The profile says IR1/CR1. Which visa would be issued depends on how long the couple has been married. "As well" as what? Egyptian males almost always go through AP. If they told him two weeks, he's in AP.

I believe Horees is the one going through DCF, and was asking about his/her's own case.

IR-1 / CR-1 Spouse Visa Process & Procedurespetition for alien relative (spuse)

Hi everyone, I got married last year in December and im filing this week. I have filled out I-130 and two G-325A forms.
my check list:

!-130 one for my spuse
G-325A for me
G-325A for my wife
2 passport style photos one for me and one for he
4 affidavits of bona fide marriage of our relationship
1 form of our joint bank account in the philippines
copy of my US passport only where my picture is and the next page departing and arrival stamps. The rest is not stamped or do i have to make copies of all pages as well? Not 100% sure about how much of the passport to send in as proof of citizenship (but you can use your US birth certificate in place of the passport to meet this requirement), as I've read conflicting information, perhaps someone else can chime in. Basically the arrival and departure stamps are to proof that you've been in the same country as each other and count towards evidence of bonafide relationship.

What else do i need or is this okay?

Other required things:
A check/money order for $420
marriage certificate
divorce certificate (if applicable)

Optional:
Any other evidence of bonafide relationship/marriage you wish to include
Form G-1145 e-notification of application/petition acceptance

Please read the instructions to the I-130 carefully and thoroughly. And the guides here are really helpful too.

Welcome to VJ! :)

IR-1 / CR-1 Spouse Visa Process & ProceduresHow can this be true?
From what I've read here, Texas does not process I-130s (except during the whole CSC-TSC-CSC fiasco awhile ago, but I haven't been here long enough to fully understand that situation)... which would explain the much shorter processing estimate.

Of course there are differences in the Service Center processing times. My VJ estimated approval time (I'm at VSC) is about a month behind those of the other CSC march filers. It's not the end of the world!

Relax. At 5months+, you are almost there.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is the next step after I 130??

Did u file for the CR-1 visa before or after you have file your I-130 form? Following the guide line we definitely fall under a CR-1 visa too.Now I know which one is ours.

The CR-1 is a spousal immigrant visa. The I-130 form you have sent in is to petition to file a spousal (or CR-1) visa application.

After the petition (the I-130) is approved, the file will be sent to the National Visa Center. It is here that:
  • You will pay for and submit the affidavit of support information
  • Your husband (or you, if he nominates you to be his agent; see form DS-3032 for more information on this) will submit the DS-230 Application for Immigrant Visa Application and Registration and it's accompanying documents

See here for Loto's EZGuideSpouse wiki for step-by-step instructions for the CR-1 process.

Hi! I sent a few copies of my US-sized passport photo to my husband (the USC) before we filed the I-130 petition. The photo was taken about a month before we submitted the petition. Can we use the same photo for the DS-230 or does it have to be a different/more recent photo?

Has anyone submitted using the same photo for the USCIS and NVC stage? Any chance it will cause problems?

Thank you. :)

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat does the USCIS case number mean?
Hi everyone,

My husband and I got bored today and started searching random case numbers using the USCIS case status information page. Anyway, that activity led us to wondering how the case number is assigned and what it means exactly.

After doing a quick google search, we found out that it used to be that the first three letters was the service center, followed by two digits for the fiscal year and then three digits representing the day of the fiscal calendar (starting October 1st) and finally the case number. So EAC0900550001 would be the first case number assigned at VSC on the 5th of October 2009 for example.

However, our case number is EAC11901XXXXX. Obviously there is no 901th day of the year. So, does anyone have any ideas what it could mean? I searched the forums and couldn't find a similar question. Just curious.

Not sure if this is the best place for this thread, if not, someone feel free to move it to a more appropriate place. Thanks! :)

You have to send in the police certificate with DS-230. I applied after getting NOA2, takes about 2 weeks to receive the certificate. We were slow in all the processes; getting the documents and held back by the holiday season.

To get the police cerf @singapore side, they require you to show an official document requesting for it. You probably need to ask NVC for one. I saw the lady rejecting several applicants. Fortunately for me, I printed out the checklist from the web(she said no to this) and a stack of emails from NVC(no mention of the need for police certificate). She glanced through the emails and i explained to her the link between the emails and the checklist. Reluctantly, she processed my application. :D

Hello, another question on I-864... You must show on this form that you have
enough income and/or assets to maintain the intending
immigrant(s) and the rest of your household at 125 percent of
the Federal Poverty Guidelines

does this mean must be from the 3 most recent years? or just the 2010 income? thanks

They really want you to show up to the date you are submitting your I864. You can show this using a combination of your 2010 tax return transcripts & W2, along with 6 months of pay stubs leading up to the date you submit your AOS package.

To be safe, you should also include transcripts for 2009 & 2008 and a employment verification letter.

The beneficiary's birth certificate does not need to be submitted with the I-130 petition. You will only need it a few months down the road when you are submitting the DS-230 immigration visa application at NVC.

Edited to add: I'm not sure which version of the birth cert you would need later on though. But I would submit the I-130 now and worry about this after.

Unless you can prove that your income will continue even after you move to the USA, your income cannot count towards the I-864.

IR-1 / CR-1 Spouse Visa Process & ProceduresGetting the Certificate of Clearance from Singapore
When I was collecting my police certificate, I saw some applications forms specifically for non-citizens (It's slightly different than the form for Singapore citizens).

If you want up to date information, you can try emailing them at spf_cid_coc@spf.gov.sg

I know they check and respond to emails because I had forgotten to submit a copy of my passport with my application form and was told to email the passport data page to them. Sent it in on a Friday and got a response to confirm they had received it the following Monday.

You can also give them a call at 6557 3985 during office hours (they are closed on weekends). I believe this is the direct line to the records and COC office that is not published on their website.

When the policy first changed, there was a lot of confusion. But since so many months have passed, I would think that they have developed a standard operating procedure for these kinds of cases by now.

Good luck!

You don't need a police certificate of clearance from Singapore. You only need to submit police certificates for countries other than your home country if you have lived there for more than 12 months (and you were 16 or older at the time).

IR-1 / CR-1 Spouse Visa Process & ProceduresGetting the Certificate of Clearance from Singapore

1.
What is Certificate of Clearance (COC)?
Certificate of Clearance (COC) is issued to Singapore Citizen to certify that the named person has no criminal record during his stay in Singapore.

Note - Why is there a change in the policy for CNCC.
Police are not obligated to issue Certificate of No Criminal Conviction (CNCC) but have done so as a form of international cooperation since other countries provide similar documents as well. However, this service does not form part of police’s core function. Further, following the recent differentiation approach between citizens and non-citizens in terms of benefits in the healthcare, medical and education sectors, a similar distinction was also drawn with regard to CNCC issuance policy. As such, COCs will only be issued to citizens henceforth. The policy change will affect only a small number and there are alternative mean such as applying for a Statutory Declaration through the Commissioners of Oath or qualified legal practitioners. This is what I found on their website, so I guess I go into the interview without the COC? Because it is unobtainable? I hope someone who recently went through this can shed some light on the subject, because this particular country is changing their policy so that all previous information would be useless. I need to hear from someone who had their interview recently, needed their Singapore police clearance, and showed up without it because of this "change of policy" Thanks VJ'ers!

Please read the link I've posted. The OP of that thread went through this in March 2011 (the change of policy happened in October 2010).

IR-1 / CR-1 Spouse Visa Process & ProceduresBest timing to process I-130.....

thanks RICARDO,
I got that part. I am still wondering, what's the time difference in whole process if I file I-130 now and later update my case with USCIS being Citizen or wait until get Citizenship and then initiate filing I-130?? make it simple, let's say it will take 6/7 months to complete CR-1 process. If I submit the I-130 now ( Status : LPR) and update my case being citizen after 3 months then how many more months in general take to complete the whole process. Still 6/7 months after UPDATE my case or just another 3/4 months.
Hope i did not make you confuse.

Not 100% sure (someone correct me if I'm wrong), but from my understanding, your I-130 petition for your wife will be processed by USCIS as per normal. The delay comes at the NVC stage of the process, when you are actually applying for a visa.

The difference between petitioning as an LPR and a USC is that there are only a limited number of visas available for immediate relatives of LPRs every year, whereas there is no limit to the number of immigrant visas issued to immediate relatives of USCs. Thus, an immigrant visa number will always be available for spouses and children for USCs.

Based on this understanding, I would go ahead and file the I-130 petition now.. since you will have to wait an average of 5 months anyway. Let USCIS get started on your file and cut waiting time later.

Hopefully someone more knowledgeable can come along and confirm this for you.

Good luck! :)

how she can knows if the payment have been cashed and i dont know what she did
i just sent her 4 photos for me and a photo copy of my passport and my birth certificate translated to englesh and i fill up the g-325a form
then she gave them to the lawyer and sign some pappers and pay for him but for now i dont know where we are....

If she paid by cheque, she should be able to find out if the money was taken from her bank account. Not sure about a cashier's cheque.

Was the petition mailed out on 29th August? Or did your wife hand it over to the lawyer on the 29th of August?

Regardless, waiting up to 3 to 4 weeks for the petitioner (your wife) or your lawyer to receive the NOA1 from USCIS is considered normal. Don't panic yet.

Sometimes, they can take a awhile to notify you. Sometimes they don't notify you by email/text message even after you've submitted the G-1145 form. The hardcopy of the NOA1 usually takes 3 weeks to a month to be delivered to the petitioner.

Does the lawyer or your wife have delivery confirmation that the package was delivered to USCIS? Also, the other thing your wife can do is check if the payment has been cashed.

No need to call them everyday yet.

It's normal to get sign in fail for a couple of days after getting your case number and IIN. We couldn't sign in for about 2 days after our case number was assigned. On the third day, we got our AOS bill by email and were able to log in to pay. This just means your case is probably not yet loaded into the payment system.

We did the I-864EZ with tax transcripts and had no issues. As of last friday, our AOS paperwork has been reviewed and found to be complete.

IR-1 / CR-1 Spouse Visa Process & ProceduresHi! everyone
The K-3 visa basically allows the spouse to enter the US while the CR-1 is being processed. It was useful before when the CR-1 visas were taking several years to be issued. These days, the CR-1s are much quicker to obtain (a year or less in most cases), so really, the K3 visa is obsolete.

What usually happens with the K-3 nowadays, is that the I-129f and I-130 forms will be approved at the same time and NVC will administratively close the I-129f case.. immediately converting the case to a CR-1.

Also important to note is that for the K-3 visa petition by filing the I-130 and then the I-129F... I-130 will get pulled from it's place in the queue so it can be matched up to the I-129F that you filed later essentially resulting in lost time.

We went a bit crazy and submitted a few months of phone logs, a couple of pages of chat histories, 4 affidavits, photocopies of our passport entry stamps from flying to see each other, and a couple of pictures of us together or with family. :hehe:

As cathy2904 said, not all of it is needed for an approval on the petition. In fact, most of this is optional. All you really need to submit as evidence of bonafide marriage is your marriage cert and one or more of the items listed from items E to J on the " What Documents Do You Need to Prove Family Relationship?" part of the I-130 instructions.

Just throwing it out there to give you an idea of what can be considered evidence.

Good luck!
