CanadaCurrency exchange conversion rates...2011 composite rate
I know this has been addressed in this forum multiple times, and last year I was able to find a link to the official composite currency exchange rate for converting Canadian dollars to US dollars, but this year, all I seem to be able to come up with is current rates and historical rates for specific dates. I know we are not the only ones who have some income in Canadian dollars we need to report on our US return (a survivor's pension from my husband's first wife). Does anyone have a link by any chance? I have tried searching IRS & Treasury Dept websites and VJ already, but I am just not coming up with it. :(

Marley and Me is hilarious, especially if you are a dog person (especially if you are not a particularly good at disciplining your dog person). Grogan's writing style adds a lot, though, so I'm a little unsure about the movie version.

Currently reading Ruth Reichl's memoir "Garlic & Saphires: Memoirs of a Critic in Disguise."

Not sure I could pick any ONE favorite book. There are so many different books---and different KINDS of books---that I've enjoyed for different reasons. A few recent ones I've especially loved were Barbara Kingsolver's The Poisonwood Bible, Amy Tan's Saving Fish From Drowning, and The Case of the Dog in the Nighttime (can't think of the author's name off hand). Books that were pretty influential for me when I read them were Claude Brown's Manchild in the Promised Land and A Tree Grows in Brooklyn. The latter is really geared towards teenaged girls. I read it when I was 13 and it was one of the few books I read that was for my age group, usually read adult books instead (I mean that in the clean sense of the word). My sixth grade teacher read Watership Down to us, and I loved that enough to re-read it as an adult, and it still held up.

I read Heinlein's Stranger in a Strange Land one summer in college and as I got towards the end, I started reading slower, re-reading pages, and deliberately putting the book down so it wouldn't end. Not sure I've quite done that with any other book, so maybe if I had to pick one "favorite," I'd pick that.

Okay, I just want to say thank you to Zyggy. It took me a while to get through this thread, but I think you have answered my questions about whether we can exclude hubby's income from before he moved down even if we elect to treat him as a resident alien for tax purposes.

Well, at least you've answered all the questions I have now---when I start filling out the forms, I may have more! Nonetheless, you've demystified the process quite a bit and have been a MAJOR help.

One question I do have though: My husband transferred his life savings through a series of wire transfers. We were told that it was reported to the IRS, not because it is taxable income (heh, it isn't income), but because they keep track of large transfers of money to guard against money laundering and/or funding terrorism). The question is what if anything do we have to report and/or document to make sure the transfers are not treated as something other than transfers of an immigrant's savings?

I'm not sure if this helps, but when my husband spoke with someone at CRA recently and said that he would need to provide my income on his final tax return (I am the USC wife). My income won't be taxable in Canada, but if my husband gets any kind of benefits from Canada, my income counts toward household income in determining eligibility (which does not make a whole lot of sense to me to be perfectly honest).

This is the general theory behind the kind of evidence they want to see: if you are willing to risk owning major assets jointly and have joint bank accounts, you are probably in it for the long haul. The problem with this is not everyone HAS major assets. Younger couples usually can't afford to buy a home and older couples (like us) come into the marriage already owning assets.

I don't know which, if any, of these things you have, but here are some things you can add if you have them:

- Do you have any cars jointly titled in both names?
- Do either of you have a life insurance policy naming the other as beneficiary?
- Any joint credit cards or loans?
- Rental lease in both names?

I don't think the fact that you have a low balance is going to be a problem, and they usually do want to see that you have a joint account. The only thing that I think MIGHT raise issues is that you say you've not used it for any transactions. Do you mean that you haven't used it for any MAJOR transactions, or don't write checks on it? If you just each write checks on it for different things but don't have major transactions, I wouldn't even worry about it. If you really just maintain the account and don't use it, you might want to see if you can get someone at the bank to write a statement just stating that you have maintained a joint account at the bank since whatever date you opened it on. There would probably be someone there to notorize it. I'm just thinking that if they see an account with no activity on it, they might question whether it is just a "shell" account set up to make it look as though you have a joint account when you really don't use it as such. On the other hand, if there is a REASON it isn't used (like you prefer to use cash for small transactions or something), you can explain that in your cover letter.

You might also want to include some personal things such as letters addressed to the two of you, boarding passes or hotel receipts from any trips you've taken, and photos. Not a lot, because this is all considered "secondary" and less important than the evidence that you are "financially mingled," but you should probably include something. And your baby's stillbirth certificate can only help, not hurt.

If you read Gary and Alla's thread "Chat with USCIS director" (that is pinned at the top of the page), it gives you a good idea what type of evidence they are looking for and why they want to see it. Another suggestion for you would be to start a separate thread asking about the bank account. Someone here may have had a similar issue and might not think to open this thread. I think you have pretty solid evidence that you share a home, I'm just a little concerned that they might not see the inactive checking account as solid evidence of financial intermingling. But again, someone here may have dealt with a similar issue and found a way to work around it.

First of all, I'm so very sorry for the loss of your baby. :(

I think the situation of the friend Tucson Chick mentioned is a bit different--they included a birth certificate of their baby in an earlier petition and then mentioned no child with their ROC petition. They probably got an RFE because this would look like a discrepency to them. In your case, I don't think you'd get an RFE because there is no requirement that a couple have a child within two years to prove a legitimate marriage. It DOES show that you conceived a child---which provides some evidence of a bona fide relationship. How helpful and/or necessary that is I don't really know. Personally, I think that if you have other solid evidence and you feel it is a personal matter you don't overwhelmingly feel like sharing, there is no need to include it. On the other hand, if you had sonograms or any baby-to-be-related evidence in your AOS or visa petitions, then you are in the same situation as Tucson Chick's friend, so in that case I'd definitely include it. It can't hurt to include it, but unless you have submitted any baby-related evidence in the past, I don't really think it's needed. Proviso: I'm at the beginning of this part of the process so that is just an opinion.

Your evidence sounds like it will be enough. Shows joint address and joint ownership of at least one asset, so you should be good.

Re affidavits: This is a question I have as well. We were not going to include any just because I don't want to bother any of our friends with it. But the way the instructions form is worded, it sounds like it is mandatory---even though it isn't really as important or telling as joint assets and so on. (According to Gary and Alla's post, Chat with USCIS Director, it's helpful but not as important to them---and doh, isn't it obvious you are only going to ask friends who you know are going to say you have a good relationship?)

Re car insurance: For ROC purposes, I wouldn't worry about it. You have lots of other things that prove essentially the same thing.

Re credit cards: Personally I would include statements rather than the cards themselves just because it probably is going to photocopy better. You can also cross out the account numbers. Not sure there really is a right answer on that one though.

The thing with taxes is married couples choose whether to file a joint return or as "married filing separately" based on which is more advantageous to them. We did not file a joint return in 2008 either, so we will only be sending our 2009 joint return, but will note that we filed separate returns in 2008. It might not be a bad idea to mention in your cover letter that you did not file a joint return in 2008 just so they don't think it is missing, but other than that, I wouldn't worry about it. I'm sure there are couples here who have been approved without filing any joint returns. No one's going to file a joint return if it means paying more taxes than they would filing separately!

As JKelly said, you CAN file your 2010 taxes before they are due, but most likely you will not get all the documentation you need until at least late January, more likely some time in February (W2s from work, 1099s from banks, that kind of thing). I don't know what your time-line is, but waiting that long, even if possible, may not be worth it.

Writing your A # on everything is a good idea in case it gets lost or separated from the rest of the package. That would be the only reason. We are using one of those little clips meant to hold material together that has been two-hole-punched at the top (drawing a blank on the name at the moment). That is not NECESSARY and I know that other people have done different things, but it allows them to rearrange your packet if they need to but still holds everything together if they don't.

I would not send every bank statement for the last two years because your package could end up weighing a ridiculous amount and costing a lot to send. Send the earliest and most recent and a few in between and they will get the idea that you've maintained joint accounts throughout your marriage. Same for any joint utility bills and insurance.

We are getting ours ready to mail this week also. We have I think about 9 or 10 bank statements, 8 or so utility bills, and 3 contracts for major home repairs. We somehow managed not to save any of our old car insurance cards so we are only sending the current insurance cards, and I'm sending 4 different medical benefits statements showing my husband is on my plan.

Some people get interviews, some do not. They may randomly pick your application for an interview, same as with AOS, or they can schedule you for an interview if they think the evidence you submitted isn't enough.

No, the evidence is not the same. Check the VJ guides, the instructions sheet for the I-751 form, and the forum for types of relationship evidence to send (things like a deed or lease, joint bank account statements, joint insurance, joint assets or debts, birth certificates or adoption decrees for any kids you have together, travel documents from trips you've taken, photos, etc....). You only need to send the form, a copy of the front and back of your 2-year GC, and relationship evidence.

3) Is it real that it might take up to 4 months to get this new Green card ( the 10 years one)??
If so, what happens during that period when the first green card expires and I am waiting for the new green card, am I gonna be able to still work , travel, enjoy life etc. or...???


Your NOA1 includes a statement saying that it extends the validity of your GC by one year. I'm not sure what the average processing time is. The shortest I've seen on here is 6 weeks.

Utility bills and any other bills/insurance policy information/anything official that is in both names: the key here is you want to show that you have had these things for the entire course of your marriage, at least since getting your 2-year GC. Okay, you mentioned in the previous thread that you lived with your mom for part of the time, so you are not going to have these things for the first few months, but that's no big deal. I would say make sure to include both your earliest and most recent statements and then maybe one for every three or four months in between.

Joint bank account statements: you did not ask about these, but they are probably more important than utility bills, and I would follow the same principle as above.

Pictures: they are considered "secondary evidence" and therefore much less important than everything else. How many you want to include probably depends on what kinds of photos you have. If you have pictures that show you taking vacations or attending family events together, you will probably send more than you would if you just have random pictures of the two of you. We sent 22 pictures. Some people have sent more than that, but I think most people send fewer.

Re biometrics letter: we haven't gotten ours yet, but I remember from AOS that the date on the letter was only two weeks before my husband's appointment. I think this varies a bit depending on the local office and how backed up they are. People with NOA1s around the same time as yours are just starting to get biometric appointment letters, so even assuming your local office is one of the faster ones, it's not too surprising that you have not gotten your biometrics letter.

A lot of couples who use cosponsors because they do not qualify actually rely on their own income all along, and I'm sure there are many couples whose situation is similar to yours. At the AOS stage, USCIS really only cares that someone with enough income sponsor you; it does not matter to them whether you actually rely on your cosponsor for financial support.

That said, a lot of the evidence you will want to submit to show that you are "financially intermingled" and share a common residence---things like your lease or deed, joint tax returns, joint bank account statements---will reflect this change. But no, you do not specifically need to call it to their attention or provide an explanation.

Re tax returns: not all couples file jointly. Whether you file jointly or as married filing separately depends on which filing status is more financially advantageous to you. Surely USCIS is aware of this. If you do not include your tax returns or transcripts, it might not be a bad idea to explain in your cover letter.

I don't think you can put him on the car insurance if he doesn't drive. I also don't think it would help, since the date would show that you did it just now. They are asking you for that because most people do drive so the majority of couples are going to have that as evidence that they share a home. I think if you establish that you have lived with your mom since (whenever you moved in with her) and explain that you don't have kids, loans, or health or life insurance and that your husband does not drive and therefore has no car insurance, you really should be okay. I'm just waiting for our ROC petition to be processed so I can't tell you that for sure, but you have to focus on what you CAN send that addresses the concerns they have.

Two other suggestions for you:

1) Do you have copies of any other kinds of "official" documents you have received in the mail addressed to both of you? They did not ask for this, but this would bolster your evidence that you have lived together at that address for whatever length of time.

2) Pictures---I know you said you already sent some and I'm a little surprised that they are asking for more. Pictures are usually considered secondary evidence, but since they specifically asked, maybe try asking everyone you know if they have any pictures of the two of you together, add those to the 8 to 10 you already sent, and make sure all are labeled with dates.

Send them the copies of your drivers license and state ID. If you have additional pictures, send some. Send a letter explaining all the things that you just told us and (as others have suggested) have your mom include an affidavit saying that you live with her.

ETA: It is probably a good idea to have your mom state in her affidavit that you have both lived with her since _______ (whenever you moved in with her). That way you show them that you've lived together for the entire length of the marriage.

First of all, I would not worry too much about not having joint home ownership or joint ownership of a car. Many couples don't. My husband imported his car from Canada and we each continue to drive the cars we owned before getting married. Although the INSURANCE is joint, it simply never occurred to us to put the title to either car in both names. We also live in the home I bought before we were married and (primarily out of sheer laziness) I did not get around to quit-claiming it to me and hubby jointly until quite recently (err, about 5 weeks before we filed ROC). However, we had joint bank accounts for the entire length of the marriage, proof that we both lived in the house (utilities in each name, yard care bill in both names, and some repair contracts), and lots of itineraries and boarding passes showing vacations together. I thought we might get an RFE about the house, but we didn't. He got approved without an interview or an RFE. Many younger couples live with relatives and do not even own cars. As long as you can at least show joint accounts and joint residence you should be fine.

I agree with JustBob also about the separate accounts, especially the separate bank accounts. You may need to use something separate to show joint residence, but I don't think I'd submit separate bank statements. Often couples do not have joint cards due to credit issues of either spouse and the fact that the USC spouse usually already has cards. Although it is true as well that many couples have separate bank accounts, I just think that one will raise more questions for them than the separate credit cards. You have what looks like enough evidence to me, I'd just take out some of the separate stuff to be sure you are not sending the wrong message (or at least potentially doing so).

I think this is the problem. You bought your house in 2010 and sent evidence only of having utilities, insurance, and such in both names recently. You do not need to send bills from every single month for the last two years, but you do need to send a few that generally cover the entire period of your marriage. What we did was send copies of the earliest bills in both names and copies of at least one bill for every 3 to 4 months in between. We did the same thing with bank statements.

If you have not saved utility bills from the beginning of your marriage, I don't think it will be a big issue as long as your apartment lease shows that you lived there together since the beginning of your marriage. If you did not save bank statements, ask someone at your bank to write an affidavit for you stating that you opened a joint account on ___________ date.

The list of different types of evidence they've requested is an auto-generated list, so I wouldn't worry too much about the fact that they are asking for something that is inapplicable (children's birth certificates). To be safe, however, it would be a good idea to address that in a cover letter, just mention that you are not enclosing children's birth certificates because you do not have children. Sending pictures can only help, not hurt, but they are generally seen as secondary evidence, so it is not really that critical.

As far as the envelope, I have no idea on that one. I hope someone else can help.

I have a silly question about putting the pkg together, I honestly cant remember from the K1, and AOS. How should the package be fastened. Should the whole thing be stapled? left loose? Should I staple or just paper clip the check?


For both AOS and K-1 (I-129F), the recommendation was NOT to staple your package. Instead, fasten it using a two-hole punch at the top of the pages. As for the check, hmm, I don't really remember specific advice about that, but what we did both times was put the check in an envelope and attach that envelope to the front of the package using the two-hole punch clip. I did not want to give them any excuse to lose my check!! I would think paper clip would be fine also. I'd recommend against stapling it just because it could be torn when they remove it.

This Friday is the first day we can file, but we will probably at least need the weekend to get our package together. Hoping to file--and official join this thread!--next Monday. :)

I am really trying to have enough of each type of evidence we have to cover the whole period of our marriage and so far it seems like it will end up being a really thick pile.

Yes, that happened with all of them. I have no idea why they decided to do it that way, but they have been assigning new receipt numbers with biometric letters and that is the only number that will pull your case up on line. On top of that, many cases are not available online at all until some time after that.

Sometime while we were on vacation, USCIS approved our ROC and sent my husband his new 10-year GC. I forgot to ask him the date on the card, but the earliest USCIS CRIS email thingie I got said Feb 16th. If it is a different date on the card, I will change it later.

WOOHOOOOO!!! We got approved!!

Congratulations to those of you who were approved while I was in Florida and hope they hurry up and approve the rest of the couples waiting really soon!

Looks like the first October Vermont filer got approved today. Based on the October thread, I would have guessed we'd start seeing the first few November approvals start to trickle in about now, but for most of us, it's still going to be another month to two months. Not sure why California is so much faster this time. They moved at about the pace of the continental drift when we were waiting for I-129F and AOS approval, with Vermond quite a bit faster.

Happy New Year, everyone. I saw in the October thread that the first two October filers have been approved. Here's hoping some of us November filers will start to get good news soon as well!

Our case status is finally visible online. LOL--this is bigger news than getting hit by tornadoes on New Year's Eve. When I logged into my old account with USCIS to set it up for email notification, I noticed that our EAD and AOS petitions had touches this year (one in May, the other in June). #######?
