Hi Carla, Thank you very much and they usually piss me off too, but only for a short every time I think of the way things are being done and not done. We are also hoping and praying; we have been doing so for what seems to be a long time. Just when we think God isn’t listening we remember that God’s answer isn’t always yes. You think one way and I the other, you say they may know the visa is coming and I say they just don’t want me down south. There is no reason they can’t do the review and make their decision without the passport. What if an emergency comes up and I need the passport, I asked for it on the 3rd of July and again on August 13th they sent it Monday, August 17 I got it on the 18th. I sent it back the panic is over with for now.

Got the passport back yesterday, it was at home when I got there. I have to send it back to Montreal so they can either continue with the process or restart it, thier choice. To be honest with you I don't think they even started it and the reason is that they said my documents were being sent to Vermont for review so how can Montreal send it if Vermont has it. According to what they wrote I was one week away from the end of the review why did they not advise me of this fact and ask if I could hold off getting the passport back.

A few questionsand comments I had for them, waiting for thier reply.
Why can’t the review be done without the passport?
The passport is only required if the reviewer grants approval and the consulate concurs, then the passport is required so the visa can be inserted.
If the passport is required at Vermont for the review why after 17 days the day of my request has it been in Montreal?


I have not yet received the passport and will return it upon its arrival, does that mean that the calendar restarts at day one?

The sad part is that in our case NVC took a complete year to do thier thing.
You do need a new medical and Police certificate but this time only a name check or better known as CPIC, you should also be sure that your passport has ample time left on it preferably a few years.
You will get a list from Montreal of things needed once the waiver is approved. Don't have either one done to soon.

One thing I'm not to sure about is thier asking for a notarized letter of intent from the fianceé and a form called DS-221. The letter of intent was obviously two pronged, first to see if the fianceé new of my charge and conviction and second whether she was still willing to marry me.
The DS-221 is something new to me and is not available on the internet, it is a 4 page form with a one page guide, this form according Laurel Scott is an internal form, I told that to the operator but was sent the form and told to fill it in and send it back and they will send it off to Vermont.
I hope the DS-221 is not becoming a new thing because it is nothing but a time consuming waste to prolong the agony.

We recieved the approval in February of 2009, first, we got an e-mail Febuary 17 from CRIS (Vermont) then a few days later Feb. 23 a Notice of Action to make it official then shortly after before the end of the month I got the package from Montreal.
Our I-601 was issued in August 2007, we filed is Feb. 2008, we were approved in Feb. 2009, Packet returned to Montreal on July 3, 2009, no reply as yet.

Your love for each other is the one and only thing that will carry you through this whole mess. If you think it is too much of a price to pay, it very well may be. The way we dealt with this is do what was asked, build on our strengths and strengthen our weaknesses.
P.S. Be frustrated with the system not each other.

This is all that I can add for your information, it was recieved from Montreal.
Your cheque was cashed March 10, 2008 and the file was indeed sent to Vermont Service Center. Please be advised that

a waiver can take anywhere from 8 months to 1 year. Once it is approved you will be advised by mail and then the file will

be returned to our office.

To you and I there is no difference it's all the same process just a different name.

BUT

As in my case which may be different for others the distinct difference is:
After my interview in Montreal I was given an I-601 waiver, and after that was processed,
I was asked by Montreal for new documentation for those that had expired which I believe placed me in AP,
Then they (Montreal) asked for another form to be filled and sent it off to Vermont this placed me in AR as per the operator who replied to my e-mail.
AP would be the gathering and verifying of information after the primary process is completed at the consulate level.
AR would be the final adjudicating at the NVC level.

I could be way off but doubt I am, disregard if you think I am

MARM, I wish thing were better and easier to understand. Sharon's mother is not well and 98 years old, we lost Sharon's father almost a month after we were told I had to file a waiver. It took a week of calls, faxes and UPS before I got permission to attend the funeral. Right now can't afford the waste of time trying to get the passport from the consulate and deal with the border folk.
They have had it about 4 weeks another 2 weeks and I'm asking again.

Three weeks ago they asked me for documents, a new medical and passport because my I-601 was approved. This week they asked for another form to be filled and a noterized letter of intent, well sent it all off yesterday and asked for the passport back since I'm back in AP in case I need it urgently.
The way I see it is if they send it back it will be a long wait, and if they keep it it could mean a few weeks give or take.

Well Joe, be glad you don't know what a I-601 is, it's like a minimum 12 month guarenteed AP. I guess for me it was a training session leading to the real thing, this AP.
I have been reading a bit and see that people get thier APs right after thier interview all I got was a I-601 and I did get an AP but that was dropped quickly after I wrote to the Director, one thing you don't do is tell a 25 year sober alcoholic that you smell booze on his breath and put it in his file. The I-601 was for a 33 years old conviction.

It's official after going through the I-601 process and being approved they have decided that an AP would be good for us.
First they ask for form DS-221 to be filled yet it is not available to the general public, I was thanks to a memeber here was able to get it and fill it and will be send it shortly along with the requested noterized letter from the petitioner stating she is aware of the ineligibility for conviction of a crime involviinig moral turpitude and she still wishes to pursue the marriage.
We were give the following:
This office regrets to inform you that it is unable to issue a visa to you because you have been found ineligible to receive a visa under the following section(s) of the Immigration and Nationality Act. The information contained in the paragraph marked with "X" pertain to your application. Please disregard the unmarked paragraphs.

(X) Section 221(g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the Immigrtion and Nationality Act. or regulations issues pursuant thereto.The following remarks apply to your case:*

What I recieved wasn't a notice; it was a comment/reply made on my request for information regarding our petition. The answer recieved was proper regarding what was asked. What I found to be strange was as I spoke with one person who denied having our petition another was sending me a yes we have it and are working on it.

It is a K1 and I wish they would forward it in a week

At about the same time I was talking to an operator at NVC and getting we have nothing yet regarding your case I got the following in the mail.
Dear Sir/Madam:

The National Visa Center (NVC) recently received this petition WAC XX XXX XXXXX. We are in the process of entering the petition information into the computer system and assigning a case number. Upon completion of this process, the appropriate agent (applicant, petitioner, or attorney) will receive instructions for the further processing of this petition.

The NVC does not have an overall processing time due to the fact that we cannot estimate how long it would take someone to accurately complete and submit the requested documentation. Once documentation is received at the NVC, the processing time for all documents to be reviewed is 2 to 4 weeks. Further information will be sent after the review is completed.

Not exactly what I was hoping for but still it is good news and means we can't be too far from Montreal now. Mind you it did take them 6 days to reply counting the time off for the holidays.

On December 8 we received an e-mail indicating we were approved.
December 13th we got our hard copy
December 21st I e-mailed NVC with questions re: our petition
December 26th before checking e-mails I called NVC and was told by operator that we were not yet at NVC.
December 26th after being on the phone to NVC I checked my e-mails and found out that we were at NVC and were being added in the system and they were waiting for a number for us.

As YuAndDAn say, E-mail NVC and also call them and speak to a live operator. As for me they are truly very nice and helpful folks to speak with.

For now forget the WAC # and to use the LDN # but not on the computer, you will need to call the Embassy/Consulate and speak to someone there, that seems to be the only way to get furthure information. I hope someone else will be able to supply you with the number to call. There is no need to panic it is just the way things are done.

Sharon and I have been apart for eight months now, we sent the I129f in September and only tomorrow will I get to call the Consulate to tell them the checklist is complete. We are lucky in having a long distance provider that charges only .25 cents per call letting us talk as long and as often as possible, and when we want to see each other I use an internet café. As for being sick a few months ago I was having trouble walking long distance and had ultra sound done only to find a narrowing of the veins in my left leg which won’t get any better, the last month I was suffering excruciating chest pains and thought the worse, the good news was it happened because I helped my daughter move into her own place and messed up my shoulder. Then I did a pre-medical medical with my doctor and had to have another ultra sound, this time on my abdomen since there is an enlarged vein or artery, I will get the results tomorrow and I hope it is nothing serious.
This journey is literally taking me down a road that is better not travelled. AS for being sick of waiting we both are, but we both look at others timelines and find that we are among the more fortunate for having gone so far so fast and not being lost in some dark bureaucratic area.
Sharon also has her stresses but is holding up as best she can knowing that everyday brings us a day closer.

I sent them an e-mail stating my concerns regarding a consulate member and was replied to within hours, not with the answer I wanted be still an answer, which was "sorry we can't help you as this is a legal matter". Now I have been waiting for 5 months for a reply from Emilio Gonzalez's office, I find it difficult for them to not see a 2.8 lb package that I have documentation of having been signed for.
I hope you get a reply soon and it is the one you want.
