband. When she asked how we met and I explained it was on twitter she got all horrified looking and decided she needed to call him to verify our relationship. (he wasn't at the airport because I was meeting him at Manchester airport). However speaking to him on the phone wasn't enough for her and she and her coworkers made me sit in a small room for NINE HOURS, with my passport and belongings locked away from me, while they asked me insanely detailed questions like when did he divorce and what were my parents jobs and what did my ex think of me flying to the UK to be with another man? It was torture. They eventually decided there was no proof I'd return home, despite my kids, current passport, return plane tickets and my fiance and his mother vouching for me. Oh and they also accused my fiance of getting into an argument with me and kicking me out on the street, which he would NEVER do!!!

 

He wrote letters to his MP's after this experience and they forwarded it on but the UKBA stood by their decision and in the future I'll need a tourist visa to go there, presumably even after I marry him.

 

He's never had a problem entering the US, so he always comes here. He has a job and has told them he's here to visit his girlfriend (he never says fiance of course) and they barely even look at him. Fingers crossed it stays that way!!!

Thanks, that's all good advice and pointers! The thing about signing on something soft I never thought of, that's a good idea.

 

The reason I was concerned about past marriage certificates was because I've read you should include these as an explanation for a name change. For instance, my birth certificate is in a different name than my current one. I was going to submit my marraige  to my 2nd husband certificate as proof of why my name is now what it is (I felt it was pointless to revert to my married name after my divorce since I will be changing again when I marry my fiance). But I kept my maiden name in marriage #1, so I was concerned that not having both marriage certificates would cause confusion. But if it's not that important to the current case I'll just explain somewhere that my name didn't change. They'll see on my divorce certificate #1 that I had my maiden name then anyway.

 

This whole thing is stressful but so unbelievably exciting! Hopefully the processing times will stay within the 5 month frame. We've waited so long to even get to this point.

At looonnggg last, I am free to assemble and file my I 129F!!! So now, good people, I have some more questions:

 

-Items like boarding passes, passport stamps, etc: My fiance wants to scan and email these things for me to print. I had read they have to be photocopies. Which is correct? Also, are black and white or color copies more preferable for this?

 

- Years ago I lived in Japan and had a few jobs there...but it was all on a US air force base. So do I need to list it as my last overseas address/job on the G 325A? Do these count as foreign addresses since military bases are US property? What if I can't get this info (it was 10 years ago and an APO address).

 

- In this first marriage, my name didn't change, and I have no marriage certificate, and one would be near impossible to obtain. Marriage certificates are for proving name changes only. I can easily get the divorce certificate. So would a post it note explaining that in that marriage my name didn't change be enough?

 

- I have just gotten divorced from my second marriage where my name DID change (yeah, bad past relationships abound). For this I will have my marriage certificate. I also will have both a divorce DECREE (orders about money, property, and custody) and CERTIFICATE (just vital statistics data, stamped but not signed by a judge). Which should I include? Or both?

 

- When it says I need my divorce decrees and birth certificate, front and back, do I need OFFICIAL copies or are photocopies ok? Color (for the birth certificate) or not? Does it need to be the hard to aquire long form, or will my basic short one be ok?

 

-At any point in this process will my fiance need his birth certificate? Does he need to send me his passport ID page, or just pictures of his stamps?

 

-I've read it should be written in black ink but signed in blue. Is this true?

I'm getting a bit ahead of myself since I'm assembling documents for the petition and this stage is months off, but, I had a look at the i-134 and also the I-864 and neither appear to have a clear way to list additional, non employer based income, such as child support. I know the child support counts, but what do people normally do to list it? Will I just list my total (work+cs) income and then just provide documents to prove I recieve that amount of cs?

 

Also I'm a bit frustrated because I called USCIS today to find an answer to a different question (do I list the US air force base I lived on as "applicant's last address outside the US of more than one year" on the g-325a, since it was overseas, or does it not count since it was US property?) and they said they can't answer questions like that and I should list it if I feel that's best. Sigh. I hope listing it won't confuse everything.

 

Despite all my questions about the various stages of this, I'm SO excited to finally be at this stage of the process, being about to file it!!!
