Our window opened August 20th, but life's been pretty crazy and we've just finally gotten all our paperwork the way we want it. Our package was mailed late yesterday afternoon. Scheduled for delivery on Monday. I've quadruple checked everything, so hopefully we didn't forget anything. What is it about dealing with USCIS that kicks my OCD into high gear? happy.png

hi everyone hope have someone to help me im still waiting the NOA2 almost 10 months now this coming may 6 i am just worried now why its takes to long to received the NOA2 we received NOA1 on july 6 2012 until we still waiting

 

Has your husband called the USCIS hotline and spoken to someone recently? The number is 1-800-767-1833. Click here for information regarding opening hours. He should ask to speak to a Supervisor as the customer service person who answers the phone don't know much more than what you can already see online.

 

fania&nelson suggested scheduling an INFOPASS appointment. This can't hurt, but I don't know if it will be all that helpful. However, if your petition is stuck at your local office, I've recently read about a case in which the I-130 was approved on the spot at the appointment. Have your husband look into the INFOPASS option. He can set up an appointment here: http://infopass.uscis.gov/

 

Or, as Penguin_ie suggested, your husband can look into making a congressional inquiry through his congressman's office.

Deal with the divorce first before you even think about immigration. Is there anyway she can get the marriage annulled or file for a legal separation in the Philippines due to abandonment based on being separated for over 2 years?

Has her husband filed for divorce in Germany? And is he only being uncooperative to be spiteful?

Evidently the wife knew something that we have not been told to have asked the neighbor to come get the little daughter. She evidently know danger was lurking. It is all very sad that this happened.


Just pointing out that it was the husband who asked the neighbour to pick up the girl. He'd obviously planned for things to get ugly at that point.

the Asian markets sell the actual water spinach that is used in kangkong. you can even find some Chinese restaurants sell a similar dish.


Sadly, the nearest asian market is about 3 hours away. Small town living sometimes sucks. :crying:

The husband and I both love kangkong (the vegetable, not the Filipino dish). Our favourite is a Thai-style stir-fry with garlic, yellow bean paste, small thai chillies and fish sauce. We make do with the spinach version in the US, but when we are back in Asia, we always eat way too much of the stuff to make up for it! :hehe:

Lots of great suggestions so far! One of my personal favorites that I haven't seen mentioned yet (unless I just missed it) is humba. I fell in love with it the first time I went to the phils, and when my wife (at that time fiancee) told me she knew how to make it, I was ecstatic. She makes it pretty regularly.


This sounds delicious and I'm going to have to try it! I found a recipe for it online which sounds super easy. It appears we also have all the ingredients it calls for except for the pork. The USC husband seems slightly dubious about the recipe but we'll see. We already do a chicken adobo that we both enjoy so maybe he'll come around! I'll report back if and when we end up doing it. :lol:

We have a Zojirushi rice cooker. Nevermind the multi-functional and programmable features... Surely the cute elephant logo alone is reason enough to buy an almost $100 ('twas on sale) rice cooker? tongue_ss.gif

 

Admittedly I've never tried making bread in it, but it works nicely even when I try to confuse it by throwing a whole bunch of other ingredients in it to make a one pot meal. We use this thing at least 4 times a week and often times the MIL will also ask us to bring it for rice making when we go there for dinner. cool.png

From what I've read so far, the timeline data is based on the data provided by other VJ members on their official VJ timelines... So, I guess it changes as additional dates get input into the system.

So, basically this is just a rough gauge which may or may not accurately reflect the grand scheme of things at USCIS.

That being said, I'm also still pretty new to this and may not understand the whole timeline concept either.

However, in the last few days, we've seen a Jan2011 CR1/IR1 filer receive their NOA2 in Feb2011.... as well as someone saying they were told by a USCIS personnel that the VJ timeline estimate is an accurate gauge.

Like you, Dave and I have known each other 7 years and we've been talking daily for at least the last four, despite the distance. The issues you've mentioned above have been rehashed over and over between the two of us over the years. It's definitely made the transition much easier because there are less surprises.

I've long suspected Dave doesn't always appreciate my "attacking" him the minute he walks through the door. :lol: Sometimes I can tell he's had a really long day and needs his space so I try to lay off on the attention-seeking-ness. But it's hard when, as you've pointed out, I've spent the day waiting for him to come home!

WOW.  Its 3:00 am in the morning and I just got text from my finance.  He finished his interview and was approved.  We are so happy with the experience with the US Consulate in Jakarta.  They treated my fiance so fantastic.  We were the first gay couple to be granted K1 at the Consulate.  They expressed their full support of DOMA and the right of all couples to be happy in marriage.  They made him feel so comfortable and asked very good questions about our relationship. Of course they ask about how we met and communicate.  Questions about me, my job and house. And my finance indicate the interviewer genuinely was happy to see our pictures and mentioned we looked so happy together. He wished us the best of luck and was happy to approve our visa.  

 

By the way our timeline indicate 85 days to interview and approval.  We couldn't have done it without the great tools on VJ.  We did get some weird advice from some members who didn't understand DOMA but maybe they will get educated.  But in terms of process of visa everything was very beneficial. Thanks again everyone.

That was my first thought too, but after calming down and thinking about it rationally, we decided we'll wait a few more days and see what happens. Nothing we can do about it now anyway. According to USPS track and confirm, our envelope is somewhere in Illinois on the way to it's destination, having already been through and left the Illinois processing site as of 8 March 2011.

If we do get electronic notification from USCIS (we sent in form G-1145), does this mean that it's already been routed to the right department and accepted there? Or does it simply mean that they just accepted the documents but it could still be sitting in the wrong place?

Based on the number of responses to my post, I'm actually surprised that this does not seem to be a common problem. The zipcode finder on the USPS website returns the zipcode of Chicago, IL 60680-4143 for the Chicago Lockbox P.O. Box number. It's all very strange... :(

I ask because I've read on VJ that you are supposed to send different types of applications to different plus four numbers at the Lockbox. For example, the I-485 forms should be sent to USCIS P.O. Box 804625 Chicago, IL 60680-4120.

I was asleep when my husband mailed out the I-130. It's not the hubby's fault because he didn't know any better, but with this knowledge, I wonder how this may affect our petition... Are they likely to reject it without opening the envelope and send it back because of this error?

Hi all,

I couldn't find an answer to this question using the search function on the forums.

We mailed our I-130 petition out today via USPS priority mail, delivery and signature confirmation (No Tracking).

When my husband paid for postage online, the system automatically changed the plus four digit number behind the postal code and we were not able to get it to reflect the correct number.

Instead of:
USCIS
P.O. Box 804625
Chicago, IL 60680-4107

Our shipping label says:
USCIS
P.O. Box 804625
Chicago, IL 60680-4143

Following this, he printed out the I-130 instructions pages and brought it with the package to inquire at the post office. He was assured by the lady at the counter that the four digits was not important for a P.O. Box address.

We also did not indicate the type of submission on the envelope.

Has anyone encountered the same problem? Are we doomed? :help:

Our letter was about three quarters of a page. I've known my husband for 7 years now.

Like Zen Den, we focused on the important information- circumstances of our meeting, when we decided to start pursuing an exclusive relationship (we also addressed the almost 4-year gap between this and our first in-person meeting), how (and how often) we've stayed in touch over the years, when we first met in person, how he came to propose, wedding (we only had a small civil ceremony so we wrote about our plans to hold a traditional Chinese wedding dinner in the future), and then threw in just a little bit about how excited and happy our families and friends are for us.

Don't think they want or need a really long sappy letter, so mostly we stuck to the facts.

Hope your interview went well! By the way, is it true that the US embassy here only allows documents in plastic bags into the embassy for the visa interview? I read it the other day on a Singapore-specific visa information website which was linked from the official US embassy in Singapore website.

Anyway, we ended up just submitting the proof of co-mingled finances, travel, wedding and wedding invite photos, a couple photopages of other photos, communication and affidavits. The whole package came up to 80 pages because the travel pages alone were almost 15 pages and communication stuff was 30-some pages.

It gave us (well, me mostly, since I'm the sort who tends to worry excessively about every single detail) a sense of comfort that we submitted what to me was enough proof beyond a shadow of a doubt of our very loving and legitimate relationship. :lol: And since we were essentially submitting larger but clearly categorized "bundles", it still seemed simple enough for whoever was reviewing our file to sift through and find things within our package if they needed to do so.

Hi. Yes we plan to enter US within 6 months, but not to settle there until I finish my job here. In fact that is why I want to get the greencard for my wife now, rather than when I am actually moving to the US. Because I have family in the US whom I would like to visit frequently and not all of them have met my wife yet.


I believe what Amy and Nick was trying to say is that there are some things the new immigrant (your wife) has to do to maintain her permanent residence status once she gets the green card. One of which is that she should ideally not leave the US for extended periods of time as her intent to live in the US would then be questionable. Her green card could be in jeopardy should you choose to ignore this.

That being said, according to the guide for new immigrants posted on the USCIS website (page 10 of the guide or page 20 of the entire pdf file), there is a re-entry permit that she can apply for before leaving the US if she will be out of the country for more than 12 months. But then the page also says

Many immigrants believe they can live abroad as long as they return to the U.S. at least once a year. This is incorrect.



Not sure what you should do if she is not able to be in the US for the majority of the time, but will be out of the country for less than 12 months. I'm also not sure what the requirements are for such a permit, but you can research it and see if it will work for your intents and purposes.

Do not file the I-129F. The I-129F used to be filed after the I-130 for a K3 NON-immigrant spouse visa, which used to be a viable alternative for married couples when it was taking years to approve the CR1. However, processing times have improved significantly and the K3 is now a dead visa that could even end up delaying the CR1 processing.

According to your timeline, you are in the process of filing for a CR1 visa as well, so you should know what's required. If in doubt, please refer to the guides provided on the site. They are extremely helpful.

Sometimes though - the info is outdated (it's up to all at VJ to keep it updated) and

usually the 'embassy webpage' - which links to the US Embassy country-specific site, has the CURRENT INFO for any IV unit.

It's a 'double-look' process - get the VJ Embassy page, then review the US Embassy page itself (usually ends in ...state.gov for the url)

Anyway, the embassy website basically only talks about payment information and provides a link with slightly more information, as well as contact information for the embassy. :(

  • A statement that if the USC has been residing in Singapore for 6 months or more, they can file the petition with the US embassy in Singapore (via DCF)

  • Embassy appointment information (arrive 15 minutes prior to appointed time and security restrictions at the embassy)
  • Visa delivery information

The only other links related to immigrant visas on the ustraveldocs website: USCIS' case status checker, average USCIS processing times, a page to select where they should send your visa when it gets approved and procedures for submitting 221(g) documents.

In conclusion, sadly lacking in clear and specific information about the IV process compared to the other consulate websites that I have seen.

Slightly off-topic, but it says that a blank copy of the DS-230 part 2 will be sent with packet 4. Does this mean we should only send the DS-230 part 1 with the DS-230 packet to NVC? Just wondering because I've seen other people saying that the DS-230 should include part 1 signed and completed and part 2 completed but not signed.

For the manila embassy it is packet 3. Check out your embassy's website to see if any packets are online.

So just to clarify, the "packet 3" (which is now called the Instruction Package for Immigrant Visa Applicants) contains the DS-230 form, I-864 form and instructions for collecting all the other civil documents needed for submission with the DS-230, correct?

AND on top of this, in your experience it also contains the medical exam instructions (which, as per the Singapore embassy information page on VJ, will be sent directly by the physician to the Singapore embassy)?

The US embassy singapore website isn't very helpful or informative, so I have started my own immigration visa flowchart that's specific to our case (right now spans two sheets of paper, each sheet is 31"x31"). It's been fun adding to it as my husband and I learn new things about the process or come up with new questions about future steps. It also gives us a little project to focus on instead of being miserable all the time. May have to start page 3 soon. :lol:

I-130 fee submitted with I-130 petition.

Upon approval of I-130 petition, you'll pay the AOS fee and IV fee to NVC when you get to each of those steps.

Jamaica-side will require whatever it costs for the pre-interview medical examination and possibly (not sure if needed for the Jamaican consulate) a visa delivery fee after the visa's been approved.

ok so what do i do about the w2's cuz I only have them for last year. was unemployed before that.


My husband is the USC so I'm not 100% sure about taxes and stuff... but from what I know, W-2 forms are completed by employers for employees. So if you were unemployed for the whole year, they will not expect you to have one for that year.

I'm sure someone more knowledgeable will come by and clarify this further.

Your courtship is short, but it will depend on other circumstances. I would definitely recommend a second visit while you are waiting for the visa if you can, ideally a third at the time of her interview.

Marriage upon the first meeting may also be a red flag, but people have done it and successfully gotten visas. So does not seem to be a hard and fast rule on that one.

Money-wise.. assuming you are going to be working a 9 to 5 job 5 days a week and you get the $120 extra in overtime a week...
40 hours at $8 = $320
$120 a week in overtime

($320 + $120) * 52 weeks in a year = $22880 which is above the poverty line ($18387 for a household of 2)

However, whether you can meet that line will hugely depend on how much you DO get in overtime every week. At $40 overtime a week, you are still above the income requirements, but $30 overtime a week will put you under the required level.

I agree with the above- as they will take your finger prints at POE again. If you get stuck in AP, they might also use it for background checks?


I have a question about fingerprinting too actually. I just applied for my police certificate of clearance the other day and they fingerprinted me. But I have pretty bad eczema on my hands right now and the fingerpad on the middle finger on my left hand is extremely dry and cracked so the lady couldn't get a proper print. After trying about 5 times, she eventually gave up and skipped on to the rest of my fingers.

I'm sure that I'm not the only eczema sufferer that has this problem. What if because of my skin condition, the pads of certain fingers differ/cannot be printed at NVC and POE? Will this be a problem or will a consistent printing of a majority of my fingers be enough to clear my identity?

Hi everyone -

We are approaching 3 months since we first filed the I-130 through the CSC for a CR-1 visa. While we are getting ready for the NVC, there are a few things we would like to have clarification on. We would be interviewing at the US embassy in New Delhi, India. I am the US citizen.

So I am clear about the DS-3032, the IV fee bill and the AOS. However my confusion is related to the DS-230. Do we need to complete both parts 1 and 2 (part 2 not signed, though still completed) and send them to the NVC? I have checked out the New Delhi US embassy's website and they indicate that they send out packets 3 and 4, which has the DS-230, so does it need to be sent to the NVC as well (if it is going to be sent by embassy to the beneficiary)?

Also, the other documents like PCC, birth certificates, marriage certificates etc - just to so I am understanding this correctly, even though the NVC already has the original marriage certificate, we still to send it another one? And for the PCC, birth certificates, do we need to send them to the NVC, or to the embassy?

I am sorry for all this mess, as you can tell, we are a little confused. I guess the gist of this is - what goes to the NVC and what goes to the embassy?

Complete both parts of the DS-230, but sign only part 1. You will need to send this to NVC as part of your DS-230 packet after paying the IV fee. All civil documents you send to NVC have to be an original or a certified copy. You did not need to send your original marriage certificate with your I-130 petition, but since you did, they might not need another one at NVC. Not completely sure about this.

Also, if you don't already know about the LingChe NVC shortcut, now is a good time to have a look. We found it very helpful as a quick reference/refresher guide.
