When I had to be in the states urgently I call the airport to see what needed to be done. The answer was bring a letter from the doctor there, letter from my employer and since I am a holder of an I-601 I needed a copy of that also. There was a ton of paperwork to fill but I was granted 14 days there, but I took the buss in stead and called the POE and made arrangements and had a 7 day parole issued. I didn't deal with the consulate just the border people.

Hi Len, It is all legalise. When dealing with bureaucrats you have to think like them and read everything once, twice, and even three times wouldn’t hurt. The government assumes everyone understands what they are saying when in fact their form of writing is at time quite confusing and leaves much to be desired. The key words in the instructions were All forms DS-156 are required to be completed in an electronically-completed format, when for some it would have been easier to understood All DS-156 forms are required to be completed in an electronically-completed format.

I hope everything works out for you and your fiancée.

For those who like myself that have been convicted and later received a pardon, the RCMP fingerprint is not enough as it will show you do not have a record, and if you marked on the forms that you do or did have one there would be a conflict of information. If you have been convicted of a crime no matter what it is you also need a copy of your pardon and a copy of the court documents, both of which can be had from the Padrons and Clemency board in Ottawa free of charge, it takes a minimum of 3 weeks

The reason I ask is that I have made copies of everything we have for them. I have two hole punched the copies at the top of the pages and placed them on an ACCO Paper Fastener along with about 20 dividers with tabs at the bottom indicating what each divider contains. I also have an accordion file with the originals in it in the same sequence as the copies, which I am not certain that they will want now that everything is done. My thought was that they wanted copies of everything and the originals were just to comfirm that the copies were in fact what they are, duplicates.

It was the right one, CR1. No problem with that. The big problem is that my husband is a total neuro! He's now worried that he might do something wrong like accidentally get into a car crash in the next week, killing someone and then be prevented from ever using the visa. Canada Post is at times very slow unless it is a bill that is being delivered. I hope for your sake they will find a way to get everything to you quickly. Hopefully your letter will be in an official looking envelope or a brown one, Canada Post seems to have this thing about brown envelopes as far as I'm concerned they always get through.
I posted as a test a letter to Dodge City Kansas and it took 21 days to arrive there, then on December 14, 2005 two Christmas presents were sent to Ottawa, Ontario one from Dodge City and the other from Garden City both in Kansas and neither one has yet made it here. I'm sure that if they think it is a bill it will come through in a very few days.

P.S. I never use Canada Post for posting letters or cards, for me it is UPS.

The document I have said 12 month but the person I talked to at the Consulate said 12 t0 18 months then it returned to Montreal for a review. I would doubt you have to re-apply, but you may have to get some of the documents that are out of date specially those needed for the AOS part of the journey

I'll share mine with you, I got an I-601 for a 31 year old "auto theft" conviction. Murderers do less time than they are having me do. The funny thing is that in Canada I am clear and clean and have no conviction, my file had to be retreived from the National Archives for a copy. In the land of In God We Trust I am a criminal regardless of where I live, where the crime was committed even if a pardon had been received. To the U.S. of A, I will always be a criminal until and only until I die or they say I'm not.

I am glad that you made it through the maze and are well on your way. I beleive that there is more to this in our case than can be seen, much like an iceberg there seems to me to be more hidden from view than is visible. Such as after the adjudication and if the adjudication is in my favor Montreal will conduct another interview at which if it pleases could find another reason for another I-601 and the whole process could go on for yet another many years to come.

Hi Lona, Thanks for the words, people like you are special.
The situation with Debbie is cleared up, if they wanted a REF concerning the alcohol problem they should have asked for one, I have the letter from the doctor regarding the test which came back clean, Debbie made me mad because she noted in the file that she smelled alcohol on my breath and that was not possible and the cause of the 212(g) I received which by itself would not warant an I-601 waiver. The 212(a)(2)(A)(1) is the one that warants the I-601 as it was an indictable offence even if it war committed 32 years ago and pardonded 17 years ago because I was slow getting it. I was staying away from the Montrealsite except for veiwing for emotional reasons, the last 4 months have been hard on us because Sharon's father was so ill and these last few weeks have been going through heII and next few weeks will be difficult also. Soon I will be able to visit the Montreal site and be able to post as I have in the past. It is difficult to be positive for others when we can't yet for ourselves.

Remember it is a 2 way street. I have a little story about Canada myself.

Years and years ago my mom raised 3 children alone.
Not having a father figure around and a mom working all the time.
I got into all kinds of trouble. And I mean a LOT!
Anyway it snow balled into early adulthood. But by the Time I was 21 years old, I was out and growing up fast.
18 years later I planed a trip to Canada.
Driving accross the border they did a random check on me.
Called me into a little room in the back with a stack of old non violent charges and started to go thru each 1
all over again. Finally I reached over and put my hand on the papers to stop her.
I said, "You are refusing me entry right?" Yes was the reply.

I was told I could not return without a waiver from Canada.

I had been out of trouble over 18 years.

When you judge a country about its laws. Remember they are in place to protect us on both sides of the border.


I was shocked at first by Canada's action's.

When I met my wife I called and made sure it was ok for me to travel to the phil's before I wasted a ticket and was turned around
at the border.

By the way, None of this proved to be a issue in getting my wife's visa; which was just approved at interveiw 8/27/2007.

So keep the faith and remember;

hi Rick thanks for writing, We are keeping the faith as you say and we are as tight as ever if not more, We just have so many other issues in our face right now to keep our head screwed on straight.

I sure hope you're on the straight and narrow now with marriage a personal life style has to change since your living two live, yours and your wifes.
I have never been refused entry in the past, I can get into the States now, that is not a problem with a letter from Sharon's father's doctor and a return ticket plus the documentation from the consulate. The border people said that since the offence was over 31 years ago I would get approval from the person in charge.
Right now I am 63 years old and I was 31 when I offended and the offence took place 32 years and 1 month ago. If you read closer to the beginning you will see that I am in agreement with you regarding the law of the land and why it is there.
Rick, you are the American, your past convictions would have no consequence regarding bringing your wife to the States unless the charges were of abuse towards an ex or something like that. I am a Canadian and I need a waiver to go to the States and get married. If the charges were against your wife believe me she would today be waiting for a waiver and you would be waiting for her.

Lona, Lenina and everyone else that has come here with support thank you each and everyone. You may not realize it but even the largest too the smallest coment even if it just a smilie face looking back at us from the screen it all makes the biggest difference to us because none of you had to comment or support us as you have. Most if not all that I write about our situation is not written seeking sympathy writing here and in a few other posts for me is downloading evrtying that could be bottled up inside making our present situation much more difficult to overcome.
One thing I miss which I was never too good at is posting in the Montreal forum, I go there and read and would like to add a few words but I am affraid to say anything because I don't know how it will come out and feel that what others have said is good and nice and I want that train of thought to continue.
Don't blame Montrel for what was done they were following the letters of the law regarding the auto theft and maybe the thing for the alcoholism, but you can get mad at Debbie for writing in my file what she did, that wasn't called for and proven to be wrong, it just cost $100.00 to get the test results from the doctor's office.
Life throws a lot of things at us and if we dwell on what happened, we wont see the good coming from it. Since the denial Sharon and I have found a house we like but may not be able to get it because according to some it is a re-fab (not accepetable) and other it was a kit house meaning that it built section by section and brought to the site and put together. We are looking at another as information on the first is sorted out. The house hunting was good for Sharon as it took her mind off the thought of her parents while she wasn't actually with them. All of what is going on is making us stronger in our committment to each other even if it is draining us of everything else.

Hi Lona, Thanks, as for the question re: Sharon coming here, that would be a possiblity except yesterday we were told by the hospice nurse that is taking care of him that Sharon's father will be gone in the next few days. The Waiver papers are a go! I am at this moment waiting for word from Sharon rergarding her putting in an offer for a house that She found and likes very much, should hear back about that in the next few days, I hope it is a go. Just got a call from the doctor about the alcohol tests and they are clean, doh, now I have to $100.00 for the doctor's letter, which I will get next week, That was the last thing needed for Montreal then the longest wait begins.
