I think you should be fine either way, actually. As someone mentioned, photographs of you together are only secondary evidence. There are couples here who have been approved after handling it both ways, and there is at least one who was approved without sending photos at all.

If you are using passport instead of birth certificate to prove the petitioner is a USC, the instructions for the I129F specifically say to include copies of all pages, I think even including the cover. For entry stamps to prove you have met, they only ask for the ID page and the relevant entry stamps. We also did what you did.

That's what I would send. Just to clarify, it has to be the "long form." That's the one that lists whatever information about your parents the county you were born in deems relevant (mine even had the name of the OB who delivered me!). I'm sure photocopies of your passport would be fine instead, but they want ALL the pages--which just adds to the bulk of your package unnecessarily.

Oh in that case I would include them. Maybe you can put them with the plane tickets and itinerary from his flight for the same trip. Without the names it isn't proof positive of having met, but you prove that with the boarding passes and I think it shows that you did stuff together and that he went to meet your parents.

I still don't know what to tell you about needing a translation. Does it give the dates numerically or with the month written out? If it just gives it numerically (like 18-12-2007 for today), they really should be able to figure it out.

Okay, I better clarify that. That was just about the evidence of having met that you were asking about. With the I-129F you also have to prove that your fiance is a US citizen and you are both legally free and able to marry each other, and then there is more later on (bona fide relationship, financial stuff, etc). But the evidence you were asking about really only needs to show one meeting in the last 24 months.

I really don't know anything about translations and what they would/would not accept, but if your names are not on the plane tickets, they may not be sufficient evidence anyway, at least not on their own.

All you need to prove is that you were in the same city at the same time at least once in the past 24 months.

If you do not have his plane tickets still, I have seen others here discussing whether/how you can get something from the airline showing that he travelled on those dates. I have no idea how that would work, but someone here might, or he could call the airline and find out.

I have a tentative wedding date set, but before signing a contract or putting down a deposit, I made sure the venue would allow me to push the date back if need be. I know that many other couples here have done that, and the venues are usually pretty willing to work with them.

The other thing is you should really check the estimated processing times first to get an idea of what a realistic date would be. Unfortunately, they are slow as molasses right now, and 6-8 months sounds extremely optimistic. But if you are going through the Vermont Service Center and your consulate is one of the faster ones, maybe that is realistic.

Just to make sure you are talking about the form I think you are talking about: do you mean the I-797 "Notice of Action" from VSC or CSC? VJ calls it NOA2; USCIS only calls it "Notice of Action." The NOA2 that you get from USCIS will not list the consulate. USCIS sends it to the National Visa Center, which then sends it to the consulate a few days later. You should get a letter soon from the NVC telling you that it has been sent to whatever consulate you are going through. It will even give you the address of the consulate. If you are talking about the letter from NVC, then I'd suggest calling them, because the consulate should be named there. If you are talking about the NOA2 from USCIS, don't sweat it; the NVC letter will list your consulate.

On my letter of intent, I put the address of the California Service Center. My fiance did not put any address on his. I am pretty sure mine did not include a salutation ("Dear ________" or "To whom it may concern") and I can't remember whether his did or not. Our petition was approved no problem. If you are going to put a recipient address, then yes, it would be the USCIS service center, not the consulate. I doubt it would cause a problem with your petition if you used the consulate address, however. The key thing to be sure to include is that you intend to marry each other within 90 days of entry into the US on the K1 visa and that you are free to marry. To make it really easy for them to find and to make sure it doesn't accidentally get lost, we also put headers on the top saying "Letter of Intent to Marry My Fiance" and made sure to include both of our names in the letters.

You will not be able to apply for a K1 visa unless you physically meet in person at least once. And you will need to save plane tickets to prove that you did meet. The one exception they make is for an arranged marriage, which yours sounds like it is not.

I don't know where you live or what her reason for not wanting to leave the US is. If it is a matter of the cost to fly to visit you, perhaps you can arrange a vacation together in a third country that is easier for her to reach and easier for you to get a visa for. If it is a matter of her not being able to take vacation time from work, at least try meeting in Mexico or Canada, which could be a long weekend trip for her.

It's also really not a bad idea to at least spend a little time together before committing yourselves to this process, relationship wise.

No, giving her a letter with information about "intent to support" just kind of implies intent to stay.

The main issue with with people being turned back at the border is proof of ties to your home country. The types of things she can use to show this are:

* A mortgage or lease for a home or apartment
* A letter from her employer stating that she is expected back by a specific date
* Bank statements showing that she has accounts at home that she's not closed
* Appointment cards showing she has an appointment scheduled for after the visit
* Utility bills in her name that are due after she returns (although if she is visiting for an entire month, I suppose this is unlikely)
* NOA1 and anything else you have from USCIS (as this shows that you are proceeding with it legally and therefore pretty unlikely to stay illegally)

She will not have all of those things, but should have as much as possible just in case she is asked. She may or may not be.

As far as what to say, I agree that you should honestly answer their questions but not volunteer extra information they don't ask for. HOWEVER they usually ask "purpose of visit" and you really do need to say "visiting fiance" if they ask that.

If you get your NOA2 during her visit, there will not be any need to buy her a one-way ticket home. It takes about a month to go through the NVC to the consulate. If you get the NOA2 at the very beginning of her visit, you might want to consider changing her return ticket so that she is home to receive packet 3 from the consulate, depending on how fast your consulate is. Most likely, she can change the booking with the airline (for a fee, of course, but it is a lot less steep than buying a new one-way ticket).

No, that will not be a problem. They will do an HIV blood test, take an X-ray to make sure you do not have TB, and make sure you've had certain vaccines. These vary by age--for my husband, who was 51 at the time, he only needed to have the chicken pox vaccine (or history), tetanus, and the MMR vaccine.

A big age difference is not a problem in and of itself. You just need to make sure you have pretty solid relationship evidence, particularly if you are going through one of the more demanding consulates. It's possible you'll be asked about it at the interview.

My husband is a citizen of both Canada and Britain (he immigrated from Britain to Canada with his family as a baby). For questions asking about citizenship and/or nationality, we put both Canadian and British because he does have both. The correct answer to those questions is that she is a citizen/national of both Spain and Mexico.

Someone can correct me on this if I'm wrong, but I would think that if she holds Spanish citizenship, she is eligible for the Visa Waiver Program just like any other Spanish citizen, so the fact that she's traveled to the US using her Spanish passport should not be an issue. She may need to submit copies of her Spanish passport with entry stamps to the US to prove that she spent time with her fiance here (for the proof of meeting in person in the past 24 months), and she will probably need to provide her birth certificate when she interviews at the consulate (which will show that she was born in Mexico).

Packet 3 varies by consulate, so it would be a good idea to check in the regional discussion branch for your consulate. Someone may have posted a checklist already or you can ask. Another place to look is in the downloads section of VJ. Go to "downloads" at the top of the page, then click on "K1 fiance(e) visa forms." The I-134, DS-156, DS-156K, and DS-230 are required by many consulates, so you can have a look at those to get an idea of what you will need to provide. But your consulate may have additional forms and/or not use all of those, so please also check the regional branch.

When we filed our I-129F, most couples going through CSC took about 5 or 6 months to get NOA2 approval. The first few petitions that were filed the same month as ours were approved after a bit less than 4 months, ours was approved a bit less than 5 months, and a few couples waited nearly 7 months. VSC tended to be faster than CSC. Once you get to the consulate stage, it largely depends on your consulate, both how fast they are and what their procedures are.

A lot of couples have only one visit. That is all you need to show USCIS to have your I-129F approved. When you get to the consulate, then you have to show you have a bona fide relationship. Multiple visits would help, obviously, but there are other things you can use to prove that---phone bills showing you call each other, chat logs, emails, anything that shows you regularly communicate with each other even when you are not visiting. However, as Baron suggested, you should check the regional discussion branches for information on your specific consulate.

Thanks for the responses and advice everyone. Probably best to have as much evidence as possible just in case. I guess we'll have to start chatting now too. Will have plenty of time while waiting for USCIS to approve the K1 petition.


It might be a good idea to look in the regional branch for the Phillipines to get an idea of what other couples have used as relationship evidence and how much is needed. As others have mentioned, you do not need to send ANY relationship evidence with the I-129F petition (other than having met in person at least one time). Many couples do send at least some because it will go in the file that is sent to the consulate.

As a general principle, what they are looking for in terms of relationship evidence is proof that you do regularly communicate. Chat logs are not the only way to show this. Other couples have used phone records (showing frequent calls to each other), emails, or multiple visits. Any cards or letters you mail to each other can help as well. We sent printouts of five emails. The ones I picked were ones that showed we talked about things like common interests (my dog, baseball, travel) and covered the entire time from when we started dating until we sent the petition. I also printed out the inbox from my hotmail account, showing that my then-fiance emailed me almost every day. What is enough for Vancouver may not be enough for Manila, so please do check the regional branch, but that might at least give you an idea what types of evidence can show a bona fide relationship.

My fiance is Canadian and I asked about that question because I am quite sure he cannot possibly remember every trip he has ever made to the US. What other Canadians have done is put things like "various trips to the US between (whatever dates). You might want to include an attachment for that saying in essence what you said here but giving dates that you've worked in your job, dates you've visited him in the US, and so on.

As for traveling to the US while the application is pending, it should not be a problem. What WILL be an issue is once you have the visa, it is a single entry--and you will obviously need to be able to fly in and out of the country multiple times before you've adjusted status or gotten the AP that allows you multiple entries. You might want to try asking this on the Canada Branch. There are a few couples who live in border towns and had to commute across the border and had this issue.

Jupiter, I get the same thing. I checked around on this site and found out that a lot of people are getting the same thing. Someone here called USCIS and they assured the person that their case number was valid, the computer system was just messed up. I noticed in at least one person's timeline that their case number showed up on line after about a month. Several people going through AOS the same time we were had this problem then as well.

If you are concerned enough about it, you can call them to be sure there is no mistake, but chances are if you got the NOA1, you are in the system and just not showing up because their computer is wonky. I decided not to bother because I don't think they can do anything except assure me the receipt number is valid.

they received it last Saturday, Nov. 26. Then I noticed yesterday, that our check was already cashed. It said that "Check# converted ACH, CSC Field Office payment". I wanted to know, why everybody else received a NOA1, how will you get this NOA1?


I replied a minute ago, but I quoted the wrong post and did not really notice the date you said they received it. They received ours on the 19th, issued the NOA that same day (some people have an NOA date 3 or 4 days after CSC receives their package), and then mailed it on the 23rd. Depending where you live, it can take anywhere from a day to a week for you to actually get it in the mail once they send it, so I would not worry too much. There is a 13-digit number under where they endorse your check --- it starts with a three-letter prefix and the rest is all numbers. You can go to the USCIS websit (www.uscis.gov), look on the left side of the screen for where it says "check case status" and use that number to check on your case. However, as I mentioned, a lot of cases are not showing up. If yours is one of them, no need to panic; you will probably have your NOA1 in hand in a few days!

They have actually been pretty quick with the NOAs compared to when we did AOS and our I-129F. Ours was dated the same day it arrived. I don't really know when it got to our house in the mail or when they cashed the check because we went out of town for a week right after sending in our package and the NOA arrived some time while we were gone. It was POSTMARKED 4 days after the date on the NOA so I know that they do not mail them immediately.

If you send a personal check, you can find out when it clears from your bank. The number on the back of the check, under where they endorse it, is your receipt number. You can use that to check case status on uscis.gov. That's how people are seeing their NOA has been issued before their checks clear. However, since you used a money order, this won't work for you. Their system is also very wonky and a lot of people (us included) are not showing up in the system anyway.

my conditional greencard was approved on Feb 26 2009, my package was received by Vermont service center on NOVEMBER 17 2010 , 3 months and 10 days before the expiration , I havent received anything from their side, the money orders have not been cashed , delivery conformation says they received it on 17th , is this normal? and plz add me to the list


You sent it too early. They will not accept it if you send it more than 90 days before your conditional green card expires. I was under the impression that what they do is just send the package back to you. It seems like you should have gotten it by now, though. Kang Lang's package was returned because the USC spouse had not signed the petition, and it took much less time. You could try to call them to find out if it's been sent back. I know they can be supremely unhelpful on their 800-number, but I can't think of anything else to suggest.
